which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide benefits authorized under the Longshore and Harbor Workers’ Compensation Act to maritime workers who contract COVID–19, and for other purposes.</official-title></form><legis-body id="H74691FF10C904FDFA8D7D2AD5106CD40" style="OLC"><section id="H01CEAF6DD16A45BD93D0F38120C03339" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Longshore and Harbor Workers’ COVID–19 Compensation Act of 2021</short-title></quote>.</text></section><section id="H85E1CCCC571B4F06A31B1D44291AAAEE"><enum>2.</enum><header>Claims related to COVID–<enum-in-header>19</enum-in-header></header><subsection id="HE4C65DB7A9A34CF9A4099D471A7A3DCF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A covered employee who receives a diagnosis of COVID–19 or is subject to an order described in subsection (b)(2) and who provides notice of or files a claim under the Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/901">33 U.S.C. 901</external-xref> et seq.) relating to such diagnosis or order shall be conclusively presumed to have an injury arising out of or in the course of employment for the purpose of compensation under the Longshore and Harbor Workers’ Compensation Act.</text></subsection><subsection id="H922444B0CD264360920727B69E8D9841"><enum>(b)</enum><header>Covered employee</header><text display-inline="yes-display-inline">In this Act, the term <term>covered employee</term> means an individual who, at any time during the period beginning January 27, 2020, and ending on January 27, 2023, is an employee engaged in maritime employment as defined in section 2 of the Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/902">33 U.S.C. 902(3)</external-xref>) and who—</text><paragraph id="H7613EDCBD5514FAC8D4F0A9908A2976C"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC376BA2D2C4C4EC7BC2503411DC73848"><enum>(A)</enum><text>is diagnosed with COVID–19; and</text></subparagraph><subparagraph id="H4D0CDC2172A0471CA0FCFD16D37C5E5E" indent="up1"><enum>(B)</enum><text>during a covered exposure period with respect to the date of such diagnosis carried out duties which—</text><clause id="HED723E7C35E742D3B8B904354AEFAB61"><enum>(i)</enum><text>required contact with members of the public, co-workers, or other individuals associated with the course of employment; or</text></clause><clause id="H103CE3D8CE75492EB80956432BA24ECA"><enum>(ii)</enum><text>included a risk of exposure to the novel coronavirus; or</text></clause></subparagraph></paragraph><paragraph id="H9F49DD5010AF48FE863B19319A427FC3"><enum>(2)</enum><text>is ordered not to return to work by the employee’s employer or by a local, State, or Federal agency because of exposure, or the risk of exposure, to 1 or more individuals diagnosed with COVID–19 in the workplace.</text></paragraph></subsection><subsection id="H3357B5930A074C5BBC6A9EAAF565C8D6"><enum>(c)</enum><header>Clarification of maritime employment</header><text>For the purposes of subsection (b), maritime employment does not include employment under—</text><paragraph id="HE459415B1FB743C89DD9E10CCD05B904"><enum>(1)</enum><text>the Defense Base Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1651">42 U.S.C. 1651</external-xref> et seq.);</text></paragraph><paragraph id="H61D581132CEB4AFEA4BD739AEA1A3D25"><enum>(2)</enum><text>the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1333">43 U.S.C. 1333(b)</external-xref>); and</text></paragraph><paragraph id="H0150DB399ADC4F0782DB6A4E8163E936"><enum>(3)</enum><text>section 8171 of title 5, United States Code.</text></paragraph></subsection><subsection id="HEE23A9655EE84D33B12259D91BE284BF"><enum>(d)</enum><header>Limitation</header><text display-inline="yes-display-inline">This Act shall not apply with respect to a covered employee who—</text><paragraph id="HB0EBD8E07664464F9B3807F9F424505C"><enum>(1)</enum><text display-inline="yes-display-inline">provides notice or files a claim described in subsection (a) on or before the date of enactment of this Act; and</text></paragraph><paragraph id="HE047A425A2174B2ABECF61E0AA5AFC13"><enum>(2)</enum><text display-inline="yes-display-inline">is determined to be entitled to the compensation described in subsection (a) or is awarded such compensation if such determination or award is made on or before the date of enactment of this Act.</text></paragraph></subsection><subsection id="H027F9436F66C4871ABD98BD88B43C6BF"><enum>(e)</enum><header>Denials on or before the date of enactment</header><text display-inline="yes-display-inline">Subsection (a) shall apply with respect to a covered employee who is determined not to be entitled to, or who is not awarded, compensation described in subsection (a) if such determination or decision not to award such compensation is made on or before the date of enactment of this Act.</text></subsection><subsection id="HA0A10549DB3D4DBA8DE95D8DA45C6C75"><enum>(f)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The Secretary shall not consider any compensation paid with respect to a notice or claim to which subsection (a) applies, including disability compensation, death benefits, funeral and burial expenses, and medical expenses, in calculating the annual assessments under section 44(c)(2) of the Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/944">33 U.S.C. 944(c)(2)</external-xref>).</text></subsection></section><section id="H3FF10FA4DE5545AD83B9365588531893"><enum>3.</enum><header>Reimbursement</header><subsection id="HB96D8A5C78184C91AF4BCEEE197F96BF"><enum>(a)</enum><header>In general</header><paragraph id="HD8B120407AFA4375BF83F33A3ABE1659"><enum>(1)</enum><header>Entitlement</header><text>An employer of a covered employee or the employer’s carrier shall be entitled to reimbursement pursuant to this Act for any compensation paid with respect to a notice or claim described in section 2(a), including disability compensation, death benefits, funeral and burial expenses, medical or other related costs for treatment and care, and reasonable and necessary allocated claims expenses.</text></paragraph><paragraph id="HE1A14AF22C0142599D13FE072270E16A"><enum>(2)</enum><header>Safety and health requirements</header><text>To be entitled to reimbursement under paragraph (1)—</text><subparagraph id="H2FDF45A58FF74B0AAA12D5C52A46CCF8"><enum>(A)</enum><text>an employer shall be in compliance with all applicable safety and health guidelines and standards that are related to the prevention of occupational exposure to the novel coronavirus, including such guidelines and standards issued by the Occupational Safety and Health Administration, State plans approved under section 18 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/667">29 U.S.C. 667</external-xref>), the Centers for Disease Control and Prevention, and the National Institute for Occupational Safety and Health; and</text></subparagraph><subparagraph id="H81FE256F4C7C43F19D06921186CF963F"><enum>(B)</enum><text>a carrier—</text><clause id="HE5BB3374D95A4F7FBF4E3731BCF84E48"><enum>(i)</enum><text>shall be a carrier for an employer that is in compliance with subparagraph (A); and</text></clause><clause id="H396897E50CC34C6E81D719AD5F8738E7"><enum>(ii)</enum><text>shall not adjust the experience rating or the annual premium of the employer based upon the compensation paid by the carrier with respect to a notice or claim described in section 2(a).</text></clause></subparagraph></paragraph></subsection><subsection id="HED10071EEB6640C5AD204CBA05A031C8"><enum>(b)</enum><header>Reimbursement procedures</header><paragraph id="H21A2C252964D4A908571FC255323FD0A"><enum>(1)</enum><header>In general</header><text>To receive reimbursement under subsection (a), a claim for such reimbursement shall be submitted to the Secretary of Labor—</text><subparagraph id="H779C06A7BB7A4FE2A14EBA9318865B3E"><enum>(A)</enum><text>not earlier than the date on which a compensation order (as described in section 19(e) of the Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/919">33 U.S.C. 919(e)</external-xref>)) is issued that fixes entitlement to benefits; or</text></subparagraph><subparagraph id="HD01E0E9F9CEC4B04A438A65F05B6CCD5"><enum>(B)</enum><text display-inline="yes-display-inline">not later than one year after the final payment of compensation to a covered employee pursuant to this Act; and</text></subparagraph><subparagraph id="H9E89E9D1EB3A4A80967335382E6CD01E"><enum>(C)</enum><text display-inline="yes-display-inline">in accordance with a rule issued by the Secretary that the Secretary determines to be similar to the process established under part 61 of title 20, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></subparagraph></paragraph><paragraph id="H04C04AF94F1D4795B39C2016F306D733"><enum>(2)</enum><header>Records</header><text display-inline="yes-display-inline">An employer and the employer’s carrier shall make, keep, and preserve such records, make such reports, and provide such information, as the Secretary of Labor determines necessary or appropriate to carry out this Act.</text></paragraph><paragraph id="H4825D6E7E80847CB8F0D696255804815"><enum>(3)</enum><header>Final agency action</header><text>The action of the Secretary in allowing or denying reimbursement under this section shall be the final Agency action with respect to such reimbursement.</text></paragraph></subsection><subsection id="H381F38D1BBB84E1BBFB27084DC4A4463"><enum>(c)</enum><header>Appropriations</header><paragraph id="HCAF00060A4F1473EA20529671B042968"><enum>(1)</enum><header>In general</header><text>A reimbursement under this section shall be paid out of the Longshore COVID–19 Fund established in section 45 of the Longshore and Harbor Workers’ Compensation Act (in this Act, referred to as the <quote>Longshore COVID–19 Fund</quote>).</text></paragraph><paragraph id="H6C27683F7E094F619BCC6EFE9B7F929B"><enum>(2)</enum><header>Funds</header><text>In addition to amounts otherwise available, there are authorized to be appropriated, and there are appropriated, out of any money in the Treasury not otherwise appropriated, such sums as may be necessary to the Longshore COVID–19 Fund for each reimbursement paid out of such Fund under this section.</text></paragraph></subsection><subsection id="HFA3BCEF602744F36A83B6C5969253D3E"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 60 days after the end of each of fiscal years 2021, 2022, and 2023, the Secretary of Labor shall submit to the Committee on Education and Labor of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate, an annual report enumerating—</text><paragraph id="H4B9CE430C6C34FFDA18A01FE225FF7A7"><enum>(1)</enum><text display-inline="yes-display-inline">the number of claims filed pursuant to section 2(a);</text></paragraph><paragraph id="H1CCED7A4649949DD9F84715E70EC23C7"><enum>(2)</enum><text display-inline="yes-display-inline">of such filed claims—</text><subparagraph id="HF3DDC3C88E2049C3864778700B3561D3"><enum>(A)</enum><text display-inline="yes-display-inline">the number and types of claims under the Longshore and Harbor Workers Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/901">33 U.S.C. 901</external-xref> et seq.) with respect to which the presumption under section 2(a) is made;</text></subparagraph><subparagraph id="HED483E49E30E4E76AAE9DF54AABED2EE"><enum>(B)</enum><text display-inline="yes-display-inline">the number and types of such claims denied; and</text></subparagraph><subparagraph id="H72771C93FEA743568974D6B1EE3C47D1"><enum>(C)</enum><text display-inline="yes-display-inline">the number and types of such claims pending; and</text></subparagraph></paragraph><paragraph id="H407707537F1147CCB8060025549F4C3F"><enum>(3)</enum><text display-inline="yes-display-inline">the total number of claims for reimbursement and the total amounts paid for such reimbursement from the Longshore COVID–19 Fund under subsection (c)(1) for the fiscal year for which the report is being submitted.</text></paragraph></subsection><subsection id="HA85DC04411A24B60A0E2D3B0EEFC8D50"><enum>(e)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Labor may promulgate such regulations as may be necessary to carry out this Act.</text></subsection><subsection id="HAA5014CABBA14903931675078C7F18A3"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="H93C12B05855F41D4A4D3FFEA1019AF9E"><enum>(1)</enum><header>Covered exposure period</header><text display-inline="yes-display-inline">The term <quote>covered exposure period</quote> with respect to the date of a diagnosis described in section 2(b)(1)(A), means the period of days—</text><subparagraph id="HD1D1EDB1EFD6463CB055511C24BD476E"><enum>(A)</enum><text>ending on the date of such diagnosis; and</text></subparagraph><subparagraph id="H9F966025CD1D448BB9A8B52C22153BBD"><enum>(B)</enum><text>equal to the maximum number of days that the Secretary of Labor, with the concurrence of the Director of the National Institute of Occupational Safety and Health, determines could occur between an exposure to the novel coronavirus and a diagnosis of COVID–19 resulting from such exposure. </text></subparagraph></paragraph><paragraph id="H0C49B87C184044DD91489AF2E3AC4C3C"><enum>(2)</enum><header>LHWCA terms</header><text display-inline="yes-display-inline">The terms <term>carrier</term>, <term>compensation</term>, <term>employee</term>, and <term>employer</term> have the meanings given the terms in section 2 of the Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/902">33 U.S.C. 902</external-xref>).</text></paragraph><paragraph id="H2BF984DDC4F9426CBEA4171C6444E82C"><enum>(3)</enum><header>Novel coronavirus</header><text display-inline="yes-display-inline">The term <term>novel coronavirus</term> means SARS–CoV–2, a variant of SARS–CoV–2, or any other coronavirus declared to be a pandemic by public health authorities.</text></paragraph></subsection></section><section id="HE4C69D408FCC49F48D6E350672601A53"><enum>4.</enum><header>Longshore COVID–<enum-in-header>19</enum-in-header> Fund</header><text display-inline="no-display-inline">The Longshore and Harbor Workers’ Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/33/901">33 U.S.C. 901</external-xref> et seq.) is amended by adding after section 44 the following:</text><quoted-block style="OLC" id="H5E010F8057D84641A826A6CA28D24B16" display-inline="no-display-inline"><section id="H1EF8B7CD8B654DC8A9930192B28E940B"><enum>45.</enum><header>Longshore COVID–<enum-in-header>19</enum-in-header> Fund</header><subsection id="HC53B2AFCA8C34EEFBB596B40D5D4E93F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States the Longshore COVID–19 Fund (in this section, referred to as the ‘Fund’), which consists of sums that are appropriated to the Fund under section 3(c) of the Longshore and Harbor Workers’ COVID–19 Compensation Act of 2021.</text></subsection><subsection id="H44B7810AC79743279F30B48A016330CF"><enum>(b)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Amounts in the Fund shall be available for the reimbursement of an employer or the employer’s carrier for compensation payments and expenses approved under section 3 of the Longshore and Harbor Workers’ COVID–19 Compensation Act of 2021, including disability compensation, death benefits, funeral and burial expenses, medical or other related costs for treatment and care, and reasonable and necessary allocated claims expenses paid under this Act when reimbursement is required under section 3 of the Longshore and Harbor Workers’ COVID–19 Compensation Act of 2021, subject to any limitations in such section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
