which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To subsidize the salaries of State and local law enforcement officers and promote officer hiring and retention, and for other purposes.</official-title></form><legis-body id="H4A873225CD564E3482A2C6FC23908575" style="OLC"><section id="H1E55F8E3F65B42FBA60A3C76992EA375" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>David Dorn Back the Blue Act</short-title></quote>.</text></section><section id="H92CAD829F03E47A89334BDB99DE6CE18"><enum>2.</enum><header>Law enforcement agency funding reform</header><subsection id="HAFFD6BB39A144D398A61D8ABC3BF75CC"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Part W of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10491">34 U.S.C. 10491</external-xref> et seq.) is amended—</text><paragraph id="H16AF63AA35A446B5B1053082AA03BB59"><enum>(1)</enum><text>in section 2301 (<external-xref legal-doc="usc" parsable-cite="usc/34/10491">34 U.S.C. 10491</external-xref>)—</text><subparagraph id="HFD27ECF7582E460EB7C8304BBAE7060B"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end; </text></subparagraph><subparagraph id="HCE6B1BF649AF4F698F6A51FA2FF842F6"><enum>(B)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H5344884EE7EF4A4BB8496E958BDEF938"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC96D8A4D648B45DD8F7B74D9B522D4D5"><paragraph id="HE1BE0A45C97A410CAB23335080BE7D4A"><enum>(7)</enum><text>provide programs to support the hiring and retention of law enforcement personnel and augment the salaries of law enforcement personnel employed by cooperating State and local law enforcement agencies or organizations.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7D10BCCA98264A6F8557E6B4D2D2C4FE"><enum>(2)</enum><text>in section 2302 (<external-xref legal-doc="usc" parsable-cite="usc/34/10492">34 U.S.C. 10492</external-xref>), by inserting before the period at the end the following: <quote>, or in the case of State and local law enforcement agencies, to support the hiring and retention of law enforcement personnel and augment wages paid to law enforcement personnel</quote>; </text></paragraph><paragraph id="H920B95E84F4C4CA591269FE5BDFD35A5"><enum>(3)</enum><text>in section 2303 (<external-xref legal-doc="usc" parsable-cite="usc/34/10493">34 U.S.C. 10493</external-xref>)—</text><subparagraph id="HA2626418504741A2A632A058DCBB927C"><enum>(A)</enum><text>in subsection (a), by inserting before the period at the end the following: <quote>, or to support the hiring and retention of law enforcement personnel and to augment wages paid to law enforcement personnel</quote>;</text></subparagraph><subparagraph id="HB17BB2CDA8DF4953AACF55F7A8704C53"><enum>(B)</enum><text>in subsection (b), in the matter preceding paragraph (1), by inserting before the colon the following: <quote>, unless supporting the hiring and retention of law enforcement personnel or augmenting wages in accordance with subsection (d)</quote>; and</text></subparagraph><subparagraph id="H15B156B061E24B16981E4F4025C73FA8"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7F34C9CC6A444616A754FFA6A3FECA7E"><subsection id="H5413298AD1DD4A48B73A99CF89F80195"><enum>(d)</enum><header>Hiring and retention of law enforcement personnel</header><text>A law enforcement agency or organization that receives funds under this part may use the funds for activities and programs to hire and pay additional law enforcement personnel or to retain existing personnel. </text></subsection><subsection id="H5252DEBA70BC40B9868553AE06B88D8A"><enum>(e)</enum><header>Augmentation of wages</header><paragraph id="H10BCC1DFDA3F45E596530ACBF3527B5B"><enum>(1)</enum><header>In general</header><text>A law enforcement agency or organization that receives funds under this part may use the funds to augment the salaries of law enforcement personnel, up to an amount equal to 110 percent of the State real median household income of the preceding year, as estimated by the United States Census Bureau.</text></paragraph><paragraph id="H654702E08C2446AB9C05E1660FD0AA42"><enum>(2)</enum><header>Requirement</header><text>A law enforcement agency or organization shall not be eligible to receive funds under this part for the purpose described in paragraph (1) if the agency or organization reduced the salaries of law enforcement personnel during the calendar year immediately preceding the application for funds for the sole purpose of dismantling law enforcement agencies or organizations pursuant to a State or local policy.</text></paragraph><paragraph id="HA696E6BBA912409D96FEA39BF1B17117"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in paragraph (2) shall be construed to affect the eligibility of any law enforcement agency or organization that reduces the salaries of law enforcement personnel due to budget constraints that are implemented as a result of the COVID-19 pandemic.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3A1E007C68B84BF49C745F6B93F43979"><enum>(4)</enum><text>in section 2304(1) (<external-xref legal-doc="usc" parsable-cite="usc/34/10494">34 U.S.C. 10494(1)</external-xref>), by inserting <quote>, unless Federal funds are sought for the purpose of personnel hiring, personnel retention, or wage augmentation,</quote> after <quote>certify</quote>; and</text></paragraph><paragraph id="H6BA4A112BD224DD4BE8BEC487A4CBD81"><enum>(5)</enum><text>in section 2305 (<external-xref legal-doc="usc" parsable-cite="usc/34/10495">34 U.S.C. 10495(b)</external-xref>)—</text><subparagraph id="H7A5E9EF9E8444F88B08DAB94AC2BCE68"><enum>(A)</enum><text>by striking <quote>The Attorney General may award</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD8C136E59ADF431FA383C24F2F806441"><paragraph id="H5E797B5920E14FA296850696A4F1A6E3"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Attorney General may award</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H3BFA504D799246759D1F85BD0491C935"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H216585D33DF142EDB411B32401B0435C"><paragraph id="H2BEC5B1177BB431E83EB8DDB33670F7B"><enum>(2)</enum><header>Exception</header><text>Paragraph (1) shall not apply to grants sought for the purpose of personnel hiring, personnel retention, or wage augmentation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H2AFABC0F08A14CF9A7318FC4A5F33DB9"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 1001(21) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10261">34 U.S.C. 10261(21)</external-xref>) is amended by striking <quote>$7,500,000 for each of fiscal years 2020 through 2024.</quote> and inserting <quote>$15,000,000,000 for each of fiscal years 2022 through 2026, of which any funds appropriated in excess of $7,500,000 shall be used for the hiring and retention of law enforcement officers and the augmentation of wages as described in such part.</quote>. </text></subsection></section></legis-body></bill>
