which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit a jurisdiction that defunds the police from receiving grants under certain Economic Development Assistance Programs and the Community Development Block Grant Program.</official-title></form><legis-body id="HD15E2123068D4539884067417DDF17D7" style="OLC"><section id="H0A96A985CAFC48829B86F4059863EBC3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defund Cities that Defund the Police Act of 2021</short-title></quote>.</text></section><section id="HD8CEC53CB0A54FF1BB684BA5989B7BC4"><enum>2.</enum><header>Defunding jurisdiction defined</header><text display-inline="no-display-inline">For purposes of this Act, the term <term>defunding jurisdiction</term> means a State or political subdivision of a State that—</text><paragraph id="HF84CCE5EDBB64674B76442828D7D2F55"><enum>(1)</enum><text display-inline="yes-display-inline">abolishes or disbands the police department with no intention of reconstituting the jurisdiction’s police department; or</text></paragraph><paragraph id="HC4D31780A1904A34AB621280E4C0B247"><enum>(2)</enum><text>significantly reduces the police department’s budget without reallocating a portion of that money to any other community policing program, provided that the jurisdiction did not face a significant decrease in revenues in the previous fiscal year.</text></paragraph></section><section id="H5FCAFC6E63484E3397C0C3161F74724A"><enum>3.</enum><header>Defunding jurisdictions ineligible for certain Federal funds</header><subsection id="H16B15CDE594B4F1A8661EBBE690AE319"><enum>(a)</enum><header>Economic development administration grants</header><paragraph id="H1E636DF226BC4CDD9528FD7A774852A3"><enum>(1)</enum><header>Grants for public works and economic development</header><text>Section 201(b) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3141">42 U.S.C. 3141(b)</external-xref>) is amended—</text><subparagraph id="H7FA5B8845BE04C06B9E9A90819EF752E"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HF6919DB5488646A69F1DAC3A86C5E64E"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HA356BEE0C976485BA4BA3F40DD24EDAD"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="H52A353E18073455A8EBA232271DF9961" style="OLC"><paragraph id="HFA38472764624476989CB1A97438F58C"><enum>(4)</enum><text display-inline="yes-display-inline">the area in which the project is to be carried out is not a defunding jurisdiction (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2021</short-title>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6368933B2D30450DA2C9823C468517BF"><enum>(2)</enum><header>Grants for planning and administrative expenses</header><text>Section 203(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3143">42 U.S.C. 3143(a)</external-xref>) is amended by adding at the end the following: <quote>A defunding jurisdiction (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2021</short-title>) may not be deemed an eligible recipient under this subsection.</quote>.</text></paragraph><paragraph id="H9EB235A58AAD45E1AB31E6511DEB2148"><enum>(3)</enum><header>Supplementary grants</header><text>Section 205(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3145">42 U.S.C. 3145(a)</external-xref>) is amended—</text><subparagraph id="H27C180BEEE6B402A8513982D6042AB6B"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H4D7DABA874554E60B0E4B8E18954E8FD"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H5227F30EFCD445659AC0F31ECB12B863"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block id="HD089C7AB3AA74588B5EE13DBB3C18DA9" style="OLC"><paragraph id="HDED1D43F0EB14D1CBC94617F1C00F861"><enum>(4)</enum><text display-inline="yes-display-inline">will be carried out in an area that does not contain a defunding jurisdiction (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2021</short-title>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H86533794BAFB4FD3831112DD2B96F4EB"><enum>(4)</enum><header>Grants for training, research, and technical assistance</header><text>Section 207 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3147">42 U.S.C. 3147</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H5862462303B74E0C9B0FAD845386E3BF" style="OLC"><subsection id="H55D58940028D4A4ABEA757302AA5EFBF"><enum>(c)</enum><header>Ineligibility of defunding jurisdictions</header><text display-inline="yes-display-inline">Grant funds under this section may not be used to provide assistance to a defunding jurisdiction (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2021</short-title>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2E3697A74AA6449EA48E14CB2B24B5AC"><enum>(b)</enum><header>Community development block grants</header><text>Title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.) is amended—</text><paragraph id="H770C28A8855B45FCA025B4E650439586"><enum>(1)</enum><text>in section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>), by adding at the end the following:</text><quoted-block id="H7E12449F74F84390B9D7852AA2567A77" style="OLC"><paragraph id="H7C6AB80D9AFE4FA9AC779FB1624A03E7"><enum>(25)</enum><text display-inline="yes-display-inline">The term <term>defunding jurisdiction</term> has the meaning given such term in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2021</short-title>.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H79FCBE028F9B4A889A366084838F7035"><enum>(2)</enum><text>in section 104 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>)—</text><subparagraph id="HBF6465391F4B4A14938F2046C1616DA0"><enum>(A)</enum><text>subsection (b)—</text><clause id="H7FF7237824964CA79E15B46972B27086"><enum>(i)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></clause><clause id="H13BB4E0977124C30A1751CAC74B56857"><enum>(ii)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></clause><clause id="H09E14F402C4846F08C4560B4C99333C3"><enum>(iii)</enum><text>by inserting after paragraph (5) the following:</text><quoted-block id="HE375709D16D34766A500745F5135CF1E" style="OLC"><paragraph id="HE548588168214B4D9097CC29C0418586"><enum>(6)</enum><text>the grantee is not a defunding injection jurisdiction and will not become a defunding jurisdiction during the period for which the grantee receives a grant under this title; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H60C5FC5376F049DF8F596AE70DF2EF33"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="HB012134B0367415A95A94EDAB812167F" style="OLC"><subsection id="H42F8535947154DDE9AEC275950ECB792"><enum>(n)</enum><header>Protection of individuals against crime</header><paragraph id="H9F58C82058E547F99A9F3B7A07470C80"><enum>(1)</enum><header>In general</header><text>No funds made available to carry out this title may be obligated or expended for any State or unit of general local government that is a defunding jurisdiction.</text></paragraph><paragraph id="H1A8762C49A97415D94106E60E742DB20"><enum>(2)</enum><header>Returned amounts</header><subparagraph id="H2D87CA0B335D4DEE8FDDF78879127A2C"><enum>(A)</enum><header>State</header><text>If a State is a defunding jurisdiction during the period for which it receives amounts under this title, the Secretary—</text><clause id="H6A2EA428EE2448E5827E75A519349ACD"><enum>(i)</enum><text>shall direct the State to immediately return to the Secretary any such amounts that the State received for that period; and</text></clause><clause id="H31CE98CB8B584ECDA2F972AFEEA86DBF"><enum>(ii)</enum><text>shall reallocate amounts returned under clause (i) for grants under this title to other States that are not defunding jurisdictions.</text></clause></subparagraph><subparagraph id="HF32FFDC5A39941D49898A1A91ACFCA82"><enum>(B)</enum><header>Unit of general local government</header><text>If a unit of general local government is a defunding jurisdiction during the period for which it receives amounts under this title, any such amounts that the unit of general local government received for that period—</text><clause id="HB2F10594452544AA857B6C790591B61D"><enum>(i)</enum><text>in the case of a unit of general local government that is not in a nonentitlement area, shall be returned to the Secretary for grants under this title to States and other units of general local government that are not defunding jurisdictions; and</text></clause><clause id="HA474C6652D9B42A08C4D827CF982C979"><enum>(ii)</enum><text>in the case of a unit of general local government that is in a nonentitlement area, shall be returned to the Governor of the State for grants under this title to other units of general local government in the State that are not defunding jurisdictions.</text></clause></subparagraph><subparagraph id="H4028A4D5F51D40C18F3F1000E377097C"><enum>(C)</enum><header>Reallocation rules</header><text>In reallocating amounts under subparagraphs (A) and (B), the Secretary shall—</text><clause id="HEF78A536D4AC418195107CD2DCFB7486"><enum>(i)</enum><text>apply the relevant allocation formula under subsection (b) or (d) of section 106, with all defunding jurisdictions excluded; and</text></clause><clause id="HB194E2933A9A44139760CB3792C17CE5"><enum>(ii)</enum><text>shall not be subject to the rules for reallocation under section 106(c).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section></legis-body></bill>
