R. 3246</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210514">May 14, 2021</action-date><action-desc><sponsor name-id="G000586">Mr. García of Illinois</sponsor> (for himself, <cosponsor name-id="K000009">Ms. Kaptur</cosponsor>, <cosponsor name-id="L000551">Ms. Lee of California</cosponsor>, <cosponsor name-id="G000551">Mr. Grijalva</cosponsor>, <cosponsor name-id="P000607">Mr. Pocan</cosponsor>, <cosponsor name-id="T000193">Mr. Thompson of Mississippi</cosponsor>, <cosponsor name-id="B001224">Ms. Bush</cosponsor>, <cosponsor name-id="T000481">Ms. Tlaib</cosponsor>, <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="E000296">Mr. Evans</cosponsor>, <cosponsor name-id="C001072">Mr. Carson</cosponsor>, <cosponsor name-id="T000483">Mr. Trone</cosponsor>, and <cosponsor name-id="K000396">Mr. Kahele</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To award funds to States and local areas for subsidized employment programs for youth.</official-title></form><legis-body id="HADD618982376454E833145DFAC92238B" style="OLC"><section id="H3C7EA217268F4F7BA7D98B5088D07F61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Connecting Youth to Jobs Act</short-title></quote>.</text></section><section id="HFEB61A22134548C2B6058050AF9AF87E"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text><paragraph id="H9336F8D814D04E5CA9E37B58D0DCE102"><enum>(1)</enum><text>offer employment to all young people who seek it, especially those who have been historically disadvantaged;</text></paragraph><paragraph id="H5CD574A7256B4F45AFD3010BBDAD8394"><enum>(2)</enum><text>create subsidized employment opportunities for young people to address National, State, and local priorities, such as infrastructure enhancement, manufacturing, public works, community development, and the arts; and</text></paragraph><paragraph id="HAAF49DA1B814408493CE3DF6A9EB2520"><enum>(3)</enum><text>support young people with services, including housing, healthcare, transportation, child care, and access to technology.</text></paragraph></section><section id="H5BD1514372C444368784A59DD07FDE07"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HFB81F0617434489989F48E77A35DAFB0" commented="no"><enum>(1)</enum><header>Qualifying emergency</header><text display-inline="yes-display-inline">The term <term>qualifying emergency</term> means—</text><subparagraph id="H904312CFBA4A40D6A29A182F1855AF80" commented="no"><enum>(A)</enum><text>a public health emergency declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>);</text></subparagraph><subparagraph id="H4C31A26E51B14F44814F82C15F423D7A" commented="no"><enum>(B)</enum><text>an event for which the President declared a major disaster or an emergency under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170 and 5191); or</text></subparagraph><subparagraph id="HFADDA47E9FDF418DAB5B7CB0EF8893A5" commented="no"><enum>(C)</enum><text>a national emergency declared by the President under section 201 of the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="H3C07CBBCA9614B7D9245895C18E024B8"><enum>(2)</enum><header>Eligible youth</header><text display-inline="yes-display-inline">The term <term>eligible youth</term> means an individual who is not younger than age 14 and not older than age 24, without regard to immigration status or past or current involvement with the juvenile or criminal justice system. </text></paragraph><paragraph id="H93F9D81ED85D485F95B5660F503714BA"><enum>(3)</enum><header>ESEA terms</header><text>The terms <term>local educational agency</term> and <term>State educational agency</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph><paragraph id="HD1CBA141883C45C6B5EA78AA142A1426"><enum>(4)</enum><header>High-poverty area</header><text display-inline="yes-display-inline">The term <term>high-poverty area</term> means a census tract with a youth poverty rate of at least 20 percent during the most recent 5 consecutive years.</text></paragraph><paragraph id="H0546DF86E61848F8927CE0F20BE7A5FA"><enum>(5)</enum><header>Historically high youth unemployment levels</header><text display-inline="yes-display-inline">The term <term>historically high youth unemployment levels</term> means any local area with a youth unemployment rate of at least 10 percent, as measured over the most recent decennial censuses, or by the Bureau of Labor Statistics for the most recent 5-year period for which data are available.</text></paragraph><paragraph id="H88CF0340903F4C238738796E007BDEBA"><enum>(6)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="HAA573474DD8A40F7A0B3CF2D988DA59B"><enum>(7)</enum><header>Public education entity</header><text display-inline="yes-display-inline">The term <term>public education entities</term> includes—</text><subparagraph id="H5F191F5DDC99443E9F618A02449FB74D"><enum>(A)</enum><text>a local educational agency;</text></subparagraph><subparagraph id="HBD4EB943AEF6408999D5FC62EE968AF5"><enum>(B)</enum><text>a State educational agency; or</text></subparagraph><subparagraph id="H36627E19CEE7434887F565C8CC2F602E"><enum>(C)</enum><text>a public institution of higher education.</text></subparagraph></paragraph><paragraph id="HB4A1FA1E04AD4FCCBF796CBAC81BC9AC"><enum>(8)</enum><header>Registered apprenticeship program</header><text>The term <term>registered apprenticeship programs</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the ‘‘National Apprenticeship Act’’; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>), including any requirement, standard, or rule promulgated under such Act, as such requirement, standard, or rule was in effect on December 30, 2019 (or successor requirements, standards or rule).</text></paragraph><paragraph id="HD9238E463DE7438DB8D4426772AC35BA"><enum>(9)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="HAD6C43E7FF1C4B549B9B236E3F61AAF4"><enum>(10)</enum><header>Supportive services</header><text>The term <term>supportive services</term> means services such as transportation, child care, dependent care, housing, and needs-related payments, that are necessary to enable an individual to participate in activities authorized under this Act.</text></paragraph><paragraph id="H3B49CFDC7A2142AC95C5A67EC6248455" commented="no"><enum>(11)</enum><header>Work-based learning</header><text display-inline="yes-display-inline">The term <term>work-based learning</term> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>), except that such term includes work-based learning in virtual settings.</text></paragraph><paragraph id="HB95BA7A8BD464AD6BFF2C4316B0C69F0" commented="no"><enum>(12)</enum><header>WIOA terms</header><text>The terms <term>in-demand industry sector or occupation</term>, <term>individual with a disability</term>, <term>in-school youth</term> , <term>local area</term>, <term>local board</term>, <term>out-of-school youth</term>, <term>outlying area</term>, <term>poverty line</term>, <term>recognized postsecondary credential</term>, <term>State</term>, <term>State board</term>, and <term>unit of general local government</term> have the meanings given the terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>). </text></paragraph><paragraph id="H392C2E6DEBAA419E974F7A192CBDDAAA" commented="no"><enum>(13)</enum><header>Youth with a barrier to employment</header><text display-inline="yes-display-inline">The term <term>youth with a barrier to employment</term> means an eligible youth who—</text><subparagraph id="H970651E749B04AE386EA6843B26087C2" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">is a homeless child or youth (as such term is defined in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>));</text></subparagraph><subparagraph id="H98F960F06D64476DB7DBC27E40CCC493" commented="no"><enum>(B)</enum><text>has been incarcerated or has past or current involvement with the criminal or juvenile justice systems;</text></subparagraph><subparagraph id="H59814363EE594F9782C9043897EC6CB9" commented="no"><enum>(C)</enum><text>is a current or former foster youth;</text></subparagraph><subparagraph id="HCA38F2D5F3DF4CECB091BBF950C2F766" commented="no"><enum>(D)</enum><text>is an individual with a disability;</text></subparagraph><subparagraph id="HB352C8DC958740158AE3DE49E2DC1045" commented="no"><enum>(E)</enum><text>is pregnant or parenting;</text></subparagraph><subparagraph id="H1674D0814C304CB0B43A14253E28AF23" commented="no"><enum>(F)</enum><text>is a school dropout (as defined by State law);</text></subparagraph><subparagraph id="H371D99A0F3094FB59D387E5A36A4F496" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">is from a family with an income level at or below 200 percent of the poverty line; or</text></subparagraph><subparagraph id="H3C9403CBACFF4DA08ED3468E9B423D17" commented="no"><enum>(H)</enum><text>is a member of another young-adult population, including racial groups, that is experiencing disparate levels of youth disconnection, as defined by the local workforce development board of the local area in which the youth resides.</text></subparagraph></paragraph></section><title id="H27C7935B181F4E47AE180691F50D105F"><enum>I</enum><header>Youth public employment program</header><section id="H386B5D1A4A3E4AD18D0DDC5AFBC03223"><enum>101.</enum><header>Formula grants to States and local areas</header><subsection id="H8849DD83A3D54BDFB4BCDE12A32C3EE7"><enum>(a)</enum><header>Funding allotments and allocations</header><paragraph id="HA143A9FB44554723B93227AE95F581CD"><enum>(1)</enum><header>State allotments</header><text>To assist States and outlying areas, and to enable States and outlying areas to assist local areas, in carrying out subsidized employment programs described in subsection (b) for youth with a barrier to employment, from the funds appropriated under section 105(a), the Secretary of Labor shall—</text><subparagraph id="H4EFDF2AC80E04A4D93CE74069F25F4AB"><enum>(A)</enum><text display-inline="yes-display-inline">make an allotment in accordance with section 127(b)(1)(C)(ii) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3162">29 U.S.C. 3162(b)(1)(C)(ii)</external-xref>) to each State that meets the requirements of section 102 or 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3112">29 U.S.C. 3112</external-xref>, 3113); and</text></subparagraph><subparagraph id="H0CFFE388DD6543038D189AFAE3C7BA60"><enum>(B)</enum><text>award a grant to each outlying area that complies with the requirements of title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3101">29 U.S.C. 3101 et seq.</external-xref>) to carry out subsidized youth employment programs for such youth. </text></subparagraph></paragraph><paragraph id="H307822C34BC8464F85F1DF6A0175ED46"><enum>(2)</enum><header>Within State allocation</header><subparagraph id="HE2D3E1ED7A064896A21498D2EC289BD6"><enum>(A)</enum><header>Statewide activities</header><text display-inline="yes-display-inline">Each State shall reserve 25 percent of the allotment received under paragraph (1)(A) to carry out statewide subsidized employment programs described in subsection (b).</text></subparagraph><subparagraph id="HA212C1A7C0A744679D2E28007DF8C48A"><enum>(B)</enum><header>Allocations to local areas</header><text>A Governor of a State that receives an allotment under paragraph (1), in coordination with relevant State and local stakeholders, shall use any remaining amounts (after reserving funds under subparagraph (A)), to allocate funds to local areas, as long as not less than 65 percent of such remaining amount is allocated to—</text><clause id="HCF1E4F33C2FF4839A91C977DF429B4FD"><enum>(i)</enum><text>high-poverty local areas with the highest youth unemployment rate compared to other local areas in the State; and</text></clause><clause id="H8F2C8CB9B3764A2AA5A23EED1B52E96E"><enum>(ii)</enum><text>local areas with historically high levels of youth unemployment within the State.</text></clause></subparagraph></paragraph></subsection><subsection id="H6E8172264A4646C685FEF44C0AC217A7"><enum>(b)</enum><header>Uses of funds</header><paragraph id="HA3912565B1654CAFBF5E1688CD8902E9"><enum>(1)</enum><header>Subsidized employment programs</header><subparagraph id="H54C1EBE30D954DCC8CC3DC51079A63CF"><enum>(A)</enum><header>In general</header><text>Funds allotted to States for statewide programs, and funds allocated to local areas under subsection (a), shall be used to carry out subsidized employment programs described in paragraph (3) that—</text><clause id="H54EDB51E91F24797A80A4B1C20184271"><enum>(i)</enum><text>lead to unsubsidized, full-time employment for youth with a barrier to employment in such State or local area; or</text></clause><clause id="HA4B226187DF4479B81CA5C71B72D383B"><enum>(ii)</enum><text>provide the necessary skills and competency attainment of at least 1 recognized postsecondary credential to further the education or career of such youth.</text></clause></subparagraph></paragraph><paragraph id="H609F288A48174476852794ED43FBF389"><enum>(2)</enum><header>Funding distribution</header><text>Of the funds allotted to States, or allocated to local areas, as described in paragraph (1) for a fiscal year:</text><subparagraph id="HAE4C3BFBEF8B4FC4B658A1D17E341F3E"><enum>(A)</enum><text>Not less than 60 percent shall be used for wages and employment benefits to individuals employed in subsidized employment programs funded under this section.</text></subparagraph><subparagraph id="H09D09024AC944A9FB53749722D513506"><enum>(B)</enum><text display-inline="yes-display-inline"> Not less than 30 percent for the first fiscal year for which such funds are so allotted or allocated, and not less than 20 percent for each fiscal year thereafter, shall be used to provide career services described in section 134(c)(2) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(c)(2)</external-xref>), training services, or youth workforce investment activities.</text></subparagraph><subparagraph id="H10A0FCD6F2214D1A972B5C39C93374D3"><enum>(C)</enum><text>Any remaining funds may be used for administrative and other allowable costs (such as supplies, materials, equipment, and health and safety resources) incurred by the State or local area, as determined by the Secretary.</text></subparagraph></paragraph><paragraph id="H3590A6566C474F569A4586390259A190"><enum>(3)</enum><header>Conditions</header><text display-inline="yes-display-inline">Except as otherwise determined by the Secretary, the following conditions shall apply to each subsidized employment program funded under this section:</text><subparagraph id="HDFA52D3966444CE9B6495378DBB98108"><enum>(A)</enum><text>Each youth with a barrier to employment residing in the State or local area funding such program shall be entitled to an opportunity to be employed by such program, and no other individual shall be provided such opportunity.</text></subparagraph><subparagraph id="H42A6360BFEAC4FE8B8D44ED3E720846C"><enum>(B)</enum><text display-inline="yes-display-inline">Each individual employed under such program shall be paid a wage, which shall at least be the highest of the following: </text><clause id="H758BA47DC6C045E99C99632A58EE1C7A"><enum>(i)</enum><text>$15 an hour. </text></clause><clause id="HF9C38EA7727E4EF1A2181FC7BF60FE19"><enum>(ii)</enum><text>The minimum wage under the applicable State or local minimum wage law. </text></clause><clause id="H3899E0D015EB4DFCA4E6B185878F4C0B"><enum>(iii)</enum><text>The prevailing rates of pay for individuals employed in similar occupations by the same employer.</text></clause><clause id="HA26DA7AC2B3A42C0B442155F4A889914"><enum>(iv)</enum><text>The Federal minimum wage in effect under section 6(a)(1) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)(1)</external-xref>).</text></clause></subparagraph><subparagraph id="HB61773F934F643D39A26BA04EA8BA615" commented="no"><enum>(C)</enum><text>With respect to a wage determined under subparagraph (B), the Secretary may promulgate regulations to increase such wage after consideration of industry, geographical region, skill requirements, and individual proficiency.</text></subparagraph><subparagraph id="HFF7C1A16127E4E1F9D6ADCB6F95C171F"><enum>(D)</enum><text>An individual may self-attest to being a youth with a barrier to employment, and verification of such eligibility may occur after the individual is employed under the program.</text></subparagraph><subparagraph id="H5F6101487A114DA1A5AD0810C8897AF2"><enum>(E)</enum><text display-inline="yes-display-inline">Earnings from such program shall not be regarded as income and shall not be regarded as a resource for the month of receipt and the following 12 months, for purposes of determining the eligibility of an individual (or the individual’s spouse or family) for benefits or assistance, or the amount or extent of benefits or assistance, under any Federal program or under any State or local program financed in whole or in part with Federal funds.</text></subparagraph><subparagraph id="HD2C576DFAC8847C79C068B163B669518"><enum>(F)</enum><text display-inline="yes-display-inline">Such program shall coordinate with the workforce systems and activities promoted by the State or local board to connect youth with a barrier to employment to educational or career opportunities.</text></subparagraph><subparagraph id="H4F1CBCEDBC9346C29E19ACD8E2D274AE"><enum>(G)</enum><text>Such program shall establish or expand diversity and inclusion opportunities and collect disaggregated data on related efforts.</text></subparagraph></paragraph></subsection></section><section id="HEA0F6B8F3FF84BEDBEEDF5966284720A"><enum>102.</enum><header>Competitive grants to eligible entities</header><subsection id="H796A6A35509244D2B18133CA4D03E288"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts appropriated under section 105(b), the Secretary shall award grants, on a competitive basis, to eligible entities for activities described in subsection (d).</text></subsection><subsection id="H0AE081E0EA0441A8B47B373E78B7215A"><enum>(b)</enum><header>Requirements on uses of funds</header><text display-inline="yes-display-inline">In awarding funds under this section the Secretary shall ensure the following:</text><paragraph id="HF2955085E8FB4DEE827B3EAC650EB853"><enum>(1)</enum><header>Direct financial assistance</header><text>Not less than 40 percent of such funds are used to provide direct financial assistance to eligible youth to support such youth with financial needs with respect to entering, remaining enrolled in, and completing a subsidized employment program described in section 101(b) (including related costs of training, supplies, food and nutrition, housing, transportation, child care, mental health and substance abuse services, payment of fines, or other targeted costs determined allowable by the Secretary).</text></paragraph><paragraph id="HC0ABAF91573B42B5A6671C84DE23FAB6"><enum>(2)</enum><header>In-demand industry sectors or occupations</header><text>Not less than 40 percent of such funds are used to connect eligible youth to employers for in-demand industry sectors or occupations, work-based learning opportunities, registered apprenticeship programs, or to reconnect to a public education entity.</text></paragraph><paragraph id="H4AB420EF164D4F4D8596A7F2B49F7382"><enum>(3)</enum><header>Diversity and inclusion activities</header><text> Not less than 10 percent of such funds are used for promoting, creating, or expanding diversity and inclusion activities for the purposes of diversifying workforce systems. </text></paragraph></subsection><subsection id="H8E4E5CDF2EB6432BBC1B8D09F867CDB0"><enum>(c)</enum><header>Eligible entity defined</header><paragraph id="H350DDF9B82BB4789A8B6B4445AF67198"><enum>(1)</enum><header>In general</header><text>The term <term>eligible entity</term> means an entity that the Secretary determines to serve a high number or high percentage of youth with a barrier to employment who are employed in a subsidized employment programs described in section 101(b).</text></paragraph><paragraph id="H1B434F125BC343838B3D04EECB40FCC1"><enum>(2)</enum><header>Inclusions</header><text>The term <term>eligible entity</term> includes—</text><subparagraph id="HE9E9E9E201B44B52A218760EC181FE34"><enum>(A)</enum><text>a community-based organization;</text></subparagraph><subparagraph id="HA6DBC10AD740448DB0CD6453EED7A854"><enum>(B)</enum><text display-inline="yes-display-inline">a State and unit of general local government in a partnership with a community-based organization;</text></subparagraph><subparagraph id="H69B624B212EC42B089E412D6B6593CD8"><enum>(C)</enum><text display-inline="yes-display-inline">a partnership among States and units of general local government, community-based organizations, public education entities, registered apprenticeships, and employers from in-demand industry sectors or occupations; </text></subparagraph><subparagraph id="H68EBF64B9EDD47FF85D23000AA17BF8F"><enum>(D)</enum><text display-inline="yes-display-inline">a partnership among community-based organizations and juvenile and adult correctional facilities; </text></subparagraph><subparagraph id="HBE1E7F24EDE0432B8961677DCB503B31"><enum>(E)</enum><text display-inline="yes-display-inline">a labor organization or joint labor-management organization; or</text></subparagraph><subparagraph id="HBC3BB4D290924CE1BC36A0E1A146CAB6"><enum>(F)</enum><text display-inline="yes-display-inline">a tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>)) or an urban Indian organization (as defined in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>))”.</text></subparagraph></paragraph></subsection><subsection id="H6726D0DA26D44B4E81D8DFB10F60C564"><enum>(d)</enum><header>Uses of funds</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section—</text><paragraph id="HAFD7B50C35F24327BCB226918ABAE442"><enum>(1)</enum><text>shall use the grant to match youth with a barrier to employment to subsidized employment programs funded under section 101, and provide hands-on work experience that does not supplant the work of existing employees; and</text></paragraph><paragraph id="HD0EF83B59AF84876B99AAA22AAD8E725"><enum>(2)</enum><text>may use a grant received under this section to carry out 1 or more of the following:</text><subparagraph id="H7BC244BA166C4754B6F3CBC1FF1E3194"><enum>(A)</enum><text>Establish or expand diversity and inclusion opportunities and collect disaggregated data on related efforts.</text></subparagraph><subparagraph id="HC1A0AE3845894BC59C26EBA0444F144A"><enum>(B)</enum><text>Provide (directly or through partnerships) technical assistance and supportive services to eligible youth and their families to help navigate supportive services and other Federal and State assistance programs to support the recruitment, retention, and completion of a program funded under section 101.</text></subparagraph><subparagraph id="HC4A36C954CA84153AF982350F6AF5772"><enum>(C)</enum><text>Coordinate partnerships with programs funded under section 101 to connect eligible youth to educational or career opportunities, including to employers for in-demand industry sectors or occupations, work-based learning opportunities, registered apprenticeship programs, or to reconnect to a public education entity.</text></subparagraph><subparagraph id="H3D2AECA7CE4C452390DA8B6DCE4A8E21"><enum>(D)</enum><text>Form comprehensive youth service delivery systems to improve education and employment outcomes for youth and to strategically connect local sectors, systems, and resources by strategically coordinating resources and public, private, and nonprofit funding to create youth pathways to further the education, skills, and access to jobs and successful careers, by—</text><clause id="HC5EAA5537A5E4E8891EFAB33192E6259"><enum>(i)</enum><text>conducting and improving outreach to underrepresented youth and families with respect to the programs funded under section 101; </text></clause><clause id="HEE8F6F1685744D57AC65B0D8A2E8FBA9"><enum>(ii)</enum><text>making appropriate use of existing education, child welfare, social services, and workforce development data collection systems to facilitate the entity’s ability to recruit youth participants; and</text></clause><clause id="H6136783AF1AF408BA8D280D9A124D0E4"><enum>(iii)</enum><text>developing wide-ranging higher education or employment pathways for youth.</text></clause></subparagraph><subparagraph id="HCDA35B0FA6EB45D089E7D50B75420A2F"><enum>(E)</enum><text>Assist in the transition between subsidized youth employment programs and unsubsidized employment or education.</text></subparagraph><subparagraph id="H0250482CAE81411285076C8408A34CCF"><enum>(F)</enum><text display-inline="yes-display-inline">In the case of an eligible entity described in subsection (d)(2)(D), assist in the transition from incarceration with the goal of reducing rates of recidivism and ensuring incarcerated youth and formerly incarcerated youth have access to employment and educational opportunities.</text></subparagraph></paragraph></subsection></section><section id="H9C418782684D4988BCCBDE0621167FC5" commented="no"><enum>103.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this title shall be construed to prohibit an individual receiving assistance under this title from being represented by a labor organization. </text></section><section id="HB86D681E5FA14571B97E8679DD462262"><enum>104.</enum><header>Performance evaluation, data collection, and accountability</header><subsection id="HCA0782C332F8450794E2B72083937FFD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the first grant is awarded under section 101, and annually thereafter, each program funded under section 101 shall be evaluated by the State board of the State receiving an allotment under section 101 to carry out such program or the local board of the local area receiving an allocation under section 101 to carry out such program.</text></subsection><subsection id="HB4A162F52A454D8AB1D9BE20F9C51E35"><enum>(b)</enum><header>Performance data collection</header><text display-inline="yes-display-inline">The Secretary of Labor shall collect data on—</text><paragraph id="H8AF5DB27BAC04C69A0DEA8F2B83B23E6"><enum>(1)</enum><text>the performance of each program using the disaggregated indicators of performance in section 116(b)(2)(A)(i) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(2)(A)(i)</external-xref>);</text></paragraph><paragraph id="H960A64ECBD444852A37F40EF2B118215"><enum>(2)</enum><text>the completion rates of the program;</text></paragraph><paragraph id="H381D846351ED4ACEA037945EA9B2549D"><enum>(3)</enum><text>the rate of full-time unsubsidized employment after program completion;</text></paragraph><paragraph id="H0E8D16FFD5F24797BE4A22BAE4242233"><enum>(4)</enum><text>the rate of reconnection to public education entities after program completion; and</text></paragraph><paragraph id="HB4C060981A9645EDBCCB70EC7686FB77"><enum>(5)</enum><text>the diversity and equal opportunity in such programs.</text></paragraph></subsection><subsection id="H1D1B69AC5AD744F198E6A254A4120F98"><enum>(c)</enum><header>Accountability metrics</header><text display-inline="yes-display-inline">The Secretary shall establish a youth work-readiness indicator.</text></subsection></section><section id="H44295418197B447BBD4893B02D28DDAC"><enum>105.</enum><header>Report to congress</header><text display-inline="no-display-inline">Not later than December 31, 2024, and annually thereafter, the Secretary of Labor shall submit a publicly available report to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate that includes—</text><paragraph id="HDE191A7A67B64D8B9614D42136A0A43F"><enum>(1)</enum><text>a review and assessment of all information related to the programs funded under this Act;</text></paragraph><paragraph id="H2435FD140FC144E4811F0A7D96A6F4E9"><enum>(2)</enum><text>any relevant guidance issued by the Secretary with respect to such programs; and</text></paragraph><paragraph id="H04E89AF687F04EA08725BC3955AF83DA"><enum>(3)</enum><text display-inline="yes-display-inline">an analysis of equity, diversity, and inclusion activities, best practices, and recommendations for improvement with respect to increasing the success of such programs and outcomes for youth, and participant demographics (while maintaining privacy protections), disaggregated by race, ethnicity, sex, age, and subpopulations described in subparagraphs (B) and (C) of section 129(a)(1) of the Workforce Innovation and Opportunity Act.</text></paragraph></section><section id="HEC6CBC2918E244968C83067B9F3CDC3B"><enum>106.</enum><header>Authorization of appropriations</header><subsection id="H3CFC63083ADE44878793A052F24D4B66"><enum>(a)</enum><header>Mandatory funds</header><text display-inline="yes-display-inline">There are authorized to be appropriated, and there are appropriated (in addition to any other amounts appropriated to carry out this section 101 and out of any money in the Treasury not otherwise appropriated), such sums as may be necessary to carry out section 101 for fiscal year 2022 and each of the succeeding 9 fiscal years.</text></subsection><subsection id="H957BD518491D49C1BFC001F75F6F4480"><enum>(b)</enum><header>Competitive grants</header><text>There are authorized to be appropriated $10,000,000,000 to carry out section 102 for fiscal year 2022 and each of the succeeding 9 fiscal years.</text></subsection></section></title><title id="H890A8CE6E1A34D83A638FDE543939CEE"><enum>II</enum><header>GAO Report</header><section id="HF5C74FC18C9940428874D9D13F5A8A6C"><enum>201.</enum><header>GAO report</header><subsection id="H98A2A36040DF4C53BB316A6E80605CAE"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the published report in section 105, and every 4 years thereafter, the Comptroller General of the United States shall conduct an independent evaluation of the activities funded under this Act and submit to Congress a report that shall be made publicly available.</text></subsection><subsection id="HA8E63EA5A3A447F4B57856A3667345CA"><enum>(b)</enum><header>Evaluation</header><text>In conducting the evaluation under subsection (a), the Comptroller General shall consider, as applicable and appropriate, information from the report under section 105.</text></subsection><subsection id="HAD9FA2706BD44CD593E76B5D9D2981BE"><enum>(c)</enum><header>Report</header><text>The report described in subsection (a) shall review, assess, and provide recommendations, as appropriate, on the following:</text><paragraph id="H66637EB277BE47D394FF30972C1EC65E"><enum>(1)</enum><text>Compliance with the requirements established under this Act.</text></paragraph><paragraph id="HB01E2F09595240C5940F83175BEE6278"><enum>(2)</enum><text>The effectiveness of the requirements established under this Act, associated challenges, and trends in the youth progress made toward the goals described in section 101(b)(1)(A).</text></paragraph><paragraph id="H1D00C7AB4EE541ACB3BFA056F9C6A9D3"><enum>(3)</enum><text>Federal guidance, best practices, and funding recommendations for related Federal youth employment activities and any innovative State and local actions that improve or further the education or career of youth participants, including employment opportunities that lead to long-term, unsubsidized employment.</text></paragraph></subsection></section></title><title id="H61F0369DC3AA490F9FE66596AC9EF4C0"><enum>III</enum><header>Youth Student Income Exclusion Under the Supplemental Nutrition Assistance Program </header><section id="H2CA6749E2D6548D89ACB38C2C0259F56"><enum>301.</enum><header>Youth student income excluded under the Food and Nutrition Act of 2008</header><text display-inline="no-display-inline">Section 5(d)(7) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014(d)(7)</external-xref>) is amended by inserting before the semicolon at the end the following:</text><quoted-block style="OLC" id="HA29DDAD7EFB84AD2A2FD4941CEC7385B" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">and income earned by a household member who is less than 22 years of age, who is an elementary or secondary school student, and who lives with a natural, adoptive, or stepparent</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></section></title></legis-body></bill>
