<section id="HCD6BE0840234423F8D886249DD18DD5B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Communities Act</short-title></quote>.</text></section> <section id="H01FCD614C49B4F4AA766DC79FE0AA443"><enum>2.</enum><header>Firearm assembly kits considered to be firearms</header><text display-inline="no-display-inline">Section 921(a) of title 18, United States Code, is amended—</text>
<paragraph id="H77AF31ED55064289923CB44D0E74B3F3"><enum>(1)</enum><text>in paragraph (3), by striking <quote>or (D) any destructive device</quote> and inserting <quote>; (D) any destructive device; or (E) any combination of parts designed or intended for use in converting any device into a firearm and from which a firearm may be readily assembled</quote>; and</text></paragraph> <paragraph id="H2C975AB43634415E8EBEDE7FA7128C4F"><enum>(2)</enum><text>in paragraph (4)—</text>
<subparagraph id="H70F31151EF9A47CCBD2063D9BC019D12"><enum>(A)</enum><text>by adding <quote>and</quote> at the end of subparagraph (A);</text></subparagraph> <subparagraph id="HA52432CB4C5641978EA9E95B444BEDE9"><enum>(B)</enum><text>by striking <quote>and</quote> at the end of subparagraph (B) and inserting a period; and</text></subparagraph>
<subparagraph id="H7554EB80B84D41C78F3959AF6F274546"><enum>(C)</enum><text>by striking subparagraph (C).</text></subparagraph></paragraph></section> <section id="H3D774D899BFA4928A050F4B8EC856115"><enum>3.</enum><header>Law enforcement protection</header> <subsection id="HF9E7C0682D23463A916626B3BEFD3670"><enum>(a)</enum><header>Armor-Piercing, concealable weapons</header> <paragraph id="HD6F4D6AD92E744368055E40851CD37A2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and (8)</quote> and inserting <quote>; (8) an armor-piercing, concealable weapon; and (9)</quote>.</text></paragraph>
<paragraph id="H1C049947D84E41E89D7D3D84392F6A79"><enum>(2)</enum><header>Armor-piercing, concealable weapon</header><text display-inline="yes-display-inline">Section 5845 of such Code is amended by adding at the end the following new subsection:</text> <quoted-block display-inline="no-display-inline" id="H00735F05777C464B8E5247BF1F302170" style="OLC"> <subsection id="HC93B82A43BBB4490B1E22AEE5A33BF81"><enum>(n)</enum><header>Armor-Piercing, concealable weapon</header><text display-inline="yes-display-inline">The term <term>armor-piercing, concealable weapon</term> means any weapon or device capable of being concealed on the person and from which can be discharged through the energy of an explosive any of the following rounds of ammunition:</text>
<paragraph id="HE2B3B4938E434E13BB3B6D61EF6B9A3E"><enum>(1)</enum><text>.450 Bushmaster.</text></paragraph> <paragraph id="H169C1D23E37C49B6933BE2A2B099E95D"><enum>(2)</enum><text>5.56mm (including the 5.56x45mm NATO and .223 Remington).</text></paragraph>
<paragraph id="HDF8EE79BD71B425F8DC447B173953EF4"><enum>(3)</enum><text display-inline="yes-display-inline">7.62mm (including the 7.62x39mm, .308 Winchester, 7.62 NATO, 7.62x51mm NATO, .30 carbine, 7.62x33mm, or .300 AAC Blackout).</text></paragraph> <paragraph id="H31A025525C44485D9C4ABD1C9A4C294D"><enum>(4)</enum><text>.50 BMG.</text></paragraph>
<paragraph id="H15922F3FFB77427CA077DBD672218D45"><enum>(5)</enum><text>5.7x28mm.</text></paragraph> <paragraph id="H7F642280CDA74DE99412597572AB83E0"><enum>(6)</enum><text display-inline="yes-display-inline">Any other round determined by the Bureau of Alcohol, Tobacco, Firearms and Explosives to be capable of, when fired by such weapon or device, penetrating the standard body armor worn by law enforcement officers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H3A82F379474948C8AC0344A19989AEB2"><enum>(3)</enum><header>Conforming amendments</header>
<subparagraph id="H1F68930A574342B688CF7B889B2E840E"><enum>(A)</enum><text>Section 921(a) of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block id="HC8336D8E662B44EF8EAD0CE8A59F6345" style="OLC"> <subsection id="HC9D9C267869A4A2E8A5F9F7E9A027884"><enum>(36)</enum><text>The term <term>armor-piercing, concealable weapon</term> has the meaning given such term in section 5845(n) of the National Firearms Act (<external-xref legal-doc="usc" parsable-cite="usc/26/5845">26 U.S.C. 5845(n)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HE036E9EF4EA74C88BBF3120030950007"><enum>(B)</enum><text>Section 922 of title 18, United States Code, is amended—</text> <clause id="H61FFFF6748F14DBF9233327E9DCF5248"><enum>(i)</enum><text>in subsection (a)(4), by striking <quote>or short-barreled rifle,</quote> and inserting <quote>short-barreled rifle, or armor-piercing, concealable weapon,</quote>; and</text></clause>
<clause id="H8955D7D9366E46D4A9109EAC702F92A1"><enum>(ii)</enum><text>in subsection (b)(4) by striking <quote>or short-barreled rifle,</quote> and inserting <quote>short-barreled rifle, or armor-piercing, concealable weapon,</quote>.</text></clause></subparagraph> <subparagraph id="H991989CED43C4F1B8B8B709B2C301AE3"><enum>(C)</enum><text>Section 924(c)(1)(B)(i) of title 18, United States Code, is amended by inserting <quote>armor-piercing, concealable weapon,</quote> after <quote>short-barreled shotgun,</quote>.</text></subparagraph></paragraph>
<paragraph id="HB36271CFD9574307B21D1639D2C68217"><enum>(4)</enum><header>Effective date</header>
<subparagraph id="HD6C089EDC47B40658859D725AB8B934D"><enum>(A)</enum><header>In general</header><text>The amendments made by this subsection shall take effect on the date of the enactment of this Act.</text></subparagraph> <subparagraph id="HDD3621F73523443FB55E370754C80F4F"><enum>(B)</enum><header>Application to possession on date of enactment</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), any person on the date of the enactment of this Act possessing a device described in <external-xref legal-doc="usc" parsable-cite="usc/26/5845">section 5845(a)(8)</external-xref> of the Internal Revenue Code of 1986 (as amended by this section) shall, not later than the end of the 18th month beginning after the date of the enactment of this Act, register such weapon or device with the Secretary of the Treasury and include with such registration the information required under section 5841(a) of such Code. Such registration shall become a part of the National Firearms Registration and Transfer Record required to be maintained by such section.</text></subparagraph></paragraph></subsection>
<subsection id="HF5B1208E90F340D7AE215E8174274DDF"><enum>(b)</enum><header>Use of National Firearms Act taxes</header><text>Part I of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/53">chapter 53</external-xref> of the Internal Revenue Code of 1986 is amended redesignating section 5849 as section 5850 and by inserting after section 5847 the following new section:</text> <quoted-block display-inline="no-display-inline" id="HE4D157B1EFCF4ABC98395B5CA644924C" style="OLC"> <section id="H35F4C20FC97E4FC396868F4DF13C5227"><enum>5849.</enum><header>Use of taxes</header><text display-inline="no-display-inline">To carry out the purposes of this chapter and to supplement appropriations otherwise made available for such purposes, the Bureau of Alcohol, Tobacco, Firearms and Explosives may spend the amounts collected under subchapter A for fiscal years 2021 and thereafter.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HFC293108B4A14955A7938AEB9034F180" display-inline="no-display-inline"><enum>4.</enum><header>Reporting of background check denials</header>
<subsection id="H142448656C6542B791A59552B1BCFE41"><enum>(a)</enum><header>Reporting to State authorities</header>
<paragraph id="HAC6C1F49EE0A4EA7B9E603C239BC6B81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/925A">section 925A</external-xref> the following:</text> <quoted-block display-inline="no-display-inline" id="H9E9BEB2370C1477F8CBA92E28EC50D71" style="USC"> <section id="HC925BEB4D42845E1A75F4CAF893D8CF3"><enum>925B.</enum><header>Reporting of background check denials to State authorities</header> <subsection id="H5E9D648393754917B0423AF3BB0C7CD0"><enum>(a)</enum><header>In general</header><text>If the national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/18/922">18 U.S.C. 922</external-xref> note) provides a notice pursuant to section 922(t) of this title that the receipt of a firearm by a person would violate subsection (g) or (n) of section 922 of this title or State law, the Attorney General shall, in accordance with subsection (b) of this section—</text>
<paragraph id="H52459C418BAD4255B7C0B41C050553F8"><enum>(1)</enum><text>report to the law enforcement authorities of the State where the person sought to acquire the firearm and, if different, the law enforcement authorities of the State of residence of the person—</text> <subparagraph id="H3646C218E5594639B60AD6EED6E5D1CC"><enum>(A)</enum><text>that the notice was provided;</text></subparagraph>
<subparagraph id="H1941FEB1BEB24377B4E966D924B435BB"><enum>(B)</enum><text>of the specific provision of law that would have been violated;</text></subparagraph> <subparagraph id="HCBD8F42AFD804862879FFB89A763963E"><enum>(C)</enum><text>of the date and time the notice was provided;</text></subparagraph>
<subparagraph id="HA0141FE9EDAC487E93DB862E87E3B3FB"><enum>(D)</enum><text>of the location where the firearm was sought to be acquired; and</text></subparagraph> <subparagraph id="H53A43DCE0ABD4DF0B48F5FB3A31E7863"><enum>(E)</enum><text>of the identity of the person; and</text></subparagraph></paragraph>
<paragraph id="H4F4522D8557A41A7A9DB352F481CC659"><enum>(2)</enum><text>where practicable, report the incident to local law enforcement authorities and State and local prosecutors in the jurisdiction where the firearm was sought and in the jurisdiction where the person resides.</text></paragraph></subsection> <subsection id="HB5B7A61DE2D94CA7BED92CA2FD44F131"><enum>(b)</enum><header>Requirements for report</header><text>A report is made in accordance with this subsection if the report is made within 24 hours after the provision of the notice described in subsection (a), except that the making of the report may be delayed for so long as is necessary to avoid compromising an ongoing investigation.</text></subsection>
<subsection id="H7D37FA6BE2194AE086BD467F75C727EF"><enum>(c)</enum><header>Rule of construction</header><text>Nothing in subsection (a) shall be construed to require a report with respect to a person to be made to the same State authorities that originally issued the notice with respect to the person.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H9F957A5618EC407AAF6407393B2F63D6"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by inserting after the item relating to section 925A the following:</text>

<subsection id="HB3A4BE530EEE4448B46667ADC9377D11"><enum>(b)</enum><header>Annual report to Congress</header>
<paragraph id="H5A92561FCC504D8A86E17B1546F8CCE9"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, as amended by subsection (a)(1) of this section, is amended by inserting after section 925B the following:</text> <quoted-block display-inline="no-display-inline" id="H6A65C17917364F039E680B03320C49F5" style="USC"> <section id="HC40A884AEAD74BE296BB759F4CA76308"><enum>925C.</enum><header>Annual report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this section, and annually thereafter, the Attorney General shall submit to the Congress a report detailing the following, broken down by Federal judicial district:</text>
<paragraph id="HBEF352717411487AB2705F61C62C8F6C"><enum>(1)</enum><text>With respect to each category of persons prohibited by section 922(g) from receiving or possessing a firearm who are so denied a firearm—</text> <subparagraph id="H303940B4FAE64560ADEFC3A7B08EB712"><enum>(A)</enum><text>the number of cases referred to the Bureau of Alcohol, Tobacco, Firearms and Explosives;</text></subparagraph>
<subparagraph id="HE6407325928C41329D60857FF36F4D0A"><enum>(B)</enum><text>the number of cases with respect to which an investigation was opened by a field division of the Bureau of Alcohol, Tobacco, Firearms and Explosives;</text></subparagraph> <subparagraph id="H4844BC5CC6F54CE2BBDF152419DF5610"><enum>(C)</enum><text>the number of arrests made; and</text></subparagraph>
<subparagraph id="H5157AC70778F4611926E398DEB4435A4"><enum>(D)</enum><text>the number of convictions obtained by Federal authorities in connection with the denial.</text></subparagraph></paragraph> <paragraph id="H02DAD648D7CF4CB2AD31F69A279F36CC"><enum>(2)</enum><text>The number of background check notices reported to State authorities pursuant to section 925B (including the number of the notices that would have been so reported but for section 925B(c)).</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H8F6D87D4FB0E4E9E8A60766BA2CE5AE8"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for such chapter, as amended by subsection (a)(2) of this section, is amended by inserting after the item relating to section 925B the following:</text> <quoted-block id="H2BC84EE66776496E86A2D3C1EBB4F772" style="USC"> <toc> <toc-entry idref="HC40A884AEAD74BE296BB759F4CA76308" level="section">925C. Annual report to Congress.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H39535DD0D6274A92BFF14A4D5EF1924D"><enum>5.</enum><header>Codification of regulations classifying bump stocks as machineguns</header><text display-inline="no-display-inline">The amendments to parts 447, 478, and 479 of title 27, Code of Federal Regulations, made by the final rule promulgated by the Department of Justice, entitled <quote>Bump-Stock-Type Devices</quote>, and published December 26, 2018 (83 Fed. Reg. 66514), shall have the force and effect of law.</text></section>
