which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act and the CARES Act to establish oversight requirements for economic injury disaster loans and advances, and for other purposes.</official-title></form><legis-body id="H4566CE2FFC3543768B0B80E1293C7ABE" style="OLC"><section id="H74DB0B5F54984108B3ECF72070AF21C4" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EIDL Oversight Act of 2021</short-title></quote>.</text></section><section id="HDC2DF422795246A0BF7928BE65392BD7" section-type="subsequent-section"><enum>2.</enum><header>Oversight requirements for economic injury disaster loans and advances</header><subsection id="H7595261714F7484A838E0D31900C48A1"><enum>(a)</enum><header>Economic injury disaster loans</header><text display-inline="yes-display-inline">Section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) is amended by inserting after paragraph (15) the following new paragraph:</text><quoted-block style="OLC" id="H15E16543A103461C95BF9DF578CA90D0" display-inline="no-display-inline"><paragraph id="HE0C945401ACE4F09AD2EF14BBD72492E"><enum>(16)</enum><header>Oversight requirements for economic injury disaster loans</header><text display-inline="yes-display-inline">With respect to a loan made under paragraph (2), the Administrator shall take such action as necessary to—</text><subparagraph id="H518D1E25253E49D797645B493F0B1DB2"><enum>(A)</enum><text>establish or strengthen controls to ensure that loan proceeds are deposited in a legitimate account of a borrower;</text></subparagraph><subparagraph id="HAFD64257985947E792A5AC3896705508"><enum>(B)</enum><text>ensure that any modification of a loan application after lender approval of such loan is reviewed by an employee of the Administration;</text></subparagraph><subparagraph id="H0E192E0ACC984DC88D69B1C53A0AC8C5" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">establish or strengthen controls to—</text><clause id="H983B6095149145D89AE9FB735D0E38B6" commented="no"><enum>(i)</enum><text>ensure that multiple loans are provided only to eligible borrowers; and</text></clause><clause id="HFAB5416AB4E04CBE818A49BA789448A2"><enum>(ii)</enum><text>prevent the erroneous duplication of loans, including by establishing a system to verify the identity of a borrower using photo identification;</text></clause></subparagraph><subparagraph id="H5B2F84C31F494B14880FA40CF2729921"><enum>(D)</enum><text>verify the applicant is a legitimate borrower with the appropriate State or local agency through tax returns, documentation relating to incorporation or status as a nonprofit organization, or another method; </text></subparagraph><subparagraph id="HE3C6B2DB170248FDA1ED569EAEFFBDB7"><enum>(E)</enum><text>ensure that 2 employees of the Administration approve each application for a loan under paragraph (2) and eliminate any processes of the Administration that allow for simultaneous approval of multiple loan applications;</text></subparagraph><subparagraph id="H050E109E49254D0DA718DFA70CCDAED1" display-inline="no-display-inline"><enum>(F)</enum><text>require an individual employee of the Administration to contact applicants who submit multiple loan applications from the same Internet Protocol addresses, email addresses, or physical addresses, or with the same bank account number, to verify eligibility of such applicants; and</text></subparagraph><subparagraph id="HD050BB6D6A27403EB15C25A991D8FDDE"><enum>(G)</enum><text>with respect to a borrower of a loan made under paragraph (2) because of the COVID–19 pandemic—</text><clause id="HE8714A646B08478E9FB77581C0D72238"><enum>(i)</enum><text display-inline="yes-display-inline">ensure that such borrower is not included on the <quote>Do Not Pay List</quote> of the Department of the Treasury (as described under section 3354 of title 31, United States Code);</text></clause><clause id="H7A09AD1B83744FFFADE28ED2A7902E4E"><enum>(ii)</enum><text>ensure that an employer identification number on an application for such a loan was registered before February 15, 2020;</text></clause><clause id="H45B69C13743A49C0A5C819A7726A59A6"><enum>(iii)</enum><text>prevent duplicate loan applications with the same employer identification number or social security number; and</text></clause><clause id="HF0322A72358648B4B6AABD9B21807A12" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">establish a system to prevent disbursement of such loans to applicants that submit more than 1 loan application with the same employer identification number, social security number, email addresses, physical addresses, or bank account number, or from the same Internet Protocol address.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9A314B5B061B4826BDE0FC1820826E78"><enum>(b)</enum><header>EIDL advances</header><text display-inline="yes-display-inline">Section 1110(e) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009">15 U.S.C. 9009(e)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H6C0467DE3ADD4D88891E018AF4BA4C50" display-inline="no-display-inline"><paragraph id="H393B7C007C0D4FF0AB3AF628022D7189"><enum>(9)</enum><header>Oversight requirements</header><text display-inline="yes-display-inline">With respect to an advance made under this subsection, the Administrator shall take such action as necessary to—</text><subparagraph id="H19240EBF7E814B4D940AC10A15CA2C35"><enum>(A)</enum><text>ensure that the advance was deposited in a legitimate account of an individual;</text></subparagraph><subparagraph id="HE9C33ECD0CA142DF93A30E4268544F91"><enum>(B)</enum><text>ensure that any modification of a request for an advance is reviewed by an employee of the Administration;</text></subparagraph><subparagraph id="HC27FCDBBBA4247A4A865AB42C5D758D2" display-inline="no-display-inline" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">prevent the erroneous duplication of advances;</text></subparagraph><subparagraph id="H3C0B6C42A6C5441AA98033C4EE15B9B5" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">ensure that an employer identification number included in a request for an advance—</text><clause id="H07DE0AB82B23440297568E6FCD8B1393"><enum>(i)</enum><text>was registered before February 15, 2020; and</text></clause><clause id="H36F91DA12F6440C0AB396F582FB81DC9"><enum>(ii)</enum><text display-inline="yes-display-inline">is not registered to a person included on the <quote>Do Not Pay List</quote> of the Department of the Treasury (as described under section 3354 of title 31, United States Code);</text></clause></subparagraph><subparagraph id="H84D1F0209692478BAFC1973C836DA75D" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">prevent duplicate requests for an advance with the same employer identification number or social security number; and</text></subparagraph><subparagraph id="H7E49DF21F5C64D438A022EF9E4581E27" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">prevent disbursement of advances to applicants that submit more than 1 request with the same employer identification number, social security number, email addresses, physical addresses, or bank account number, or from the same Internet Protocol address.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection><subsection id="H27F72E70676E4C08976F0743219B1288"><enum>(c)</enum><header>Targeted EIDL advances</header><text>Section 331 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) is amended by adding at the end the following new subsection: </text><quoted-block style="OLC" id="H8C96CF73A15040D3A225362165284786" display-inline="no-display-inline"><subsection id="H3B6ABF19B0264F54A26B5E3C0035077C"><enum>(i)</enum><header>Oversight requirements</header><text display-inline="yes-display-inline">With respect to a payment made under this section, the Administrator shall take such action as necessary to—</text><paragraph id="HB2243D0D0B1046F69F2C157F34B2F90B"><enum>(1)</enum><text display-inline="yes-display-inline">establish or strengthen controls to ensure that the payment is deposited in a legitimate account of a recipient of a payment;</text></paragraph><paragraph id="H824E10D47F6449C7AB336E0381358074"><enum>(2)</enum><text>ensure that any modification of a request for a payment is reviewed by an employee of the Administration;</text></paragraph><paragraph id="HEDEA20F7416849A3A9D4D91F6B1173ED" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">establish or strengthen controls to prevent the erroneous duplication of payments under this section, including by establishing a system to verify the identity of an applicant using photo identification;</text></paragraph><paragraph id="H7218372F01F64458B1B661F614A7B2F6"><enum>(4)</enum><text>verify the applicant is a legitimate applicant for a payment with the appropriate State or local agency through tax returns, documentation relating to incorporation or status as a nonprofit organization, or another method; </text></paragraph><paragraph id="H0E80F9EA2E9049A5AD85265280CA6DC5"><enum>(5)</enum><text display-inline="yes-display-inline">ensure that 2 employees of the Administration approve each request for a payment and eliminate any processes of the Administration that allow for simultaneous approval of multiple advances;</text></paragraph><paragraph id="HEAF5C8193AF245479D3708120D779410" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">require an individual employee of the Administration to contact applicants who submit multiple requests for a payment from the same Internet Protocol addresses, email addresses, or physical addresses, or with the same bank account number, to verify eligibility of such applicants;</text></paragraph><paragraph id="HC8E097DE6F5341639BC793DA1BF7B4B0" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">ensure that an employer identification number included in a request for a payment—</text><subparagraph id="HA5C6E5C45AB34761BD0C56AECD1BF52D"><enum>(A)</enum><text>was registered before February 15, 2020; and</text></subparagraph><subparagraph id="HBA4D4C7A8FB342B3BF4B843B907827B9"><enum>(B)</enum><text display-inline="yes-display-inline">is not registered to a person included on the <quote>Do Not Pay List</quote> of the Department of the Treasury (as described under section 3354 of title 31, United States Code);</text></subparagraph></paragraph><paragraph id="HF9AD3E20DA234F7EB353E07839488486" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">prevent duplicate requests for a payment with the same employer identification number or social security number; and</text></paragraph><paragraph id="HED8120964FF8413B82D9821C55E84233" commented="no"><enum>(9)</enum><text display-inline="yes-display-inline">establish a system to prevent disbursement of payments to applicants that submit more than 1 request with the same employer identification number, social security number, email addresses, physical addresses, or bank account number, or from the same Internet Protocol address.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
