which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to authorize the Operation Stonegarden grant program, and for other purposes.</official-title></form><legis-body id="HD6AB19BB94604E9186A774B3CF255273" style="OLC"><section id="HE686CBC2CDCA42D6BBCD2A73AF96C179" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Operation Stonegarden Authorization Act</short-title></quote>.</text></section><section id="H45A69484471B4832ACACFA38A79185C0"><enum>2.</enum><header>Operation Stonegarden</header><subsection id="HD1BB880C3A5442E386FD34E64E3DCB97"><enum>(a)</enum><header>In general</header><text>Subtitle A of title XX of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/601">6 U.S.C. 601</external-xref> et seq.) is amended by adding at the end the following new section:</text><quoted-block id="H13A6C8B5FEDD4BBBB2FB7A8BB61ED93D" style="OLC"><section id="HE774EF684C504527874FCC2386A08DAC"><enum>2010.</enum><header>Operation Stonegarden</header><subsection id="H9B593AB0DC124043A3B5F0CD9B331FEF"><enum>(a)</enum><header>Establishment</header><text>There is established in the Department a program to be known as <quote>Operation Stonegarden</quote>, under which the Secretary, acting through the Administrator, shall make grants to eligible law enforcement agencies, through the State administrative agency, to enhance border security in accordance with this section.</text></subsection><subsection id="H873DB5F9683F4FA284D1852C4B21E267"><enum>(b)</enum><header>Eligible recipients</header><text>To be eligible to receive a grant under this section, a law enforcement agency—</text><paragraph id="H1885BB6401F247438A55669D087A5545"><enum>(1)</enum><text>shall be located in—</text><subparagraph id="HEC8A4EB0F21E430B9C1434DC713B0A53"><enum>(A)</enum><text>a State bordering Canada or Mexico; or</text></subparagraph><subparagraph id="H4FDE59EBECB24CF0A8CF4688D4663018"><enum>(B)</enum><text>a State or territory with a maritime border; and</text></subparagraph></paragraph><paragraph id="HECA3BA825B7849C1BD2969004E680A75"><enum>(2)</enum><text>shall be involved in an active, ongoing, U.S. Customs and Border Protection operation coordinated through a U.S. Border Patrol sector office.</text></paragraph></subsection><subsection id="H04088BAAA9834B66A1A94DD33C009F75"><enum>(c)</enum><header>Permitted uses</header><text>The recipient of a grant under this section may use such grant for—</text><paragraph id="HD9ABB81D1B664FC1827A449C53049D3F"><enum>(1)</enum><text>equipment, including maintenance and sustainment costs;</text></paragraph><paragraph id="HE826AF31449045E89438A040F4146865"><enum>(2)</enum><text>personnel, including overtime and backfill, in support of enhanced border law enforcement activities;</text></paragraph><paragraph id="H14DC5F12C3D742629D1DC5780C4FFBB6"><enum>(3)</enum><text>any activity permitted for Operation Stonegarden under the Department of Homeland Security’s most recent Homeland Security Grant Program Notice of Funding Opportunity; or</text></paragraph><paragraph id="H41880BCF1CA74026B808E081E03DBF5A"><enum>(4)</enum><text>any other appropriate activity, as determined by the Administrator, in consultation with the Commissioner of U.S. Customs and Border Protection.</text></paragraph></subsection><subsection id="HB74B9CBB38B74E28BCFFDE3EE246F721"><enum>(d)</enum><header>Period of performance</header><text>The Secretary shall award grants under this section to grant recipients for a period of not less than 36 months.</text></subsection><subsection id="H9D88CBC811784F7CB58A883D4105719B" commented="no"><enum>(e)</enum><header>Report</header><text>For each of the fiscal years 2022 through 2026, the Administrator shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a report that contains information on the expenditure of grants made under this section by each grant recipient.</text></subsection><subsection id="H7879EE53E0B14756B8E759C277B62D6A" commented="no"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $110,000,000 for each of the fiscal years 2022 through 2026 for grants under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H183D4939C46F468F930A1268D28E8038"><enum>(b)</enum><header>Conforming amendment</header><text>Subsection (a) of section 2002 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/603">6 U.S.C. 603</external-xref>) is amended to read as follows:</text><quoted-block id="HD9858B3678774F118F0D77EC78B4E181" style="OLC"><subsection id="HF79D81F35AED42339106F9FF453949A5"><enum>(a)</enum><header>Grants authorized</header><text>The Secretary, through the Administrator, may award grants under sections 2003, 2004, 2009, and 2010 to State, local, and Tribal governments, as appropriate.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF49F6743BD644CBDA2F10DC9F9EB470A"><enum>(c)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 is amended by inserting after the item relating to section 2009 the following new item:</text><quoted-block id="H55BD93A0E23F417EA71E2FE7023EB17F" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 2010.
