R. 3205</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210513">May 13, 2021</action-date><action-desc><sponsor name-id="M001177">Mr. McClintock</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To repeal the Jones Act restrictions on coastwise trade, and for other purposes.</official-title></form><legis-body id="H6B3D2EC39CB84932A27CC00BDF42F50E" style="OLC"><section id="HA1805FF932D64B2AACC7A6816AE9A234" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Open America’s Waters Act</short-title></quote>.</text></section><section id="H8364F4B651CF4F95B78FA8AFD11C8F54"><enum>2.</enum><header>Repeal of certain limitations on coastwise trade</header><subsection id="H0A9110F9298F4475904BF29A86A0F6EA"><enum>(a)</enum><header>In general</header><text>Section 12112(a) of title 46, United States Code, is amended to read as follows:</text><quoted-block id="H931B4EDF0EB24CB9AF9209F73684536A" style="OLC"><subsection id="H36482E0BC92E4856BE05EBF34CB790BB"><enum>(a)</enum><header>In general</header><text>A coastwise endorsement may be issued for a vessel that qualifies under the laws of the United States to engage in the coastwise trade.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCA2E139AB61C4D1E9C0C52D272E91F9C"><enum>(b)</enum><header>Regulations</header><text>Not later than 90 days after the date of the enactment of this Act, the Commandant of the United States Coast Guard shall issue regulations to implement the amendment made by subsection (a) that require all vessels permitted to engage in the coastwise trade to meet all appropriate safety and security requirements.</text></subsection><subsection id="HAA463B2946064EA58FA121F510206C31"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="HD56781D5B95349AF8AF8AB251FFA4CC9"><enum>(1)</enum><header>Tank vessel construction standards</header><text>Section 3703a(c)(1)(C) of title 46, United States Code, is amended by striking <quote>and is qualified for documentation as a wrecked vessel under section 12112 of this title</quote>.</text></paragraph><paragraph id="HE06DBE353ECA4B069BA7F7AD6285421C"><enum>(2)</enum><header>Liquified gas tankers</header><text>Section 12120 of such title is amended by striking <quote>, if the vessel—</quote> and all that follows and inserting a period.</text></paragraph><paragraph id="H099AF80B5EEF4BA9A81D9B9DD597988D"><enum>(3)</enum><header>Small passenger vessels</header><text>Section 12121(b) of such title is amended by striking <quote>12112,</quote>.</text></paragraph><paragraph id="H761DF0A135B94145817C8327BE5565AD"><enum>(4)</enum><header>Loss of coastwise trade privileges</header><text>Section 12132 of such title is repealed.</text></paragraph><paragraph id="H0D667750DEA74EEDB95C682FCA08974F"><enum>(5)</enum><header>Oil spill response vessels</header><text display-inline="yes-display-inline">Section 12117(b) of such title is amended by striking <quote>sections 12103, 12132, and 50501</quote> and inserting <quote>sections 12103 and 50501</quote>.</text></paragraph><paragraph id="H6DC6B3F5893E462995A5008FFC23D3FB"><enum>(6)</enum><header>Optional regulatory measurement</header><text>Section 14305(a)(6) of such title is amended by striking <quote>sections 12118 and 12132</quote> and inserting <quote>section 12118</quote>.</text></paragraph><paragraph id="HD773E59F514841BC89AFC8AEF86DC934"><enum>(7)</enum><header>Court sales of undocumented vessels</header><text>Section 31329(b) of such title is amended—</text><subparagraph id="H52D79B74996948B69D9D99EBDD82FA00"><enum>(A)</enum><text>in paragraph (1), by striking <quote>;</quote> and inserting <quote>; and</quote>;</text></subparagraph><subparagraph id="H96B234D7DF2A490B94ACB275E6E79395"><enum>(B)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a period; and</text></subparagraph><subparagraph id="H22941B2A7F734D538DEE65943F3B25C7"><enum>(C)</enum><text>by striking paragraph (3).</text></subparagraph></paragraph><paragraph id="HB54264743A6C48819E7D2DCB8C9A89FF"><enum>(8)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/121">chapter 121</external-xref> of title 46, United States Code, is amended by striking the item relating to section 12132.</text></paragraph></subsection></section></legis-body></bill>
