<heading style="-uslm-lc:I650174">United States Capitol Police Mutual Aid Reimbursements</heading>
<content style="-uslm-lc:I650120">  For an additional amount for “United States Capitol Police Mutual Aid Reimbursements”, $35,396,000, to remain available until September 30, 2026, for reimbursements for mutual aid and related training, including mutual aid and training provided under the agreements described in <ref href="/us/pl/108/458/s7302">section 7302 of Public Law 108–458</ref>: <proviso><i> Provided</i>, That of such amount, up to $9,096,000 is available to be used for reimbursement to the United States Capitol Police’s primary local law enforcement partners for mutual aid provided in response to the events of January 6, 2021: </proviso><proviso><i> Provided further</i>, That obligation of the funds made available under this heading in this Act be subject to notification to the Chairmen and Ranking Members of the Committees on Appropriations of both Houses of Congress, the Senate Committee on Rules and Administration, and the Committee on House Administration of the amount and purpose of the expense within 15 days of obligation: </proviso><proviso><i> Provided further</i>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</proviso></content></appropriations>

<level style="-uslm-lc:I650174"><heading style="-uslm-lc:I650174">Administrative Provisions</heading>
<section><heading style="-uslm-lc:I650174"><inline class="smallCaps">wellness program</inline></heading><num style="-uslm-lc:I650120 -uslm-lc:emspace2" value="301"><inline class="smallCaps">Sec. 301.</inline> </num><subsection class="inline"><num value="a">(a) </num><heading><inline class="smallCaps">Application of Law</inline>.—</heading><content>The wellness program of the United States Capitol Police shall be known and designated as the “Howard C. Liebengood Center for Wellness”.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><content>This section shall apply with respect to fiscal year 2021 and each succeeding fiscal year.</content></subsection></section>
<section><heading style="-uslm-lc:I650174"><inline class="smallCaps">capitol police salary cap adjustment</inline></heading><num style="-uslm-lc:I650120 -uslm-lc:emspace2" value="302"><inline class="smallCaps">Sec. 302. </inline> </num><content class="inline">For the purposes of administering pay during calendar year 2021, the maximum annual payable rate for any member or civilian employee of the Capitol Police whose compensation includes overtime pay under the Fair Labor Standards Act of 1938 (<ref href="/us/usc/t29/s201/etseq">29 U.S.C. 201 et seq.</ref>) shall be set at Executive Schedule II at $199,300. Excluded from this limitation for calendar year 2021 shall be retention bonuses and hazard bonuses related to the events of January 6th.</content></section>

<heading style="-uslm-lc:I650174">Capital Construction and Operations</heading>
<content style="-uslm-lc:I650120">  For an additional amount for “Capital Construction and Operations”, $21,869,069, to remain available until September 30, 2022, to prevent, prepare for, and respond to coronavirus, for necessary expenses of the Architect of the Capitol to supplement the funding made available in <ref href="/us/pl/116/136">Public Law 116–136</ref>, as amended by <ref href="/us/pl/116/159/s159/3">section 159(3) of Public Law 116–159</ref>, and for the same purposes; and for related purchases for Congressional offices, including in Congressional Districts and State Offices, wherever located: <proviso><i> Provided</i>, That any funds transferred by the Architect to restore amounts, either directly or through reimbursement, for obligations incurred for the purposes provided herein prior to the date of enactment of this Act shall be merged with and made available for the same purposes, and period of availability, as the appropriations to which the funds are transferred: </proviso><proviso><i> Provided further</i>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</proviso></content></appropriations>

<heading style="-uslm-lc:I650174">Capitol Police Buildings, Grounds and Security</heading>

<content style="-uslm-lc:I650120">  For an additional amount for “Capitol Police Buildings, Grounds and Security”, $300,000,000, to remain available until September 30, 2023, to respond to the events at the United States Capitol on January 6, 2021: <proviso><i> Provided</i>, That of such amount $283,000,000 shall be for necessary upgrade or replacement of windows and doors in the Capitol Building and the House of Representatives and Senate office buildings on the Capitol grounds, as well as any related work to harden or enhance physical security of such structures: </proviso><proviso><i> Provided further</i>, That of such amount, $17,000,000 shall be for the purchase and installation of cameras at the Senate and House of Representatives office buildings for the purposes of safety and security: </proviso><proviso><i> Provided further</i>, That amounts necessary for the purpose in the preceding proviso may be transferred between the Architect of the Capitol and the United States Capitol Police, as needed: </proviso><proviso><i> Provided further</i>, That such amount is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</proviso></content></appropriations>

<level style="-uslm-lc:I650174"><heading style="-uslm-lc:I650174">GENERAL PROVISIONS—THIS TITLE</heading>
<section style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="310"><inline class="smallCaps">Sec. 310. </inline> </num><content class="inline">None of the funds made available in this or any other Act in prior fiscal years, this fiscal year, or any fiscal year thereafter may be used to install permanent, above-ground fencing around the perimeter, or any portion thereof, of the United States Capitol Grounds, as described in <ref href="/us/usc/t40/s5102">section 5102 of title 40, United States Code</ref>.</content></section>
<section style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="311"><inline class="smallCaps">Sec. 311. </inline> </num><content class="inline">For fiscal years 2021 and 2022, subject to the approval of the Chairs and Ranking Members of Committee on Appropriations of the House of Representatives and the Senate, the Architect of the Capitol may accept contributions of, and may incur obligations and make expenditures out of available appropriations for, supplies, products, and services necessary to respond to an emergency involving the safety of human life or the protection of property, as determined or declared by the Capitol Police Board, which may be provided for the use of any office which is located within any building, grounds, or facility for which the Architect of the Capitol is responsible for the maintenance, care, and operation, on a reimbursable or non-reimbursable basis subject to the availability of funds.</content></section>

or</content></item><item class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650130"><num style="-uslm-lc:emspace2" value="bb">“(bb) </num><content>to perform activities for the United States military personnel stationed at International Security Assistance Force (or any successor name for such Force);”</content></item></subclause></clause></quotedContent>; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="4">(4) </num><content>in paragraph (13), in the matter preceding subparagraph (A), by <amendingAction type="delete">striking</amendingAction> “<quotedText>January 31, 2023</quotedText>” and <amendingAction type="insert">inserting</amendingAction> “<quotedText>January 31, 2024</quotedText>”.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Emergency Requirement</inline>.—</heading><content>The amount provided by this section is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Report to Congress</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Not later than 1 year after the date of the enactment of this Act, the Secretary of State, in consultation with the Secretary of Defense, shall submit to the appropriate congressional committees a report, including a classified annex, if necessary, on the Afghan special immigrant visa program as described in Section 602(b) of the Afghan Allies Protection Act of 2009 (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101 note</ref>) and Section 1059 of the National Defense Authorization Act of 2006 (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101 note</ref>).</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Elements</inline>.—</heading><chapeau>The report required by paragraph (1) shall include the following:</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>The total number of visas issued under such program, disaggregated by fiscal year.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>With respect to principal aliens issued special immigrant visas under such program, a description of the types of roles performed for which such aliens earned eligibility for such visas.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="C">(C) </num><content>Information regarding the average processing times for visa applicants under such program, disaggregated by the fiscal year in which visa applications under the program were submitted.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="D">(D) </num><content>The number of individuals who have pending applications for visas under such program, including—</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>The number of individuals approved of the total number of applications processed by the Chief of Mission; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><chapeau>The number of successful appeals of the total number of application appeals filed.</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="E">(E) </num><content>The estimated total number of individuals who have performed the requisite employment to apply for a visa under such program, but who have not yet applied for or received a visa, including a description of the methodology used to create such an estimate.</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Appropriate congressional committees defined</inline>.—</heading><chapeau>In this section, the term “<term>appropriate congressional committees</term>” means—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>the Committee on Appropriations, the Committee on Armed Services, the Committee on the Judiciary, the Committee on Foreign Relations, and the Committee on Homeland Security and Governmental Affairs of the Senate; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>the Committee on Appropriations, the Committee on Armed Services, the Committee on the Judiciary, the Committee on Foreign Affairs, and the Committee on Homeland Security of the House of Representatives.</content></subparagraph></paragraph></subsection></section>
<section><heading style="-uslm-lc:I650174"><inline class="smallCaps">waiver of medical examination for afghan allies</inline></heading><num style="-uslm-lc:I650120 -uslm-lc:emspace2" value="402"><inline class="smallCaps">Sec. 402.</inline> </num><subsection class="inline"><num value="a">(a) </num><heading><inline class="smallCaps">Authorization</inline>.—</heading><content>The Secretary of State and the Secretary of Homeland Security may jointly issue a blanket waiver of the requirement that aliens described in section 602(b)(2) of the Afghan Allies Protection Act of 2009 (<ref href="/us/usc/t8/s1101">8 U.S.C. 1101</ref>) undergo a medical exam under section 221(d) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1201/d">8 U.S.C. 1201(d)</ref>), or any other applicable provision of law, prior to issuance of an immigrant visa or admission to the United States.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Duration</inline>.—</heading><content>A waiver under subsection (a) shall be for a period of 1 year, and, subject to subsection (g), may be extended by the Secretary of State and Secretary of Homeland Security for additional periods, each of which shall not exceed 1 year.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Notification</inline>.—</heading><content>Upon exercising the waiver authority under subsection (a), or the authority to extend a waiver under subsection (b), the Secretary of State and the Secretary of Homeland Security shall notify the appropriate congressional committees.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Requirement for Medical Examination After Admission</inline>.—</heading><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>The Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall establish procedures to ensure, to the greatest extent practicable, that any alien who receives a waiver of the medical examination requirement under this section completes such an exam not later than 30 days after the date on which the alien is admitted to the United States.</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><heading><inline class="smallCaps">Conditional basis for status</inline>.—</heading><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><heading><inline class="smallCaps">In general</inline>.—</heading><content>Notwithstanding any other provision of law, an alien who receives a waiver of the medical examination requirement under this section shall be considered, at the time of admission to the United States, as an alien lawfully admitted for permanent residence on a conditional basis.</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><heading><inline class="smallCaps">Removal of conditions</inline>.—</heading><content>The Secretary of Homeland Security shall remove the conditional basis of the alien’s status upon the Secretary’s confirmation that such alien has completed the medical examination and is not inadmissible under section 212(a)(1)(A) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1182/a/1/A">8 U.S.C. 1182(a)(1)(A)</ref>).</content></subparagraph></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="3">(3) </num><heading><inline class="smallCaps">Report</inline>.—</heading><chapeau>Not later than 1 year after the date on which the waiver authority under subsection (a) is exercised, or such waiver is extended under subsection (b), as applicable, the Secretary of Homeland Security, in consultation with the Secretary of Health and Human Services, shall submit to the appropriate congressional committees a report on the status of medical examinations required under paragraph (1), including—</chapeau><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="A">(A) </num><content>the number of pending and completed examinations; and</content></subparagraph><subparagraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650124"><num style="-uslm-lc:emspace2" value="B">(B) </num><content>the number of aliens who have failed to complete the medical examination within the 30-day period after the date of such aliens’ admission.</content></subparagraph></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" role="definitions" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="e">(e) </num><heading><inline class="smallCaps">Appropriate Congressional Committees</inline>.—</heading><chapeau>The term “<term>appropriate committees of Congress</term>” means—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>the Committee on Armed Services, the Committee on the Judiciary, the Committee on Foreign Relations, and the Committee on Homeland Security and Governmental Affairs of the Senate; and</content></paragraph><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="2">(2) </num><content>the Committee on Armed Services, the Committee on the Judiciary, the Committee on Foreign Affairs, and the Committee on Homeland Security of the House of Representatives.</content></paragraph></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="f">(f) </num><heading><inline class="smallCaps">Rule of Construction</inline>.—</heading><content>Nothing in this Act may be construed to prevent the Secretary of State, the Secretary of Homeland Security, the Secretary of Defense, or the Secretary of Health and Human Services from adopting appropriate measures to prevent the spread of communicable diseases, including COVID–19, to the United States.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="g">(g) </num><heading><inline class="smallCaps">Sunset</inline>.—</heading><content>The authority under subsections (a) and (b) expires on the date that is 3 years after the date of enactment of this Act.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="h">(h) </num><heading><inline class="smallCaps">Emergency Requirement</inline>.—</heading><content>The amount provided by this section is designated by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.</content></subsection></section>
<section><heading style="-uslm-lc:I650174"><inline class="smallCaps">special immigrant status for certain surviving spouses and children</inline></heading><num style="-uslm-lc:I650120 -uslm-lc:emspace2" value="403"><inline class="smallCaps">Sec. 403.</inline> </num><subsection class="inline" role="instruction"><num value="a">(a) </num><heading><inline class="smallCaps">Immigration and Nationality Act</inline>.—</heading><chapeau>Section 101(a)(27)(D) of the Immigration and Nationality Act (<ref href="/us/usc/t8/s1101/a/27/D">8 U.S.C. 1101(a)(27)(D)</ref>) <amendingAction type="amend">is amended</amendingAction>—</chapeau><paragraph class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="1">(1) </num><content>by <amendingAction type="delete">striking</amendingAction> “<quotedText>an immigrant who is an employee</quotedText>” and <amendingAction type="insert">inserting</amendingAction> <quotedContent>“an immigrant who—<clause class="indentUp3 firstIndent1 fontsize10" style="-uslm-lc:I650126"><num style="-uslm-lc:emspace2" value="i">“(i) </num><content>is an employee”</content></clause></quotedContent>; <title id="d57096e1180" identifier="/us/bill/117/hr/3237/tVI" style="-uslm-lc:I650174"><num value="VI">TITLE VI</num><heading style="-uslm-lc:I650174">GENERAL PROVISIONS—THIS ACT</heading>
<section id="d57096e1186" identifier="/us/bill/117/hr/3237/tVI/s601" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="601"><inline class="smallCaps">Sec. 601. </inline> </num><content class="inline">Each amount appropriated or made available by this Act is in addition to amounts otherwise appropriated for the fiscal year involved.</content></section>
<section id="d57096e1195" identifier="/us/bill/117/hr/3237/tVI/s602" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="602"><inline class="smallCaps">Sec. 602. </inline> </num><content class="inline">No part of any appropriation contained in this Act shall remain available for obligation beyond the current fiscal year unless expressly so provided herein.</content></section>
<section id="d57096e1204" identifier="/us/bill/117/hr/3237/tVI/s603" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="603"><inline class="smallCaps">Sec. 603. </inline> </num><content class="inline">Unless otherwise provided for by this Act, the additional amounts appropriated by this Act to appropriations accounts shall be available under the authorities and conditions applicable to such appropriations accounts for fiscal year 2021.</content></section>
<section id="d57096e1213" identifier="/us/bill/117/hr/3237/tVI/s604" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="604"><inline class="smallCaps">Sec. 604. </inline> </num><content class="inline">Except for funds used to restore amounts, either directly or through reimbursement, for obligations incurred prior to the date of the enactment of this Act, and notwithstanding any other provision of law, funds made available in this Act shall only be used for the purposes specifically described herein.</content></section>
<section id="d57096e1223" identifier="/us/bill/117/hr/3237/tVI/s605" role="definitions" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="605"><inline class="smallCaps">Sec. 605. </inline> </num><content class="inline">In this Act, the term “<term>coronavirus</term>” means SARS–CoV–2 or another coronavirus with pandemic potential.</content></section>
<section id="d57096e1232" identifier="/us/bill/117/hr/3237/tVI/s606" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="606"><inline class="smallCaps">Sec. 606. </inline> </num><content class="inline">Each amount designated in this Act by the Congress as being for an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 shall be available (or rescinded or transferred, if applicable) only if the President subsequently so designates all such amounts and transmits such designations to the Congress.</content></section>
<section id="d57096e1241" identifier="/us/bill/117/hr/3237/tVI/s607" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="607"><inline class="smallCaps">Sec. 607. </inline> </num><content class="inline">Any amount appropriated by this Act, designated by the Congress as an emergency requirement pursuant to section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985 and subsequently so designated by the President, and transferred pursuant to transfer authorities provided by this Act shall retain such designation.</content></section>
