which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize and limit the pre-disaster mitigation program of the Small Business Administration, and for other purposes.</official-title></form><legis-body id="H37155DDC1D124875ABD7141019988E6E" style="OLC"><section section-type="section-one" id="HB28AAC24599F47CD8F5355B46F1F4D99"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Resources for Emergency Preparedness And Resilient Enterprises Act</short-title></quote> or the <quote><short-title>PREPARE Act</short-title></quote>.</text></section><section id="HCFD3442C52244251A45FDFB6134C6568"><enum>2.</enum><header>Pre-disaster mitigation program</header><subsection id="H12EF1C8AB1D54E39B776895246ECDAC6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended—</text><paragraph id="H534E390FDC404A9B8668E548BAC2B66B"><enum>(1)</enum><text>in paragraph (1)(C)—</text><subparagraph id="HBFDAA96A53CC45A99544A491D5A16611"><enum>(A)</enum><text>by striking <quote>during fiscal years 2000 through 2004, to establish a predisaster mitigation program</quote> and inserting <quote>to establish a pre-disaster mitigation program</quote>;</text></subparagraph><subparagraph id="HAFA45408DB1D4EB2B1B21F3AA0D63371"><enum>(B)</enum><text>by inserting <quote>in accordance with paragraph (16) and</quote> before <quote>as the Administrator may</quote>; </text></subparagraph><subparagraph id="HEDA9CCBC916542AD87925A05A37571B1"><enum>(C)</enum><text>by striking <quote>to enable small businesses</quote> and inserting <quote>to small business concerns to enable those concerns</quote>; and</text></subparagraph><subparagraph id="H7795FE8EDE3D4EE692762E0019F9CEF9"><enum>(D)</enum><text>by striking <quote>in support of a formal</quote> and all that follows through the semicolon at the end and inserting <quote>to protect the commercial real estate, equipment, inventory, supplies, and materials of those concerns from damages related to disasters;</quote>; and</text></subparagraph></paragraph><paragraph id="H4159CB996720427F8951D73243A87716"><enum>(2)</enum><text>by inserting after paragraph (15) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H03228073D5494C589E56A75F4CA3FEE2"><paragraph id="H5EEA44AF0BC84CB9B7554E94894271C8"><enum>(16)</enum><header>Pre-disaster mitigation program loans</header><subparagraph id="HF0C0824683E44AA087C44D06785007B5"><enum>(A)</enum><header>Loan cap</header><text display-inline="yes-display-inline">The aggregate amount of loans made under the pre-disaster mitigation program under paragraph (1)(C) to a borrower may not exceed $500,000.</text></subparagraph><subparagraph id="H0047F7254ED047E7811139797C8E4CE5"><enum>(B)</enum><header>Outreach</header><text display-inline="yes-display-inline">In carrying out the pre-disaster mitigation program under paragraph (1)(C), the Administrator shall—</text><clause id="H7906E316F4014FF5AFCFEDF57DF8DB96"><enum>(i)</enum><text>establish an advertising and outreach program to help small business concerns understand the value of mitigation and that the pre-disaster mitigation program is available for that purpose; </text></clause><clause id="HA86A18F38729426880F26BC62FF9A2CB"><enum>(ii)</enum><text>conduct outreach campaigns to small business concerns regarding the pre-disaster mitigation program, including—</text><subclause id="H94BD984FF2AC459188BA035655D5308A"><enum>(I)</enum><text>advertising to educate those concerns on the importance of disaster mitigation; and</text></subclause><subclause id="HAAFDCA7DF6554BDE8DB4DDE3064E7118"><enum>(II)</enum><text>campaigns to promote participation in the program by small business concerns located in economically depressed areas;</text></subclause></clause><clause id="H6DCEF34FC1FE4B21AC603263DFA40ECE"><enum>(iii)</enum><text>provide technical assistance to applicants, including instructions on how to participate in the pre-disaster mitigation program, assistance in preparing applications, and expertise on best practices for projects; and</text></clause><clause id="HAB3AD43FA22C4323874C98E681BF7A3F"><enum>(iv)</enum><text>provide detailed information on the purposes for which funds from loans made under the pre-disaster mitigation program may be used.</text></clause></subparagraph><subparagraph id="HF9A5FB0375EB4A0093E5016F13EAECC2"><enum>(C)</enum><header>Reservation of funds</header><text display-inline="yes-display-inline">Not more than 4 percent of the funds made available to the Administrator to carry out the pre-disaster mitigation program under paragraph (1)(C) may be reserved by the Administrator for—</text><clause id="H3CF614BFEABC4ABCAE5B15195B0214B9"><enum>(i)</enum><text display-inline="yes-display-inline">the administrative costs of the program; and</text></clause><clause id="H8ED28CDE403D46369437D144F11BBA85"><enum>(ii)</enum><text>the activities described in subparagraph (B).</text></clause></subparagraph><subparagraph id="H75E129C560314678B14AE122A4DC0D9D"><enum>(D)</enum><header>Guidance</header><text>The Administrator shall issue guidance to ensure that borrowers purchase and maintain adequate insurance coverage over the duration of a loan obtained under the pre-disaster mitigation program under paragraph (1)(C).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF34A6E659A9A4A209EBC935BEF26EC53"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 20(c) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE6284B764BD849CD8164F10EF11D1929"><subsection id="H48C60C92B9C649F69D25D7FB0941ECE7"><enum>(c)</enum><header>Pre-Disaster mitigation program</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the purpose of carrying out the program established under section 7(b)(1)(C) the following amounts:</text><paragraph id="H742B4C3B09B44FB19D390A01435DA372"><enum>(1)</enum><text display-inline="yes-display-inline">$25,000,000 for fiscal year 2022.</text></paragraph><paragraph id="H11E84B6AAA00484399CB8C217C96E40D"><enum>(2)</enum><text>$25,000,000 for fiscal year 2023.</text></paragraph><paragraph id="H8745FFDAAB9547229E6A6CC5437A6968"><enum>(3)</enum><text>$25,000,000 for fiscal year 2024.</text></paragraph><paragraph id="H4F854F2E980C4C3DB3E674B56DB458A1"><enum>(4)</enum><text>$25,000,000 for fiscal year 2025.</text></paragraph><paragraph id="HE1EAB9EDF8A14E6E82CF55F98A73B1EF"><enum>(5)</enum><text>$25,000,000 for fiscal year 2026.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2023D3D260D54A09A4710EFC75A2EEFC"><enum>(c)</enum><header>Program evaluation</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator of the Small Business Administration shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on the pre-disaster mitigation program under section 7(b)(1)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(1)(C)</external-xref>), as amended by this Act, including—</text><paragraph id="HC89E86A7A0624306BE8B1F4234DFEE0E"><enum>(1)</enum><text>a list of the geographic areas in which recipients of loans under the program are located;</text></paragraph><paragraph id="H6C9AD34131D447A9A1FFEBDEE5C26F06"><enum>(2)</enum><text>the types of mitigation projects that were funded;</text></paragraph><paragraph id="HFECCE5D31199432EBEC0027EC43E3F03"><enum>(3)</enum><text>the number and dollar value of the loans made under the program;</text></paragraph><paragraph id="HC481DD3C014943FC88AE66DA47AF9DAB"><enum>(4)</enum><text display-inline="yes-display-inline">the estimated aggregate value resulting from the use of mitigation techniques funded by loans made under the program, including—</text><subparagraph id="HDFCEA05A08484ABF8F7FC05ACCE3E6C4"><enum>(A)</enum><text>the lost productivity and expenses that were avoided; and</text></subparagraph><subparagraph id="H401598A943604CACB48FEC4B825B2AB7"><enum>(B)</enum><text>the estimated amount saved by the Federal Government;</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H107EF22620684936BEB5C2C023AD9AE1"><enum>(5)</enum><text>the information required by paragraph (4) disaggregated by region, by State, and by industry; and</text></paragraph><paragraph id="H42AF0E25E05541CB8A2BDDE87AAC3EC8"><enum>(6)</enum><text>the estimated dollar value of loans that would have been made under section 7(b)(1)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(1)(A)</external-xref>) without the loans made under the program.</text></paragraph></subsection><subsection id="H4BE83E09BDA049189BE8BAB52F8C9C70"><enum>(d)</enum><header>Initial reporting on pilot program</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives—</text><paragraph id="H32D9095FA14C4C2C91CD4A4203CB4EB6"><enum>(1)</enum><text>a description of and all related materials for outreach advertising campaign efforts made during the duration of the pre-disaster mitigation pilot program of the Small Business Administration;</text></paragraph><paragraph id="HBF937397E1A54FD9A4CDF9E4F5F94A65"><enum>(2)</enum><text>information on how the Small Business Administration appropriately staffed the Office of Disaster Assistance to carry out the pilot program described in paragraph (1); and</text></paragraph><paragraph id="H2DC000A49BAF4C63B1B413B8C4350123"><enum>(3)</enum><text>the amount of the budget of the pilot program described in paragraph (1) that was used for outreach advertising campaign efforts. </text></paragraph></subsection><subsection id="HFEF92609DFB74A099E3591E5B6E2698C"><enum>(e)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply only with respect to loans made under section 7(b)(1)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(1)(C)</external-xref>), as amended by this Act, on or after the date of enactment of this Act.</text></subsection></section><section id="H3C1782773C0A4CBDAD47DE17F95B4AEB"><enum>3.</enum><header>Increase in allowable amount of physical disaster loan for mitigation</header><text display-inline="no-display-inline">Section 7(b)(1)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(1)(A)</external-xref>) is amended, in the second proviso, by striking <quote>20 per centum</quote> and inserting <quote>30 percent</quote>.</text></section></legis-body></bill>
