which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Lacey Act Amendments of 1981 to prohibit importation, exportation, transportation, sale, receipt, acquisition, and purchase in interstate or foreign commerce, or in a manner substantially affecting interstate or foreign commerce, or possession, of any live animal of any prohibited primate species.</official-title></form><legis-body id="H9A36ADBFC0204DFB8C93827262E1DCF6" style="OLC"><section id="H969733A2E86541A38C0CD85C6685C908" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Captive Primate Safety Act</short-title></quote>.</text></section><section id="H157DEB2E90EF4B9394A161F6F8C5229A"><enum>2.</enum><header>Definition of prohibited primate species</header><text display-inline="no-display-inline">Section 2 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref>) is amended—</text><paragraph id="H554741024C554A4CAD11C696A4828E81"><enum>(1)</enum><text>by redesignating paragraphs (g) through (k) as paragraphs (h) through (l), respectively; and</text></paragraph><paragraph id="HB22D74FDEC3F4B2E9771FDA8A207F892"><enum>(2)</enum><text>by inserting after paragraph (f) the following:</text><quoted-block id="H782DA841C41E4A92A60BCB6335827B3A" style="OLC"><subsection id="HB89285E5A56A4567B76CB9A7DA1DF7BD"><enum>(g)</enum><header>Prohibited primate species</header><text>The term <term>prohibited primate species</term> means any live species of nonhuman primate, including chimpanzees, galagos, gibbons, gorillas, lemurs, lorises, monkeys, orangutans, tarsiers, or any hybrid of such a species.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE57BDCC973644BEAA2BCAC6E9C4CD467"><enum>3.</enum><header>Prohibitions</header><subsection id="H5FD270332A474F538B8777939BC34BFD"><enum>(a)</enum><header>Prohibited acts</header><text>Section 3 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3372">16 U.S.C. 3372</external-xref>) is amended—</text><paragraph id="H47D2DF7CE2EB416CB3D74374B4FFFF17"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H182DF2326FB24C2C902D2620F72FFDBE"><enum>(A)</enum><text>in paragraph (3)(B)(iii), by striking <quote>; or</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="H73AC520C72E849588BAAE9250CFC711D"><enum>(B)</enum><text>by striking paragraph (4) and inserting the following:</text><quoted-block id="H620FC5B19F8C4D66A02029E8BCE7B460" style="OLC"><paragraph id="H58D446A88BF74AE0AA17C690C6A8CF10"><enum>(4)</enum><text>subject to subsection (f), to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce, or in a manner substantially affecting interstate or foreign commerce, or to possess, any prohibited primate species; or</text></paragraph><paragraph id="HA4F7A9A060A04C0CB21C09B4A3DA11E5"><enum>(5)</enum><text>to attempt to commit any act described in paragraphs (1) through (4).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H041D4094989F496A9418386EF8AEE1F7"><enum>(2)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph><paragraph id="HCF95D0FCFF24460E9AE5BF02B070447A"><enum>(3)</enum><text>by inserting before subsection (g) (as so redesignated) the following:</text><quoted-block id="HF5717FC93F394A5D8F757E886696C707" style="OLC"><subsection id="HC02A86C6ABE743AA922CAE8F6EC58BE5"><enum>(f)</enum><header>Nonapplicability of prohibited primate species offense</header><text display-inline="yes-display-inline">Subsection (a)(4) does not apply to—</text><paragraph id="H94C7D54A314F43468B27A7B2675C9914"><enum>(1)</enum><text>a person exhibiting animals to the public under a Class C license issued by the Department of Agriculture, or a Federal facility registered with the Department of Agriculture that exhibits animals, if such person or facility holds such license or registration in good standing and—</text><subparagraph id="H2E3A388DEFCC417EAFE4879F2B52D29C"><enum>(A)</enum><text>does not allow any individual to come into direct physical contact with a prohibited primate species, unless that individual is—</text><clause id="HC6E527CDFD4F4D60B0EA03FD883E05DF"><enum>(i)</enum><text>a trained professional employee or contractor of the person or facility, or an accompanying employee receiving professional training;</text></clause><clause id="H4650D6B7675D4687B9DFA126D40B4834"><enum>(ii)</enum><text>a licensed veterinarian, or a veterinary student accompanying such a veterinarian; or</text></clause><clause id="H0567D7C0606B4CFEB3AFEC8735F21B19"><enum>(iii)</enum><text>directly supporting conservation programs of the entity or facility, the contact is not in the course of commercial activity (which may be evidenced by advertisement or promotion of such activity or other relevant evidence), and the contact is incidental to humane husbandry conducted pursuant to a species-specific, publicly available, peer-edited population management and care plan that has been provided to the Secretary with justifications that the plan—</text><subclause id="HD0CA1E840A294DEAA1928FCED591D410"><enum>(I)</enum><text>reflects established conservation science principles;</text></subclause><subclause id="HEF83878356484997A1A425F2B012F58B"><enum>(II)</enum><text>incorporates genetic and demographic analysis of a multi-institution population of animals covered by the plan; and</text></subclause><subclause id="H97166592D2804EC2804ADD9F22CC65A7"><enum>(III)</enum><text>promotes animal welfare by ensuring that the frequency of breeding is appropriate for the species; and</text></subclause></clause></subparagraph><subparagraph id="H8AE239E97B4B4D0681E7844E513443C4"><enum>(B)</enum><text display-inline="yes-display-inline">ensures that during public exhibition of any prohibited primate species, other than lemurs and galagos, the animal is at least 15 feet from members of the public unless there is a permanent barrier sufficient to prevent public contact with the animal;</text></subparagraph></paragraph><paragraph id="H3F63EC055AFF4624BD25E56C87CBCE58"><enum>(2)</enum><text>a person registered as a research facility by the Department of Agriculture;</text></paragraph><paragraph id="H76AD08ADE14945D096893D78E8713049"><enum>(3)</enum><text>a State college, university, or agency, or a State-licensed veterinarian;</text></paragraph><paragraph id="H6CAA00C1F378408A8CBEF3E559A10565"><enum>(4)</enum><text>a wildlife sanctuary that cares for prohibited primate species, and—</text><subparagraph id="H9831F61090D44C918459F99CD9C58ADB"><enum>(A)</enum><text>is a corporation that is exempt from taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(a)</external-xref> of the Internal Revenue Code of 1986 and described in sections 501(c)(3) and 170(b)(1)(A)(vi) of such Code;</text></subparagraph><subparagraph id="HF7557C46A26F43678D24B7B3ED01F6D9"><enum>(B)</enum><text>does not commercially trade in any prohibited primate species, including offspring, parts, and byproducts of such animals;</text></subparagraph><subparagraph id="H6666B2A9A1E349CFA6FBAF80FFA86A28"><enum>(C)</enum><text>does not breed any prohibited primate species;</text></subparagraph><subparagraph id="H5D8B2A47A5E947AE8E0814B913BB7A8F"><enum>(D)</enum><text>does not allow direct contact between the public and any prohibited primate species; and</text></subparagraph><subparagraph id="HB2BB2D3355AE4267A5541EDAF5B625FF"><enum>(E)</enum><text>does not allow the transportation and display of any prohibited primate species off-site;</text></subparagraph></paragraph><paragraph id="HB125D10781234CFEB3DEDC268D779A4B"><enum>(5)</enum><text>a person that has custody of any prohibited primate species solely for the purpose of expeditiously transporting the prohibited primate species to a person described in this subsection with respect to the species; or</text></paragraph><paragraph id="HDFED1C16256047ECB6331FCDB82EC635"><enum>(6)</enum><text>a person that is in possession of any prohibited primate species that was born before the date of the enactment of the <short-title>Captive Primate Safety Act</short-title>, if the person—</text><subparagraph id="H7C17D4FBFB23457388BFB9600DFA7048"><enum>(A)</enum><text>not later than 180 days after the date of the enactment of such Act, registers each individual animal of each prohibited primate species possessed by the person with the United States Fish and Wildlife Service;</text></subparagraph><subparagraph id="HE6D14CE526464637A8BBA067788CCFBE"><enum>(B)</enum><text>does not breed, acquire, or sell any prohibited primate species after the date of the enactment of such Act; and</text></subparagraph><subparagraph id="HD1C72D7C51904C1AA0B822DD43A29F75"><enum>(C)</enum><text>does not allow direct contact between the public and prohibited primate species.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFD472E93A18E4D6C8ABE7657095E7955"><enum>(b)</enum><header>Civil penalties</header><text>Section 4(a)(1) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373(a)(1)</external-xref>) is amended—</text><paragraph id="H0636B2F8F46D4BAD8D7D5EF466EFE773"><enum>(1)</enum><text>by striking <quote>and (f)</quote> and inserting <quote>(f), and (g)</quote>; and</text></paragraph><paragraph id="HB44F8F63DC464880A0203103AF073E62"><enum>(2)</enum><text>by striking <quote>or (f)</quote> and inserting <quote>(f), or (g)</quote>.</text></paragraph></subsection><subsection id="H21E436102D45481EBDB1A7B0462CB51E"><enum>(c)</enum><header>Criminal penalties</header><text>Section 4(d) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373(d)</external-xref>) is amended—</text><paragraph id="HED6CF8E4CA19495E9DCC4C446137B37B"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and (f)</quote> each place it appears and inserting <quote>(f), and (g)</quote>; and</text></paragraph><paragraph id="HB0C8A4B18E8745848E4A828425309833"><enum>(2)</enum><text>in paragraph (3), by striking <quote>(d) or (f)</quote> and inserting <quote>(d), (f), or (g)</quote>.</text></paragraph></subsection><subsection id="H4BA3AA0248514BD68D45E88F86D18A48"><enum>(d)</enum><header>Effective date; regulations</header><paragraph id="H8FBC9E9CA57F44F0B45476FF468415C6"><enum>(1)</enum><header>Effective date</header><text>Subsections (a) through (c), and the amendments made by those subsections, shall take effect on the earlier of—</text><subparagraph id="H85A0D7FDD0164B9892073076DAD4D3D9"><enum>(A)</enum><text>the date of promulgation of regulations under paragraph (2); and</text></subparagraph><subparagraph id="HB0BBB969BC26428284002E5910106865"><enum>(B)</enum><text>the expiration of the period referred to in paragraph (2).</text></subparagraph></paragraph><paragraph id="H6F631CCEF5284BA0932D817EDEC31F49"><enum>(2)</enum><header>Regulations</header><text>Not later than the end of the 180-day period beginning on the date of the enactment of this Act, the Secretary of the Interior shall promulgate regulations implementing the amendments made by this section.</text></paragraph></subsection></section><section id="H2C1FBC48811943CA8E8B8F8E9DFABB8B"><enum>4.</enum><header>Regulations</header><text display-inline="no-display-inline">Section 7(a) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3376">16 U.S.C. 3376(a)</external-xref>) is amended— </text><paragraph id="HB38C14197AB445F783D095BF7957FA7D"><enum>(1)</enum><text>in paragraph (1), by striking <quote>3(f)</quote> and inserting <quote>3(g)</quote>; and</text></paragraph><paragraph id="HDB0DACF07AAD4122AE49E2ED0A8D717F"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H8B848B8C0E5C49C8937922F0E8F57244" style="OLC"><paragraph id="H962EE9A4E51D4698A12362936BF16EAC"><enum>(3)</enum><text>The Secretary shall, in consultation with other relevant Federal and State agencies, promulgate any regulations necessary to implement section 3(f).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
