which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to provide for the appointment of additional Federal circuit judges, to divide the Ninth Judicial Circuit of the United States into two judicial circuits, and for other purposes.</official-title></form><legis-body id="H6914E2FA754F48A6A7433166D250242D" style="OLC"><section display-inline="no-display-inline" id="H41456307C42049F6B536648623C41371" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ninth Circuit Court of Appeals Judgeship and Reorganization Act of 2021</short-title></quote>.</text></section><section id="H0CFA513135B9423AB80584B553B1DBAB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="HC5DE5E4492C842239B0AF9B5EB67CFE7"><enum>(1)</enum><text>the term <term>former ninth circuit</term> means the ninth judicial circuit of the United States as in existence on the day before the effective date of this Act;</text></paragraph><paragraph id="H9511353E983D473391339F0CDB80FBB9"><enum>(2)</enum><text>the term <term>new ninth circuit</term> means the ninth judicial circuit of the United States established by the amendment made by section 3(2)(A); and</text></paragraph><paragraph id="HE9990C100D43430E8C03A4C729E6DF75"><enum>(3)</enum><text>the term <term>twelfth circuit</term> means the twelfth judicial circuit of the United States established by the amendment made by section 3(2)(B).</text></paragraph></section><section id="HB8A9E75AAB57420DAE5D45657B98A59A"><enum>3.</enum><header>Number and composition of circuits</header><text display-inline="no-display-inline">Section 41 of title 28, United States Code, is amended—</text><paragraph id="H4FCA071DD1F4439CBF15540DDC138CF7"><enum>(1)</enum><text>in the matter preceding the table, by striking <quote>thirteen</quote> and inserting <quote>fourteen</quote>; and</text></paragraph><paragraph id="H887DFB70735C4B0B9AFF5FC9CBF431A8"><enum>(2)</enum><text>in the table—</text><subparagraph id="HB17695243F8A4B5AA90DF8B670B31B57"><enum>(A)</enum><text>by striking the item relating to the ninth circuit and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H7F383DD231E64EAB9F1543714B2E4C59" style="OLC"><table align-to-level="section" blank-lines-before="1" frame="none" line-rules="no-gen" rule-weights="0.0.0.4.0.0" subformat="S6211" table-type="2-General"><tgroup cols="2" fnote-size="0" grid-typeface="1.1" thead-tbody-ldg-size="10.10.10" ttitle-size="0"><colspec align="left" coldef="txt" colname="col1" colsep="1" colwidth="78" min-data-value="50"></colspec><colspec align="left" coldef="txt-no-ldr" colname="col2" colsep="1" colwidth="279.00pt" min-data-value="50"></colspec><tbody><row><entry align="left" colname="col1" leader-modify="force-ldr" rowsep="0" stub-definition="txt-ldr" stub-hierarchy="1">Ninth</entry><entry align="left" colname="col2" leader-modify="clr-ldr" rowsep="0">California, Guam, Hawaii, Northern Mariana Islands.</entry></row></tbody></tgroup></table><after-quoted-block>;</after-quoted-block></quoted-block><continuation-text continuation-text-level="subparagraph">and </continuation-text></subparagraph><subparagraph id="H04E0C4A0F66F4B0583AD02448B57911C"><enum>(B)</enum><text>by inserting after the item relating to the eleventh circuit the following:</text><quoted-block display-inline="no-display-inline" id="H1B3D3BFEDD3F4BBC9210C3B94D269100" style="OLC"><table align-to-level="section" blank-lines-before="1" frame="none" line-rules="no-gen" rule-weights="0.0.0.4.0.0" subformat="S6211" table-type="2-General"><tgroup cols="2" fnote-size="0" grid-typeface="1.1" thead-tbody-ldg-size="10.10.10" ttitle-size="0"><colspec align="left" coldef="txt" colname="col1" colsep="1" colwidth="78" min-data-value="50"></colspec><colspec align="left" coldef="txt-no-ldr" colname="col2" colsep="1" colwidth="337.50pt" min-data-value="50"></colspec><tbody><row><entry align="left" colname="col1" leader-modify="force-ldr" rowsep="0" stub-definition="txt-ldr" stub-hierarchy="1">Twelfth</entry><entry align="left" colname="col2" leader-modify="clr-ldr" rowsep="0">Alaska, Arizona, Idaho, Montana, Nevada, Oregon, Washington.</entry></row></tbody></tgroup></table><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H4A46D799D23A4FB884A8C80C066D6E98"><enum>4.</enum><header>Judgeships</header><subsection id="H1BB43C811C2E4D5EB2C374057B9844CC"><enum>(a)</enum><header>New judgeships</header><paragraph id="H67D88BF4B4224F2CAC4E8CC670188269"><enum>(1)</enum><header>For former Ninth Circuit</header><text>The President shall appoint, by and with the advice and consent of the Senate, 2 additional circuit judges for the former ninth circuit. The official duty station of a judge appointed under this paragraph shall be in Arizona, California, or Nevada.</text></paragraph><paragraph id="H636601D351644856B7A538C23F894E8A"><enum>(2)</enum><header>For new Ninth Circuit</header><text>The President shall appoint, by and with the advice and consent of the Senate, 3 circuit judges for the new ninth circuit. The judges authorized by this paragraph shall not be appointed before January 21, 2021.</text></paragraph></subsection><subsection id="HF1DF5751E82E4B56AB33AE2E005A21B6"><enum>(b)</enum><header>Temporary judgeships</header><paragraph id="HC744F3072A0748C7B2F3C07DD57EB977"><enum>(1)</enum><header>Appointment of judges</header><text>The President shall appoint, by and with the advice and consent of the Senate, 2 additional circuit judges for the former ninth circuit. The official duty station of a judge appointed under this paragraph shall be in Arizona, California, or Nevada.</text></paragraph><paragraph id="HF9E37E0DF02E48D7A5A5297B9119B91C"><enum>(2)</enum><header>Effect of vacancies</header><text>The first 2 vacancies occurring on the new ninth circuit 10 years or more after judges are first confirmed to fill both temporary circuit judgeships created by this subsection shall not be filled.</text></paragraph></subsection><subsection id="HE745E308A0D146F5A661DF71F33C3AFE"><enum>(c)</enum><header>Effective date</header><text>This section shall take effect on the date of the enactment of this Act.</text></subsection></section><section id="H66257918E39249BE8CD35F32519B1AA2"><enum>5.</enum><header>Number of circuit judges</header><text display-inline="no-display-inline">The table contained in section 44(a) of title 28, United States Code, is amended—</text><paragraph id="H59040E6CF72F46BEBD5CD2D6CF0FD3A7"><enum>(1)</enum><text>by striking the item relating to the ninth circuit and rowsep="0">Phoenix, Seattle.</entry></row></tbody></tgroup></table><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HEE021E10164F414C9309AC1266314015"><enum>7.</enum><header>Assignment of circuit judges</header><subsection id="H6E5C1E3661954E35BDDE0001A8F52ED1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), each circuit judge of the former ninth circuit who is in regular active service and whose official duty station on the day before the effective date of this Act—</text><paragraph id="HA44B124D0E394EC8B334076E1E42804D"><enum>(1)</enum><text>is in California, Guam, Hawaii, or the Northern Mariana Islands shall be a circuit judge of the new ninth circuit as of such effective date; and</text></paragraph><paragraph id="H0F5BC6E237E54F039FDF13D5DA1FA8AA"><enum>(2)</enum><text>is in Alaska, Arizona, Idaho, Montana, Nevada, Oregon, or Washington shall be a circuit judge of the twelfth circuit as of such effective date.</text></paragraph></subsection><subsection id="HD9174BEDC7B94BEFBE7E550436844D7A"><enum>(b)</enum><header>Special rule To ensure statutory distribution of judges</header><text display-inline="yes-display-inline">If the assignment of judges under subsection (a) would result in a number of judges in either the new ninth circuit or the twelfth circuit that exceeds the number provided for that circuit in the table contained in section 44(a) of title 28, United States Code, as amended by section 5 of this Act, then a number of judges accounting for such excess who are the least senior in commission shall be assigned to the other circuit.</text></subsection></section><section id="H992171BB5685460D8383E5251AC0C2CD"><enum>8.</enum><header>Election of assignment by senior judges</header><text display-inline="no-display-inline">Each judge who is a senior circuit judge of the former ninth circuit on the day before the effective date of this Act may elect to be assigned to the new ninth circuit or to the twelfth circuit as of such effective date, and shall notify the Director of the Administrative Office of the United States Courts of such election.</text></section><section id="HEB83BE8C26CC4522908605BFE1D7C889"><enum>9.</enum><header>Seniority of judges</header><text display-inline="no-display-inline">The seniority of each judge—</text><paragraph id="HF5EFBF7A995B4DA0895A0B8E9A472FD6"><enum>(1)</enum><text>who is assigned under section 7, or</text></paragraph><paragraph id="H8F72CF2162C645EDB188DAC2E6E757CC"><enum>(2)</enum><text>who elects to be assigned under section 8,</text></paragraph><continuation-text continuation-text-level="section">shall run from the date of commission of such judge as a judge of the former ninth circuit. </continuation-text></section><section id="H419D925F6429479E840EB4619D2A3273"><enum>10.</enum><header>Application to cases</header><text display-inline="no-display-inline">The following apply to any case in which, on the day before the effective date of this Act, an appeal or other proceeding has been filed with the former ninth circuit:</text><paragraph id="H638F592654AF4FAE9FF9F029554DDB0A"><enum>(1)</enum><text>If the matter has been submitted for decision, further proceedings with respect to the matter shall be had in the same manner and with the same effect as if this Act had not been enacted.</text></paragraph><paragraph id="HE417ABAF35CF48EC8EA377E7693FD26A"><enum>(2)</enum><text>If the matter has not been submitted for decision, the appeal or proceeding, together with the original papers, printed records, and record entries duly certified, shall, by appropriate orders, be transferred to the court to which the matter would have been submitted had this Act been in full force and effect at the time such appeal was taken or other proceeding commenced, and further proceedings with respect to the case shall be had in the same manner and with the same effect as if the appeal or other proceeding had been filed in such court.</text></paragraph><paragraph id="H5FBB89CD77794DB9AED48E310956FF22"><enum>(3)</enum><text>A petition for rehearing or a petition for rehearing en banc in a matter decided before the effective date of this Act, or submitted before the effective date of this Act and decided on or after such effective date as provided in paragraph (1), shall be treated in the same manner and with the same effect as though this Act had not been enacted. If a petition for rehearing en banc is granted, the matter shall be reheard by a court comprised as though this Act had not been enacted.</text></paragraph></section><section id="HAE2509AFCD854B7E928F4D42DC614D1C"><enum>11.</enum><header>Temporary assignment of circuit judges between circuits</header><text display-inline="no-display-inline">Section 291 of title 28, United States Code, is amended by adding at the end the following new subsections:</text><quoted-block id="HD2A8F9A106B44FEE9F78A79181115CE5"><subsection id="H6F19FA8119B04241B267BF3977953E19"><enum>(c)</enum><text>The chief judge of the Ninth Circuit may, in the public interest and upon request by the chief judge of the Twelfth Circuit, designate and assign temporarily any circuit judge of the Ninth Circuit to act as circuit judge in the Twelfth Circuit.</text></subsection><subsection id="H62585A401E654AD7A606C80469BEECD6"><enum>(d)</enum><text>The chief judge of the Twelfth Circuit may, in the public interest and upon request by the chief judge of the Ninth Circuit, designate and assign temporarily any circuit judge of the Twelfth Circuit to act as circuit judge in the Ninth Circuit.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H20C6635764AC4A95AD6AA2C229ABFD8A"><enum>12.</enum><header>Temporary assignment of district judges between circuits</header><text display-inline="no-display-inline">Section 292 of title 28, United States Code, is amended by adding at the end the following new subsections:</text><quoted-block id="H8482F5E83F7F40A9BCAAB98B3878A29E"><subsection id="H50A2700A451E4E3EA1120F345534A789"><enum>(f)</enum><text>The chief judge of the Ninth Circuit may in the public interest—</text><paragraph id="HE64CA389C46E42F9872444E5633FB905"><enum>(1)</enum><text>upon request by the chief judge of the Twelfth Circuit, designate and assign one or more district judges within the Ninth Circuit to sit upon the Court of Appeals of the Twelfth Circuit or a division thereof whenever the business of that court so requires; and</text></paragraph><paragraph id="HCC060BCF83984D35B8413130CE3601C5"><enum>(2)</enum><text>designate and assign temporarily any district judge of the Ninth Circuit to hold a district court in any district within the Twelfth Circuit.</text></paragraph></subsection><subsection id="HD388A17991F14021A6253392A1F8021C"><enum>(g)</enum><text>The chief judge of the Twelfth Circuit may in the public interest—</text><paragraph id="HE45247AE33D54BF9A415A14E9D83F303"><enum>(1)</enum><text>upon request by the chief judge of the Ninth Circuit, designate and assign one or more district judges within the Twelfth Circuit to sit upon the Court of Appeals of the Ninth Circuit or a division thereof whenever the business of that court so requires; and</text></paragraph><paragraph id="H7BA6071DE2C445BD8AC53F30487193D2"><enum>(2)</enum><text>designate and assign temporarily any district judge of the Twelfth Circuit to hold a district court in any district within the Ninth Circuit.</text></paragraph></subsection><subsection id="HDE352BAC27834DAAAFF4CCD5844980C4"><enum>(h)</enum><text>Any designation and assignment of a judge under subsection (f)(1) or (g)(1) shall be in conformity with the rules or orders of the court of appeals of the circuit to which the judge is designated and assigned.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8CE2894793434B839F06B68B9E1CABA0"><enum>13.</enum><header>Administrative coordination</header><text display-inline="no-display-inline">Section 332 of title 28, United States Code, is amended by adding at the end the following new subsection:</text><quoted-block id="H709E68812C9640B4AA716B427EBEB882"><subsection id="H740D30AC298841E7B9812E682414E624"><enum>(i)</enum><text>Any 2 contiguous circuits may jointly carry out such administrative functions and activities as the judicial councils of the 2 circuits determine may benefit from coordination or consolidation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H73D1648E4AD54BEE933D6EC4FED21C93"><enum>14.</enum><header>Administration</header><text display-inline="no-display-inline">The United States Court of Appeals for the Ninth Circuit as constituted on the day before the effective date of this Act may take such administrative action as may be required to carry out this Act and the amendments made by this Act. Such court shall cease to exist for administrative purposes upon the expiration of the 2-year period beginning on the effective date of this Act.</text></section><section id="H3AD96426C6C44257A2FBBFCF86FE7054"><enum>15.</enum><header>Effective date</header><text display-inline="no-display-inline">Except as provided in section 4(c), this Act and the amendments made by this Act shall take effect on the first day of the first fiscal year that begins after the expiration of the 9-month period beginning on the first date on which 5 of the judges authorized to be appointed under section 4 have been confirmed by the United States Senate.</text></section><section id="H358EF7FA721444CF9592203E501A3269"><enum>16.</enum><header>Authorization of Appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act, including funds for additional court facilities.</text></section></legis-body></bill>
