<section id="H09044687BE44455EB50F2E7095706E56" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Body-worn Camera Act of 2021</short-title></quote> or the <quote><short-title>ABC Act of 2021</short-title></quote>. </text></section> <section id="HDA5EA064953041DC88E00DBA0BC7C310"><enum>2.</enum><header>Body-Worn Camera Partnership Grant Program</header><text display-inline="no-display-inline"> Subpart 1 of part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10151">34 U.S.C. 10151 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HF441DF594DA04973B4B7E2422FE6873B"><enum>509.</enum><header>Body-Worn Camera Partnership Grant Program</header>
<subsection id="H4EE27E4566354E388D08D9BC78357377"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section— </text> <paragraph id="HC79CA8012F0641AC9CE5EBBF6172BCAC"><enum>(1)</enum><text>the term <term>covered government</term> means a State or unit of local government; and </text></paragraph>
<paragraph id="H675F34F75DE347B698B91281F9FECC1D"><enum>(2)</enum><text>the term <term>Director</term> means the Director of the Bureau of Justice Assistance. </text></paragraph></subsection> <subsection id="HED30644683B74C3988DAC96210A109A7"><enum>(b)</enum><header>Authorization of grants</header><text display-inline="yes-display-inline">The Director may make grants to eligible covered governments for use by the covered government for—</text>
<paragraph id="HE0B0A1ADEEDF48A9845C35D1F2C586E2"><enum>(1)</enum><text>the purchase of body-worn cameras or other audio-video technology that is utilized to record interactions between law enforcement and the public;</text></paragraph> <paragraph id="HC3D06E00064347019AE578E2EAFF8763"><enum>(2)</enum><text>necessary initial supportive technological infrastructure for body-worn cameras or other technologies for law enforcement officers in the jurisdiction of the grantee;</text></paragraph>
<paragraph id="HEA4E40757C214A9EA6D68D43D29C4AB3"><enum>(3)</enum><text>the development of policies and procedures relating to the use of body-worn cameras or other technologies;</text></paragraph> <paragraph id="H7D1273EC32434D7D88CA01231AEF86DD"><enum>(4)</enum><text>training on the use of body-worn cameras or other technologies; and </text></paragraph>
<paragraph id="H765EBE7900D9473888C0003538F707BC"><enum>(5)</enum><text>the storage, retention, viewing, auditing, and release of footage from body-worn cameras or other technologies. </text></paragraph></subsection> <subsection id="H82CFD2A4F5DE41A2B58CE884A11AAC79"><enum>(c)</enum><header>Eligibility</header> <paragraph id="H7C15D9614BB346ACB14EF62BB9FFBDC4"><enum>(1)</enum><header>Application</header><text>For a covered government to be eligible to receive a grant under this section, the chief executive officer of the covered government shall submit to the Director an application in such form and containing such information as the Director may require.</text></paragraph>
<paragraph id="H5AA83EF66A0E48BCAD8E9CE9E404336E"><enum>(2)</enum><header>Policies and procedures assurances</header><text>The application under paragraph (1) shall, as required by the Director, provide assurances that the covered government will establish policies and procedures in accordance with subsection (d).</text></paragraph></subsection> <subsection id="HD16691D837A5401FA2126EAEB94640E8"><enum>(d)</enum><header>Required policies and procedures</header> <paragraph id="HB33064EE569646EFACBD0AF9C3A0C6D9"><enum>(1)</enum><header>In general</header><text>A covered government receiving a grant under this section shall develop policies and procedures related to the use of body-worn cameras or other technologies that—</text>
<subparagraph id="HFA26E103ABF64796BE930D09729BDFD0"><enum>(A)</enum><text display-inline="yes-display-inline">are developed with input from law enforcement officers who are not supervisors, or the representatives of such officers; </text></subparagraph> <subparagraph id="H230156103A0D40BAB629FB4D073F721A"><enum>(B)</enum><text>are developed with community input, including from prosecutors and organizations representing crime victims, in accordance with recognized best practices;</text></subparagraph>
<subparagraph id="H33E2E1247BDE46D2998AC5E8EC15D494"><enum>(C)</enum><text display-inline="yes-display-inline">require that a body-worn camera or other technologies be activated when a law enforcement officer arrests or detains any person in the course of the official duties of the officer, with consideration to sensitive cases;</text></subparagraph> <subparagraph id="HBD376FE2F7C04FD9839C8EEC695E5AB3"><enum>(D)</enum><text display-inline="yes-display-inline">apply discipline to any law enforcement officer who intentionally fails to ensure that a body-worn camera or other technology is engaged, functional, and properly secured at all times during which the camera is required to be worn;</text></subparagraph>
<subparagraph id="HDAD290B08C224E3A980818B80B1666E2"><enum>(E)</enum><text>require training for—</text> <clause id="H86263274AE9D469498C65367587CF537"><enum>(i)</enum><text display-inline="yes-display-inline">the proper use of body-worn cameras or other technologies; and</text></clause>
<clause id="HEB5DA3CB23D74E009A7BE252FC6F2DF2"><enum>(ii)</enum><text>the handling and use of the obtained video and audio recordings;</text></clause></subparagraph> <subparagraph id="HAD565267B59549A5A095B37B71E9456E"><enum>(F)</enum><text>provide clear standards for privacy, data retention, and use for evidentiary purposes in a criminal proceeding, including in the case of an assault on a law enforcement officer; and </text></subparagraph>
<subparagraph id="HCCF633B991354B6CAB634290485B971E"><enum>(G)</enum><text>make footage available to the public in response to a valid request under an applicable freedom of information law if the footage can be made available—</text> <clause id="HCF504F18DA14461ABEE849B628A2903F"><enum>(i)</enum><text>without compromising an ongoing investigation or revealing the identity of third parties, including victims, informants, or witnesses; and</text></clause>
<clause id="H240262B152374C52A6E4703DDE9B59DB"><enum>(ii)</enum><text>with consideration given to the rights of victims and surviving family members.</text></clause></subparagraph></paragraph> <paragraph id="HC6A8B25CBFC94854BE077D0986E3A657"><enum>(2)</enum><header>Publication</header><text display-inline="yes-display-inline">A covered government receiving a grant under this section shall make all policies and procedures regarding body-worn cameras or other technologies available on a public website.</text></paragraph>
<paragraph id="H79A431CDE86A4FB1B69BE4012E60C79E"><enum>(3)</enum><header>Guidance</header><text>The Director shall issue guidance to covered governments related to the requirements under paragraph (1).</text></paragraph></subsection> <subsection id="H3D9D6A7A6ECD4DECA708E8B60B05A6AD"><enum>(e)</enum><header>Grant amounts</header> <paragraph id="H6C9EB4732BBC454F8FAAF1CDD926B163"><enum>(1)</enum><header>Minimum amount</header> <subparagraph id="H5DFD66DA7EAA442585607C0DEF059592"><enum>(A)</enum><header>In general</header><text>Each fiscal year, unless the Director has awarded a fully funded grant for each eligible application submitted by a State and any units of local government within the State under this section for the fiscal year, the Director shall allocate to the State and units of local government within the State for grants under this section an aggregate amount that is not less than 0.5 percent of the total amount appropriated for the fiscal year for grants under this section.</text></subparagraph>
<subparagraph id="H9CFD1EE12AB14671A31D19693BB3AD0A"><enum>(B)</enum><header>Certain territories</header><text>For purposes of the Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands, subparagraph (A) shall be applied by substituting <quote>0.25 percent</quote> for <quote>0.5 percent</quote>.</text></subparagraph></paragraph> <paragraph id="H68B53EB17C66450AB5F95A696570798A" commented="no"><enum>(2)</enum><header>Aggregate amount per State</header><text display-inline="yes-display-inline">A State and each covered government within the State may not receive grants under this section for a fiscal year in an aggregate amount that is more than 10 percent of the total amount appropriated for grants under this section for the fiscal year.</text></paragraph>
<paragraph id="HDF4097E825324F769F04542AEF9BDADC" commented="no"><enum>(3)</enum><header>Allocation</header>
<subparagraph id="H88DCE89F23D74CEAA89EE000DC1221A3"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), of funds available in any fiscal year—</text> <clause id="HC2E7C93F94CB4788BFE89CBE7C705E59" commented="no"><enum>(i)</enum><text>not more than 40 percent shall be allocated for grants pursuant to applications submitted by a covered government having jurisdiction over areas with populations exceeding 150,000;</text></clause>
<clause id="HBFF63AABF6A64FA0B499821D90858A41" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">not more than 30 percent shall be allocated for grants pursuant to applications submitted by a covered government having jurisdiction over areas with populations of 150,000 or less, but exceeding 50,000; and</text></clause> <clause id="H46A8DB3D907249B683ABC71429B212CE" commented="no"><enum>(iii)</enum><text>not more than 30 percent shall be allocated for grants pursuant to applications submitted by a covered government having jurisdiction over areas with populations of 50,000 or less.</text></clause></subparagraph>
<subparagraph id="HF8C36C733E3847438F85034B9CEE0B91"><enum>(B)</enum><header>Exception</header><text>In the case that all eligible grant applications have been funded for a fiscal in an allocation category under clauses (i) through (iii) of subparagraph (A) and there are funds remaining under that allocation category, the Director may make such funds available to applicants described in the remaining allocation categories. </text></subparagraph></paragraph></subsection> <subsection id="HAF6BF054C4BA417F909708743EDE7A49"><enum>(f)</enum><header>Matching funds</header><text>The portion of the costs of a body-worn camera program provided by a grant under this section may not exceed 75 percent. </text></subsection>
<subsection id="HF0CA7850959B43308FB237EAB4AA563F"><enum>(g)</enum><header>Supplement, not supplant</header><text>Funds made available under this section shall not be used to supplant covered government funds, but shall be used to increase the amount of funds that would, in the absence of Federal funds, be made available from covered government sources for the purposes of this section.</text></subsection> <subsection id="H95F31DBF130C448AAC9E7B14D5B94C76"><enum>(h)</enum><header>Reports to the Director</header><text>A covered government that receives a grant under this section shall submit to the Director, for each year in which funds from a grant received under this section are expended, a report at such time and in such manner as the Director may reasonably require, that contains—</text>
<paragraph id="HF92348B56B7D461FA6223153578274DD"><enum>(1)</enum><text>a summary of the activities carried out under the grant and an assessment of whether the activities are meeting the needs identified in the grant application; and</text></paragraph> <paragraph id="H04A01CCFB92F450696C31B07A49D6A2E"><enum>(2)</enum><text>such other information as the Director may require.</text></paragraph></subsection>
<subsection id="HFB392BC645E2415BA89DE393F9D4DA4A"><enum>(i)</enum><header>Reports to Congress</header><text>Not later than 90 days after the end of a fiscal year for which grants are made under this section, the Director shall submit to Congress a report that includes—</text> <paragraph id="HD6AAAA20517C4D51A36DCE4AE466A46E"><enum>(1)</enum><text>the aggregate amount of grants made under this section to each covered government for the fiscal year;</text></paragraph>
<paragraph id="HDDC9D9EF084A40FD92DBEC008159E3FE"><enum>(2)</enum><text>a summary of the information provided by covered governments receiving grants under this section; and</text></paragraph> <paragraph id="HC759D8511A81443DB3BA147F83EE8208"><enum>(3)</enum><text>a description of the priorities and plan for awarding grants among eligible covered governments, and how the plan will ensure the effective use of body-worn cameras to protect public safety.</text></paragraph></subsection>
<subsection id="HBD7A777B2CD14305A7D5CCF5339E7D4A"><enum>(j)</enum><header>Direct appropriations</header><text display-inline="yes-display-inline">For the purpose of making grants under this section there is authorized to be appropriated, and there is appropriated, out of amounts in the Treasury not otherwise appropriated, to remain available until expended—</text> <paragraph id="H961DB1891E5D4EB482246D47EE2DD0B7"><enum>(1)</enum><text display-inline="yes-display-inline">$40,000,000 for fiscal year 2022;</text></paragraph>
<paragraph id="H2E3F89B6C0774A5FBE7F1599EB301F6A"><enum>(2)</enum><text>$45,0000,000 for fiscal year 2023;</text></paragraph> <paragraph id="H3E4FFC624FA24417A2B19522E72CD3F4"><enum>(3)</enum><text>$50,000,000 for fiscal year 2024;</text></paragraph>
<paragraph id="HE379D458B9B246F7BE68191B1EE53800"><enum>(4)</enum><text>$55,000,000 for fiscal year 2025; and</text></paragraph> <paragraph id="HD3ABAD14A2AE4969A17AD0FA7A53EEA7"><enum>(5)</enum><text>$60,000,000 for fiscal year 2026. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
