which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Safe Drinking Water Act and the Federal Water Pollution Control Act to establish programs to assist low-income households in maintaining access to drinking water and wastewater services, and for other purposes.</official-title></form><legis-body id="H9843614BA2824DDAA8FDF2B64D9F5FE7" style="OLC"><section id="HD68B6F778007477A90EB6FAF0647E492" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Low-Income Water Customer Assistance Programs Act of 2021</short-title></quote>.</text></section><section id="HAE59ECB58D8441438EFBD25D04B71BA3"><enum>2.</enum><header>Low-income drinking water assistance program</header><text display-inline="no-display-inline">Part E of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j">42 U.S.C. 300j et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB289D7CCE0DC482E855FD2D1CCDC8B74" style="OLC"><section id="HEC77B337C5DB428E85861B3B2E395443"><enum>1459E.</enum><header>Low-income drinking water assistance program</header><subsection id="HB5CCAC953FC54B59A94596DCCB5FD6B3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H282786345F4F45448AD7151955D995EE" commented="no"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H11B1943675664B2FA20AC752FCF4F441" commented="no"><enum>(A)</enum><text>a community water system that is owned or operated by a municipality, other than a small community-serving water system; or</text></subparagraph><subparagraph id="H86C4FEA04CCF468D9255E60FB1DD2988" commented="no"><enum>(B)</enum><text>a State, with respect to a small community-serving water system located in the State.</text></subparagraph></paragraph><paragraph id="H77BBAA35804A4E9CA5E3A2585FE4117B"><enum>(2)</enum><header>Household</header><text display-inline="yes-display-inline">The term <term>household</term> means any individual or group of individuals who are living together as 1 economic unit.</text></paragraph><paragraph id="H5CA130D658C845CDBB3A1FDAE3056E64" commented="no"><enum>(3)</enum><header>Local drinking water access program</header><text>The term <term>local drinking water access program</term> means a program developed or implemented by an eligible entity using a grant awarded under this section.</text></paragraph><paragraph id="HC55D10D3C1494467AFF5FDDEC4BE9915"><enum>(4)</enum><header>Low-income household</header><text>The term <term>low-income household</term> means a household—</text><subparagraph id="H594CCEFF32DD4DA5AEB01EAAB2EBF040"><enum>(A)</enum><text display-inline="yes-display-inline">in which 1 or more individuals are receiving—</text><clause id="H64CAC5420F5B48C180154AC90086D12A"><enum>(i)</enum><text>assistance under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></clause><clause id="HA04DC8C6FF2B43269359A0A9CFCDE2BB"><enum>(ii)</enum><text>supplemental security income payments under title XVI of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>);</text></clause><clause id="H0635AA54804144B6AF942B34BBD389E0"><enum>(iii)</enum><text>supplemental nutrition assistance program benefits under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008 </act-name>(<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); or</text></clause><clause id="H572CD61202494C98821D7015CFCF1D33"><enum>(iv)</enum><text display-inline="yes-display-inline">payments under—</text><subclause id="HD06BAF62F5BE407BBD7A84EA2C24D2FB"><enum>(I)</enum><text display-inline="yes-display-inline">section 1315, 1521, 1541, or 1542 of title 38, United States Code; or</text></subclause><subclause id="HA353B2782F8B4EC399753DF57CDCDC88"><enum>(II)</enum><text display-inline="yes-display-inline">section 306 of the Veterans’ and Survivors’ Pension Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/38/1521">38 U.S.C. 1521</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/95/588">Public Law 95–588</external-xref>); or</text></subclause></clause></subparagraph><subparagraph id="HB0C38C6E1DAB4D23AEEEA4A6DC0211F4"><enum>(B)</enum><text>that has an income that—</text><clause id="H1F720DCEB7E2496493C1003C948E190D"><enum>(i)</enum><text>as determined by the State in which the household is located, does not exceed the greater of—</text><subclause id="H64316B48FBE04D8294F5190DB9FF7744"><enum>(I)</enum><text>an amount equal to 150 percent of the poverty level; and</text></subclause><subclause id="H17831D0282884A4F82AE8C0F76D48A85"><enum>(II)</enum><text>an amount equal to 60 percent of the State median income for that State; or</text></subclause></clause><clause id="HBEECA646417E4785BAAF1846C944C8D8" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">does not exceed an amount, determined by an eligible entity receiving a grant under this section, that—</text><subclause id="H493FE79E9F0147B095F14C63610E86FC" commented="no"><enum>(I)</enum><text>is lower that the amount described in clause (i); and</text></subclause><subclause id="H6E8236DF7E0048949569EA434144ED49" commented="no"><enum>(II)</enum><text>is greater than or equal to 110 percent of the poverty level.</text></subclause></clause></subparagraph></paragraph><paragraph id="HFA234CA9E32D406F8D5DE65915B6CC21" commented="no"><enum>(5)</enum><header>Poverty level</header><text>The term <term>poverty level</term> means, with respect to a household in a State, the income described in the poverty guidelines issued by the Secretary of Health and Human Services pursuant to section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>), as applicable to the household.</text></paragraph><paragraph id="HDE53C0AD360645FD82119FCDEA35207D" commented="no"><enum>(6)</enum><header>Small community-serving water system</header><text display-inline="yes-display-inline">The term <term>small community-serving water system</term> means a community water system that provides drinking water services to a municipality with a population of fewer than 10,000 residents, at least 20 percent of whom are at or below the poverty level.</text></paragraph><paragraph id="H26605A079759407BA3CBF6DCEA10FA07"><enum>(7)</enum><header>State median income</header><text display-inline="yes-display-inline">The term <term>State median income</term> has the meaning given that term in section 2603 of the <short-title>Low-Income Home Energy Assistance Act of 1981</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/42/8622">42 U.S.C. 8622</external-xref>). </text></paragraph></subsection><subsection id="H2251D36FE62C40108A5E09B444ADF605"><enum>(b)</enum><header>Establishment</header><paragraph id="HAC3B6CBAA1754C8D8004E3B6ECC8D05A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish a Federal low-income drinking water assistance program to award grants to eligible entities to develop and implement local drinking water access programs to assist low-income households in maintaining access to affordable drinking water.</text></paragraph><paragraph id="HA04BE05AAA0F44CCBE022ED589124B2D" commented="no"><enum>(2)</enum><header>Requirements for small community-serving water systems</header><text display-inline="yes-display-inline">In order for a State to be eligible to receive a grant under this section for a small community-serving water system, the State and the small community-serving water system shall enter into a memorandum of understanding, under which the State shall—</text><subparagraph id="HB9F021CDB2D44292B9422DC0C650A8DD" commented="no"><enum>(A)</enum><text>submit to the Administrator an application under paragraph (6) for the small community-serving water system; and</text></subparagraph><subparagraph id="H0AD4C02E2E744728A9358BB57B377CCF" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">on receipt of a grant under this section, develop and implement a local drinking water access program for the small community-serving water system.</text></subparagraph></paragraph><paragraph id="H3561760C6C0D4EFA8AF93DFECDF517BC"><enum>(3)</enum><header>Limitations</header><text>A grant awarded under this subsection—</text><subparagraph id="H58ADC2CDF96E40BB88C090A8CE20A0E9"><enum>(A)</enum><text display-inline="yes-display-inline">shall not be used to replace funds for any existing similar local program to assist low-income households in maintaining access to affordable drinking water; but</text></subparagraph><subparagraph id="HB746402A088742C3A409FC653899CEC1"><enum>(B)</enum><text>may be used to supplement or enhance such a local program.</text></subparagraph></paragraph><paragraph id="H2E7043ACEB8D4274AACDB0E0E256184A"><enum>(4)</enum><header>Term</header><text>The term of a grant awarded under this subsection shall be one year.</text></paragraph><paragraph id="H76CB1CEACAEB401D8E8D34124A5BBE36"><enum>(5)</enum><header>Minimum local program requirements</header><subparagraph id="H519F6852BAED4A28A1BBF6C9687FF174"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this section, the Administrator shall develop, in consultation with relevant stakeholders, the minimum requirements for a local drinking water access program.</text></subparagraph><subparagraph id="H722A316B16304E0686D63C85AB94F4FF"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The local drinking water access program requirements developed under subparagraph (A) may include—</text><clause id="HAC6FE5F7C28D46A3988A8030DE8C3B2A"><enum>(i)</enum><text>direct financial assistance;</text></clause><clause id="H1CDEE40326D74FAE9851F2C429150A29" commented="no"><enum>(ii)</enum><text>a lifeline rate;</text></clause><clause id="H041B0E142A2D41B7BCA03F8FC16C2462"><enum>(iii)</enum><text>bill discounting;</text></clause><clause id="H72B9A641971B409EBE26D520BC6DFE40"><enum>(iv)</enum><text>special hardship provisions;</text></clause><clause id="H2F7F4F96310D48F6904CFCCC8F1DD583"><enum>(v)</enum><text>a percentage-of-income payment plan;</text></clause><clause id="H41BDCB5B31E84985B863445FA0C05B27"><enum>(vi)</enum><text>water efficiency assistance, including subsidizing the cost of the installation of water efficient fixtures or leak repair work that is carried out or contracted by a homeowner; or</text></clause><clause id="H0498FD33CE984FFD817B72CFCF640BFD"><enum>(vii)</enum><text display-inline="yes-display-inline">any other form of assistance identified by the Administrator.</text></clause></subparagraph></paragraph><paragraph id="H9DFCAE6D64D04278908C077877F1753A"><enum>(6)</enum><header>Application</header><text>To receive a grant under this subsection—</text><subparagraph id="HBF8659758DDA40BC863F8A6F579C12D6"><enum>(A)</enum><text>an eligible entity shall submit to the Administrator an application that demonstrates that—</text><clause id="H956A28E8CCF34355BE79B3A73C971766"><enum>(i)</enum><text display-inline="yes-display-inline">the proposed local drinking water access program meets the requirements developed under paragraph (5); and</text></clause><clause id="H639DA76B9E3448FCA12BAEAEEC9DFF88"><enum>(ii)</enum><text display-inline="yes-display-inline">the proposed local drinking water access program will treat households that live in owner-occupied homes and households that live in rental housing equitably; and</text></clause></subparagraph><subparagraph id="H1CF5144A387F4D4B800F75252BCCA1A1"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an eligible entity described in subsection (a)(1)(A), the eligible entity shall submit to the Administrator an application that demonstrates that—</text><clause id="HC450E26969CC4B74A755E06D160E95BC"><enum>(i)</enum><text>the eligible entity has—</text><subclause id="H849F34D46B6841EFAA608645581B328B"><enum>(I)</enum><text>a long-term financial plan based on an analysis of the rates the applicable community water system charges for drinking water services;</text></subclause><subclause id="HFF03A4A7368443F59D4546C5E6CD133C"><enum>(II)</enum><text>an asset management plan;</text></subclause><subclause id="HFD736198EEC94B6AA32B0D0AB679FB24"><enum>(III)</enum><text>a capital improvement plan with a period of not less than 20 years;</text></subclause><subclause id="HB91E13AF76E34762898CB1009CC8D14E"><enum>(IV)</enum><text>a fiscal management plan; or</text></subclause><subclause id="HA9F71979EC414FFC9D892639EA2F3368"><enum>(V)</enum><text>another plan similar to the plans described in clauses (i) through (iv);</text></subclause></clause><clause id="HF4395D569E50457C9154D382918BB562"><enum>(ii)</enum><text>a grant awarded under this subsection would support the efforts of the eligible entity to generate the necessary funds to achieve or maintain compliance with this Act while mitigating the cost to low-income households; and</text></clause><clause id="HD1CDC08B90134C2CA9DF5FBC18260C74" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the eligible entity has the capacity to create and implement an effective community outreach plan to inform low-income households of the local drinking water access program and assist with enrollment.</text></clause></subparagraph></paragraph><paragraph id="H3181A8308C0C4B4EA3DC042C7CFF61F7"><enum>(7)</enum><header>Priority</header><text>In awarding grants under this subsection, the Administrator shall give priority to applications for local drinking water access programs with respect to which—</text><subparagraph id="HB5A7F17F410542099D1A8B6A03227420"><enum>(A)</enum><text>the owner or operator of the applicable community water system—</text><clause commented="no" id="HFB55E56A7CC047C78D386D4101763660"><enum>(i)</enum><text display-inline="yes-display-inline">owns or operates a—</text><subclause commented="no" id="HF8707642E071460FB4310E6014D5622F"><enum>(I)</enum><text>treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)) for municipal waste; or</text></subclause><subclause commented="no" id="HBA5B4341B8D248CE8C13D0C8C9AEDDC3"><enum>(II)</enum><text>a municipal separate storm sewer system (as such term is used in the Federal Water Pollution Control Act); and</text></subclause></clause><clause id="H0064376D79014145B65D5260CA23EC9F"><enum>(ii)</enum><text>is subject to a consent decree relating to compliance with the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) with respect to a treatment works or system described in clause (i);</text></clause></subparagraph><subparagraph commented="no" id="H7183E7CFE9B4470A95C4487DFA1B82CD"><enum>(B)</enum><text>the residential customers of the applicable community water system have experienced rate or fee increases for drinking water services or wastewater services (including stormwater services) of 30 percent or more during the 3-year period ending on the date of enactment of this section; or</text></subparagraph><subparagraph id="H3B483E12D1024758B7FCEAD83D53CCCB"><enum>(C)</enum><text>the eligible entity will provide matching funds in an amount equal to or greater than the amount of the grant.</text></subparagraph></paragraph><paragraph id="H3912939BB535482EA293F87789A9F211"><enum>(8)</enum><header>Reporting requirements</header><subparagraph id="H20BA15F8C66A474C8092B0BA6EDF1109"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of receiving a grant under this subsection, an eligible entity shall submit to the Administrator, in a manner determined by the Administrator, information regarding the applicable local drinking water access program, including—</text><clause id="H4D9EF39AB2194F5FBA618EFE6D772B93"><enum>(i)</enum><text>key features, including rate structures, rebates, discounts, and related initiatives that assist low-income households, including—</text><subclause id="H2950153EA7CA4C83A68CA4F7B7DF8E52"><enum>(I)</enum><text>billing methods that average rates over the course of a year, known as <quote>budget billing</quote>;</text></subclause><subclause id="HF9E6F6F0ED28463B96281D39891EF60D"><enum>(II)</enum><text>bill timing; and</text></subclause><subclause id="H7858AA07BE59476099B2D528D3706FCD"><enum>(III)</enum><text>pretermination protections;</text></subclause></clause><clause id="H4806FB1F3D564EE2A9CD6AB320D61549"><enum>(ii)</enum><text>sources of funding;</text></clause><clause id="H1722ED96627248669986D7A1294897A1"><enum>(iii)</enum><text>eligibility criteria;</text></clause><clause id="H74D20F44D9544DD8BB51782F29390CDC"><enum>(iv)</enum><text display-inline="yes-display-inline">participation rates by households;</text></clause><clause id="HEF7BD31CF954464BB4D1E2C1337519CA"><enum>(v)</enum><text display-inline="yes-display-inline">the average amount of assistance provided to participating households;</text></clause><clause id="H375BBD808EF448098DB199A259CBD960"><enum>(vi)</enum><text>program costs;</text></clause><clause id="H5911DD0396AA4E2CAE2C44DF521D9517"><enum>(vii)</enum><text display-inline="yes-display-inline">the demonstrable impacts of the program on arrearage and service disconnection for households, based on data from before and after the implementation of the program, to the maximum extent practicable; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H40D22C4083B04A868B4F4C6293D0219D"><enum>(viii)</enum><text display-inline="yes-display-inline">other relevant information required by the Administrator.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8567BE099BBB4BC7B0B6C33AE0661DF8"><enum>(B)</enum><header>Publication</header><text>The Administrator shall publish a report that compiles and summarizes the information submitted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="HEF83450986E34296B6901711B899812C" commented="no"><enum>(9)</enum><header>Assistance exempt from taxation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, assistance provided to a low-income household under a local drinking water access program shall not be includible in the gross income of the recipient of such assistance for purposes of the Internal Revenue Code of 1986. </text></paragraph></subsection><subsection id="HFD2F0479BBAA4DB7953F7DAE74B8B08C"><enum>(c)</enum><header>Technical assistance</header><text>The Administrator shall provide technical assistance to each eligible entity that receives a grant under this section to ensure—</text><paragraph id="H5584CDDAF25A4FE88D5241DD1E3D32D5"><enum>(1)</enum><text display-inline="yes-display-inline">full implementation of the applicable local drinking water access program; and</text></paragraph><paragraph id="H2A60AD5FDA7E49849BF8CC9B15526FC9"><enum>(2)</enum><text display-inline="yes-display-inline">maximum enrollment of low-income households in the applicable local drinking water access program, including through—</text><subparagraph id="H3497EE86A51D491D9926CE934404CA71"><enum>(A)</enum><text>community outreach campaigns; or</text></subparagraph><subparagraph id="HF7E57DBA4759404F945F2E772FCAE0F8"><enum>(B)</enum><text>coordination with local health departments to determine the eligibility of households for assistance.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H10501F846D984A93931D9B0BB7A49127"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which grant funds are first disbursed to an eligible entity under this section, and annually thereafter, the Administrator shall submit to Congress a report on the results of the Federal program established under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H96BD18B83E7A4078BFEB7A4D6BA1302B"><enum>3.</enum><header>Low-income wastewater assistance program</header><text display-inline="no-display-inline">Title I of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA90ED9DC414243C0920281997649D8DB" style="OLC"><section id="H7B85EBE97E624E77AB25D7D1508F6573"><enum>124.</enum><header>Low-income wastewater assistance program</header><subsection id="H8915810B78AC4F5BB2F42ED9E2B27F60"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE75BEE85A0DF4BAAAF44A27809AECC37"><enum>(1)</enum><header>Covered facility</header><text>The term <term>covered facility</term> means—</text><subparagraph id="H261A6573FD324823B3EFB7C78E45CE57"><enum>(A)</enum><text>a treatment works for municipal waste; or</text></subparagraph><subparagraph id="HD5DB4D01E5D841698831220AB6A78FF3"><enum>(B)</enum><text display-inline="yes-display-inline">a municipal separate storm sewer system.</text></subparagraph></paragraph><paragraph id="H1C2B237ECDC642ADA589F4C8C391FB39"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H4CFFD0A1D5354F33AA61756C937E590F"><enum>(A)</enum><text display-inline="yes-display-inline">a municipality that owns or operates a covered facility, other than a small community-serving wastewater facility;</text></subparagraph><subparagraph id="H60A190B716AF4391A55CF8FBB9F92A7D"><enum>(B)</enum><text>2 or more municipalities described in subparagraph (A) that have entered into a partnership agreement or a cooperative agreement; or</text></subparagraph><subparagraph id="H739B275603FB41E1A4AB01B694DF9A76"><enum>(C)</enum><text display-inline="yes-display-inline">a State, with respect to a small community-serving wastewater facility located in the State.</text></subparagraph></paragraph><paragraph id="H57BFF08A315D45F984FC28364D0F3D20"><enum>(3)</enum><header>Household</header><text display-inline="yes-display-inline">The term <term>household</term> means any individual or group of individuals who are living together as 1 economic unit.</text></paragraph><paragraph id="H26EA8F7777854D10AA3CA39A8584A93D" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Local wastewater services access program</header><text>The term <term>local wastewater services access program</term> means a program developed or implemented by an eligible entity using a grant awarded under this section.</text></paragraph><paragraph id="HE1318FD5B3C34667B95498C95C6E7216" display-inline="no-display-inline"><enum>(5)</enum><header>Low-income household</header><text>The term <term>low-income household</term> means a household—</text><subparagraph id="H968FBA2B831C486B9A01187555E81CDA"><enum>(A)</enum><text display-inline="yes-display-inline">in which 1 or more individuals are receiving—</text><clause id="H318F071CEAD44172AD76395BDE48AD29"><enum>(i)</enum><text>assistance under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></clause><clause id="H2CD2BBCAB6B74A28BA338C002963AA55"><enum>(ii)</enum><text>supplemental security income payments under title XVI of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>);</text></clause><clause id="H75FC7DABA5E04DCEB7F27573729DE45F"><enum>(iii)</enum><text>supplemental nutrition assistance program benefits under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008 </act-name>(<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); or</text></clause><clause id="H9F94908A723F4EC0A26EBB31ED9F2745"><enum>(iv)</enum><text display-inline="yes-display-inline">payments under—</text><subclause id="H3A73B80046F6440A9C3322AAE138B317"><enum>(I)</enum><text display-inline="yes-display-inline">section 1315, 1521, 1541, or 1542 of title 38, United States Code; or</text></subclause><subclause id="HBAF747D4513D4E4F9E9A422602BE4E31"><enum>(II)</enum><text display-inline="yes-display-inline">section 306 of the Veterans’ and Survivors’ Pension Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/38/1521">38 U.S.C. 1521</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/95/588">Public Law 95–588</external-xref>); or</text></subclause></clause></subparagraph><subparagraph id="HF90214F3A52242948D415ED0DE76CD9D"><enum>(B)</enum><text>that has an income that—</text><clause id="H6FA6476CC886419EB8D91BE24408D0E4"><enum>(i)</enum><text>as determined by the State in which the household is located, does not exceed the greater of—</text><subclause id="H03F95A65DDDD49C3BCFCF4E09D7DAF78"><enum>(I)</enum><text>an amount equal to 150 percent of the poverty level; and</text></subclause><subclause id="HFFA7DE2475B64722B6C7B06E5AD1B02A"><enum>(II)</enum><text>an amount equal to 60 percent of the State median income for that State; or</text></subclause></clause><clause id="H50F6EA5ACD1A44D490AC2F15DC2D75EC" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">does not exceed an amount, determined by an eligible entity receiving a grant under this section, that—</text><subclause id="HBF0AB99200714AB8BF401C45BF3ACB7A" commented="no"><enum>(I)</enum><text>is lower that the amount described in clause (i); and</text></subclause><subclause id="H7050B9BDC8F4494EA68E624894DFD74E" commented="no"><enum>(II)</enum><text>is greater than or equal to 110 percent of the poverty level.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBBCFC8D1D7434688AF7D9A52DC5B5A4A"><enum>(6)</enum><header display-inline="yes-display-inline">Poverty level</header><text display-inline="yes-display-inline">The term <term>poverty level</term> means, with respect to a household in a State, the income described in the poverty guidelines issued by the Secretary of Health and Human Services pursuant to section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>), as applicable to the household.</text></paragraph><paragraph id="H71F7F2553EC840D798581926BB475C7A"><enum>(7)</enum><header>Small community-serving wastewater facility</header><text>The term <term>small community-serving wastewater facility</term> means a covered facility that provides services to municipality with a population of fewer than 10,000 residents, at least 20 percent of whom are at or below the poverty level.</text></paragraph><paragraph id="H3D3B7684FABA45A28183BB268C506A84"><enum>(8)</enum><header>State median income</header><text display-inline="yes-display-inline">The term <term>State median income</term> has the meaning given that term in section 2603 of the <short-title>Low-Income Home Energy Assistance Act of 1981</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/42/8622">42 U.S.C. 8622</external-xref>).</text></paragraph></subsection><subsection id="H9C0C24E23B164496BBBDB9D3DF5AA95C"><enum>(b)</enum><header>Establishment</header><paragraph id="H455AF5B3763040B89EEDF90E0B9AADDB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish a Federal low-income wastewater assistance program to award grants to eligible entities to develop and implement local wastewater access programs to assist low-income households in maintaining access to affordable wastewater services, including municipal stormwater services.</text></paragraph><paragraph id="H81CB3CA543D84476A2C0ADC747FA0DAA" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Requirements for small community-serving wastewater facilities</header><text display-inline="yes-display-inline">In order for a State to be eligible to receive a grant under this section for a small community-serving wastewater facility, the State and the small community-serving wastewater facility shall enter into a memorandum of understanding, under which the State shall—</text><subparagraph id="H6419529CA1AC4203A7DCFC345EF3F682" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Administrator an application under paragraph (6) for the small community-serving wastewater facility; and</text></subparagraph><subparagraph id="H3CA5EE4D370C4340B18FD08E57B84D10" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">on receipt of a grant under this section, develop and implement a local wastewater access program for the small community-serving wastewater facility.</text></subparagraph></paragraph><paragraph id="H155B21B3D4D64234940165E95A3868EE"><enum>(3)</enum><header>Limitations</header><text>A grant awarded under this subsection—</text><subparagraph id="H2720C5BDD8D64527B2B80FD2E78C3891"><enum>(A)</enum><text display-inline="yes-display-inline">shall not be used to replace funds for any existing similar local program to assist low-income households in maintaining access to affordable wastewater services, including municipal stormwater services; but</text></subparagraph><subparagraph id="H91FD75ABB9D4474AA519959AB96B45B6"><enum>(B)</enum><text>may be used to supplement or enhance such a local program.</text></subparagraph></paragraph><paragraph id="H9A5318DEC0954AB0AECE6E441439AAFE" commented="no"><enum>(4)</enum><header>Term</header><text>The term of a grant awarded under this subsection shall be one year.</text></paragraph><paragraph id="H22B75AE2D1904DA4A343F1123C5D8B36"><enum>(5)</enum><header>Minimum local program requirements</header><subparagraph id="HC14CE32BF509443CB2312299A7D8F793"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this section, the Administrator shall develop, in consultation with relevant stakeholders, the minimum requirements for a local wastewater access program.</text></subparagraph><subparagraph id="H229BFB697DC747A99864B6F4624C650F"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The local wastewater access program requirements developed under subparagraph (A) may include—</text><clause id="HD28C79FBBC6B4105B6DFE4973267F605"><enum>(i)</enum><text>direct financial assistance;</text></clause><clause id="H6B1F78F3B03E4BFCA4ECE5951F3C48DE" commented="no"><enum>(ii)</enum><text>a lifeline rate;</text></clause><clause id="H9419FD0048764F50B9B1A12ADE106447"><enum>(iii)</enum><text>bill discounting;</text></clause><clause id="HC7586801B004422F9E90E4E4C480C3A4"><enum>(iv)</enum><text>special hardship provisions;</text></clause><clause id="H78AF2F17FD51452999FCD7629F1B6F55"><enum>(v)</enum><text>a percentage-of-income payment plan;</text></clause><clause id="HC56E43AC23D84F54ABFD3B730D70AD94"><enum>(vi)</enum><text display-inline="yes-display-inline">water efficiency assistance, including subsidizing the cost of the installation of water efficient fixtures or leak repair work that is carried out or contracted by a homeowner; or</text></clause><clause id="HC64AE5E061574A3BA7BFF02FF2A77FF1"><enum>(vii)</enum><text display-inline="yes-display-inline">any other form of assistance identified by the Administrator.</text></clause></subparagraph></paragraph><paragraph id="HCD35DC2467B94C9D924697E090EF953D"><enum>(6)</enum><header>Application</header><text>To receive a grant under this subsection—</text><subparagraph id="H282458427605408596F8AA411B38F27E"><enum>(A)</enum><text>an eligible entity shall submit to the Administrator an application that demonstrates that—</text><clause id="H5ACAF6B4FBB14EB1A3CFE07FEFE36A1C"><enum>(i)</enum><text display-inline="yes-display-inline">the proposed local wastewater access program meets the requirements developed under paragraph (5); and</text></clause><clause id="HC308EDCDF60342C78714FCC39CCA753C"><enum>(ii)</enum><text display-inline="yes-display-inline">the proposed local wastewater access program will treat households that live in owner-occupied homes and households that live in rental housing equitably; and</text></clause></subparagraph><subparagraph id="H2FCF6F56ED93426F8418C6C4A51FFDC6"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an eligible entity described in subsection (a)(1)(A), the eligible entity shall submit to the Administrator an application that demonstrates that—</text><clause id="HD04D349CE9684CC9B34BDDD3C27F40BD"><enum>(i)</enum><text>the eligible entity has—</text><subclause id="HAAC47659EA7B4F0CBD74E1B0B956F364"><enum>(I)</enum><text>a long-term financial plan based on an analysis of the rates the applicable covered facility charges for services;</text></subclause><subclause id="HBC62B7AB549241E9A6077F9E170FD63E"><enum>(II)</enum><text>an asset management plan;</text></subclause><subclause id="H5C856BD86D9F46A798AF77C4A8990900"><enum>(III)</enum><text>a capital improvement plan with a period of not less than 20 years;</text></subclause><subclause id="HC95D6D94C4F544F292A7606472C94933"><enum>(IV)</enum><text>a fiscal management plan; or</text></subclause><subclause id="H234AEF56C1354BC89CE12A4AEFEE7D39"><enum>(V)</enum><text>another plan similar to the plans described in clauses (i) through (iv);</text></subclause></clause><clause id="H53D87D5B4BB0498B8DA50B3B739FC38F"><enum>(ii)</enum><text>a grant awarded under this subsection would support the efforts of the eligible entity to generate the necessary funds to achieve or maintain compliance with this Act while mitigating the cost to low-income households; and</text></clause><clause id="HB68CEC865C684F59A9E37C4987309D1E"><enum>(iii)</enum><text display-inline="yes-display-inline">the eligible entity has the capacity to create and implement an effective community outreach plan to inform low-income households of the local wastewater access program and assist with enrollment.</text></clause></subparagraph></paragraph><paragraph id="H114ED54F33F74DA5B32B1F8A24D56FEB"><enum>(7)</enum><header>Priority</header><text>In awarding grants under this subsection, the Administrator shall give priority to applications for local wastewater access programs with respect to which—</text><subparagraph id="HE2FD65F75F7B4091AF0122B6BE7E80AC"><enum>(A)</enum><text>the applicable covered facility is subject to a consent decree relating to compliance with this Act;</text></subparagraph><subparagraph commented="no" id="H0BA5D4308AE741ADAEB73BF40B872F16"><enum>(B)</enum><text>the residential customers of the applicable covered facility have experienced rate or fee increases for drinking water services or wastewater services (including stormwater services) of 30 percent or more during the 3-year period ending on the date of enactment of this section;</text></subparagraph><subparagraph id="H107A6CDAB35948D59D84E98C4B68DF28" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">the eligible entity develops an equivalent program, as determined by the Administrator, that is administered separately by the eligible entity;</text></subparagraph><subparagraph id="H714BF75763474C82B946809F0AA1382F"><enum>(D)</enum><text>matching funds will be provided in an amount equal to or greater than the amount of the grant; or</text></subparagraph><subparagraph id="HFA12B538354144E6A035C127889D9359"><enum>(E)</enum><text>the eligible entity is described in subsection (a)(2)(B).</text></subparagraph></paragraph><paragraph id="H4E320AB02C244FE7AC7BC24658FE4CDB"><enum>(8)</enum><header>Reporting requirements</header><subparagraph id="H377863C26D614998A7DBFD27FEE59AA6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As a condition of receiving a grant under this subsection, an eligible entity shall submit to the Administrator, in a manner determined by the Administrator, information regarding the applicable local wastewater access program, including—</text><clause id="HA27A1FD811154378AFEAC275B4AEE2C4"><enum>(i)</enum><text display-inline="yes-display-inline">key features, including rate structures, rebates, discounts, and related initiatives that assist low-income households, including—</text><subclause id="H64891659283840868A68047FD13D821A"><enum>(I)</enum><text>billing methods that average rates over the course of a year, known as <quote>budget billing</quote>;</text></subclause><subclause id="H4F9F77C3452A4793ADD0EE88CAA1A200"><enum>(II)</enum><text>bill timing; and</text></subclause><subclause id="HD3690F50E04443B0AB93755EFD463203"><enum>(III)</enum><text>pretermination protections;</text></subclause></clause><clause id="H06CA5E11F7174CA081740F5F950F40A0"><enum>(ii)</enum><text>sources of funding;</text></clause><clause id="HD0AAB8799C5744169B91026DCFA9E667"><enum>(iii)</enum><text>eligibility criteria;</text></clause><clause id="HA28D43412DF14CD6B79EB86F05BFD3B9"><enum>(iv)</enum><text display-inline="yes-display-inline">participation rates by households;</text></clause><clause id="H2588A612E4AF4A0FA0F6D76C06AB057D"><enum>(v)</enum><text display-inline="yes-display-inline">the average amount of assistance provided to households;</text></clause><clause id="HB525C26AB882444FB99992AC066D3C1B"><enum>(vi)</enum><text>program costs;</text></clause><clause id="H4A9D671762684C30A46E465F2970E78C"><enum>(vii)</enum><text display-inline="yes-display-inline">the demonstrable impacts of the program on arrearage and service disconnection for households, based on data from before and after the implementation of the program, to the maximum extent practicable; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HCDC63724A0984F8484A584B4D611965D"><enum>(viii)</enum><text display-inline="yes-display-inline">other relevant information required by the Administrator.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9597BDC4D6614DAE89223789DC07932C"><enum>(B)</enum><header>Publication</header><text>The Administrator shall publish a report that compiles and summarizes the information submitted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H7C3B6AC668A44EC7B6210FF41CF8CF57" commented="no"><enum>(9)</enum><header>Assistance exempt from taxation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, assistance provided to a low-income household under a local wastewater access program shall not be includible in the gross income of the recipient of such assistance for purposes of the Internal Revenue Code of 1986. </text></paragraph></subsection><subsection id="HE363A3CDEB5A4E4CB53937FA3437427D"><enum>(c)</enum><header>Technical assistance</header><text>The Administrator shall provide technical assistance to each eligible entity that receives a grant under this section to ensure—</text><paragraph id="H0D061A74264847159C96FC9AD1980E1A"><enum>(1)</enum><text display-inline="yes-display-inline">full implementation of the applicable local wastewater access program; and</text></paragraph><paragraph id="H036EEF204B534494AF93C2D6C529EDB7"><enum>(2)</enum><text display-inline="yes-display-inline">maximum enrollment of low-income households in the applicable local wastewater access program, including through—</text><subparagraph id="H41E30048707E43359CEC1B2E516A4CDB"><enum>(A)</enum><text>community outreach campaigns; or</text></subparagraph><subparagraph id="H29CFDA8167EC4D6B9B98A48E87930289"><enum>(B)</enum><text>coordination with local health departments to determine the eligibility of households for assistance.</text></subparagraph></paragraph></subsection><subsection id="HDC9887C2104A496D994B26E9B73D1673"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which grant funds are first disbursed to an eligible entity under this section, and annually thereafter, the Administrator shall submit to Congress a report on the results of the Federal program established under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC676661CC6B548B3BA31760B900EF39A"><enum>4.</enum><header>Needs assessment for nationwide rural and urban low-income community water assistance program</header><subsection id="H0AE49B9A25D543BDAE7FD1224B5188B8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HBC7DEB0B605F4E0593D64C4E6CF69251"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="HBDDAF87CCAEC4E7280C72FD8E056F161" display-inline="no-display-inline"><enum>(2)</enum><header>Household</header><text display-inline="yes-display-inline">The term <term>household</term> means any individual or group of individuals who are living together as 1 economic unit.</text></paragraph><paragraph id="H50FE5A9275EA49C2B87EB8EC578DD9AE"><enum>(3)</enum><header>Low-income household</header><text>The term <term>low-income household</term> means a household—</text><subparagraph id="H7AAAC8E834D84B9F918857A3A99117A6"><enum>(A)</enum><text display-inline="yes-display-inline">in which 1 or more individuals are receiving—</text><clause id="HB78D95CBFC1F40D88B13AD20B6F91B1B"><enum>(i)</enum><text>assistance under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601 et seq.</external-xref>);</text></clause><clause id="HA67E14132CE34D0EB71C97A382ADB9F0"><enum>(ii)</enum><text>supplemental security income payments under title XVI of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>);</text></clause><clause id="H121BCB4D0E0748D1B5539AD190511B81"><enum>(iii)</enum><text>supplemental nutrition assistance program benefits under the <act-name parsable-cite="FSA77">Food and Nutrition Act of 2008 </act-name>(<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); or</text></clause><clause id="H4043964F4C6A4249828143947FEF0683"><enum>(iv)</enum><text display-inline="yes-display-inline">payments under—</text><subclause id="H281C585DABE64C83BA01D23529B202F3"><enum>(I)</enum><text display-inline="yes-display-inline">section 1315, 1521, 1541, or 1542 of title 38, United States Code; or</text></subclause><subclause id="HE8338066B6894F3193F65A406BEA11B3"><enum>(II)</enum><text display-inline="yes-display-inline">section 306 of the Veterans’ and Survivors’ Pension Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/38/1521">38 U.S.C. 1521</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/95/588">Public Law 95–588</external-xref>); or</text></subclause></clause></subparagraph><subparagraph id="HBA8047B18EED43A0892CFC804455E75D" commented="no"><enum>(B)</enum><text>that has an income that, as determined by the State in which the household is located, does not exceed the greater of—</text><clause id="HDDBDADB2CE6A40848F7E267EB8F052F6" commented="no"><enum>(i)</enum><text>an amount equal to 150 percent of the poverty level; and</text></clause><clause id="H5BCEA9726B1941D09497DEAA27AF670E" commented="no"><enum>(ii)</enum><text>an amount equal to 60 percent of the State median income for that State.</text></clause></subparagraph></paragraph><paragraph id="H60D382AC3F014FD1A8459AA6C78B7AB6" commented="no"><enum>(4)</enum><header>Poverty level</header><text display-inline="yes-display-inline">The term <term>poverty level</term> means, with respect to a household in a State, the income described in the poverty guidelines issued by the Secretary of Health and Human Services pursuant to section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>), as applicable to the household.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H248C0D36E637467FACE7DF37ECC199B5"><enum>(5)</enum><header display-inline="yes-display-inline">State median income</header><text display-inline="yes-display-inline">The term <term>State median income</term> has the meaning given that term in section 2603 of the <short-title>Low-Income Home Energy Assistance Act of 1981</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/42/8622">42 U.S.C. 8622</external-xref>).</text></paragraph></subsection><subsection id="HAEFCA8033AF64216B4F093874463CB88"><enum>(b)</enum><header>Study; report</header><paragraph id="H87A07F3CC1E046DC9B593E5553C7B34F"><enum>(1)</enum><header>In general</header><text>Not later than one year after the date of enactment of this Act, the Administrator shall conduct, and submit to Congress a report describing the results of, a study regarding the prevalence throughout the United States of low-income households that do not have access to—</text><subparagraph id="H36443CEF38CF49B69255F3CC87E35FF7"><enum>(A)</enum><text>affordable and functional centralized or onsite wastewater services that protect the health of individuals in the households;</text></subparagraph><subparagraph id="HBF8B4D9D6CE5409B9226FE2ECCD768BF"><enum>(B)</enum><text>affordable municipal stormwater services; or</text></subparagraph><subparagraph id="H842CB4D5079E4BBAB043A2164915E7F2"><enum>(C)</enum><text>affordable public drinking water services to meet household needs.</text></subparagraph></paragraph><paragraph id="H92A1C883F0F648E88A92D16CEFD824C7"><enum>(2)</enum><header>Inclusions</header><text>The report under paragraph (1) shall include—</text><subparagraph id="HD77B093600294C84B2113A987C87C504"><enum>(A)</enum><text>recommendations of the Administrator regarding the best methods to increase access to the services described in paragraph (1);</text></subparagraph><subparagraph id="H06DEE1595A0C44988CE099EDE7435DB8"><enum>(B)</enum><text>a description of the cost of each method described in subparagraph (A);</text></subparagraph><subparagraph id="H72E95661F4684EC4A0BD434FCEF2B840" commented="no"><enum>(C)</enum><text>a description of all consultation with relevant stakeholders carried out in developing the report;
