R. 3269</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210517">May 17, 2021</action-date><action-desc><sponsor name-id="B001260">Mr. Buchanan</sponsor> (for himself and <cosponsor name-id="P000614">Mr. Pappas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Controlled Substances Act to list fentanyl-related substances as schedule I controlled substances, and for other purposes.</official-title></form><legis-body id="HEFBCB40D65A3477585D4C986CFA9245E" style="OLC"><section section-type="section-one" id="H4FE56857494F44F7A2F4A7D759F49AFD"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Initiative to Guarantee Health by Targeting Fentanyl Act</short-title></quote>.</text></section><section id="H5A21087410FA4031A7621E65E491A52B"><enum>2.</enum><header>Fentanyl-related substances</header><subsection id="H1592A768993C45D5BDAFE1B182B328C5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Schedule I of section 202(c) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H61F51E1AAEA7474DA972A4F388B96F41"><subsection id="H0A3C7FEB8C8A4384A4B4F46B5EFC7CB0"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H166419C0641B479BA6B9B9E532B77319"><enum>(1)</enum><text>Unless specifically exempted or unless listed in another schedule, any material, compound, mixture, or preparation which contains any quantity of fentanyl-related substances, or which contains their salts, isomers, and salts of isomers whenever the existence of such salts, isomers, and salts of isomers is possible within the specific chemical designation.</text></paragraph><paragraph id="H4D3EF25531324503816F258CEED599C4" indent="up1"><enum>(2)</enum><text>In paragraph (1), the term <term>fentanyl-related substances</term> includes any substance that is structurally related to fentanyl by 1 or more of the following modifications:</text><subparagraph id="H2BCAFBF0D70E4C95836072CFEE58A3E6"><enum>(A)</enum><text>By replacement of the phenyl portion of the phenethyl group by any monocycle, whether or not further substituted in or on the monocycle.</text></subparagraph><subparagraph id="H0AAA6399762548F9A98DF6F9491F2F5E"><enum>(B)</enum><text>By substitution in or on the phenethyl group with alkyl, alkenyl, alkoxyl, hydroxyl, halo, haloalkyl, amino, or nitro groups.</text></subparagraph><subparagraph id="HEED3AD1CD2BA48B6BB75678A0F061B8C"><enum>(C)</enum><text>By substitution in or on the piperidine ring with alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo, haloalkyl, amino, or nitro groups.</text></subparagraph><subparagraph id="H825C605C06054AB08837EE53735FE835"><enum>(D)</enum><text>By replacement of the aniline ring with any aromatic monocycle whether or not further substituted in or on the aromatic monocycle.</text></subparagraph><subparagraph id="H1C32BCA2E9044EC4A22E7E0AED7D01E2"><enum>(E)</enum><text>By replacement of the N-propionyl group by another acyl group.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF360F025C43D4E5CA23F26426C23E037"><enum>(b)</enum><header>No minimum sentence</header><text>Section 401(b)(1)(C) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(C)</external-xref>) is amended by adding at the end the following: <quote>Any minimum term of imprisonment required to be imposed under this subparagraph shall not apply with respect to a controlled substance described in subsection (e)(1) of schedule I.</quote>.</text></subsection></section></legis-body></bill>
