which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the President to appoint a Medical Supplies Response Coordinator to coordinate the efforts of the Federal Government regarding the supply and distribution of certain supplies and equipment relating to COVID–19.</official-title></form><legis-body id="HBEC3D54257434FE2B35C06D67BB7A282" style="OLC"><section id="HD32909C6F2344DA28119AC7ADF913899" section-type="section-one"><enum>1.</enum><header>Medical Supplies Response Coordinator</header><subsection id="H0EDE9201975A4368AC9A88D5FFF5313B"><enum>(a)</enum><header>In general</header><text>The President shall appoint a Medical Supplies Response Coordinator to coordinate the efforts of the Federal Government regarding the supply and distribution of critical medical supplies and equipment related to detecting, diagnosing, preventing, and treating COVID–19, including personal protective equipment, medical devices, drugs, and vaccines.</text></subsection><subsection id="HD5268063B24E492B91E320A2337D5E6B"><enum>(b)</enum><header>Qualifications</header><text display-inline="yes-display-inline">To qualify to be appointed as the Medical Supplies Response Coordinator, an individual shall be a senior government official with—</text><paragraph id="H1A942548BB6F4036A054BB2A63E39FF0"><enum>(1)</enum><text>health care training, including training related to infectious diseases or hazardous exposures; and</text></paragraph><paragraph id="H04926DEAB1DB4CC29BA47F23E89394C3"><enum>(2)</enum><text>a familiarity with medical supply chain logistics.</text></paragraph></subsection><subsection id="H8E46E4F665C24FA0AD59E4D4949C2F57"><enum>(c)</enum><header>Activities</header><text>The Medical Supplies Response Coordinator shall—</text><paragraph id="H94DC74A8D3C44B55840A88A4C11CBB9A"><enum>(1)</enum><text display-inline="yes-display-inline">consult with State, local, territorial, and Tribal officials to ensure that health care facilities and health care workers have sufficient personal protective equipment and other medical supplies;</text></paragraph><paragraph id="H74E5515C34D6420CAA34B54D77ABF486"><enum>(2)</enum><text display-inline="yes-display-inline">evaluate ongoing needs of States, localities, territories, Tribes, health care facilities, and health care workers to determine the need for critical medical supplies and equipment;</text></paragraph><paragraph id="H89D8620B04F14E109B15C271914B207E"><enum>(3)</enum><text display-inline="yes-display-inline">serve as a point of contact for industry for procurement and distribution of critical medical supplies and equipment, including personal protective equipment, medical devices, testing supplies, drugs, and vaccines;</text></paragraph><paragraph id="HC558ABD7110E415EA05531B6D4F7E5C5"><enum>(4)</enum><text display-inline="yes-display-inline">procure and distribute critical medical supplies and equipment, including personal protective equipment, medical devices, testing supplies, drugs, and vaccines;</text></paragraph><paragraph id="H65780154F17A432B995BCB84CE76C427"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5E468EEA03D745B99826B59087385522"><enum>(A)</enum><text>establish and maintain an up-to-date national database of hospital capacity, including beds, ventilators, and supplies, including personal protective equipment, medical devices, drugs, and vaccines; and</text></subparagraph><subparagraph id="H0FFC0AF35E714B1A876907FF5E82714B" indent="up1"><enum>(B)</enum><text>provide weekly reports to the Congress on gaps in such capacity and progress made toward closing the gaps;</text></subparagraph></paragraph><paragraph id="H10149B7DC2304638B7DA0D18BC3FDE4D"><enum>(6)</enum><text display-inline="yes-display-inline">require, as necessary, industry reporting on production and distribution of personal protective equipment, medical devices, testing supplies, drugs, and vaccines and assess financial penalties as may be specified by the Medical Supplies Response Coordinator for failure to comply with such requirements<italic></italic> for reporting on production and distribution;</text></paragraph><paragraph id="H6693FBE32B844996BFC47AA0F2D032A9"><enum>(7)</enum><text>consult with the Secretary and the Administrator of the Federal Emergency Management Agency, as applicable, to ensure sufficient production levels under the Defense Production Act (<external-xref legal-doc="usc" parsable-cite="usc/50/4501">50 U.S.C. 4501</external-xref> et seq.); and</text></paragraph><paragraph id="HF1BCF5344A124C9DB7C9650EE99F49CB"><enum>(8)</enum><text display-inline="yes-display-inline">monitor the prices of critical medical supplies and equipment, including personal protective equipment and medical devices, drugs, and vaccines related to detecting, diagnosing, preventing, and treating COVID–19 and report any suspected price gouging of such materials to the Federal Trade Commission and appropriate law enforcement officials.</text></paragraph></subsection></section></legis-body></bill>
