R. 3148</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210512">May 12, 2021</action-date><action-desc><sponsor name-id="J000020">Mr. Jacobs of New York</sponsor> (for himself, <cosponsor name-id="J000301">Mr. Johnson of South Dakota</cosponsor>, and <cosponsor name-id="M000871">Mr. Mann</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Coronavirus Aid, Relief, and Economic Security Act to require States to impose certain requirements on individuals seeking pandemic unemployment assistance, and for other purposes.</official-title></form><legis-body id="H74C35818130D46A4BBD47DC38061F928" style="OLC"><section id="H3561FF5CDC7B49999892CB2846418892" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help Wanted Act</short-title></quote>. </text></section><section id="HEFE3001724EE429787947DB9DCF56808"><enum>2.</enum><header>Reinstating State work requirements</header><subsection id="H3A505ADDBB1B44A68C68BF1D16CD2204"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle A of title II of division A of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H51881FCADF194DE59D4A0E9119594B1C" display-inline="no-display-inline"><section id="HBDFE601061C548A393DFDA1C72187DA5"><enum>2119.</enum><header>State work requirements</header><text display-inline="no-display-inline">As a condition of any agreement under section 2102(f), section 2104(a), or section 2107(a), a State may not modify its unemployment compensation law and policies with respect to work search requirements under the authority of section 4102(b) of the Families First Coronavirus Response Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note). </text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7F4534D6E95741C2A223E0731F2F0608"><enum>(b)</enum><header>Pandemic Unemployment Assistance</header><text display-inline="yes-display-inline">Section 2107(a)(7) of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025(a)(7)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H0EAD07BAA33B4F55A7936964F3382F6A" display-inline="no-display-inline"><paragraph id="HE2F34499793D47C298D6F395BA15701B"><enum>(7)</enum><header>Actively seeking work</header><text display-inline="yes-display-inline">For purposes of paragraph (2)(D), the term <quote>actively seeking work</quote> means, with respect to any individual, that such individual—</text><subparagraph id="PH583EADA1CEA34C23B9B84DB0ADB44266"><enum>(A)</enum><text>is registered for employment services in such a manner and to such extent as prescribed by the State agency;</text></subparagraph><subparagraph id="H5A85D8DD5CDD499CAD1CEB77636F496D"><enum>(B)</enum><text>has engaged in an active search for employment that is appropriate in light of the employment available in the labor market, the individual’s skills and capabilities, and includes a number of employer contacts that is consistent with the standards communicated to the individual by the State;</text></subparagraph><subparagraph id="H830B784CC0AF4929BDAEBDD370C57C7E"><enum>(C)</enum><text>has maintained a record of such work search, including employers contacted, method of contact, and date contacted; and</text></subparagraph><subparagraph id="H587E44856A8D4B4680033647E692D1D3"><enum>(D)</enum><text>when requested, has provided such work search record to the State agency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCC9FB85269D04FFB825115C8044A8F80"><enum>(c)</enum><header>Conforming amendment</header><text>Section 2 of the Coronavirus Aid, Relief, and Economic Security Act is amended in the table of contents by inserting after the item related to section 2118 the following:</text><quoted-block style="OLC" id="HBD57FD2136844861A913415D2DA1BE8B" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 2119. State work requirements</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H60C02CEABFDB4EE58073229FA9F6C18E"><enum>3.</enum><header>Voluntary departure</header><text display-inline="no-display-inline">Section 2102(a)(3)(A)(ii)(I) of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021(a)(3)(A)(ii)(I)</external-xref>) is amended by striking item (ii).</text></section><section id="H23C8F454E76343FE9DD4318760D46CEA"><enum>4.</enum><header>Safety concerns</header><text display-inline="no-display-inline">Section 2102(a)(3)(B) of the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021(a)(3)(B)</external-xref>) is amended—</text><paragraph id="HFCA9DE9A79314C94B4B665ADBD1EE53F"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>or</quote>;</text></paragraph><paragraph id="HDAE72AD0D2144207A3C7E63187EB3DDB"><enum>(2)</enum><text>in clause (ii), by striking the period and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HD09805EE7C004601911A45E006A77A85"><enum>(3)</enum><text>by inserting at the end the following:</text><quoted-block style="OLC" id="H5DF95060148D4AAA96FDCA5BE1DC926D" display-inline="no-display-inline"><clause id="HA49496A07B3B46E69967F822DDEBD98F"><enum>(iii)</enum><text display-inline="yes-display-inline">an individual who declines to work on the basis of safety concerns related to COVID–19. </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
