R. 3180</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210513">May 13, 2021</action-date><action-desc><sponsor name-id="B000574">Mr. Blumenauer</sponsor> (for himself, <cosponsor name-id="L000593">Mr. Levin of California</cosponsor>, <cosponsor name-id="B001292">Mr. Beyer</cosponsor>, <cosponsor name-id="D000617">Ms. DelBene</cosponsor>, <cosponsor name-id="G000585">Mr. Gomez</cosponsor>, <cosponsor name-id="H001066">Mr. Horsford</cosponsor>, <cosponsor name-id="L000557">Mr. Larson of Connecticut</cosponsor>, <cosponsor name-id="P000613">Mr. Panetta</cosponsor>, and <cosponsor name-id="R000305">Ms. Ross</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide an elective payment for energy property and electricity produced from certain renewable resources, and for other purposes.</official-title></form><legis-body id="H1FFD7B65ADA54E1FB8A449C973CFFE68" style="OLC"><section id="HD31A9A576920493DA1B0BD80A3463431" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Renewable Energy Investment Act</short-title></quote>. </text></section><section id="H35C2D897F7264151B2E4870CE285A6E7"><enum>2.</enum><header>Elective payment for energy property and electricity produced from certain renewable resources, etc</header><subsection id="H6184730A931440D1B8D4DC144E7E81DC"><enum>(a)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/65">chapter 65</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block id="H4E1D15C60E874BE6A1445E0B03D15644" style="OLC"><section id="H4B20C6C2D0134D0EBD3813530F4E5D32"><enum>6431.</enum><header>Elective payment for energy property and electricity produced from certain renewable resources, etc</header><subsection id="H35D47357AD614D99BD567A34FE4F3C7D"><enum>(a)</enum><header>Energy property</header><text>In the case of a taxpayer making an election under this subsection (at such time and in such manner as the Secretary may provide) with respect to any portion of an applicable credit, such taxpayer shall be treated as making a payment against the tax imposed by subtitle A for the taxable year equal to the amount of such portion.</text></subsection><subsection id="HF56AF0ACAB774249B33D599963DC7EE8"><enum>(b)</enum><header>Application to partnerships and S corporations</header><paragraph id="HB0D5B7DF8EDF42E78965818DC4E2C7BA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any applicable credit determined with respect to any qualified resources, qualified facility, or energy property held directly by a partnership or S corporation, if such partnership or S corporation makes an election under this subsection (in such manner as the Secretary may provide) with respect to any portion of such credit—</text><subparagraph id="HA5B2EF12BF56422BA8D9F2EA4457EEDF"><enum>(A)</enum><text>the Secretary shall make a payment to such partnership or S corporation equal to the amount of such portion,</text></subparagraph><subparagraph id="HC313D570DBE7434BAB381BB4FBA617CB"><enum>(B)</enum><text>subsection (e)(1) shall be applied with respect to such credit before determining any partner’s distributive share, or shareholder’s pro rata share, of such credit, and </text></subparagraph><subparagraph id="H05550146A73044B9BFA59563199F336F"><enum>(C)</enum><text display-inline="yes-display-inline">any amount excluded from gross income by reason of subsection (e)(2) shall be treated as tax exempt income for purposes of sections 705 and 1366. </text></subparagraph></paragraph><paragraph id="H2DFEF4803A8C4DDF855E11F4CA2EF6E3"><enum>(2)</enum><header>Coordination with application at partner or shareholder level</header><text>In the case of any partnership or S corporation, subsection (a) shall be applied at the partner or shareholder level after application of paragraph (1)(B).</text></paragraph><paragraph id="H94F1DBE11F8F41A2BCE357E5E09315A1"><enum>(3)</enum><header>Irrevocable election</header><text display-inline="yes-display-inline">Any election under this subsection shall be made not later than the due date (including extensions of time) for the partnership or S corporation return for the taxable year for which the applicable credit is determined. Any such election, once made, shall be irrevocable.</text></paragraph></subsection><subsection id="HBBC8F16F19B2482D9EB4B563F5B8065F"><enum>(c)</enum><header>Application to governmental entities</header><text>In the case of an election under this section—</text><paragraph id="HD1244E9AF0C8498F9049FC03E92589B9"><enum>(1)</enum><text>any State or local government, or a political subdivision thereof, or</text></paragraph><paragraph id="HCDDBB1935511450EA6537597642DA2AF"><enum>(2)</enum><text>an Indian tribal government (within the meaning of section 139E),</text></paragraph><continuation-text continuation-text-level="subsection">shall not fail to be treated as a taxpayer for purposes of this section and determining any applicable credit. </continuation-text></subsection><subsection id="H514EBF7898CB4347AD51FE1EE485CC66"><enum>(d)</enum><header>Applicable credit</header><text>For purposes of this section, the term <quote>applicable credit</quote> means each of the following credits determined with respect to the taxpayer:</text><paragraph id="HCEB3F0D96A6B439B8182012F8CD5557C"><enum>(1)</enum><text>The energy credit under section 48.</text></paragraph><paragraph id="HA487FEF39FFA43139A485F266FB7C31C"><enum>(2)</enum><text>The renewable electricity production credit under section 45.</text></paragraph></subsection><subsection id="HE86A792668F845658698D1F43568979A"><enum>(e)</enum><header>Special rules</header><paragraph id="HA653378FC4E2497A83B99060CE7E5E9A"><enum>(1)</enum><header>Denial of double benefit</header><text>Solely for purposes of section 38, in the case of a taxpayer making an election under this section with respect to any applicable credit, such credit shall be reduced by the amount of the portion of such credit with respect to which the taxpayer makes such election.</text></paragraph><paragraph id="HEFA36D9FBB804775B7C941DF16B31A38"><enum>(2)</enum><header>Exclusion from gross income</header><text>Gross income of the taxpayer shall be determined without regard to this section.</text></paragraph><paragraph id="HB06501AA5C9741F19009FA2798FD282D"><enum>(3)</enum><header>Timing of deemed payment</header><text>The payment described in subsection (a) shall be treated as made on—</text><subparagraph id="HFD985B4588EE4E2AB2A121F657C4830C"><enum>(A)</enum><text>in the case of any government, or political subdivision, to which paragraph (1) applies and for which no return is required under section 6011 or 6033(a), the later of the date that a return would be due under section 6033(a) if such government or subdivision were described in that section or the date on which such government or subdivision submits a claim for credit or refund (at such time and in such manner as the Secretary shall provide), and</text></subparagraph><subparagraph id="H614EAB8C9406417F97B73CB3ABC5A9CB"><enum>(B)</enum><text>in any other case, the later of the due date of the return of tax for the taxable year or the date on which such return is filed.</text></subparagraph></paragraph><paragraph id="HD9F9B6739EC54B1399CD452198DE35B2"><enum>(4)</enum><header>Waiver of special rules</header><text>In the case of an election under this section, the determination of any applicable credit shall be without regard to paragraphs (3) and (4)(A)(i) of section 50(b).</text></paragraph><paragraph id="HA7AAB76DD8104454A20091AF3D634956"><enum>(5)</enum><header>Treatment of payments to partnerships and S corporations</header><text display-inline="yes-display-inline">For purposes of section 1324 of title 31, United States Code, the payments under subsection (b)(1)(B) shall be treated in the same manner as a refund due from a credit provision referred to in subsection (b)(2) of such section.</text></paragraph></subsection><subsection id="H5C27561245E842448B713317757CF67A"><enum>(f)</enum><header>Regulations</header><text>The Secretary shall issue such regulations or other guidance as may be necessary or appropriate to carry out the purposes of this section, including regulations or other guidance providing rules for determining a partner’s distributive share of the tax exempt income described in subsection (b)(1)(C).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HACD31BC572F845068CB96D9A443630F4"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for subchapter B of chapter 65 of such Code is amended by adding at the end the following new item:</text><quoted-block id="HDAA5E22D452A472EB7D6843D81F6E026" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 6431. Elective payment for energy property and electricity produced from certain renewable resources, etc.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0E1C02DF0E604413AAFD4AC61FB652F5"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to property originally placed in service after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
