which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to modify the work opportunity credit for certain youth employees.</official-title></form><legis-body id="H364343BFFF6E4660A5B7E0AAF67D2F35" style="OLC"><section section-type="section-one" id="H8A8373C9D5394D2A81D2CD171E44296F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping to Encourage Real Opportunities (HERO) for Youth Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="HE38C726FBFF54368BFB4F735482FB310"><enum>2.</enum><header>Modification and extension of work opportunity credit for certain youth employees</header><subsection id="H99F37F10E0884FD2A91A434DD17D16E9"><enum>(a)</enum><header>Expansion of credit for summer youth</header><paragraph id="HA957D80E00034BEC86211F92271C39C3"><enum>(1)</enum><header>Credit allowed for year-round employment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/51">Section 51(d)(7)(A)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><subparagraph id="H4E099D4EC7A44DB5B59B48D660A7A328"><enum>(A)</enum><text>by striking clauses (i) and (iii) and redesignating clauses (ii) and (iv) as clauses (i) and (ii), respectively;</text></subparagraph><subparagraph id="H5311539205CE489BAF4162480FA448BC"><enum>(B)</enum><text>in clause (i) (as so redesignated), by striking <quote>(or if later, on May 1 of the calendar year involved),</quote>;</text></subparagraph><subparagraph commented="no" id="HF93AC239B1304FE3B998933809BF3A3B"><enum>(C)</enum><text>by striking the period at the end of clause (ii) (as so redesignated) and inserting <quote>, and</quote>; and</text></subparagraph><subparagraph commented="no" id="H751FB81625214E64B47AEE2891F006D1"><enum>(D)</enum><text>adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD33CB01752F84B28A6B6A652F4875DCF"><clause commented="no" id="H29FF4C3E906C4B5C9F97E432FB21CB65"><enum>(iii)</enum><text>who will be employed for not more than 20 hours per week during any period between September 16 and April 30 in which such individual is regularly attending any secondary school.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4F4E7A9AB1804711B9D3F6BCE30177D7"><enum>(2)</enum><header>Increase in credit amount</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/51">Section 51(d)(7)</external-xref> of the Internal Revenue Code of 1986 is amended by striking subparagraph (B) and by redesignating subparagraph (C) as subparagraph (B).</text></paragraph><paragraph id="H0F875E0B40634E2FADC29871017EE070"><enum>(3)</enum><header>Conforming amendments</header><subparagraph id="HE2133DF1DEA04700A6660DCCF1F126A4"><enum>(A)</enum><text>Subparagraph (F) of <external-xref legal-doc="usc" parsable-cite="usc/26/51">section 51(d)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>summer</quote>.</text></subparagraph><subparagraph id="H453B9D273F564E5F9C96F593F261F70F"><enum>(B)</enum><text>Paragraph (7) of section 51(d) of such Code is amended—</text><clause id="H81060E1BE7284EDB934DAABF400777DF"><enum>(i)</enum><text>by striking <quote>summer</quote> each place it appears in subparagraphs (A);</text></clause><clause id="H6BBE48C24AA54EABA0D646E1FFEBD7C7"><enum>(ii)</enum><text>in subparagraph (B), as redesignated by paragraph (2), by striking <quote>subparagraph (A)(iv)</quote> and inserting <quote>subparagraph (A)(ii)</quote>; and</text></clause><clause id="H72F60B3AC5AB41BF8F6006928109230B"><enum>(iii)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">summer</header-in-text></quote> in the heading thereof.</text></clause></subparagraph></paragraph></subsection><subsection id="H9A06F2C71E044F4E86BDE14F0E5B18E6"><enum>(b)</enum><header>Credit for disconnected youth</header><paragraph id="HE16CDF74D1EF4B17994E607B398087A3"><enum>(1)</enum><header>In general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/51">section 51(d)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of subparagraph (I), by striking the period at the end of subparagraph (J) and inserting <quote>, or</quote> , and by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H54014F8359C44ECEA136FFA7694CFF30"><subparagraph id="H7F43475DC89B43C484499CCEB930D39F"><enum>(K)</enum><text>an disconnected youth.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H19A40EECE8D843E4A43E396101A31B93"><enum>(2)</enum><header>Disconnected youth</header><text>Paragraph (14) of section 51(d) of such Code is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H65D1FF64A69C4721AE5B8AC3F054072D"><paragraph id="HCAB1DC5BE7C04B39941B5534C092F9AC"><enum>(14)</enum><header>Disconnected youth</header><text>The term <term>disconnected youth</term> means any individual who—</text><subparagraph id="H72E0F70D77D2471A9C2C546C716CED5A"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="HEF75FF50C82D47C5A27C3F3AD9AFEE44"><enum>(i)</enum><text>is certified by the designated local agency as having attained age 16 but not age 25 on the hiring date, and</text></clause><clause indent="up1" id="H530C493D50C44F6AB037B76FEBDAE753"><enum>(ii)</enum><text>has self-certified (on a form prescribed by the Secretary) that such individual—</text><subclause id="H400764707135421CA856FA8D46D44249"><enum>(I)</enum><text>has not regularly attended any secondary, technical, or post-secondary school during the 6-month period preceding the hiring date,</text></subclause><subclause id="H46E2EB89B8EE4059BC42D46A101DD882"><enum>(II)</enum><text>has not been regularly employed during such 6-month period, and</text></subclause><subclause id="HE21DE4E45D184EB0A03A180732127B7B"><enum>(III)</enum><text>is not readily employable by reason of lacking a sufficient number of basic skills, or</text></subclause></clause></subparagraph><subparagraph id="H81DE2D3DA51E463CB3B20AA964F43D6A"><enum>(B)</enum><text>is certified by the designated local agency as—</text><clause id="H12AF97A117004FFE9BD07DFDD4AC3754"><enum>(i)</enum><text>having attained age 16 but not age 21 on the hiring date, and</text></clause><clause id="H47571155B0AA4A9E805D1AC74A4FD11A"><enum>(ii)</enum><text>an eligible foster child (as defined in section 152(f)(1)(C)) who was in foster care during the 12-month period ending on the hiring date.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF3A7C25F4E614516B12060C58A40D59C"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to individuals who begin work for the employer after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
