which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a pilot program to enhance the mapping of urban flooding and associated property damage and the availability of such mapped data to homeowners, businesses, and localities to help understand and mitigate the risk of such flooding, and for other purposes.</official-title></form><legis-body id="HC8B3AC41758A4461A8FA417754CC20C1" style="OLC"><section id="H25E667D04AFE4FE1AD6F2BE685F1BC34" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flood Mapping Modernization and Homeowner Empowerment Pilot Program Act of 2021</short-title></quote>.</text></section><section id="HBAC44BC578EC4F2B86B28EA0F4251160"><enum>2.</enum><header>Flood mapping modernization and homeowner empowerment pilot program</header><subsection id="H67C7898922A64119985DC1F85C73B4CE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency Management Agency shall carry out a pilot program to make grants to units of local government to enhance the mapping of urban flooding and associated property damage and the availability of such mapped data to homeowners, businesses, and units of local government to enable them to minimize the risk of such flooding.</text></subsection><subsection id="H0CA532B833EC43329A3985C21A8A02EE"><enum>(b)</enum><header>Objectives</header><text>Amounts from grants made under the pilot program under this section may be used only to carry out activities to meet the following objectives:</text><paragraph id="HE09510EB1AF04A6CB88EBD8B22EDBC42"><enum>(1)</enum><text>To develop a methodology for assessing urban flood risk through the deployment of technology-based mapping tools that are easily understandable by the public and effectively convey information regarding the level of flood risk.</text></paragraph><paragraph id="H99F7CA96AC684A37AACC03275E499E8D"><enum>(2)</enum><text>To provide structure-specific projections of annual chance flood frequency.</text></paragraph><paragraph id="H18697F95AC8A4CB6B9E1D302A79350F4"><enum>(3)</enum><text>To provide structure-based flood-risk assessments.</text></paragraph><paragraph id="H772BE0D9A01B4347874D738596BF0C74"><enum>(4)</enum><text>To provide urban flood-risk mitigation program design.</text></paragraph><paragraph id="H2011EE9D494D42BEA991F18AB4B0779B"><enum>(5)</enum><text>To incorporate information regarding climate trends into urban flooding risk assessments.</text></paragraph><paragraph id="HB3FBCBE3E5E14E5CB9FDC96D49627BEC"><enum>(6)</enum><text>To make the information described in this subsection publicly available on the internet through a web-based portal so as to increase transparency regarding homeowner flood risks.</text></paragraph></subsection><subsection id="H7A6252E6D41A4347B6FBE40FBE004636"><enum>(c)</enum><header>Eligible recipients</header><paragraph id="H30C28E21495B42D5AD0BB8FCF7AF4759"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Grants under the pilot program under this section may be made only to units of general local government located in a urbanized areas, as such term is used by the Bureau of the Census of the Department of Commerce, having populations exceeding 50,000 or to stormwater management authorities of such units of general local government.</text></paragraph><paragraph id="H1BE9832394D9480E9BFCEEA877B21E65"><enum>(2)</enum><header>One-time grants</header><text display-inline="yes-display-inline">A grant under the pilot program under this section may not be made to—</text><subparagraph id="H834CEC6E25964A2BAA8FCB3C6AB52B43"><enum>(A)</enum><text>any unit of general local governmental, or stormwater management authority of a unit of general government, that has previously received a grant under the pilot program;</text></subparagraph><subparagraph commented="no" id="HE1407C42F6F94559873B2ADB18E36FB6"><enum>(B)</enum><text display-inline="yes-display-inline">any unit of general local government if the stormwater management agency for such unit has previously received a grant under the pilot program; or</text></subparagraph><subparagraph commented="no" id="HF6534619FCAC474DB15DC1DB0CE0A214"><enum>(C)</enum><text display-inline="yes-display-inline">any stormwater management agency of a unit of general local government if such unit has previously received a grant under the pilot program.</text></subparagraph></paragraph><paragraph id="HBB9EF2FE0492428C81417DDFE7C47E81"><enum>(3)</enum><header>Treatment of stormwater management authorities</header><text display-inline="yes-display-inline">In the case of a stormwater management authority that operates with respect to more than one unit of general local government, the application of such authority shall be considered for purposes of paragraph (2) of this subsection and subsections (e), (f), and (g)(1) to be made for the largest unit of general local government for which such authority operates. The preceding sentence shall not limit the ability of such authority to carry out activities under the demonstration project in any other jurisdictions or unit of local government with respect to which the authority operates.</text></paragraph></subsection><subsection id="HC44F2CBBA9C84556B34BF6519A513D29"><enum>(d)</enum><header>Applications</header><text>To be eligible for a grant under this section a unit of general local government or storm­wa­ter management agency shall submit to the Administrator an application in such form and containing such information as the Administrator shall require.</text></subsection><subsection id="H87FCA53526CC4BA6B708D364830E5B39"><enum>(e)</enum><header>Selection of recipients</header><paragraph id="H1AC4B9137F254E7D87E21346D37CC6C1"><enum>(1)</enum><header>Annual selection</header><text display-inline="yes-display-inline">Subject to paragraph (2) and to the submission of approvable applications, in each fiscal year for which amounts are made available for grants under the pilot program under this section the Administrator shall select, from among applications submitted under subsection (d) for such fiscal year, 3 units of general government or stormwater management authorities to receive grants under the pilot program under this section.</text></paragraph><paragraph id="HE419D7E252D347568696D5780E8E6F2F"><enum>(2)</enum><header>Aggregate limit</header><text display-inline="yes-display-inline">Subject only to the submission of approvable applications, the Administrator shall select, in the aggregate over the entire duration of the pilot program under this section, 12 units of general government or stormwater management authorities to receive grants under the pilot program, as follows:</text><subparagraph id="H66A14AA5642140D0B432550DC5C7A1E0"><enum>(A)</enum><header>Tier 1</header><text>Three of the applicants selected shall be units of general local government, or stormwater management authorities for such units, having a population exceeding 800,000, as follows:</text><clause id="H46A70F0189B34FC5A6E408981B219AAD"><enum>(i)</enum><header>Pelagic coastal city</header><text display-inline="yes-display-inline">One shall be a unit of general local government, or stormwater authority for such a unit, that is a pelagic unit.</text></clause><clause id="HB974322FD73D48E38672EB31F508683A"><enum>(ii)</enum><header>Non-pelagic coastal city</header><text display-inline="yes-display-inline">One shall be unit of general local government, or stormwater authority for such a unit, that is a coastal unit, but not a pelagic unit.</text></clause><clause id="H7F7089B8AD87440394C7EF2D65C1DC6F"><enum>(iii)</enum><header>Non-coastal city</header><text display-inline="yes-display-inline">One shall be unit of general local government, or stormwater authority for such a unit, that is not a coastal unit.</text></clause></subparagraph><subparagraph id="H3A1ECBE3DA3D47F88FA76D4A84DC69F3"><enum>(B)</enum><header>Tier 2</header><text display-inline="yes-display-inline">Six of the applicants selected shall be units of general local government, or stormwater management authorities for such units, having a population exceeding 200,000 but not exceeding 800,000, as follows:</text><clause id="HEE0DA19C6454473987AABDFDFF846747"><enum>(i)</enum><header>Coastal cities</header><text display-inline="yes-display-inline">Three shall be units of general local government, or stormwater management authorities for such units, that are coastal units.</text></clause><clause id="H003CAD74050D4C1E8FC9618321D08FE6"><enum>(ii)</enum><header>Non-coastal cities</header><text display-inline="yes-display-inline">Three shall be units of general local government, or stormwater management authorities for such units, that are not coastal units.</text></clause></subparagraph><subparagraph id="HD6ACDECE6934474A90D1E0D223A12D1D"><enum>(C)</enum><header>Tier 3</header><text display-inline="yes-display-inline">Three of the applicants selected shall be units of general local government, or stormwater management authorities for such units, having a population exceeding 50,000 but not exceeding 200,000.</text></subparagraph></paragraph></subsection><subsection id="HC04A4A955F63457596C655B1B4281D0C"><enum>(f)</enum><header>Priority</header><paragraph id="HAC40ADDAEBE64517B1F4334B009D64DA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall select applicants for grants under the pilot program under this section based on the extent to which their applications will achieve the objectives set forth in subsection (b).</text></paragraph><paragraph id="HAA09F5994ADE43EEB64F1D1092208AB8"><enum>(2)</enum><header>Tiers 2 and 3</header><text display-inline="yes-display-inline">In selecting applicants to receive grants under the pilot program under this section pursuant to subparagraphs (B) and (C) of subsection (e)(2), the Administrator shall give priority to applicants—</text><subparagraph id="HA5649C024EA14A3698110265D9469394"><enum>(A)</enum><text>that are highly vulnerable to sea level rise;</text></subparagraph><subparagraph id="H456536B3F9444D1FAF7271C14D3B8D26"><enum>(B)</enum><text>within which are located a military installation or other facility relating to national security concerns; or</text></subparagraph><subparagraph id="HB6499B11FDBC40BF9BD6519AC8D67FD3"><enum>(C)</enum><text>that have a population that is highly vulnerable to urban flooding and have an uneven capacity for flood mitigation and response efforts resulting from socioeconomic factors.</text></subparagraph></paragraph></subsection><subsection id="H2431A362DCD64FF39AF945F3C1468F82"><enum>(g)</enum><header>Amount</header><paragraph id="HE6F868D44FBA43E39EFB2DBE21748502"><enum>(1)</enum><header>Considerations</header><text display-inline="yes-display-inline">In determining the amount of grant under the pilot program under this section, the Administrator shall consider the population of the grant recipient, which may be considered in terms of the tier under subsection (e)(2) of the recipient.</text></paragraph><paragraph id="H64C56326ECCF4982A8C946CA47993BB7"><enum>(2)</enum><header>Federal share</header><text display-inline="yes-display-inline">The amount of a grant under the pilot program under this section may not exceed 75 percent of the total cost of the activities under subsection (b) to be carried out using the grant amounts.</text></paragraph></subsection><subsection id="H4B018A0F515F4367A1DE083DE8ABCE75"><enum>(h)</enum><header>Duration</header><text display-inline="yes-display-inline">The Administrator shall require each recipient of a grant under the pilot program under this section to complete the activities under subsection (b) to be carried out using the grant amounts before the expiration of the 18-month period beginning upon the initial receipt of grant amounts under the pilot program.</text></subsection><subsection id="HE01B69436F984A039B9666174B786C13"><enum>(i)</enum><header>Use of census data</header><text display-inline="yes-display-inline">The Administrator shall make all determinations under the pilot program regarding population using the most recent available data from the decennial census.</text></subsection><subsection id="H4AECDBD013994542839994BBF6C48037"><enum>(j)</enum><header>Grantee reports to FEMA</header><text>Each recipient of a grant under the pilot program under this section shall, not later than the expiration of the 30-month period beginning upon the initial receipt of any such grant amounts, submit to the Administrator a report that describes—</text><paragraph commented="no" id="HA0CF7953D99D4CE9A5B026957A0EE69D"><enum>(1)</enum><text display-inline="yes-display-inline">the activities carried out with amounts from the grant;</text></paragraph><paragraph id="H6EBC82B534B742919F5D19C419E06B8F"><enum>(2)</enum><text>how the activities carried out with such grant amounts have met the objectives described in subsection (b); and</text></paragraph><paragraph id="H51B67C442ABD4BE8815742647386AD78"><enum>(3)</enum><text>any lessons learned in carrying out such activities and any recommendations for future mapping modernization efforts by the Federal Emergency Management Agency.</text></paragraph></subsection><subsection id="H5873A655F7D647A487CC82952858FB27"><enum>(k)</enum><header>Biennial reports by FEMA</header><text>Not later than the expiration of the 24-month period beginning on the date of the enactment of this Act, and not later than the expiration of each successive 24-month period thereafter until the completion of all activities carried out with amounts from grants under the pilot program under this section, the Administrator shall submit to the Congress and make available to the public on an internet website a report that—</text><paragraph id="H47E5CFCAE2FF499D98331754DB1FD8A1"><enum>(1)</enum><text>describes—</text><subparagraph id="H2250F6E7FFAA4B029E640762F9BCCFAE"><enum>(A)</enum><text>the progress of the activities carried out with amounts from such grants; and</text></subparagraph><subparagraph id="H13EE2264EEA44C7BB8E5B9B3E3F4488E"><enum>(B)</enum><text>the effectiveness of technology-based mapping tools used in carrying out the activities described in subparagraph (A); and</text></subparagraph></paragraph><paragraph id="H95084FB43B5446A380053D9AF1B7E4F3"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to the final report that the Administrator is required to submit under this subsection, includes recommendations to the Congress and the executive branch of the Federal Government for implementing strategies, practices, and technologies to mitigate the effects of urban flooding.</text></paragraph></subsection><subsection id="H3447552D34CC40D4A36E7FB802DC7688"><enum>(l)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that, because the pilot program is limited with respect to scope and resources, communities that participate in the pilot program should acknowledge that the most successful efforts to mitigate the effects of urban flooding—</text><paragraph id="H8E6BF0D45E9D4D158F7B7608E8A0DCA0"><enum>(1)</enum><text>take a structural-based mitigation approach with respect to construction, which includes—</text><subparagraph id="H60FD00682688491EAAB876FB21AE9D06"><enum>(A)</enum><text>recognizing any post-storm damage that may occur; and</text></subparagraph><subparagraph id="H55B34EF05E8C4EB393B4C33FC1FE65FF"><enum>(B)</enum><text>pursuing designs that proactively minimize future flood damage;</text></subparagraph></paragraph><paragraph id="H5D8B805A1E5F4431AC85953420367304"><enum>(2)</enum><text>make individuals in the community aware, through any cost-effective and available means of education, of the best approaches regarding the construction of properties that are able to survive floods, which reduces the cost of future repairs; and</text></paragraph><paragraph id="H4F5489A86B2F4553A65831278FB690F5"><enum>(3)</enum><text>encourage home and property owners to consider the measures described in paragraphs (1) and (2), which are the most cost-effective and prudent ways to reduce the impact of flooding, when constructing or renovating building components.</text></paragraph></subsection><subsection id="HF638260D93B64FE0B4F2E911673EF103"><enum>(m)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text><paragraph id="H315CFF545BFD4C20AD01DBB140405944"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="H6E17E1DE361F4E0F8D822EFB6D6020CD"><enum>(2)</enum><header>Coastal</header><text display-inline="yes-display-inline">The term <quote>coastal</quote> means, with respect to a unit of general local government, that the unit borders a body of water that—</text><subparagraph id="H3DB0B5EFD09F47AF99A0B3AF5D12A6F5"><enum>(A)</enum><text>exceeds 2,000 square miles in size; and</text></subparagraph><subparagraph id="HF755AF96A17E4B31980EB8CDCA95F6E5"><enum>(B)</enum><text>is not a river.</text></subparagraph></paragraph><paragraph id="H85848B8958C247C3B85E46C8E6E0AE30"><enum>(3)</enum><header>Pelagic</header><text display-inline="yes-display-inline">The term <quote>pelagic</quote> means, with respect to a unit of general local government, that the unit is a coastal unit and the body of water that the unit borders is an ocean or other large, open body of water (including bays and gulfs) that empties into an ocean.</text></paragraph><paragraph id="HB5DBCF234628465DA3F109ED5CADA85D"><enum>(4)</enum><header>Urban flooding</header><subparagraph id="HC2B7D6BEA2F14B04817928228F36EB5D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>urban flooding</quote> means the inundation of property in a built environment, particularly in more densely populated areas, caused either by falling rain collecting on impervious surfaces or increasing the levels of nearby water bodies and overwhelming the capacity of drainage systems, such as storm sewers, including—</text><clause id="H9D81E7DEED9741D0A1C6043FBC6A2887"><enum>(i)</enum><text>situations in which stormwater enters buildings through windows, doors, or other openings;</text></clause><clause id="HC4FA203D8B71415281826FF1A9A4E22C"><enum>(ii)</enum><text>water backup through sewer pipes, showers, toilets, sinks, and floor drains;</text></clause><clause id="HE5427074C75047F9ACB58CFAF46D2DEC"><enum>(iii)</enum><text>seepage through walls and floors;</text></clause><clause id="HF9FBBAB115C245FDB3C0FDF4E5A6D601"><enum>(iv)</enum><text>the accumulation of water on property or public rights-of-way; and</text></clause><clause id="HF1A07BAFF0CB4559BFD13DE5A250BA0A"><enum>(v)</enum><text>the overflow from water bodies, such as rivers, lakes, and oceans.</text></clause></subparagraph><subparagraph id="HA9DFDF1B035747268869F7D9B8FDB919"><enum>(B)</enum><header>Exclusion</header><text>Such term does not include flooding in undeveloped or agricultural areas.</text></subparagraph></paragraph></subsection><subsection id="H32870EB46D2D4E5CBE3BDE6AB6541DE6"><enum>(n)</enum><header>Funding</header><text>There is authorized to be appropriated for grants under the pilot program under this section—</text><paragraph id="HC9A64456660843B093B6DA3EFEDDE662"><enum>(1)</enum><text>$1,200,000 for fiscal year 2022; and</text></paragraph><paragraph id="HA4602D9E2F414C3BA193CCCA50CC8178"><enum>(2)</enum><text>$4,300,000 for fiscal year 2023, to remain available through 2025.</text></paragraph></subsection></section></legis-body></bill>
