which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Safe Drinking Water Act to require drinking water distribution systems to be flushed under certain circumstances, and for other purposes.</official-title></form><legis-body id="HE7948B3660474872A79EEFF21A186152" style="OLC"><section id="H20E53398F1CE4316926BE40402FEB01A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Order Assurance, Safety, and Inspection of water Systems Act</short-title></quote> or the <quote><short-title>Emergency OASIS Act</short-title></quote>.</text></section><section id="H0222F7DA05F2414FA9DC9F6298A1E35E"><enum>2.</enum><header>Amendments to Safe Drinking Water Act</header><subsection id="HF2BE901031934EA79CFAD8CF9A3859DB"><enum>(a)</enum><header>Drinking water distribution system flushing</header><text display-inline="yes-display-inline">Section 1412(b) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300g-1">42 U.S.C. 300g–1(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC5A4797B93C446F3AC0DC4568CB666D9" display-inline="no-display-inline"><paragraph id="HBC59FA3C85134DC8B2E7F64491384315"><enum>(16)</enum><header>Drinking water distribution system flushing</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Emergency OASIS Act</short-title>, the Administrator shall promulgate a regulation to require each community water system to flush its distribution system if—</text><subparagraph id="H003ED5EC095D486BA4840842CE8C7338"><enum>(A)</enum><text>the concentration of any contaminant in the drinking water of the community water system has exceeded the applicable maximum contaminant level for longer than 6 months; or</text></subparagraph><subparagraph id="H746ED64E7DEE4393A8B96BC65A753DB2"><enum>(B)</enum><text>drinking water has stood motionless in the distribution system of the community water system for longer than 6 months.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H073D52036C754033BA2AA414F24F9780"><enum>(b)</enum><header>Emergency orders</header><text display-inline="yes-display-inline">Section 1431 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300i">42 U.S.C. 300i</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H8B4945AA3CF4471E97F1656242599F50" display-inline="no-display-inline"><subsection id="HAA41A32B12864CF09399FA690814BC3E"><enum>(c)</enum><text>The actions the Administrator may take under subparagraph (a) also include, with respect to a community water system that is the subject of an order issued under subsection (a)(1)—</text><paragraph id="HB10A21A85E524551922D84D8C85D0FC8"><enum>(1)</enum><text>carrying out testing for metalloid contaminants at not more than 25, but not less than 10 percent, of the service connections of such a community water system; and</text></paragraph><paragraph id="H11B5C3AD96A64BE298DE93A6CDA2022C"><enum>(2)</enum><text display-inline="yes-display-inline">providing alternative water supplies in accordance with subsection (d).</text></paragraph></subsection><subsection id="H04F61714733E4881A5C557E241DA213F"><enum>(d)</enum><text display-inline="yes-display-inline">If the Administrator determines that, after a period of 7 days beginning on the date on which an order is issued under subsection (a)(1), a community water system has not provided alternative water supplies as required by such order—</text><paragraph id="HA2FA8ABDE69E40B6A554FF58B184A5C3"><enum>(1)</enum><text>the Administrator may provide such alternative water supplies; and</text></paragraph><paragraph id="H2591F342BA1D422287BC6249CAD2ABC3"><enum>(2)</enum><text display-inline="yes-display-inline">if the Administrator provides such alternative water supplies under paragraph (1), the Administrator may require the owner of the community water system to pay an amount that is not less than twice the cost of providing such alternative water supplies.</text></paragraph></subsection><subsection id="H2D53DEC1E7E34759914383851FFF3A81"><enum>(e)</enum><text display-inline="yes-display-inline">Any community water system that is required to provide alternative water supplies under an order issued under subsection (a) may not increase any fees, rent, or other costs on customers in order to comply with such order.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
