which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to expand the availability of medical nutrition therapy services under the Medicare program.</official-title></form><legis-body id="H40DF250A5FE64C4DAB7FDC8661D61A69" style="OLC"><section id="H4EB7744E425E4BA7BB0C6115C6A495D8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Nutrition Therapy Act of 2021</short-title></quote>.</text></section><section id="HA093187592E0497F8E24E6A561E69013"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H8D598E15E3504352A77DB12DDB0424BF"><enum>(1)</enum><text display-inline="yes-display-inline">Over two-thirds of Medicare fee-for-service beneficiaries have two or more chronic conditions, many of which can be prevented, delayed, treated, or managed through nutrition.</text></paragraph><paragraph id="HC345A8801D974E0EAFBDD2921F0A3C79"><enum>(2)</enum><text display-inline="yes-display-inline">Individuals from many racial and ethnic minority backgrounds are more likely to be diagnosed with chronic diseases such as diabetes, prediabetes, chronic kidney disease, end-stage renal disease, and obesity.</text></paragraph><paragraph id="H36B9D298515B402C804A4EF8E71C6F74"><enum>(3)</enum><text display-inline="yes-display-inline">The Centers for Disease Control and Prevention finds that individuals are at an increased risk of severe illness from COVID–19 if they have cancer, chronic kidney disease, diabetes, heart conditions such as health failure or coronary artery disease, or obesity.</text></paragraph><paragraph id="HA5671F66A3A144DD9892E0343FE1105F"><enum>(4)</enum><text display-inline="yes-display-inline">Coverage for medical nutrition therapy is only available to Medicare part B beneficiaries with diabetes or a renal disease, despite medical nutrition therapy being part of the standard of care, in clinical guidelines, and medically necessary for many more chronic conditions.</text></paragraph><paragraph id="H35B41FAE41E44A7EA00973661DCBB223"><enum>(5)</enum><text display-inline="yes-display-inline">Medical nutrition therapy has been shown to be a cost-effective component of treatment for obesity, diabetes, hypertension, dyslipidemia, HIV infection, unintended weight loss in older adults and other chronic conditions.</text></paragraph></section><section id="HC4147D802B8048FEA916E8D642707BD3"><enum>3.</enum><header>Expanding the availability of medical nutrition therapy services under the Medicare program</header><subsection id="H9A39ABFB5B454E819CC5F9910EDABF2D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="H624DA179A79C4AFD820F0911CF08DFBE"><enum>(1)</enum><text>in subsection (s)(2)(V), by striking <quote>in the case of</quote> and all that follows through <quote>organizations</quote>; and</text></paragraph><paragraph id="H7711EB3A75584C6C8B828A904D8181D3"><enum>(2)</enum><text>in subsection (vv)—</text><subparagraph id="H187DB88C4D494022B7CC96EF7DA9E99F"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H2531C838D51448A9B57DEB6C73753050"><enum>(i)</enum><text>by striking <quote>disease management</quote> and inserting <quote>the prevention, management, or treatment of a disease or condition specified in paragraph (4)</quote>; and</text></clause><clause id="H4D8F3365C29E412DB98E49A15F729A33"><enum>(ii)</enum><text>by striking <quote>by a physician</quote> and all that follows through the period at the end and inserting the following: </text><quoted-block style="OLC" id="H8A1DB94BC6C14A88842FB4E76555709C" display-inline="yes-display-inline"><text>by a—</text><subparagraph id="H2AE33F0FFDD94944B5B5B36547CA0EBD"><enum>(A)</enum><text display-inline="yes-display-inline">physician (as defined in subsection (r)(1));</text></subparagraph><subparagraph id="HEA202F76965A47EBA0A68F07BAC618B3"><enum>(B)</enum><text>physician assistant;</text></subparagraph><subparagraph id="H3874AF268A9347B784BD21B6D5F96E2E"><enum>(C)</enum><text>nurse practitioner;</text></subparagraph><subparagraph id="H06D8D9B842D240919AE07AA1FE2A0AAD"><enum>(D)</enum><text>clinical nurse specialist (as defined in subsection (aa)(5)(B)); or</text></subparagraph><subparagraph id="H0E6E6E8BBE4C4D1EA83BD098D96DDC71"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of such services furnished to manage such a disease or condition that is an eating disorder, a clinical psychologist (as defined by the Secretary).</text></subparagraph><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Such term shall not include any services furnished to an individual for the prevention, management, or treatment of a renal disease if such individual is receiving maintenance dialysis for which payment is made under section 1881.</quoted-block-continuation-text><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H25ED0434E39D4C53969817C32A189C34"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H525F83FD21744BF5A7A4CD9547822F50" display-inline="no-display-inline"><paragraph id="H6ABFC4A61FF44CE98CCFF59CFD23E663" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), the diseases and conditions specified in this paragraph are the following:</text><subparagraph id="H07B049F69FF24EE29EAB85EE1F0A7E87"><enum>(A)</enum><text>Diabetes and prediabetes.</text></subparagraph><subparagraph id="H74CD1F917ABB46C19DC2DCF682B852DF"><enum>(B)</enum><text>A renal disease.</text></subparagraph><subparagraph id="HB451C243475A4893ABA703E7BAB5EE53"><enum>(C)</enum><text>Obesity (as defined for purposes of subsection (yy)(2)(C) or as otherwise defined by the Secretary).</text></subparagraph><subparagraph id="HF6939930B654484D9DAB6645A6DF2ACA"><enum>(D)</enum><text>Hypertension.</text></subparagraph><subparagraph id="H05F430A2AA2C4D27BEB5CD7A0277EC2A"><enum>(E)</enum><text>Dyslipidemia.</text></subparagraph><subparagraph id="H32876A0AE4DF4B7186DDA7C28530BA0F"><enum>(F)</enum><text>Malnutrition.</text></subparagraph><subparagraph id="HF02382CE1D094A28920370390585782A"><enum>(G)</enum><text>Eating disorders.</text></subparagraph><subparagraph id="H3576786250D847BF872104F895FDBF91"><enum>(H)</enum><text>Cancer.</text></subparagraph><subparagraph id="H70E4A24CCFA440BBA9A8A4D9930F43BE"><enum>(I)</enum><text>Gastrointestinal diseases, including celiac disease.</text></subparagraph><subparagraph id="HE52FC3A3AEC546BBA32E17F08B4716C3"><enum>(J)</enum><text>HIV.</text></subparagraph><subparagraph id="HABAA2425F72C454EA7C874DB44B6B319"><enum>(K)</enum><text>AIDS.</text></subparagraph><subparagraph id="HCD4E0A66F6214F4D94ADBCD7BC6A47D9"><enum>(L)</enum><text>Cardiovascular disease.</text></subparagraph><subparagraph id="HDF7A5992677346DB8E33484751F578D0"><enum>(M)</enum><text>Any other disease or condition—</text><clause id="HB6B1E94E9E4A4749BE22147CBA4648D1"><enum>(i)</enum><text>specified by the Secretary relating to unintentional weight loss; </text></clause><clause id="HBCFBB29F0E164BF485E197AE1A5D2539"><enum>(ii)</enum><text>for which the Secretary determines the services described in paragraph (1) to be medically necessary and appropriate for the prevention, management, or treatment of such disease or condition, consistent with any applicable recommendations of the United States Preventive Services Task Force; or</text></clause><clause id="H331112CC083B4104BC17FC5E8B977DC6"><enum>(iii)</enum><text display-inline="yes-display-inline">for which the Secretary determines the services described in paragraph (1) are medically necessary, consistent with either protocols established by registered dietitians or nutrition professional organizations or with accepted clinical guidelines identified by the Secretary. </text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H1DEAF325770546B59BB2BCF0AB57100F"><enum>(b)</enum><header>Exclusion modification</header><text display-inline="yes-display-inline">Section 1862(a)(1) is amended—</text><paragraph id="H82A4665E79554D749CAB41263743B583"><enum>(1)</enum><text>in subparagraph (O), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HCA54269332D8437F9E8CD83EC6E42610"><enum>(2)</enum><text>in subparagraph (P), by striking the semicolon at the end and inserting <quote>, and</quote>; and</text></paragraph><paragraph id="H0486B8B60671491595B08BC6C92AFDD6"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H0CBD6B35D93E403EB25CF2E86D9136AD" display-inline="no-display-inline"><subparagraph id="H7D031FDE8F0D4A00991906A9525D53DA" indent="up1"><enum>(Q)</enum><text display-inline="yes-display-inline">in the case of medical nutrition therapy services (as defined in section 1861(vv)), which are not furnished for the prevention, management, or treatment of a disease or condition specified in paragraph (4) of such section;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDD2AEDE1A3694A67A939943793942861"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to items and services furnished on or after January 1, 2023.</text></subsection></section></legis-body></bill>
