which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles 23 and 49, United States Code, to require metropolitan planning organizations to consider greenhouse gas emissions in long-range transportation plans and transportation improvement programs, and for other purposes.</official-title></form><legis-body id="H630224E0E5D44633946345369E643CE0" style="OLC"><section id="H76F6BA2801F54779AD933AAA2F970245" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Green Transportation Act</short-title></quote>.</text></section><section id="H127A24638BFC43CF83CE268927B4BB4B" section-type="subsequent-section"><enum>2.</enum><header>Greenhouse gas emissions in long-range transportation plans</header><subsection id="H9776DF1C64754FB8977465D5CF2A31A2"><enum>(a)</enum><header>Highway planning</header><text display-inline="yes-display-inline">Section 134(c)(2) of title 23, United States Code, is amended by adding at the end the following: <quote>Such plans and TIPs shall be developed after consideration of direct and indirect emissions of greenhouse gases (as defined in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>)) and shall provide for reductions in such emissions.</quote>.</text></subsection><subsection id="H23D9BAEB5D18409D9F0636BE648C7830"><enum>(b)</enum><header>Public transportation planning</header><text>Section 5303(c)(2) of title 49, United States Code, is amended by adding at the end the following: <quote>Such plans and TIPs shall be developed after consideration of direct and indirect emissions of greenhouse gases (as defined in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>)) and shall provide for reductions in such emissions.</quote>.</text></subsection><subsection id="H63C03C8A20884F9284E073E61ADE4407"><enum>(c)</enum><header>Statewide and nonmetropolitan highway planning</header><text>Section 135(a)(2) of title 23, United States Code, is amended by adding at the end the following: <quote>Such plans and TIPs shall be developed after consideration of direct and indirect emissions of greenhouse gases (as defined in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>)) and shall provide for reductions in such emissions.</quote>.</text></subsection><subsection id="H190F3A7DEF06404DA1A04862EA94F431"><enum>(d)</enum><header>Statewide and nonmetropolitan public transportation planning</header><text display-inline="yes-display-inline">Section 5304(a)(2) of title 49, United States Code, is amended by adding at the end the following: <quote>Such plans and TIPs shall be developed after consideration of direct and indirect emissions of greenhouse gases (as defined in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>)) and shall provide for reductions in such emissions.</quote>.</text></subsection><subsection id="H8A6CB1242DC84EFCBD16DA4828D39BF5"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect—</text><paragraph id="HA5877DA5E0824C5F89E3D6846D84CA91"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to a metropolitan planning organization that operate within a metropolitan planning area with a population of not less than 200,000, on the date of enactment of this section; and</text></paragraph><paragraph id="HC0984D60A22849BDAE6612953E87B26B"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to a metropolitan planning organization other than a metropolitan planning organization described in paragraph (1), on the date that is 4 years after the date of enactment of this section.</text></paragraph></subsection></section><section display-inline="no-display-inline" id="HB0A7EE944FC54FB0914E2F609858CD0F" section-type="subsequent-section"><enum>3.</enum><header>Consideration of emissions of greenhouse gases</header><subsection id="H866B4549AE4D488E80566F2A241865CC"><enum>(a)</enum><header>Title 23</header><text display-inline="yes-display-inline">Title 23, United States Code, is amended—</text><paragraph id="H568CB13437FF4480BC42F95507C30A20"><enum>(1)</enum><text>in section 134(a)(1)—</text><subparagraph id="HA1A5CC5227104FD6B7A6002396EDA09C"><enum>(A)</enum><text>by striking <quote>fuel consumption and air pollution</quote> and inserting <quote>fuel consumption and air pollution and greenhouse gas emissions</quote>; and</text></subparagraph><subparagraph id="HA0C425C1E48A45F1AE22953087105CD6"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>minimizing</quote> and inserting <quote>reducing</quote>;</text></subparagraph></paragraph><paragraph id="H37CD03AD0EF542A1AD21496E12BAD5B6"><enum>(2)</enum><text>in section 134(d)(3), by adding at the end the following: </text><quoted-block style="USC" id="H75CE9AEEB2AB4EFC9740EC984D54FA89" display-inline="no-display-inline"><subparagraph id="HB3DC2E4A5E8B4A7CADA6ED8547019FE8"><enum>(D)</enum><header>Considerations</header><clause id="HC77ADEDE79C749A3AB8FCF3FA5593F72"><enum>(i)</enum><header>Equitable and proportional representation</header><text display-inline="yes-display-inline">In designating officials or representatives under paragraph (2), the metropolitan planning organization shall consider the equitable and proportional representation of the population of the metropolitan planning area.</text></clause><clause id="H8DDB583D2F9E40F7839234D748280F95"><enum>(ii)</enum><header>Savings clause</header><text>Nothing in this paragraph shall require a metropolitan planning organization in existence on the date of enactment of this subparagraph to be restructured. </text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H2DFECC0C85F644F3B8E975B1C8EF2E79"><enum>(3)</enum><text>in section 134(i)(2)(H), by striking <quote>play in reducing congestion, pollution,</quote> and inserting <quote>play in reducing congestion, pollution, greenhouse gas emissions,</quote>;</text></paragraph><paragraph id="H41DED7826E864F9DABE0D12B6C3A74DF"><enum>(4)</enum><text>in section 134(g)(3)(A), by striking <quote>disaster risk reduction, environmental protection,</quote> and inserting <quote>disaster risk reduction, environmental protection, climate change adaptation and resilience,</quote>;</text></paragraph><paragraph id="H07DF7BE711D542838F45FDD2B26BE5B9"><enum>(5)</enum><text>in section 134(h)(1)(E)—</text><subparagraph id="HEF40FC784D9C4CF492A6C598DA45AE4C"><enum>(A)</enum><text>by striking <quote>promote energy conservation</quote> and inserting <quote>promote energy conservation, reduce greenhouse gas emissions</quote>;</text></subparagraph><subparagraph id="HB140B47A661B42AFBEA3FCF70DFF919D"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>and public health</quote> after <quote>quality of life</quote>; and</text></subparagraph><subparagraph id="HA2CCB1FBCC034C72B1A5AC73CD5BA4F4"><enum>(C)</enum><text>by inserting <quote>, including housing and land use patterns</quote> after <quote>development patterns</quote>;</text></subparagraph></paragraph><paragraph id="HCB6E5D8CE0114FF9A734586E063195C8"><enum>(6)</enum><text>in section 134(i)(2)(D)(i), by striking <quote>greatest potential to</quote> and inserting <quote>greatest potential to reduce greenhouse gas emissions and</quote>;</text></paragraph><paragraph id="H21216CBE93684F77A78F70EB9C1E881D"><enum>(7)</enum><text display-inline="yes-display-inline">in section 134(i)(5)(A), by inserting <quote>air quality, public health, housing, transportation,</quote> after <quote>conservation,</quote>;</text></paragraph><paragraph id="HC12D659EA282424084DB7ED3ED027A73"><enum>(8)</enum><text>in section 135(d)(1)(E)—</text><subparagraph id="H771F2C7E49FA4347B934EB737751542C"><enum>(A)</enum><text>by striking <quote>promote energy conservation</quote> and inserting <quote>promote energy conservation, reduce greenhouse gas emissions</quote>;</text></subparagraph><subparagraph id="H09B6FE1615EB4A658463883944FB6EE5"><enum>(B)</enum><text>by inserting <quote>and public health</quote> after <quote>quality of life</quote>; and</text></subparagraph><subparagraph id="H6F19BB67A50647F9B8E25D1ED01EDC44"><enum>(C)</enum><text>by inserting <quote>, including housing and land use patterns</quote> after <quote>development patterns</quote>;</text></subparagraph></paragraph><paragraph id="HEBA512343BAB4BD1BB31043756157205"><enum>(9)</enum><text>in section 135(d)(1)(I), by striking <quote>mitigate stormwater</quote> and inserting <quote>mitigate stormwater and climate change</quote>;</text></paragraph><paragraph id="HA0A2455C0623469EB4E9904967513892"><enum>(10)</enum><text display-inline="yes-display-inline">in section 135(f)(2)(D)(i), by inserting <quote>air quality, public health, housing, transportation,</quote> after <quote>conservation,</quote>;</text></paragraph><paragraph id="H119C74B699DD400EA1EC97FF30856540"><enum>(11)</enum><text>in section 135(f)(4)(A), by striking <quote>have the greatest potential to</quote> and inserting <quote>have the greatest potential to reduce greenhouse gas emissions and</quote>; and</text></paragraph><paragraph id="HAA7E3411F75742A38B455F30A17B07CA"><enum>(12)</enum><text>in section 135(f)(8), by striking <quote>play in reducing congestion, pollution,</quote> and inserting <quote>play in reducing congestion, pollution, greenhouse gas emissions,</quote>.</text></paragraph></subsection><subsection id="H6E5B290FCA8246DC9E08F30423F58D87"><enum>(b)</enum><header>Title 49</header><text display-inline="yes-display-inline">Title 49, United States Code, is amended—</text><paragraph id="HA2009AA236EF438DBAF7D31FBC9CFD43"><enum>(1)</enum><text>in section 5303(a)(1), by striking <quote>fuel consumption and air pollution</quote> and inserting <quote>fuel consumption and air pollution and greenhouse gas emissions</quote>;</text></paragraph><paragraph id="H2C84AA5E990E4EA4B14829548BB1685C"><enum>(2)</enum><text>in section 5303(i)(2)(H), by striking <quote>reducing congestion, pollution,</quote> and inserting <quote>reducing congestion, pollution, greenhouse gas emissions</quote>;</text></paragraph><paragraph id="HD979044B579D44E3BDF183722D9E1507"><enum>(3)</enum><text>in section 5303(g)(3)(A), by striking <quote>reduction, environmental protection,</quote> and inserting <quote>reduction, environmental protection, climate change adaptation and resilience,</quote>;</text></paragraph><paragraph id="H8169B0903B954D07A528CF42518ADD0A"><enum>(4)</enum><text>in section 5303(h)(1)(E), by striking <quote>promote energy conservation</quote> and inserting <quote>promote energy conservation, reduce greenhouse gas emissions</quote>;</text></paragraph><paragraph id="H02AFCFB8C9164B649F7C61233DA3D725"><enum>(5)</enum><text display-inline="yes-display-inline">in section 5303(h)(1)(I), by striking <quote>reliability of the transportation system</quote> and inserting <quote>reliability of the transportation system and reduce or mitigate stormwater and climate change impacts of surface transportation</quote>;</text></paragraph><paragraph id="H32C0F0C1D1D44EF99F05212B39AEB79F"><enum>(6)</enum><text>in section 5303(i)(2)(D), by striking <quote>may have the greatest potential to</quote> and inserting <quote>may have the greatest potential to reduce greenhouse gas emissions and</quote>;</text></paragraph><paragraph id="H2622F7E25EF94059B36DB21B626E5899"><enum>(7)</enum><text>in section 5304(d)(1)(E), by striking <quote>promote energy conservation,</quote> and inserting <quote>promote energy conservation, reduce greenhouse gas emissions,</quote>;</text></paragraph><paragraph id="H44E8D0AE345741BA9F265B9CAC76A82C"><enum>(8)</enum><text>in section 5304(f)(2)(D)(i), by striking <quote>resources, environmental protection,</quote> and inserting <quote>resources, environmental protection, climate change adaptation and resilience,</quote>; and</text></paragraph><paragraph id="HBA180AD79481430DA9C8ECED43152007"><enum>(9)</enum><text>in section 5304(f)(4)(A), by striking <quote>have the greatest potential to</quote> and inserting <quote>have the greatest potential to reduce greenhouse gas emissions and</quote>.</text></paragraph></subsection></section><section id="HD05150184D1148D68DF55F167DDBD7DA"><enum>4.</enum><header>Use of funds for measuring and monitoring transportation-related greenhouse gas emissions</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a State or metropolitan planning organization may use amounts authorized pursuant to section 1101 of the FAST Act to develop standardized models and methodologies for measuring and monitoring transportation-related greenhouse gas emissions.</text></section><section id="HF01FA7F6CDA647369CD879AC3BF570C8"><enum>5.</enum><header>Submission of reports</header><subsection id="H71BDAFC07CDD4AEDABF274DBFA896E0C"><enum>(a)</enum><header>States</header><text display-inline="yes-display-inline">Section 150(e) of title 23, United States Code, is amended—</text><paragraph id="H4BE17BBD8E16435FA96B5C463AD95E43"><enum>(1)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HBAEEEB0ACC7A4FCAA4816BEF4251523F"><enum>(2)</enum><text>in paragraph (4), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HA3BF9C865E0D4992867951CF5829240B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HBFCC697519AC406FB01D2242B67CAF23" style="USC"><paragraph id="H50B6B9DE92014ED095AEABA7FE620BEC"><enum>(5)</enum><text display-inline="yes-display-inline">the standardized models and methodologies the State uses to measure and monitor transportation-related greenhouse gas emissions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H09EC7F71771048DE81E93F2DA0DEC40E"><enum>(b)</enum><header>MPOs</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this section, and biennially thereafter, each metropolitan planning organization (as such term is defined in section 134 of title 23, United States Code) shall submit to the Secretary of Transportation the standardized models and methodologies the metropolitan planning organization uses to measure and monitor transportation-related greenhouse gas emissions.</text></subsection><subsection id="HB8E614B5F4494347AC555BCF507AEB84"><enum>(c)</enum><header>Analysis</header><text display-inline="yes-display-inline">The Secretary of Transportation shall collect and organize the models and methodologies that are submitted pursuant to section 150(e)(5) of title 23, United States Code, and subsection (b) of this section, in a publicly available clearinghouse.</text></subsection></section><section id="H1FC11CE7BC5E4D10A86E48F0305B2B43"><enum>6.</enum><header>National goals and performance management measures</header><subsection id="H471798BD24CD49988071FB165CA0B26C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 150 of title 23, United States Code, is amended—</text><paragraph id="HF2A3F3C4F19A48528E9C1158AB32381F"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H2CE51BEB5111475281FFAB91B16C9173"><enum>(A)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></subparagraph><subparagraph id="H24CD25C346E44A9288EA98B338C0E0CC"><enum>(B)</enum><text>by inserting after paragraph (6) the following: </text><quoted-block display-inline="no-display-inline" id="H14477E386F18458AB3A15F9D8E086196" style="USC"><paragraph id="H2CD0BC794A4148EE824B905BC3947A1A"><enum>(7)</enum><header>Combating climate change</header><text display-inline="yes-display-inline">To reduce carbon dioxide and other greenhouse gas emissions and reduce the climate impacts of the transportation system.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCDCF5417417A4DBB871BF2BF9ED91FC1"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H002DF211628D4AD0BBC8C6968D16FACE"><enum>(A)</enum><text>in paragraph (1) by striking <quote>Not later than 18 months after the date of enactment of the MAP–21, the Secretary</quote> and inserting <quote>The Secretary</quote>; and </text></subparagraph><subparagraph id="H830FDFE069084F3DB9D0BFCBDC602099"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H4974AACEF6884E819B5F034769249753" style="USC"><paragraph id="H780EE12F0ECF44228907F6BCD45013DF"><enum>(7)</enum><header>Greenhouse gas emissions</header><text display-inline="yes-display-inline">The Secretary shall establish, in consultation with the Administrator of the Environmental Protection Agency, measures for States to use to assess—</text><subparagraph id="H5A540F31347049238F540F6F5A5081FD"><enum>(A)</enum><text>carbon dioxide emissions per capita on public roads; and</text></subparagraph><subparagraph id="H16C1DEAE48C14560B07164D1D1134D5F"><enum>(B)</enum><text>any other greenhouse gas emissions per capita on public roads that the Secretary determines to be appropriate. </text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H2F9C828B5F8C4B7CA6328791D4C42A8D"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph id="H9F8D305D51E3450E96C5F4EA74EDCF0A"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HE27FAD64D8B24F2082895AC065F34DEA"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>Not later than 1 year after the Secretary has promulgated the final rulemaking under subsection (c), each</quote> and inserting <quote>Each</quote>; and</text></clause><clause id="H4047829E13F04406AE09649B7140A6D6"><enum>(ii)</enum><text>by striking <quote>and (6)</quote> and inserting <quote>(6), and (7)</quote>; and</text></clause></subparagraph><subparagraph id="H9FE62125A12B4EA9B52413DE52C2526B"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H9B8813D6BC014C63B07556E6234A827C" style="USC"><paragraph id="H6DBAC1AAF963446EA32E24521AFACA16"><enum>(3)</enum><header>Regressive targets</header><subparagraph id="H544005BFEF494FB0B7A921DF9F182FF5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A State may not establish a regressive target for the measures described under paragraph (4) or paragraph (7) of subsection (c). </text></subparagraph><subparagraph id="H513E079CBEEA46D697CF456CCF0650CE"><enum>(B)</enum><header>Regressive target defined</header><text>In this paragraph, the term <term>regressive target</term> means a target that fails to demonstrate constant or improved performance for a particular measure.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAD65EA162A8644DAAA3C2D9B023FD98A"><enum>(4)</enum><text>in subsection (e)—</text><subparagraph id="H242B6D1907B34782A88AFD0B2B6EB69A"><enum>(A)</enum><text>by striking <quote>Not later than 4 years after the date of enactment of the MAP–21 and biennially thereafter, a</quote> and inserting <quote>A</quote>; and</text></subparagraph><subparagraph id="H970022BF0CC34D07822BBBA5B79C6522"><enum>(B)</enum><text>by inserting <quote>biennial</quote> after <quote>the Secretary a</quote>. </text></subparagraph></paragraph></subsection><subsection id="H0D0B163BD6A94B748C56613120A02D7C" commented="no"><enum>(b)</enum><header>Development of greenhouse gas measure</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Transportation shall issue such regulations as are necessary to carry out paragraph (7) of section 150(c) of title 23, United States Code, as added by this Act.</text></subsection></section><section id="HBB7972D3CA344AE988D9E48FE50D7FD5"><enum>7.</enum><header>Carbon pollution reduction</header><subsection id="H89B88E33CA4843C2BB78BB1A734F439F"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HE17F9E8D0C6A463197F736FAF4BD6EF2" style="USC"><section id="H13DA7382F44C41BC89028EEE07A96D76"><enum>171.</enum><header>Carbon pollution reduction</header><subsection id="HAFF953D85D904CBAA280A3C40BC2A2B2"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a carbon pollution reduction program to support the reduction of greenhouse gas emissions from the surface transportation system.</text></subsection><subsection id="H85CFB683BA4B480B9E4F0EE05BFEE3F1"><enum>(b)</enum><header>Eligible projects</header><text>A project is eligible for funding under this section if such project—</text><paragraph id="H3D5CEEE88E244315B4288D1D454EE2B2"><enum>(1)</enum><text>is expected to yield a significant reduction in greenhouse gas emissions from the surface transportation system;</text></paragraph><paragraph id="HFF8DEB3EFEF143BDB965DD77F65F4264"><enum>(2)</enum><text>will help a State meet the greenhouse gas emissions performance targets established under section 150(c)(7); and</text></paragraph><paragraph id="HC01B3C84F2B64F468B455D6FB3ED7E9C"><enum>(3)</enum><text>is—</text><subparagraph id="H67D6B01F795B4F0081BE816A715B5E5A"><enum>(A)</enum><text>eligible for assistance under this title or under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49; or</text></subparagraph><subparagraph id="H9838F589E4AC4E6382F2FEDAC9D3BD37"><enum>(B)</enum><text>a capital project, as such term is defined in section 22906 of title 49, to improve intercity rail passenger transportation, provided that the project will yield a significant reduction in single occupant vehicle trips and improve mobility on public roads.</text></subparagraph></paragraph></subsection><subsection id="H44FB82452AE1405FB7AF74C5358B03FE"><enum>(c)</enum><header>Guidance</header><text display-inline="yes-display-inline">The Secretary shall issue guidance on methods of determining the reduction of single occupant vehicle trips and improvement of mobility on public roads as those factors relate to intercity rail passenger transportation projects under subsection (b)(4).</text></subsection><subsection id="HF74140F7670F4B3F8FFF4AA551BB58FC"><enum>(d)</enum><header>Operating expenses</header><text display-inline="yes-display-inline">A State may use not more than 10 percent of the funds provided under section 104(b)(7) for the operating expenses of public transportation and passenger rail transportation projects.</text></subsection><subsection id="HBC062E6952C54A7A8175E1CB85A34796"><enum>(e)</enum><header>Single-Occupancy vehicle highway facilities</header><text>None of the funds provided under this section may be used for a project that will result in the construction of new capacity available to single occupant vehicles unless the project consists of a high occupancy vehicle facility and is consistent with section 166.</text></subsection><subsection id="H9A5D71D81F524886968E655A6516AAAA"><enum>(f)</enum><header>Evaluation</header><paragraph id="H6D0A6475527B4EF0B185394EE9BD33CF"><enum>(1)</enum><header>In general</header><text>The Secretary shall annually evaluate the progress of each State in carrying out the program under this section by comparing the percent change in carbon dioxide emissions per capita on public roads in the State calculated as—</text><subparagraph id="HD4BBC59811C547B8A60A99598D0161F3"><enum>(A)</enum><text>the annual carbon dioxide emissions per capita on public roads in the State for the most recent year for which there is data; divided by</text></subparagraph><subparagraph id="H2512249E854B4C9BB6643AA74D880FDD"><enum>(B)</enum><text>the average annual carbon dioxide emissions per capita on public roads in the State in calendar years 2015 through 2019.</text></subparagraph></paragraph><paragraph id="H3D86B24D92614734AA44367DE82DB2B0"><enum>(2)</enum><header>Measures</header><text display-inline="yes-display-inline">In conducting the evaluation under paragraph (1), the Secretary shall—</text><subparagraph id="H2C6DEC81F6FF4175B22C4BCE78853BF8"><enum>(A)</enum><text>prior to the effective date of the greenhouse gas performance measures under section 150(c)(7), use such data as are available, which may include data on motor fuels usage published by the Federal Highway Administration and information on emissions factors or coefficients published by the Energy Information Administration of the Department of Energy; and </text></subparagraph><subparagraph id="H8990884F300F45BBB5097EE7A238F7E5"><enum>(B)</enum><text>following the effective date of the greenhouse gas performance measures under section 150(c)(7), use such measures.</text></subparagraph></paragraph></subsection><subsection id="HF0B0813A5B074B2287AEAACDE491DFC5"><enum>(g)</enum><header>Progress report</header><text>The Secretary shall annually issue a carbon pollution reduction progress report, to be made publicly available on the website of the Department of Transportation, that includes—</text><paragraph id="HF28AFA51AAAF43B08AE55931CF245545"><enum>(1)</enum><text>the results of the evaluation under subsection (f) for each State; and</text></paragraph><paragraph id="H1A82D559220B44C19808DBC00464B285"><enum>(2)</enum><text>a ranking of all the States by the criteria under subsection (f), with the States that, for the year covered by such report, have the largest percentage reduction in annual carbon dioxide emissions per capita on public roads being ranked the highest.</text></paragraph></subsection><subsection id="HEF1166108B544383ADE2A608DFEE67FA"><enum>(h)</enum><header>High-Performing States</header><paragraph id="H290F9513F75240E1B5F5882416CB117F"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">For purposes of this section, each State that is 1 of the 15 highest ranked States, as determined under subsection (g)(2), and that achieves a reduction in carbon dioxide emissions per capita on public roads, as determined by the evaluation in subsection (f), shall be designated as a high-performing State for the following fiscal year. </text></paragraph><paragraph id="HD0F81FC4CFDC4DBD915737CD93D4FC9B"><enum>(2)</enum><header>Use of funds</header><text>For each State that is designated as a high-performing State under paragraph (1)—</text><subparagraph commented="no" id="HB5099299EB0D43B3BAC9DEC5C66E303D"><enum>(A)</enum><text>notwithstanding section 120, the State may use funds made available under this title to pay the non-Federal share of a project under this section during any year for which such State is designated as a high-performing State; and</text></subparagraph><subparagraph id="H63F2A22B11264859865270B7E806CE66"><enum>(B)</enum><text>notwithstanding section 126, the State may transfer up to 50 percent of funds apportioned under section 104(b)(7) to the program under section 104(b)(2) in any year for which such State is designated as a high-performing State.</text></subparagraph></paragraph><paragraph id="H17816BA21BCD430B88729F58E14B3335"><enum>(3)</enum><header>Transfer</header><text display-inline="yes-display-inline">For each State that is 1 of the 15 lowest ranked States, as determined under subsection (g)(2), the Secretary shall transfer 10 percent of the amount apportioned to the State under section 104(b)(2) in the fiscal year following the year in which the State is so ranked, not including amounts set aside under section 133(d)(1)(A) and under section 133(h) or 505(a), to the apportionment of the State under section 104(b)(7).</text></paragraph><paragraph id="H77406E2BC18945C68742618B4D12D379"><enum>(4)</enum><header>Limitation</header><text>The Secretary shall not conduct a transfer under paragraph (3)—</text><subparagraph id="H88E29F8A314646E79FEAB4E31046B78A"><enum>(A)</enum><text>until the first fiscal year following the effective date of greenhouse gas performance measures under section 150(c)(7); and</text></subparagraph><subparagraph id="HDFD5E23AE2FD4660920FB043D7F7AF49"><enum>(B)</enum><text>with respect to a State in any fiscal year following the year in which such State achieves a reduction in carbon dioxide emissions per capita on public roads in such year as determined by the evaluation under subsection (f).</text></subparagraph></paragraph></subsection><subsection id="HBF77C10261E044C290A129FC0D47F3F8"><enum>(i)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this section and periodically thereafter, the Secretary, in consultation with the Administrator of the Environmental Protection Agency, shall issue a report—</text><paragraph id="H1BEEBB37FAD44B0886D6660B3B936A76"><enum>(1)</enum><text>detailing, based on the best available science, what types of projects eligible for assistance under this section are expected to provide the most significant greenhouse gas emissions reductions from the surface transportation sector; and</text></paragraph><paragraph id="H6CBE343E6F5F4796BBB5D4A0617E9DA9"><enum>(2)</enum><text>detailing, based on the best available science, what types of projects eligible for assistance under this section are not expected to provide significant greenhouse gas emissions reductions from the surface transportation sector.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB815E70597E34EBEA4BA4C6859E2CC02"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="H8B8EF9B3BB1E4C789276A661025C4961" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">171. Carbon pollution reduction.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H4DCEF7D1A4A2402B965FE6E734EC827C"><enum>(c)</enum><header>Applicability</header><text>Subsection (b)(2) of section 171 of title 23, United States Code, as added by this section, shall apply to a State beginning on the first fiscal year following the fiscal year in which the State sets greenhouse gas performance targets under section 150(d) of title 23, United States Code.</text></subsection><subsection id="H3E4919656BD14EB0ABF72D2B072E9794"><enum>(d)</enum><header>Apportionment</header><text>Section 104(b) of title 23, United States Code, is amended—</text><paragraph id="HC7CDDEF22B04400C80F6858DBDC741CA"><enum>(1)</enum><text>in paragraph (1) by striking <quote>63.7 percent</quote> and inserting <quote>62.38 percent</quote>;</text></paragraph><paragraph id="H3E1660FB72AB46AFB867D4A5996EBB95"><enum>(2)</enum><text>in paragraph (2) by striking <quote>29.3 percent</quote> and inserting <quote>27.98 percent</quote>; </text></paragraph><paragraph id="H5D1A489ED0974B83B961BEC391AB5D3D"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3) by striking <quote>7 percent</quote> and inserting <quote>5.69 percent</quote>; and</text></paragraph><paragraph id="H8A701CDA6930417B8696112474CE4E18"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="HD183CC8591744B1D8A882508577925F7" display-inline="no-display-inline"><paragraph id="HC8A2B2EE99B44CF898317163C6E27C8B"><enum>(7)</enum><header>Carbon pollution reduction program</header><text display-inline="yes-display-inline">For the carbon pollution reduction program, 3.95 percent of the amount remaining after distributing amounts under paragraphs (4), (5), and (6). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
