R. 3164</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210512">May 12, 2021</action-date><action-desc><sponsor name-id="R000577">Mr. Ryan</sponsor> (for himself and <cosponsor name-id="S001145">Ms. Schakowsky</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Transportation to issue a rule that requires all new passenger motor vehicles to be equipped with a child safety alert system, and for other purposes.</official-title></form><legis-body id="HE95CFA91A6274A4BB56615FBFB993C27" style="OLC"><section id="HB7B29F24647E4567A88E1F4A9CD1BD31" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hot Cars Act of 2021</short-title></quote>.</text></section><section id="HB5A2CD05E8424BD29800F37E846E5356" commented="no"><enum>2.</enum><header>Findings and purpose</header><subsection id="H3042E3D4A7D54EE8AEF188AFC6B9589B" commented="no"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="H50DD7B24AE93447092946F3143445792"><enum>(1)</enum><text>Children and pets left unattended in vehicles, or children independently accessing unoccupied vehicles, are a significant public health and safety problem.</text></paragraph><paragraph id="H3EFFC44F37B24B71B2BAF6672F942896"><enum>(2)</enum><text>Millions of children are transported every day in the back seat of vehicles and are at risk of being unknowingly left behind and dying or suffering serious injuries from heatstroke.</text></paragraph><paragraph id="HE0C1869C03024A3C94A140BDBE068D07"><enum>(3)</enum><text>Data collected by KidsAndCars.org found information about at least 8,000 children left alone in hot cars or as a result of gaining access independently into unoccupied cars between 1990 and 2020. Of those, over 990 children have been killed due to heatstroke and more than 1,200 children were injured.</text></paragraph><paragraph id="H64FF58418E0448E98570C91E0092AECB"><enum>(4)</enum><text>Over the past 30 years, child hot car deaths have continued to trend upwards despite widespread education programs and public awareness.</text></paragraph><paragraph id="HF2F6CB658678499BABFBE415497EC478"><enum>(5)</enum><text>Inexpensive technology is currently available to detect the presence of an occupant unattended in a vehicle and engage a warning.</text></paragraph></subsection><subsection id="HB4F8635A71AF49ABB9CCB2855DAB4247" commented="no"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to reduce the deaths and injuries that result from occupants being left unattended in vehicles and instances in which children independently access an unoccupied vehicle.</text></subsection></section><section id="HD7F35B9F26EF46A2A59F06A2E1FBCC7D"><enum>3.</enum><header>Safety warning for occupants of hot cars</header><subsection id="H520819362D224353B66B07945AA6899D"><enum>(a)</enum><header>Occupant safety</header><paragraph id="H5CE6ED42B1164A949E7350E3DF8665F6"><enum>(1)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">Chapter 301</external-xref> of title 49, United States Code, is amended by adding at the end the following new section:</text><quoted-block id="HCFBA5BC9D71F440E8DAFCCE7323202C5" style="USC"><section id="H1C5569E7F74141A286E154EABFEBB583"><enum>30129.</enum><header>Occupant safety</header><subsection id="HA8F3F3B1D6C74F13AECA1DA435C9FA35"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H51539F00522C4B35803DD22DF65BFBC9"><enum>(1)</enum><header>Passenger motor vehicle</header><text>The term <term>passenger motor vehicle</term> has the meaning given that term in section 32101.</text></paragraph><paragraph id="H0BC158FC726C414CB9E3A3CD9332F95E"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection id="H82308B76FB2548A39B6F65F09146B4E7"><enum>(b)</enum><header>Rulemaking</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall issue a final rule prescribing a motor vehicle safety standard that requires all new passenger motor vehicles with a gross vehicle weight rating of 10,000 pounds or less to be equipped with a system that detects the presence of an unattended occupant in the passenger compartment of the vehicle and engages a warning to reduce death and injury resulting from vehicular heatstroke, particularly incidents involving children.</text></subsection><subsection id="H616C793205324A65B3585FD7CA545902"><enum>(c)</enum><header>Limitation on capability of being disabled</header><text>The motor vehicle safety standard prescribed under subsection (b) shall require that the system described in that subsection cannot be disabled, overridden, reset, or recalibrated in such a way that the system will no longer detect the presence of an unattended occupant in the passenger compartment of the vehicle and engage a warning.</text></subsection><subsection id="H45699C50D64D4B099B77177FCF3B4C5D"><enum>(d)</enum><header>Means</header><paragraph id="H2401A4E7F6F74EF885D8B8A65CF10E45"><enum>(1)</enum><header>In general</header><text>The warning required under the motor vehicle safety standard prescribed under subsection (b) shall include a distinct auditory and visual warning to notify individuals inside and outside of the vehicle of the presence of an unattended occupant, which shall be combined with an interior haptic warning.</text></paragraph><paragraph id="H681A69A6A96349FCA6325AF41DBECC6B"><enum>(2)</enum><header>Consideration</header><text>In developing such warning, the Secretary shall also consider including a secondary additional warning to—</text><subparagraph id="HEB08469A1940439993CB38F0F63A8176"><enum>(A)</enum><text>notify—</text><clause id="H5F97A47B00244CA88A9A66BA5296E0B8"><enum>(i)</enum><text>operators that are not in close proximity to the vehicle; and</text></clause><clause id="H593C9CBDD9ED4768906F30D573FFC630"><enum>(ii)</enum><text>emergency responders; and</text></clause></subparagraph><subparagraph id="HB4047DFE4576452FB574C062B28D0D13"><enum>(B)</enum><text>provide the geographical location of the vehicle in a manner that allows for an emergency response.</text></subparagraph></paragraph></subsection><subsection id="H755C4FD31AB947D9B2CD9780BC531282"><enum>(e)</enum><header>Compliance deadline</header><text>The rule issued pursuant to subsection (b) shall require full compliance with the motor vehicle safety standard prescribed in the rule not later than 2 years after the date on which the final rule is issued.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC25C23047DCE4A8891825CADD8B3C3EF"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by adding at the end the following new item:</text><quoted-block id="HE25269924F1B4C69853F66F9B8C93EBF" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">30129. Occupant safety.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4CAAA523A43943C2BC2B6B2AA1F334E3"><enum>(b)</enum><header>Study</header><paragraph id="HE05ED2A7359C4B068565CF33E6E3A730"><enum>(1)</enum><header>Independent study</header><subparagraph id="H67BC89810B2F4633918317C05A8B1360"><enum>(A)</enum><header>Contract</header><text>Not later than 90 days after the date on which a final rule is issued pursuant to section 30129(b) of title 49, United States Code, as added by subsection (a)(1), and every two years thereafter, the Secretary shall enter into a contract with an independent third party to conduct the study described under subparagraph (B).</text></subparagraph><subparagraph id="HF8C48E822CAB425FA9F5DA100A3C0022"><enum>(B)</enum><header>Study</header><clause id="H0C5C7295860949CA9C88B9487A1D5AF5"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Under the contract between the Secretary and an independent third party under subparagraph (A), the independent third party shall carry out a study on retrofitting passenger motor vehicles introduced into interstate commerce before the effective date of the rule required pursuant to section 30129(b) of title 49, United States Code, as added by subsection (a)(1), with technologies and products that meet the safety need addressed by the motor vehicle safety standard prescribed under such section.</text></clause><clause id="HE67B202BD5AB461B9175DDF8E7A932CD"><enum>(ii)</enum><header>Elements</header><text>In carrying out the study required under clause (i), the independent third party shall—</text><subclause id="H3A63CB6337754B5EB8249244647CC849"><enum>(I)</enum><text>identify technologies and products—</text><item id="H5141A78B00574A659014A201099EBB42"><enum>(aa)</enum><text display-inline="yes-display-inline">manufactured for use in passenger motor vehicles introduced into interstate commerce before the effective date of the rule required by section 30129(b) of title 49, United States Code, as added by subsection (a)(1); and</text></item><item id="H703DDFA71D034FB18CB4A92F8210829A"><enum>(bb)</enum><text>that reduce death and injury resulting from vehicular heatstroke, particularly incidents involving children; and</text></item></subclause><subclause id="HB27F9409929A4CCF908744C88BC83509"><enum>(II)</enum><text>make recommendations for manufacturers of such technologies and products to undergo a functional safety performance assessment to ensure that the technologies and products perform as designed by the manufacturer under a variety of real-world conditions.</text></subclause></clause></subparagraph></paragraph><paragraph id="H97E72552F7D04BC396D921B9807089B1"><enum>(2)</enum><header>Publication; public comment</header><text>Not later than 2 years after the date on which the Secretary enters into a contract pursuant to paragraph (1)(A), and every two years thereafter, the Secretary shall—</text><subparagraph id="HC1959423FA4246D8AE8407B71B52952E"><enum>(A)</enum><text>publish the study required under paragraph (1)(B) in the Federal Register; and</text></subparagraph><subparagraph id="H9B7123415A244AE7B8712FC14665C18B"><enum>(B)</enum><text>provide a period for public comment of not longer than 90 days after the date on which the study is published pursuant to subparagraph (A).</text></subparagraph></paragraph><paragraph id="H480B3FD0A1F747A885F16B9C03B5DFBB"><enum>(3)</enum><header>Consumer information</header><text display-inline="yes-display-inline">Not later than 120 days after expiration of the public comment period described under paragraph (2)(B) and upon review of the public comments, the Secretary shall provide information for consumers through the website of the National Highway Traffic Safety Administration on the performance of the technologies and products described in paragraph (1)(B)(ii) to retrofit existing vehicles.</text></paragraph><paragraph id="H9CE468D961EB41A3B7001FAC3297DFEC"><enum>(4)</enum><header>Submission to Congress</header><text>Upon issuance of the recommendations required under paragraph (1)(B), the Secretary shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives the study and recommendations required by paragraph (1)(B), including any public comment received under paragraph (2)(B).</text></paragraph><paragraph id="H2CD3C5188D0A4019AF137CF5CCCC9825"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H36E21ED39165435680E5C38BD2CC4CA0"><enum>(A)</enum><header>Child restraint system</header><text>The term <term>child restraint system</term> has the meaning given that term in section 571.213 of title 49, Code of Federal Regulations (or any successor regulation).</text></subparagraph><subparagraph id="HAE73F3CF09924C7B9E3A183BA04DA3ED"><enum>(B)</enum><header>Independent third party</header><text>The term <term>independent third party</term> means a manufacturer (as defined in section 30102 of title 49, Code of Federal Regulations (or any successor regulation)) that does not receive any direct financial assistance from an entity that produces or supplies—</text><clause id="HE9E2321DCB714F00B198B36632573CB3"><enum>(i)</enum><text>equipment for the systems mandated in such section 30129; or</text></clause><clause id="H03173A34C1684724AFA5784D84E4A25D"><enum>(ii)</enum><text>child restraint systems.</text></clause></subparagraph><subparagraph id="H61FD86B0487741B7B8AF5B6A10B661F2"><enum>(C)</enum><header>Passenger motor vehicle</header><text>The term <term>passenger motor vehicle</term> has the meaning given that term in section 32101 of title 49, United States Code.</text></subparagraph><subparagraph id="H79B1B8225D3F49FEA3C42C2A701FED45"><enum>(D)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
