R. 3155</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210512">May 12, 2021</action-date><action-desc><sponsor name-id="L000590">Mrs. Lee of Nevada</sponsor> (for herself, <cosponsor name-id="S001212">Mr. Stauber</cosponsor>, <cosponsor name-id="A000378">Mrs. Axne</cosponsor>, <cosponsor name-id="M001194">Mr. Moolenaar</cosponsor>, <cosponsor name-id="W000826">Ms. Wild</cosponsor>, <cosponsor name-id="T000479">Mr. Taylor</cosponsor>, <cosponsor name-id="L000557">Mr. Larson of Connecticut</cosponsor>, <cosponsor name-id="D000619">Mr. Rodney Davis of Illinois</cosponsor>, and <cosponsor name-id="H001088">Mr. Hagedorn</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To allow nonprofit child care providers to participate in the loan programs of the Small Business Administration.</official-title></form><legis-body id="HC5B64F44AC544868B96771AC7AFE2DCE" style="OLC"><section section-type="section-one" id="H583CC6CABAF94369A343D36499AD1306"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Child Care Investment Act</short-title></quote>.</text></section><section id="H67FFBC6289B749D78B207C31864AFD18"><enum>2.</enum><header>Small business loans for nonprofit child care providers</header><text display-inline="no-display-inline">Section 3(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE593DDC6E6334DA18CA4744A63B9E134"><paragraph id="H7AFD1C6A51424782A8A27E8BFF5736C2"><enum>(10)</enum><header>Nonprofit child care providers</header><subparagraph id="HE2C2857C40804C0695C95BE1ADF03ACF"><enum>(A)</enum><header>Definition</header><text>In this paragraph, the term <term>covered nonprofit child care provider</term> means an organization—</text><clause id="H3B699A076746428C8DB1FB4153FFB0C0"><enum>(i)</enum><text>that—</text><subclause id="H902679FC18D6464DBC811221BB81F2C1"><enum>(I)</enum><text>is in compliance with licensing requirements for child care providers of the State in which the organization is located;</text></subclause><subclause id="HEFD81D7E57BA4BB89B841D528A2F48D6"><enum>(II)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code; and</text></subclause><subclause id="H6F8C7F1ED72A4E52A0DBC3BAB04567D2"><enum>(III)</enum><text>is primarily engaged in providing child care for children from birth to compulsory school age;</text></subclause></clause><clause id="HBF2EA27AC17D47EA8A41C0D32162617B"><enum>(ii)</enum><text>for which each employee and regular volunteer complies with the criminal background check requirements under section 658H(b) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858f">42 U.S.C. 9858f(b)</external-xref>); and</text></clause><clause id="H164AE6C2692D4745B044BC4125EBABDC"><enum>(iii)</enum><text>that may—</text><subclause id="HF6F61063D132433E969E3DCA24F44FCF"><enum>(I)</enum><text>provide care for school-age children outside of school hours or outside of the school year; or</text></subclause><subclause id="HFCCD749B0EEE4D7E8EC7AF317460D71D"><enum>(II)</enum><text>offer preschool or prekindergarten educational programs.</text></subclause></clause></subparagraph><subparagraph id="H67067361054C463D9EC56E1188ABA4A8"><enum>(B)</enum><header>Eligibility for loan programs</header><text>Notwithstanding any other provision of this subsection, a covered nonprofit child care provider shall be deemed to be a small business concern for purposes of any program under this Act or the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/661">15 U.S.C. 661</external-xref> et seq.) under which—</text><clause id="HCE32A6ED709347528664F7E71071AA5A"><enum>(i)</enum><text>the Administrator may make loans to small business concerns;</text></clause><clause id="H217C4B58C11947E6A10C49489DC5A25F"><enum>(ii)</enum><text>the Administrator may guarantee timely payment of loans to small business concerns; or</text></clause><clause id="H07F67084AEB7454486816B2ADF57A2B6"><enum>(iii)</enum><text>the recipient of a loan made or guaranteed by the Administrator may make loans to small business concerns.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
