Maloney of New York</cosponsor>, and <cosponsor name-id="W000825">Ms. Wexton</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To nullify the Executive Order 13957 entitled <quote>Executive Order on Creating Schedule F In The Excepted Service</quote>, and for other purposes.</official-title></form><legis-body id="H817D280F1BF8431289C2C22697E2919A" style="OLC"><section id="H8C58A2E543B541F59563EF07C8C7E488" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving the Civil Service Act</short-title></quote>. </text></section><section id="H7C2F3D1FCB64488EA7611C994AF7691C"><enum>2.</enum><header>Nullification of Executive Order 13957 relating to schedule F in the excepted service</header><subsection id="HC8148B178CB6455A99243FFD716B3253"><enum>(a)</enum><header>Rescission</header><paragraph id="HAA21234E45A54E9CA7BF154BB761682E"><enum>(1)</enum><header>In general</header><text>The provisions of the Executive Order 13957 (relating to Executive Order on Creating Schedule F In The Excepted Service), issued on October 21, 2020, are rescinded and shall have no force or effect.</text></paragraph><paragraph id="H9CB57DFF94C149079A15F6DF7DB66BC9"><enum>(2)</enum><header>Effective date</header><text>This subsection shall take effect as if enacted on October 21, 2020.</text></paragraph></subsection><subsection id="HC68C46F653744EB68A4DE7FD034C39EF"><enum>(b)</enum><header>Limitation on funds</header><text>No Federal funds may be used to implement, administer, or otherwise carry out the Executive Order described in subsection (a)(1), or any successor Executive Order or regulation.</text></subsection></section><section id="HAC531836CA3549E7AEF7CAFBA887189F"><enum>3.</enum><header>Limitations on conversions of positions and appointments</header><subsection id="HE69B42D1BCB74DFB98E903CB75E43213"><enum>(a)</enum><header>Prohibition</header><text>Notwithstanding any other law, rule, or regulation, and except as provided in subsection (b)—</text><paragraph id="H954B7C15656647C8A1DA42579FDD618B"><enum>(1)</enum><text>a position in the competitive service or the Senior Executive Service may not be converted to a position in the excepted service; and</text></paragraph><paragraph id="H50E24893C81D41458F9F0AA97C87D187"><enum>(2)</enum><text>an individual serving in an appointment in the competitive service or the Senior Executive Service may not be converted to an appointment in the excepted service.</text></paragraph></subsection><subsection id="H55178EAD7EFC4BB880B66B9D98C356B9"><enum>(b)</enum><header>Conversions and appointments reversed</header><text>Notwithstanding subsection (a)—</text><paragraph id="H4058637EB0B9458785048EB37E5C7DA2"><enum>(1)</enum><text display-inline="yes-display-inline">any position in the competitive service that was converted to a position in the excepted service under Executive Order 13957 during the period beginning on October 21, 2020, and ending on the date of enactment of this Act shall be converted to a position in the competitive service; </text></paragraph><paragraph id="H1FB724A436934B979114B23B5198010B"><enum>(2)</enum><text>any individual serving in an appointment in the competitive service who was converted to an appointment in the excepted service under such Executive Order during such period shall be converted to an appointment in the competitive service; </text></paragraph><paragraph id="H27EF21D90A734B84958070E2DF49437C"><enum>(3)</enum><text display-inline="yes-display-inline">any individual serving in an appointment in the excepted service who was transferred to schedule F from any of schedules A, B, C, D, or E in the excepted service during such period shall be transferred to such schedule A, B, C, D, or E (as the case may be); </text></paragraph><paragraph id="H0471D5D0FDED4EA3B20BDB59172B2BFE"><enum>(4)</enum><text display-inline="yes-display-inline">any individual noncompetitively appointed to any position under schedule F during such period shall be transferred to schedule C in the excepted service; and</text></paragraph><paragraph id="H040FFFCA1FC34FB7A7416C112B1BDADB"><enum>(5)</enum><text display-inline="yes-display-inline">any individual serving in the Senior Executive Service as a limited term appointee, limited emergency appointee, or noncareer appointee (as those terms are defined in paragraphs (5), (6), and (7), respectively, of section 3132(a) of title 5, United States Code) and who was converted to an appointment in the excepted service under such Executive Order during such period shall be converted to such appointee position in the Senior Executive Service.</text></paragraph></subsection><subsection id="HFC2D09751037494581D8791A02BE3DE0"><enum>(c)</enum><header>Political appointees noncompetitively appointed or transferred to schedule F positions</header><text display-inline="yes-display-inline">Any individual described in subsection (b)(3), (b)(4), or (b)(5)—</text><paragraph id="H0F7D3635A720428AA13F749C9DE37857"><enum>(1)</enum><text>may not be converted to a position or appointment in the competitive service;</text></paragraph><paragraph id="H90D0F650DF0C4382B0CC9F33620DE583"><enum>(2)</enum><text>may not acquire competitive status under any conversion carried out under this section; and</text></paragraph><paragraph id="HE4E655A48ED64DFF86E1DD6266C97E5D"><enum>(3)</enum><text display-inline="yes-display-inline">shall not be afforded any employment protections established under section 6 of the Executive Order 13957.</text></paragraph></subsection><subsection id="H6126F5003D0B4323A70682AA299BED3A"><enum>(d)</enum><header>Reinstatement</header><text display-inline="yes-display-inline">Any individual occupying a position that was converted from the competitive service to the excepted service under the Executive Order 13957, and any individual whose appointment was converted from the competitive service to the excepted service under such Executive Order, who was involuntarily removed from the civil service during the period beginning on October 21, 2020, and ending on the date of enactment of this Act shall be appointed by reinstatement with backpay in accordance with section 5596 of title 5, United States Code.</text></subsection><subsection id="H717DEC85C478437B898F581CFBB46BFB"><enum>(e)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H3D14424E367C453391B6D3B60C11533F"><enum>(1)</enum><text>the terms <term>civil service</term>, <term>competitive service</term>, and <term>excepted service</term> have the meaning given those terms in sections 2101(1), 2102, and 2103, respectively, of title 5, United States Code; and</text></paragraph><paragraph id="H7AB698E67A6E4D30BDDBE17AEB5F90FB"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>schedule F</term> means schedule F in the excepted service established under Executive Order 13957.</text></paragraph></subsection></section></legis-body></bill>
