R. 3096</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210511">May 11, 2021</action-date><action-desc><sponsor name-id="D000627">Mrs. Demings</sponsor> (for herself and <cosponsor name-id="B001298">Mr. Bacon</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To allow Federal law enforcement officers to purchase retired service weapons, and for other purposes.</official-title></form><legis-body id="H82B206659C704FD782073B15E1DDFAE4" style="OLC"><section id="H9277641865224985A9B80A642ACD228D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Law Enforcement Officer Service Weapon Purchase Act</short-title></quote>. </text></section><section id="HBAAC6680B4014A5D80A0173448337ED0"><enum>2.</enum><header>Purchase of retired handguns by Federal law enforcement officers</header><subsection id="H4B3A3B0AEEEC41E0ACDB1589FDF9BF82"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator of General Services shall establish a program under which a Federal law enforcement officer may purchase a retired handgun from the Federal agency that issued the handgun to such officer.</text></subsection><subsection id="H8C7B2648748F45C5A80A64995B95157E"><enum>(b)</enum><header>Limitations</header><text>A Federal law enforcement officer may purchase a retired handgun under subsection (a) if—</text><paragraph id="HE10CC8D7333E41F9AE2CB0FDCFB37BD5"><enum>(1)</enum><text>the purchase is made during the 6-month period beginning on the date the handgun was so retired;</text></paragraph><paragraph id="H149AFA10127E44568491F86A29622062"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to such purchase, the officer has passed a background check within 30 days of purchase under the national instant criminal background check system established under the Brady Handgun Violence Prevention Act; and</text></paragraph><paragraph id="HAF545B92D5264316826554FB4307C2C1"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to such purchase, the officer is in good standing with the Federal agency that employs such officer.</text></paragraph></subsection><subsection id="H5CC9F418C69D47339BD7730054A9BE9C"><enum>(c)</enum><header>Cost</header><text>A handgun purchased under this section shall be sold at the fair market value for such handgun taking into account the age and condition of the handgun.</text></subsection><subsection id="H06B8433F52334009B6BBEB39E211C080"><enum>(d)</enum><header>Sense of Congress on use of funds</header><text display-inline="yes-display-inline">It is the sense of Congress that any amounts received by the Government from the sale of a handgun under this section should be transferred and used to fund evidence-based gun violence prevention or gun safety education and training programs.</text></subsection><subsection id="H31C33A3E93CC41C8AEEBA9B576E21E87"><enum>(e)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H96C1E028CB9C4E22A2880EDBFC96A10A"><enum>(1)</enum><text>the term <term>Federal law enforcement officer</term> has the meaning given that term in section 115(c)(1) of title 18, United States Code;</text></paragraph><paragraph id="H9F67A96552C945CB9F887AF9724C4B52"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>handgun</term> has the meaning given that term in section 921(a) of title 18, United States Code; and</text></paragraph><paragraph id="H568B81564365418285674172DA7DFE32"><enum>(3)</enum><text>the term <term>retired handgun</term> means any handgun that has been declared surplus by the applicable agency.</text></paragraph></subsection></section></legis-body></bill>
