Juvenile justice and delinquency prevention.</toc-entry></toc></subsection></section><section id="H4DC143E01112497AA81F630DECAAFB30"><enum>2.</enum><header>Effective date</header><text display-inline="no-display-inline">Unless otherwise provided, this Act, and the amendments made by this Act, shall take effect 1 year after the date of enactment of this Act.</text></section><title id="H594D4C2099C144ECB36FD553C8B37351"><enum>I</enum><header>School Breakfast Program</header><section id="H1441C2C212CA4F129108D41D8E057A3B"><enum>101.</enum><header>Free school breakfast program</header><subsection id="H7DBD92BA99314427A9D5F740D6BB5A29"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4(a) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(a)</external-xref>) is amended, in the first sentence—</text><paragraph id="H8918041947604D5FB6414DDF522B33D7"><enum>(1)</enum><text>by striking <quote>is hereby</quote> and inserting <quote>are</quote>; and</text></paragraph><paragraph id="H2B2D88659EC7404AADC37E72E2A05C36"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>to provide free breakfast to all children enrolled at those schools</quote> before <quote>in accordance</quote>.</text></paragraph></subsection><subsection id="H3017518B9A86459186F4D187254974F0"><enum>(b)</enum><header>Apportionment to States</header><text>Section 4(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(b)</external-xref>) is amended—</text><paragraph id="H4788F1EED23D40CF8C49E8309F202784"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="H52FC7DC75C734A3EA81E37ED67AEB638"><enum>(A)</enum><text>in subparagraph (A)(i), by striking subclause (II) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCA4F1ED1681B4032BCA7E6B197C82EE8"><subclause id="H0A9D5490456342208DFF620D952FD768"><enum>(II)</enum><text display-inline="yes-display-inline">the national average payment for free breakfasts, as specified in subparagraph (B).</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H3E573576376049D586599A84D5329776"><enum>(B)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA63A24A6A8AC4D70B6500AC26AAC3BF2"><subparagraph id="HCBE20E5484E741E685F58D30B8AEEADE"><enum>(B)</enum><header>Payment amounts</header><clause id="HC4B73620C20A442ABA604C3723A3B0F5"><enum>(i)</enum><header>In general</header><text>The national average payment for each free breakfast shall be $2.72, adjusted annually for inflation in accordance with clause (ii) and rounded in accordance with clause (iii).</text></clause><clause id="H0B3C23B2E5B14DD58C1DAEDD2E86E045"><enum>(ii)</enum><header>Inflation adjustment</header><subclause id="H767502A609D948ECAFE3EF32EF28825D"><enum>(I)</enum><header>In general</header><text>The annual inflation adjustment under clause (i) shall reflect changes in the cost of operating the free breakfast program under this section, as indicated by the change in the Consumer Price Index for food away from home for all urban consumers.</text></subclause><subclause id="H1E979ECCE49E4474B7BCCC0B4A779804"><enum>(II)</enum><header>Basis</header><text>Each inflation annual adjustment under clause (i) shall reflect the changes in the Consumer Price Index for food away from home for the most recent 12-month period for which that data is available.</text></subclause></clause><clause id="H0357F136EC444B30A8034AB6CDF3FD18"><enum>(iii)</enum><header>Rounding</header><text>On July 1, 2021, and annually thereafter, the national average payment rate for free breakfast shall be—</text><subclause id="HDF65E9C403E94F65A5C865617CC999E2"><enum>(I)</enum><text>adjusted to the nearest lower-cent increment; and</text></subclause><subclause id="HC9AD567863A84A8D9F7070DA0636F2AB"><enum>(II)</enum><text>based on the unrounded amounts for the preceding 12-month period.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HF315534332764781A24035660F05E4F6"><enum>(C)</enum><text>by striking subparagraphs (C) and (E); and</text></subparagraph><subparagraph id="HB0D1BD595E3E4667900DFF71ADAC62D4"><enum>(D)</enum><text>by redesignating subparagraph (D) as subparagraph (C);</text></subparagraph></paragraph><paragraph id="H6F40B2E820FB410AB6DA646DB49F81F4"><enum>(2)</enum><text>by striking paragraphs (2) and (3);</text></paragraph><paragraph id="H58CE941C19564CF3814E51C281AF01F0"><enum>(3)</enum><text>by redesignating paragraphs (4) and (5) as paragraphs (2) and (3), respectively; and</text></paragraph><paragraph id="H522731E2B8834C9BB821AA1C12FBF519"><enum>(4)</enum><text>in paragraph (3) (as so redesignated), by striking <quote>paragraph (3) or (4)</quote> and inserting <quote>paragraph (2)</quote>.</text></paragraph></subsection><subsection id="H6876C1F25BFB49F3AC378EC9FAFA7318"><enum>(c)</enum><header>State disbursement to schools</header><text display-inline="yes-display-inline">Section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) is amended by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA10068B7CE6B43E49B8E8D3BBA2D578E"><subsection id="H10855179DC17454A912A735364592D0D"><enum>(c)</enum><header>State disbursement to schools</header><text display-inline="yes-display-inline">Funds apportioned and paid to any State for the purpose of this section shall be disbursed by the State educational agency to schools selected by the State educational agency to assist those schools in operating a breakfast program.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCB3A7D9FCBA04B55B9110247353C38FF"><enum>(d)</enum><header>No collection of debt</header><paragraph id="HE293B25F9B4E479A95257F54693224A8"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1771">42 U.S.C. 1771</external-xref> et seq.) or any other provision of law, effective beginning on the date of enactment of this Act, as a condition of participation in the breakfast program under section 4 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>), a school—</text><subparagraph id="H1B9CFD0F45B246EE9B0D13E684E8E2F5"><enum>(A)</enum><text>shall not collect any debt owed to the school for unpaid meal charges; and</text></subparagraph><subparagraph id="H20DC55B60D04468B947AD43869284CEC"><enum>(B)</enum><text>shall continue to accrue debt for unpaid meal charges—</text><clause id="HB011DFA4A12242EE9499EF6385EB20DA"><enum>(i)</enum><text>for the purpose of receiving reimbursement under section 212; and</text></clause><clause id="H5B456DE23BA647C2BC726CA004C0D610"><enum>(ii)</enum><text>until the effective date specified in section 2.</text></clause></subparagraph></paragraph><paragraph id="HD8A289CE4EAC4B938D88A16F134E74DB"><enum>(2)</enum><header>Child Nutrition Act of 1966</header><subparagraph id="H04F5BBF0363C49FDBFD4F3AF5DBD7A25"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) is amended by striking subsection (d) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1134E14628D845048A830D471EE04A86"><subsection id="H43A0043D0E43424E8FF844B84505FD59"><enum>(d)</enum><header>No collection of debt</header><text>A school participating in the free breakfast program under this section shall not collect any debt owed to the school for unpaid meal charges.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="H592F877951494DDC8627ED605C730A35"><enum>(B)</enum><header>Conforming amendment</header><text>Section 23(a) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1793">42 U.S.C. 1793(a)</external-xref>) is amended by striking <quote>school in severe need, as described in section 4(d)(1)</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H6A55D511419C41A690E6361B1E8A8864"><text>school—</text><paragraph commented="no" id="HC478F49E4DB84B7D9D36C104417060B4"><enum>(1)</enum><text>that has a free breakfast program under section 4 or seeks to initiate a free breakfast program under that section; and</text></paragraph><paragraph commented="no" id="HCBA2006CB3FE475F8F13332BE29FF0A1"><enum>(2)</enum><text>of which not less than 40 percent of the students are identified students (as defined in paragraph (8) of section 1113(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)</external-xref>))</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H03528FE508764226B34B867FAFCCF0B5"><enum>(e)</enum><header>Nutritional and other program requirements</header><text display-inline="yes-display-inline">Section 4(e) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(e)</external-xref>) is amended—</text><paragraph id="H7F41E1FB2D2840CCB1B143EEDCC8E9A3"><enum>(1)</enum><text>in paragraph (1)(A), in the second sentence, by striking <quote>free or</quote> and all that follows through the period at the end and inserting <quote>free to all children enrolled at a school participating in the school breakfast program.</quote>; and</text></paragraph><paragraph id="HB6AF978CA83D4B9E9F570020E5454EE4"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), in the second sentence, by striking <quote>the full charge to the student for a breakfast meeting the requirements of this section or</quote>.</text></paragraph></subsection><subsection commented="no" id="H97D0E561B0284D1BB616AAD868907160"><enum>(f)</enum><header>Prohibition on breakfast shaming, meal denial</header><paragraph commented="no" id="HC700E506ECCC4DB1B6AC5BDB145EB021"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Effective beginning on the date of enactment of this Act, a school or school food authority—</text><subparagraph commented="no" id="HC125DA1B55C344A6BE12BA1417F31B83"><enum>(A)</enum><text display-inline="yes-display-inline">shall not—</text><clause commented="no" id="H3B950A3F42A14910A75856493229FD9D"><enum>(i)</enum><text>physically segregate or otherwise discriminate against any child participating in the breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); or</text></clause><clause commented="no" id="HA2CCFDCD82AC47AB990614C44D21CDB3"><enum>(ii)</enum><text>overtly identify a child described in clause (i) by a special token or ticket, an announced or published list of names, or any other means; and</text></clause></subparagraph><subparagraph commented="no" id="HBA51C2E886AF424E89C93B2D03CB751D"><enum>(B)</enum><text>shall provide the program meal to any child eligible under the program.</text></subparagraph></paragraph><paragraph commented="no" id="H50839E7CEF664C78BF7558595EB0A38A"><enum>(2)</enum><header>Child Nutrition Act of 1966</header><text>Section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBFE2B515C2244859AD968EC0D62E7E06"><subsection commented="no" id="H59E5DA3C1D1447F6B7A596D5E0B7EBE6"><enum>(f)</enum><header>Prohibition on breakfast shaming</header><text display-inline="yes-display-inline">A school or school food authority shall not—</text><paragraph commented="no" id="HCE237748C3F241DF8B66D6627A67C7DD"><enum>(1)</enum><text>physically segregate or otherwise discriminate against any child participating in the free breakfast program under this section; or</text></paragraph><paragraph commented="no" id="HA1367BE848A34385B6E61806A5F65E9C"><enum>(2)</enum><text>overtly identify a child described in paragraph (1) by a special token or ticket, an announced or published list of names, or any other means.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H542E937E5B584D9F9D7DE8AFC9746937"><enum>(g)</enum><header>Department of Defense Overseas Dependents' Schools</header><text>Section 20(b) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1789">42 U.S.C. 1789(b)</external-xref>) is amended—</text><paragraph id="H336EED4E45574C0BBBC1C463F3CCF61E"><enum>(1)</enum><text>by striking <quote>and reduced-price</quote>; Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1753">42 U.S.C. 1753(b)</external-xref>) is amended—</text><paragraph id="H8B82E51DECB2414789740D2CC789DB4E"><enum>(1)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF6777351DF194AD4B71A098B72BC61F0"><paragraph id="H9A94E4EF8B8049F0A5A22DEA3097BF2E"><enum>(2)</enum><header>Payment amounts</header><subparagraph id="HDE8CBD33615B4DCCB2F89D9583A96131"><enum>(A)</enum><header>In general</header><text>The national average payment for each free lunch shall be $3.81, adjusted annually for inflation in accordance with subparagraph (C) and rounded in accordance with subparagraph (D).</text></subparagraph><subparagraph id="HFFF60440573E440189D5C6CED9E7CD33"><enum>(B)</enum><header>Additional payment for local food</header><clause commented="no" id="HA89FA91C860F4F87A6FE6B1531032066"><enum>(i)</enum><header>Definition of locally-sourced farm product</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>locally-sourced farm product</term> means a farm product that—</text><subclause commented="no" id="H6951AFC4659E44D5B9521807EA588C33"><enum>(I)</enum><text>is marketed to consumers—</text><item commented="no" id="H47F2FEC5A7C54A19B9E1273488F94445"><enum>(aa)</enum><text>directly; or</text></item><item commented="no" id="H43B62230C5F645B68C377E7DE73D4A03"><enum>(bb)</enum><text>through intermediated channels (such as food hubs and cooperatives); and</text></item></subclause><subclause commented="no" id="H85BED26B84C847CDB3DCC22B40DB17CC"><enum>(II)</enum><text>with respect to the school food authority purchasing the farm product, is produced and distributed—</text><item commented="no" id="H0D713004EE20458DA43ABBC0DF5F321B"><enum>(aa)</enum><text>in the State in which the school food authority is located; or</text></item><item commented="no" id="H4906EB056CFE4D998D2DB44810103C88"><enum>(bb)</enum><text>not more than 250 miles from the location of the school food authority.</text></item></subclause></clause><clause id="HC8928CCC91644037A4DEBB83FEE44C2C"><enum>(ii)</enum><header>Additional payment eligibility</header><text display-inline="yes-display-inline">During a school year, a school food authority shall receive an additional payment described in clause (iii) if the State certifies that the school food authority served meals (including breakfasts, lunches, suppers, and supplements) during the last school year of which not less than 25 percent were made with locally-sourced farm products.</text></clause><clause id="H548484C075A644B49E0597C2292B059B"><enum>(iii)</enum><header>Payment amount</header><subclause id="H60F83A3540CB4A70BC3E39F3B6D18C20"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The additional payment amount under this subparagraph shall be—</text><item id="H86CC8BFF1ACC462880AAC592FE5BFCD4"><enum>(aa)</enum><text display-inline="yes-display-inline">$0.30 for each free lunch and supper;</text></item><item id="HC7E60DA84080443F9F885A4EE4315184"><enum>(bb)</enum><text>$0.21 for each free breakfast; and</text></item><item id="H84C7995D52FF49E2BDCAF4516AEA6B86"><enum>(cc)</enum><text>$0.08 for each free supplement.</text></item></subclause><subclause id="H13315E485E584ADF9FC5DB1BA7A4A9C2"><enum>(II)</enum><header>Adjustments</header><text display-inline="yes-display-inline">Each additional payment amount under subclause (I) shall be adjusted annually in accordance with subparagraph (C) and rounded in accordance with subparagraph (D).</text></subclause></clause><clause id="H61E52D5E53CA48B0BE91CA53B41B31F9"><enum>(iv)</enum><header>Disbursement</header><text>The State agency shall disburse funds made available under this clause to school food authorities eligible to receive additional reimbursement.</text></clause></subparagraph><subparagraph id="HEC28648A894B43A5B7094857C228C79D"><enum>(C)</enum><header>Inflation adjustment</header><clause id="HDFE1666EF71346CDAAE27C7EFFE30DBB"><enum>(i)</enum><header>In general</header><text>The annual inflation adjustment under subparagraphs (A) and (B)(iii) shall reflect changes in the cost of operating the free lunch program under this Act, as indicated by the change in the Consumer Price Index for food away from home for all urban consumers.</text></clause><clause id="H20E06D4DFD2E409DACFF74AB79E2347D"><enum>(ii)</enum><header>Basis</header><text>Each annual inflation adjustment under subparagraphs (A) and (B)(iii) shall reflect the changes in the Consumer Price Index for food away from home for the most recent 12-month period for which that data is available.</text></clause></subparagraph><subparagraph id="H8319BB9AE6B34577AD767C09E7440595"><enum>(D)</enum><header>Rounding</header><text>On July 1, 2021, and annually thereafter, the national average payment rate for free lunch and the additional payment amount for free breakfast, lunch, supper, and supplement under subparagraph (B) shall be—</text><clause id="H052CBD47F0984FE6B3F03555A5131C5A"><enum>(i)</enum><text>adjusted to the nearest lower-cent increment; and</text></clause><clause id="H1A7C10D278EB40AC85DE97DCC0008907"><enum>(ii)</enum><text>based on the unrounded amounts for the preceding 12-month period.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H05BCFE28D0CC4773AA6307DC4AB4409B"><enum>(2)</enum><text>by striking paragraph (3).</text></paragraph></section><section id="HAFDAEE26E7284DDAB5B0641218C3EDF2"><enum>202.</enum><header>Nutritional and other program requirements</header><subsection id="H9B866B6B23914D8EA43405A1423E0DB1"><enum>(a)</enum><header>Elimination of free lunch eligibility requirements</header><paragraph id="H42A5238D8F6B480098E90BB3F06F0348"><enum>(1)</enum><header>In general</header><text>Section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)(1)</external-xref></quote>.</text></subparagraph><subparagraph id="HC0EB388738BE4C24AC70F5ABDF4FF271"><enum>(G)</enum><text>Section 4301 of the Food, Conservation, and Energy Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/42/1758a">42 U.S.C. 1758a</external-xref>) is repealed.</text></subparagraph></paragraph></subsection><subsection id="H57236D87C78C4E5FB4640D55A3C689B9"><enum>(b)</enum><header>No collection of debt</header><paragraph id="HF61E6F1E4F71496D8683A1830E583C00"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.) or any other provision of law, effective beginning on the date of enactment of this Act, as a condition of participation in the school lunch program under that Act, a school—</text><subparagraph id="H95EFB2E525C84239B2F9199567263122"><enum>(A)</enum><text>shall not collect any debt owed to the school for unpaid meal charges; and</text></subparagraph><subparagraph id="H447E80259EFB462F90F071FDFA0194A4"><enum>(B)</enum><text>shall continue to accrue debt for unpaid meal charges—</text><clause id="H2A0D5D6B3F2B4438A9CE9922D90715EC"><enum>(i)</enum><text>for the purpose of receiving reimbursement under section 213; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H15B28A758D84485CB7883ADB3CB81FDE"><enum>(ii)</enum><text>until the effective date specified in section 2.</text></clause></subparagraph></paragraph><paragraph id="HC5131FD32B764B9ABD1846EF9D79737A"><enum>(2)</enum><header>National School Lunch Act</header><subparagraph id="HB13F7DE797AC43F19187CA1859AED9E8"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761</external-xref>) is amended—</text><paragraph id="HD14C658CEB714B9390A63EAD47972792"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H9D91A54925E3463D877B799232727759"><enum>(A)</enum><text>in paragraph (2), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE2DBC43CE1AE4EBD94DFF44F0906FEAA"><subparagraph commented="no" id="H388753B2EEDF459BA4E87836E6E69BD9"><enum>(C)</enum><header>Waiver</header><text>If the Secretary determines that a program requirement under this section limits the access of children to meals served under this section, the Secretary may waive that program requirement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3E054FCCF6A04011824B06227EEB5219"><enum>(D)</enum><header>Eligibility</header><text>All children shall be eligible to participate in the program under this section.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HCAD6D97FA8DA41FD8004D9D8535E5A08"><enum>(B)</enum><text>in paragraph (5), by striking <quote>only for</quote> and all that follows through the period at the end and inserting <quote>for meals served to all children.</quote>;</text></subparagraph></paragraph><paragraph id="H51CFFB2CD9514C008969175949EFBFDA"><enum>(2)</enum><text>in subsection (b)(2), by striking <quote>may only serve</quote> and all that follows through <quote>migrant children</quote>;</text></paragraph><paragraph commented="no" id="H6C2547C5DB96466E9430088D72DF9D00"><enum>(3)</enum><text display-inline="yes-display-inline">by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1593F417B08643838E56DF7F48C78949"><subsection commented="no" id="HD7EE7E0078444CB3902533B461EF165F"><enum>(c)</enum><header>Payments</header><paragraph commented="no" id="H024AC216EF2048858DBF7E9D310F2549"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Payments shall be made to service institutions for meals served—</text><subparagraph commented="no" id="HAD712FCFAA574155BA0DCE860F352CDF"><enum>(A)</enum><text display-inline="yes-display-inline">during the months of May through September;</text></subparagraph><subparagraph commented="no" id="H4482193CC89D4490BB49261EF38D31FC"><enum>(B)</enum><text>during school vacation at any time during an academic school year;</text></subparagraph><subparagraph commented="no" id="H57B0E3D6405C4450BC4EB5C0671A728D"><enum>(C)</enum><text>during a teacher in-service day; and</text></subparagraph><subparagraph commented="no" id="HF58CA2C8BA5F4A8CAB0EF6C8D55B4134"><enum>(D)</enum><text>on days that school is closed during the months of October through April due to a natural disaster, building repair, court order, or similar cause, as determined by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" id="HB1B4DDD563B1403DBE8EE0E2AD472769"><enum>(2)</enum><header>Limitation on payments</header><text>A service institution shall receive payments under this section for not more than 3 meals and 1 supplement per child per day.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE56A5A63040049B9B8650BC0C2EC56EC"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (f)(3), by striking <quote>, except that</quote> and all that follows through <quote>section</quote>.</text></paragraph></section><section id="H182F6EC706104B138B3F67080D4CABCC"><enum>206.</enum><header>Summer Electronic Benefit Transfer for Children Program</header><text display-inline="no-display-inline">Section 13(a) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1761">42 U.S.C. 1761(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H9BCB42C2611F40CDA7DD605273A35FA9"><paragraph id="H674CBE0B4ABA41B082C92D0CD20811EE"><enum>(13)</enum><header>Summer Electronic Benefit Transfer for Children Program</header><subparagraph id="H047BE18C77484E72999AC9FE3F47804F"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause id="HED2331E33FA84BF19E0A47748ACD96EC"><enum>(i)</enum><header>EBT card</header><text>The term <term>EBT card</term> means an electronic benefit transfer card.</text></clause><clause id="H0E6FDA07D41D41349228FD386216C91D"><enum>(ii)</enum><header>Eligible household</header><text>The term <term>eligible household</term> means a household with—</text><subclause id="H1501081940624823B81B364303CA2485"><enum>(I)</enum><text>an income that does not exceed 200 percent of the poverty line (as defined in section 673 of the Community Services Block Grant Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9902">42 U.S.C. 9902</external-xref>)); and</text></subclause><subclause id="H0E741F6E48904F0DBCF68672C2C11837"><enum>(II)</enum><text>1 or more children.</text></subclause></clause><clause id="H0AD287C389F540A8B7D8B095822AA32F"><enum>(iii)</enum><header>Program</header><text>The term <term>Program</term> means the Summer Electronic Benefit Transfer for Children Program established under subparagraph (B).</text></clause></subparagraph><subparagraph id="H91BBBDBBECEA405099845B1C6A689613"><enum>(B)</enum><header>Establishment</header><text>The Secretary shall establish a national program, to be known as the <quote>Summer Electronic Benefit Transfer for Children Program</quote>, under which the Secretary shall issue EBT cards to eligible households to provide food assistance during the summer months.</text></subparagraph><subparagraph id="H1B3451A95BA34C868578348CFB6BC550"><enum>(C)</enum><header>EBT amount</header><clause id="HF1BE463AE1C0474594D1CFD6468BB224"><enum>(i)</enum><header>In general</header><text>The value of an EBT card provided under the Program to an eligible household shall be $60 per month per child (adjusted for inflation).</text></clause><clause id="HEAFBEC09E8F94E84B5395F72B6776D8A"><enum>(ii)</enum><header>Annual limitation</header><text>No eligible household shall receive benefits under the Program for more than 3 months in a calendar year.</text></clause></subparagraph><subparagraph commented="no" id="HEFDECF21FA0341819FD3F3831A777493"><enum>(D)</enum><header>Administration</header><clause commented="no" id="H5D364A03E7BB45E49A25F8583A42D053"><enum>(i)</enum><header>In general</header><text>Except as provided under this paragraph, the Program shall be based on the summer electronic benefit transfer for children demonstration program carried out pursuant to section 749(g) of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/80">Public Law 111–80</external-xref>; 123 Stat. 2132).</text></clause><clause commented="no" id="H5B61AE71643044B3B327E53DCC164C4F"><enum>(ii)</enum><header>SNAP or <enum-in-header>WIC</enum-in-header></header><subclause commented="no" id="HCAD907DF2C63478781606D2BC31FFBF1"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subclause (II), a State shall administer the Program through the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011</external-xref> et seq.).</text></subclause><subclause commented="no" id="H720BFFB1C5104FB88095BFE3A817844D"><enum>(II)</enum><header>WIC option</header><text>If a State has participated in the demonstration program described in clause (i) before the effective date specified in section 2 of the <short-title>Universal School Meals Program Act of 2021</short-title>, the State may elect to administer the Program through the special supplemental nutrition program for women, infants, and children established by section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>).</text></subclause></clause></subparagraph><subparagraph id="H39AAF6976AF24D6CB5D6D0BB33027936"><enum>(E)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary to carry out this paragraph such sums as are necessary for fiscal year 2021 and each fiscal year thereafter.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" id="H579EE37919A646E88913F3DF200507A4"><enum>207.</enum><header>Child and adult care food program</header><text display-inline="no-display-inline">Section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>) is amended—</text><paragraph commented="no" id="H7F81B5F1124847B59986BFAE93C0D58D"><enum>(1)</enum><text>in subsection (a)(2), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEE6CCB6E554F4A8A8521251DF7085BD8"><subparagraph commented="no" id="HB3017A027F7840599B8393E236D9D49F"><enum>(B)</enum><text display-inline="yes-display-inline">any other private organization providing nonresidential child care or day care outside school hours for school children;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HE523E1568F224F17897140A1E840F6D3"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8A26603BEF034976A6B843B8475D9A0F"><subsection commented="no" id="H8C9EE565E22341328893F852AAF31147"><enum>(c)</enum><header>Free meals</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law—</text><paragraph commented="no" id="HB0FBEAD76D534BF3B468F70FC7505CB3"><enum>(1)</enum><text display-inline="yes-display-inline">all meals and supplements served under the program authorized under this section shall be provided for free to participants of the program; and</text></paragraph><paragraph commented="no" id="HB0E6FCC692274D41906974446FBF1141"><enum>(2)</enum><text>an institution that serves those meals and supplements shall be reimbursed—</text><subparagraph commented="no" id="HA885411B065D415AAF0F079F72497657"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of breakfast, at the rate established for free breakfast under section 4(b)(1)(B)(i) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773(b)(1)(B)(i)</external-xref>);</text></subparagraph><subparagraph commented="no" id="HEC6A71838B9F4342B2536EE65C361986"><enum>(B)</enum><text>in the case of lunch, at the rate established for free lunch under section 4(b)(2)(A); and</text></subparagraph><subparagraph commented="no" id="H0546EFE2950A4A3599E4FABAEEAEE89E"><enum>(C)</enum><text>in the case of a supplemental meal, $0.96, adjusted for inflation in accordance with section 4(b)(2)(C).</text></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="HCB7D0788F9C94EF8B1D818E79F5BB567"><enum>(3)</enum><text>in subsection (f)—</text><subparagraph id="H9EB33F9205A94EB09E454A71049AFEC9"><enum>(A)</enum><text>in paragraph (2), by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1A6397DAD80449A8A2AEDADF0A5DF56B"><subparagraph commented="no" id="H09160C6C14EA436FA1EB7A55786F6411"><enum>(B)</enum><header>Limitation to reimbursements</header><text display-inline="yes-display-inline">An institution may claim reimbursement under this paragraph for not more than 3 meals and 1 supplement per day per child.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9ABF40B577714F50BFFFC1870EF5E81E"><enum>(B)</enum><text>by striking paragraph (3); and</text></subparagraph></paragraph><paragraph commented="no" id="H6042BD93DD3142118BCEC4F6070143A3"><enum>(4)</enum><text>in subsection (r)—</text><subparagraph commented="no" id="HCABF41582D1B45F796FB3FB22B1106E7"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text level="subsection" style="OLC">Program for at-risk school children</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Afterschool meal and snack program</header-in-text></quote>;</text></subparagraph><subparagraph id="H052556FC62E14A68AF2D8F0370FC6F7E"><enum>(B)</enum><text>by striking <quote>at-risk school</quote> each place it appears and inserting <quote>eligible</quote>;</text></subparagraph><subparagraph id="H039A1D602294476589A5A9902860BF15"><enum>(C)</enum><text>in paragraph (1)—</text><clause id="H523E86B8F6A747398EFC4975F3B8925F"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">at-risk school</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">eligible</header-in-text></quote>; and</text></clause><clause id="HFDA7B30C95234E61B23A7AFB25532E50"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>operated</quote> and all that follows through the period at the end and inserting a period; and</text></clause></subparagraph><subparagraph id="HEEBB9B24120F44C189CB16B33E415BC5"><enum>(D)</enum><text>in paragraph (4)(A), by striking <quote>only for</quote> and all that follows through the period at the end and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HD5EFCD49BBFA475DB8ED8F0AC952769B"><text>for—</text><clause id="H43DA19AEF88D4264AF411577964BC79B"><enum>(i)</enum><text>not more than 1 meal and 1 supplement per child per day served on a regular school day; and</text></clause><clause id="H355C1AE0CE9D4AC681F6B871604DC0F8"><enum>(ii)</enum><text>not more than 3 meals and 1 supplement per child per day served on any day other than a regular school day.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H5BB2159705F743B6B3DEC19D2A5197A9"><enum>208.</enum><header>Meals and supplements for children in afterschool care</header><text display-inline="no-display-inline">Section 17A of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766a">42 U.S.C. 1766a</external-xref>) is amended—</text><paragraph id="H4F1C66DEA2BB450B9B401C41BD29BFAC"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Meal supplements</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Meals and supplements</header-in-text></quote>;</text></paragraph><paragraph id="H4049515AF2254CBCB83B64DDC3E19AD2"><enum>(2)</enum><text>in subsection (a)(1), by striking <quote>meal supplements</quote> and inserting <quote>free meals and supplements</quote>;</text></paragraph><paragraph id="H287E1A7708294B4DB5BBDA493903ABBB"><enum>(3)</enum><text>in subsection (b), by inserting <quote>meals and</quote> before <quote>supplements</quote>; and</text></paragraph><paragraph id="H41F9E30D1B8B48A1B255607BC91C40AC"><enum>(4)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H62E8F19CE3B1437C87FB72F55D6CF306"><subsection id="HF10592B9519B40A7A50711CD5F419155"><enum>(c)</enum><header>Reimbursement</header><paragraph id="H4E3FE59296924CA88424C63165BCE42E"><enum>(1)</enum><header>In general</header><subparagraph id="H19692F1926BD493380933D55D494A3FA"><enum>(A)</enum><header>Meals</header><text>A free meal provided under this section to a child shall be reimbursed at a rate of $3.81, adjusted annually for inflation in accordance with paragraph (3)(A) and rounded in accordance with paragraph (3)(B).</text></subparagraph><subparagraph id="HAA8D024D5D3E42838B3EEF0EE2CE0033"><enum>(B)</enum><header>Supplements</header><text>A free supplement provided under this section to a child shall be reimbursed at the rate at which free supplements are reimbursed under section 17(c)(2)(C).</text></subparagraph></paragraph><paragraph commented="no" id="HA07800AD4AD346108F86467C3EE58FE5"><enum>(2)</enum><header>Limitation to reimbursements</header><text display-inline="yes-display-inline">An institution may claim reimbursement under this section for not more than 1 meal and 1 supplement per day per child served on a regular school day.</text></paragraph><paragraph commented="no" id="HD36D6EF9CB4F4B3EA5C069EFA82D8C00"><enum>(3)</enum><header>Inflation; rounding</header><subparagraph id="H37F39723CC2C472C9DE7A06B73290C8C"><enum>(A)</enum><header>Inflation adjustment</header><clause id="H7D1EE7BEE3434AB28999024A431142CE"><enum>(i)</enum><header>In general</header><text>The annual inflation adjustment under paragraph (1)(A) shall reflect changes in the cost of operating the program under this section, as indicated by the change in the Consumer Price Index for food away from home for all urban consumers.</text></clause><clause id="H5C3930AD8CD646D4BEA33DE92E217EF0"><enum>(ii)</enum><header>Basis</header><text>Each inflation annual adjustment under paragraph (1)(A) shall reflect the changes in the Consumer Price Index for food away from home for the most recent 12-month period for which that data is available.</text></clause></subparagraph><subparagraph id="HFD4DA59F37D145C48B566DEFCE48ABC6"><enum>(B)</enum><header>Rounding</header><text>On July 1, 2021, and annually thereafter, the reimbursement rate for a free meal under this section shall be—</text><clause id="H9243226D30294E1CAFEF58A94CF0E906"><enum>(i)</enum><text>adjusted to the nearest lower-cent increment; and</text></clause><clause id="HCC5ED4B321234582ADC7D9D8053902C7"><enum>(ii)</enum><text>based on the unrounded amounts for the preceding 12-month period.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="H68C501574400437B8982A5C6C6A6E9D6"><enum>209.</enum><header>Access to local foods: farm to school program</header><text display-inline="no-display-inline">Section 18(g)(5) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769(g)(5)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC8CD8B0D9DF94693BB35734C967F4AD9"><subparagraph commented="no" id="HCD9D58086F534A82BB152758BDCB5273"><enum>(B)</enum><text display-inline="yes-display-inline">serve a high proportion of identified students (as defined in paragraph (8) of section 1113(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)</external-xref>));</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="H0AD7B27AC6DA46B5B85ED79F8EF1459A"><enum>210.</enum><header>Fresh fruit and vegetable program</header><text display-inline="no-display-inline">Section 19(d) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769a">42 U.S.C. 1769a(d)</external-xref>) is amended—</text><paragraph id="H9D015664606A4E66A94B9DD7BD07410F"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H18FA1753D50A46A68D96B1C6E386D250"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>paragraph (2) of this subsection and</quote>;</text></subparagraph><subparagraph id="H489C1B473EDD42BC88DD752C2895F5BF"><enum>(B)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>school—</quote> and all that follows through <quote>submits</quote> in clause (ii) and inserting <quote>school that submits</quote>;</text></subparagraph><subparagraph id="H8F23BF5999664543A83C6DAEF991A7CA"><enum>(C)</enum><text>in subparagraph (B), by striking <quote>schools</quote> and all that follows through <quote>Act</quote> and inserting <quote>high-need schools (as defined in section 2211(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6631">20 U.S.C. 6631(b)</external-xref>))</quote>; and</text></subparagraph><subparagraph id="H02F2E9183AED40E985C1D07D10A34046"><enum>(D)</enum><text>in subparagraph (D)—</text><clause id="H1503981B34E14768ADA13723A6E7A81B"><enum>(i)</enum><text>by striking clause (i); and</text></clause><clause id="HAAB6D74F1F54475EAF20231511291A79"><enum>(ii)</enum><text>by redesignating clauses (ii) through (iv) as clauses (i) through (iii), respectively; and</text></clause></subparagraph></paragraph><paragraph id="H7882EA676C1C48B78032BB1650E1F0BC"><enum>(2)</enum><text>by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H55BFB5AD6C1146128D1D29FA5480E966"><paragraph commented="no" id="H7D3DE52551B644C4B8234233A6ACC8A9"><enum>(2)</enum><header>Outreach to high-need schools</header><text display-inline="yes-display-inline">Prior to making decisions regarding school participation in the program, a State agency shall inform high-need schools (as defined in section 2211(b) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6631">20 U.S.C. 6631(b)</external-xref>)), including Tribal schools, of the eligibility of the schools for the program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" id="HD77662D88D7E4249A79377FDB64823FB"><enum>211.</enum><header>Training, technical assistance, and Food Service Management Institute</header><text display-inline="no-display-inline">Section 21(a)(1)(B) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769b-1">42 U.S.C. 1769b–1(a)(1)(B)</external-xref>) is amended in the matter preceding clause (i) by striking <quote>certified to receive free or reduced price meals</quote> and inserting <quote>who are identified students (as defined in paragraph (8) of section 1113(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6313">20 U.S.C. 6313(a)</external-xref>)</quote>.</text></section><section commented="no" id="H89D98545C65F4DF8BF74F4EC3F1D709C"><enum>212.</enum><header>Reimbursement of school meal delinquent debt program</header><subsection commented="no" id="H0DB191C4AF5B4453AEC4F2A5702DC584"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H9AA008975E7A48E28D508958A57AD089"><enum>(1)</enum><header>Delinquent debt</header><text>The term <term>delinquent debt</term> means the debt owed by a parent or guardian of a child to a school—</text><subparagraph commented="no" id="HEA81F02744EA4B7C9EC7843A155BD63C"><enum>(A)</enum><text>as of the effective date specified in section 2; and</text></subparagraph><subparagraph commented="no" id="H2CB811673EDA4EDEA020DC080A8E3877"><enum>(B)</enum><text>for meals served by the school under—</text><clause commented="no" id="H2605A89EECD346D781DD11F5C9333420"><enum>(i)</enum><text>the school breakfast program under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>);</text></clause><clause commented="no" id="H4A1ED8444D664ECABDD2FB6E73FB8B40"><enum>(ii)</enum><text>the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.); or</text></clause><clause commented="no" id="HFD1FCB5E2AA342F4BC7D564808A9CF7D"><enum>(iii)</enum><text>both of the programs described in clauses (i) and (ii).</text></clause></subparagraph></paragraph><paragraph commented="no" id="H61325F19A9C045D9AA07A5856A8ADD35"><enum>(2)</enum><header>Program</header><text>The term <term>program</term> means the program established under subsection (b)(1).</text></paragraph><paragraph commented="no" id="HDA8BF6C1D82E48A992BFA86FA50D7300"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection commented="no" id="HF16A883CB4FF4B4790FDCF1F8F3E8ED6"><enum>(b)</enum><header>Reimbursement program</header><paragraph commented="no" id="H16798E1A03CD41C99C672AB1667D5771"><enum>(1)</enum><header>Establishment</header><text>Not later than 60 days after the effective date specified in section 2, the Secretary shall establish a program under which the Secretary shall reimburse each school participating in a program described in clause (i) or (ii) of subsection (a)(1)(B) for all delinquent debt.</text></paragraph><paragraph commented="no" id="H8C8E11867ABF43C3824B044B2EE44F9F"><enum>(2)</enum><header>Form for reimbursement</header><text>To carry out the program, the Secretary shall design and distribute a form to State agencies to collect data on all delinquent debt in applicable schools in the State, grouped by school food authority.</text></paragraph><paragraph commented="no" id="HA6D6647BCAA940D88F11D25FC8A4FFC5"><enum>(3)</enum><header>Completion date</header><text>The Secretary shall provide all reimbursements under the program not later than 180 days after the effective date specified in section 2.</text></paragraph></subsection><subsection commented="no" id="HB03A2C8BC7AE48C88B9A702D30D25F49"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the effective date specified in section 2, the Comptroller General of the United States shall submit to Congress and make publicly available a report that describes the successes and challenges of the program.</text></subsection></section><section id="H089ECECED53A473298D05EA61185DF33" commented="no"><enum>213.</enum><header>Conforming amendments</header><text display-inline="no-display-inline">The Richard B. and</text></clause><clause id="H64149C31EDD343839F7BE0D1BA908DF5"><enum>(ii)</enum><text>in which—</text><subclause id="H5C2FB7636346441D9A2B7B084B89BDE9"><enum>(I)</enum><text display-inline="yes-display-inline">at least 50 percent of the students enrolled are identified students (as defined in section 1113(a)(8) of the Elementary and Secondary Education Act of 1965); or</text></subclause><subclause id="H10CA726785354534B819780FAAE735F0"><enum>(II)</enum><text>if an eligible entity determines that it would promote the effectiveness of a program, an entire grade level of students, beginning not later than the 7th grade, reside in public housing, as defined in section 3(b)(1) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)(1)</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDF7FC089D6494C77A18F8312B8BEE567"><enum>(c)</enum><header>Simplified needs test</header><text display-inline="yes-display-inline">Section 479(d)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ss">20 U.S.C. 1087ss(d)(2)</external-xref>) is amended—</text><paragraph id="H4D88D5CB832A4CBFA6BA05CB88BCF83C"><enum>(1)</enum><text>by striking subparagraph (C); Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.).</text></paragraph><paragraph id="HAF1E5700D77C46DABAA2895111F8E356"><enum>(2)</enum><header>Guidance</header><text>Not later than 1 year after the date of the enactment of the <short-title>Universal School Meals Program Act of 2021</short-title>, the Attorney General, in consultation with the Secretary of Agriculture, shall provide guidance to States relating to the options for school food authorities in the States to apply for reimbursement for free lunches under the Richard B.
