R. 3226</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210513">May 13, 2021</action-date><action-desc><sponsor name-id="T000483">Mr. Trone</sponsor> (for himself, <cosponsor name-id="K000391">Mr. Krishnamoorthi</cosponsor>, and <cosponsor name-id="S001192">Mr. Stewart</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to ensure accurate and timely reporting of smoking variants through updating the Federal Health IT Strategic Plan.</official-title></form><legis-body id="HEEF937DC271545DA8F5A883C2A53BC2A" style="OLC"><section id="H453C269DA1FB4AB2B81CE9FE31C1AF81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accurate Reporting of Smoking Variants Act of 2021</short-title></quote>.</text></section><section id="HCE9FDD9AE9A549E098A4322BBC7E9701"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H9693DA07007646078F62D7630996EDCE"><enum>(1)</enum><text display-inline="yes-display-inline">The Centers for Disease Control and Prevention has reported 2,807 lung injuries and 68 confirmed deaths from vaping-related injuries.</text></paragraph><paragraph id="H076023D73F5B48F6904DF6BE6A73E493"><enum>(2)</enum><text display-inline="yes-display-inline">According to the 2020 National Youth Tobacco Survey, over 3.6 million kids were reported to be currently using electronic nicotine delivery systems (ENDS), or e-cigarettes.</text></paragraph><paragraph id="H56F7C40F76E8425D92B8CEB9CE3C7BE0"><enum>(3)</enum><text>Repeated prolonged exposure to aerosols founds in e-cigarettes and vaping devices pose considerable potential risk, the long-term health consequences of which also remain to be determined.</text></paragraph></section><section id="H1270EBE3FD7C4C7CBD8A2DE782919805"><enum>3.</enum><header>Ensuring accurate and timely reporting of smoking variants</header><subsection id="H4A9E40AF61C0402681486F1D78A3D643"><enum>(a)</enum><header>Updating the Federal Health IT Strategic Plan</header><text display-inline="yes-display-inline">Section 3001(c)(3)(A) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300jj-11">42 U.S.C. 300jj–11(c)(3)(A)</external-xref>) is amended by adding at the end the following new clause: </text><quoted-block style="OLC" id="H36792C4BD6AB4B55986C9110B8565EDE" display-inline="no-display-inline"><clause id="HA8143ED78C754BB5B1B7BCA33B2DB93E"><enum>(ix)</enum><text display-inline="yes-display-inline">Strategies to enable, through the use of electronic health records, the accurate and timely collection and use of information on the use of electronic nicotine delivery systems, vaping, water pipes, and other variations of smoking in the same manner as, through such records, information on smoking is collected and used. </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H382C18109E964AE49D7E966713A68C3E"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Health and Human Services shall issue such regulations as are necessary to carry out the amendment made by subsection (a). </text></subsection></section></legis-body></bill>
