R. 3092</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210511">May 11, 2021</action-date><action-desc><sponsor name-id="C001119">Ms. Craig</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To adjust the applicability of certain amendments to the Truth in Lending Act, and for other purposes.</official-title></form><legis-body id="H4189007890E446159F32F960412E6A86" style="OLC"><section id="H30D4ED0F1E794A0583737C632A3A2A24" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ryan Frascone Memorial Student Loan Relief Act of 2021</short-title></quote>. </text></section><section id="H3C9483D27402463FB605F845B18A3F86"><enum>2.</enum><header>Applicability of certain amendments to the Truth in Lending Act</header><subsection id="H863358C9F46C4945B689A5D9EB16BAA2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Effective on the date of enactment of the Economic Growth, Regulatory Relief, and Consumer Protection Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/174">Public Law 115–174</external-xref>), section 601(b) of such Act is amended to read as follows: </text><quoted-block style="OLC" id="HF7C53659AFB345ECA679FB7798120DB7" display-inline="no-display-inline"><subsection id="H376B4C63783C4299A166740B7CABCE95"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to private education loan agreements entered into before, on, or after the date of enactment of this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7416810BFFA943DBAA7740917CC3D6D1"><enum>(b)</enum><header>Treasury loan purchase program</header><paragraph id="H813070FC55324DE49376590FC597032C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall establish a program under which the Secretary shall purchase and retire outstanding private education loans—</text><subparagraph id="H4A78EE5C467E47BCA179B25E302A2444"><enum>(A)</enum><text>where the borrower on such loan is deceased;</text></subparagraph><subparagraph id="HED5161DADFFB431CB6CD09AA4B0EF2A8"><enum>(B)</enum><text>where there remains a cosigner on the loan;</text></subparagraph><subparagraph id="HB6FEF4697CF541FCB766EBA7370A9FE3"><enum>(C)</enum><text display-inline="yes-display-inline">that were entered into before the date that is 180 days after the date of enactment of the Economic Growth, Regulatory Relief, and Consumer Protection Act; and</text></subparagraph><subparagraph id="H352AD7EE97F54C51B8AFAEB350AD36DC"><enum>(D)</enum><text>only upon an application from a holder of such loan pursuant to paragraph (2) that demonstrates the holder has suffered financial injury as a result of the amendment made by subsection (a).</text></subparagraph></paragraph><paragraph id="H6E03F73937F044F28C8363BBF2C9A20B"><enum>(2)</enum><header>Application</header><text>The holder of a loan described under paragraph (1) may apply to the Secretary of the Treasury to have the Secretary purchase and retire such loan by submitting an application in such form and manner as the Secretary may require.</text></paragraph><paragraph id="H3B06D8C152254585BBFEF10F1DAE7460"><enum>(3)</enum><header>Authorization of appropriation</header><text>There is authorized to be appropriated to the Secretary of the Treasury $5,000,000 to carry out this subsection.</text></paragraph><paragraph id="H730188DE40834428926C04769B0C81C2"><enum>(4)</enum><header>Truth in Lending Act terms</header><text>In this subsection, the terms <quote>cosigner</quote> and <quote>private education loan</quote> have the meaning given those terms, respectively, under section 140 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
