which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To protect children through eliminating visa loopholes.</official-title></form><legis-body id="H8983B0B97326475B826F240DFD5C909A" style="OLC"><section id="H369B1063A63A40AC9131DBDDDD8D8840" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Children Through Eliminating Visa Loopholes Act</short-title></quote>.</text></section><section id="H5D2D421A9D1D4B4BA9C8E1FA4CAF9EE6"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H4010223F45DC4370B4BB2879146D9665"><enum>(1)</enum><text display-inline="yes-display-inline">the laws of the United States and the policies of the Department of State aim to prevent and reduce the risks of child marriages, sex trafficking, and sexual abuse occurring throughout the world;</text></paragraph><paragraph id="H0495389B61D04815B51C68189E619B82"><enum>(2)</enum><text display-inline="yes-display-inline">major loopholes in Federal law have allowed up to thousands of minors to be subjected to child marriages;</text></paragraph><paragraph id="H841D9F383B32422594F8AC5BD7370DB1"><enum>(3)</enum><text display-inline="yes-display-inline">under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>)—</text><subparagraph id="HEBD2924B8A554E60A20329C171BF8F2C"><enum>(A)</enum><text display-inline="yes-display-inline">a United States citizen child may petition for an immigrant visa for a spouse or fiancé living in another country; and</text></subparagraph><subparagraph id="H06F8C350CAF44F76B06340C6EF225587"><enum>(B)</enum><text display-inline="yes-display-inline">a United States citizen adult may petition for an immigrant visa for a minor spouse or fiancé living abroad;</text></subparagraph></paragraph><paragraph id="HD879A6F270564C4EA2125BAECA3BB188"><enum>(4)</enum><text>the United States Government has advocated for preventing and reducing the occurrence of child marriages throughout the world;</text></paragraph><paragraph id="H23F7B3BE5EF140D6B8E3C5F715BCD817"><enum>(5)</enum><text>Congress passed the Violence Against Women Reauthorization Act of 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/113/4">Public Law 113–4</external-xref>), which requires the Secretary of State to establish and implement a multiyear strategy—</text><subparagraph id="H99FE0DE10E494091A9E29D05EBB038B7"><enum>(A)</enum><text>to <quote>prevent child marriages</quote>; and</text></subparagraph><subparagraph id="H6B4391DCA03348D696B78B88FE97935E"><enum>(B)</enum><text>to <quote>promote the empowerment of girls at risk of child marriage in developing countries</quote>;</text></subparagraph></paragraph><paragraph id="H07E3901CA72B4B89A985AEF6A325CB80"><enum>(6)</enum><text>acknowledges that although the Federal Government is limited in its ability to address child marriage within individual States, establishing a minimum age of 18 years for marriage-based and fiancé-based immigrant visa petitions is an immediate and viable solution for preventing child marriage through exploitation of the United States immigration system;</text></paragraph><paragraph id="HA4AFF7BFAEA640E5B87DB4ED18E5D461"><enum>(7)</enum><text>affirms that child well being is a foremost priority and consideration when imposing strict age requirements for visa spousal and fiancé petitions within the United States immigration system; and</text></paragraph><paragraph id="HE1A56593A6B44313BB560DCFB220855B"><enum>(8)</enum><text>recognizes that under the current immigration legal framework, individuals may exploit visa marriage and fiancé petitions for nefarious purposes, including—</text><subparagraph id="H633D9AF3D9184D28AA9FC96EE422FAD2"><enum>(A)</enum><text>coercing forced marriages; and</text></subparagraph><subparagraph id="H6226C4374EC84BC199FE48750A807232"><enum>(B)</enum><text>the trafficking and abuse of children.</text></subparagraph></paragraph></section><section id="H2E1097DA77F143778040CA503D49FFC3" section-type="subsequent-section"><enum>3.</enum><header>Protecting children through eliminating visa loopholes</header><subsection id="H717E647B758D45C696434BCF96548594"><enum>(a)</enum><header>Definitions</header><text>Section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) is amended—</text><paragraph id="HD8C439649FAD4FCABC62A94024F466C1"><enum>(1)</enum><text>in paragraph (15)(K)—</text><subparagraph id="H87B0354268D84F76B8234029CF255F47"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>(p) of section 214, an alien</quote> and inserting <quote>(r) of section 214, an alien who is at least 18 years of age</quote>; and</text></subparagraph><subparagraph id="HD2468AF8BB914B729ACBA350F8CC9B10"><enum>(B)</enum><text>by inserting <quote>who is at least 18 years of age</quote> after <quote>a citizen of the United States</quote> each time such term appears; and</text></subparagraph></paragraph><paragraph id="HB2065C7E7A2E4456822470249CB320B1"><enum>(2)</enum><text>in paragraph (35), by adding at the end the following: <quote>Such terms do not include any individual who is younger than 18 years of age or who is married to an individual who is younger than 18 years of age.</quote>.</text></paragraph></subsection><subsection id="H63FA958511F946999A087AB21F64E938"><enum>(b)</enum><header>Effective date</header><paragraph id="H68505FE00BD1487D9AC7D61C42DFDDD1"><enum>(1)</enum><header>K nonimmigrants</header><text>The amendments made by subsection (a)(1)—</text><subparagraph id="H1E94660DE63F4632B4865987A585FF22"><enum>(A)</enum><text>shall take effect on the date of the enactment of this Act; and</text></subparagraph><subparagraph id="H6FD3017E17B9400C8505746A995EEC4C"><enum>(B)</enum><text>shall apply to any petition or application seeking nonimmigrant status for any alien under section 101(a)(15)(K) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(K)</external-xref>) that is pending before any agency, officer, or employee of the United States on or after such date of enactment.</text></subparagraph></paragraph><paragraph id="H3ECB2042FA864280B1DF444EB406C2B9"><enum>(2)</enum><header>Spouse; wife; husband</header><text>The amendment made by subsection (a)(2)—</text><subparagraph id="H9D57ABBF46DB4640B099A455B8E6C912"><enum>(A)</enum><text>subject to subparagraphs (B) and (C), shall take effect on the date of the enactment of this Act;</text></subparagraph><subparagraph id="HAB2F007CB79F432AAA2E64A0198A42EB"><enum>(B)</enum><text>subject to subparagraph (C), shall apply to marriages entered into before, on, or after such date of enactment; and</text></subparagraph><subparagraph id="H78379689C92247AFA4AB9AD9B169EFD7"><enum>(C)</enum><text>shall apply to any petition or application for any status or benefit under the immigration laws (as defined in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>) that is filed or otherwise submitted on or after such date of enactment, except for a petition under section 216 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a</external-xref>) to remove the conditional basis of lawful permanent residence based upon a grant of conditional lawful permanent resident status before such date of enactment.</text></subparagraph></paragraph></subsection><subsection id="HE8E4D0DE44244DAD8E1790A0D8385BC0"><enum>(c)</enum><header>Rule of construction</header><text>The amendment made by subsection (a)(2)—</text><paragraph id="H302910DB31CF4419A936A5DB784ED562"><enum>(1)</enum><text>shall apply to the immigration laws (as defined in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>);</text></paragraph><paragraph id="HB660B914DBB24601B7AE53EB388F27A7"><enum>(2)</enum><text>may not be construed to affect or modify any reference to, or legal effect of, any marriage under any provision of the immigration laws using a term not defined by such amendment, including whether any person is married or has been born in wedlock or legitimated for purposes of determining whether such person is a child or is a married or unmarried son or daughter; and</text></paragraph><paragraph id="H1B7ED9F3725641D5A6B85CE88A45B3D2"><enum>(3)</enum><text>may not be construed to limit or modify the eligibility of any VAWA self-petitioner (as defined in section 101(a)(51) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(51)</external-xref>) for any available relief under the immigration laws.</text></paragraph></subsection></section></legis-body></bill>
