Davis of Illinois</cosponsor>, and <cosponsor name-id="B000574">Mr. Blumenauer</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program to support interstate rail compacts and improve the safety, efficiency, or reliability of passenger and freight rail transportation systems, and for other purposes.</official-title></form><legis-body id="HE0D0FC868F1042A79FC2E5883F2A56A4" style="OLC"><section id="HE8F6B351743041F2B82513F0186F62BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Interstate Rail Compacts Advancement Act of 2021</short-title></quote>.</text></section><section id="HA5E35865E6A4415D8C5749B9DBF08B5B"><enum>2.</enum><header>Interstate rail compacts</header><subsection id="HD7CB67D003834D199CFA543F04C8736D"><enum>(a)</enum><header>Identification</header><text display-inline="yes-display-inline">Section 410 of the Amtrak Reform and Accountability Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/134">Public Law 105–134</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/49/24101">49 U.S.C. 24101</external-xref> note) is amended—</text><paragraph id="H9C73675344654862B8F6C79ECB3C14E7"><enum>(1)</enum><text>in subsection (b)(2) by striking <quote>(except funds made available for Amtrak)</quote>; and</text></paragraph><paragraph id="H58E5F3470456435EAFA134F5A8645410"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HA5E0031D596943739544AB0FFE881482"><subsection id="HCF46112B0DEE415F8625B4C9C110A3A2"><enum>(c)</enum><header>Interstate rail compacts program</header><text display-inline="yes-display-inline">The Secretary of Transportation shall—</text><paragraph id="HF174C3057984440B9C419A5D166C9E32"><enum>(1)</enum><text display-inline="yes-display-inline">make available on a publicly accessible website a list of interstate rail compacts established in accordance with subsection (a);</text></paragraph><paragraph id="HEB63996DAA3941CBB87CA5536ECE484D"><enum>(2)</enum><text display-inline="yes-display-inline">provide information to the public regarding interstate rail compacts, including how States may establish interstate rail compacts under subsection (a); and</text></paragraph><paragraph id="H2F8B41351310418E8360755300B69631"><enum>(3)</enum><text display-inline="yes-display-inline">annually update the information provided under paragraph (2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8319A79C58AD46EE869A22449FE1229E"><enum>(b)</enum><header>Grants authorized</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/229">Chapter 229</external-xref> of title 49, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HAC0B895B6075445DBB28B20890CEDB1B"><section id="HBA77FFE17911439AAF3D05C0A95FA990"><enum>22909.</enum><header>Interstate rail compacts support program</header><subsection id="H2FA081E4B74A4AF8B13D5CB76F1DE775"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop and implement a program for providing administrative assistance grants to an applicant, on a competitive basis, to support interstate and regional efforts—</text><paragraph id="H6842B5DE834D4D7691CF5A20822FC3A1"><enum>(1)</enum><text display-inline="yes-display-inline">to improve the safety, efficiency, or reliability of intercity passenger rail; and</text></paragraph><paragraph id="H75F154DA3AA6407DABCA283BB8F0CE4B"><enum>(2)</enum><text display-inline="yes-display-inline">to promote and develop intercity passenger rail service, including through initiating, restoring, or enhancing intercity passenger rail service.</text></paragraph></subsection><subsection id="H3FD60BFDBB3B496680573F99829BD6B1"><enum>(b)</enum><header>Applicant selection criteria</header><paragraph id="HD73A0E473FB74CE5AF91372EA13FF686"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall consider—</text><subparagraph id="H3F8AA06ADB0F473980F7721BE28CA5E5"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of funding received (including funding from railroads) or other significant participation by State, local, and regional governmental and private entities;</text></subparagraph><subparagraph id="H9EAD7421DD184F11AAF2917B89C33B87"><enum>(B)</enum><text display-inline="yes-display-inline">the applicant’s work to facilitate and encourage regional planning for passenger rail improvement, enhancement, and development;</text></subparagraph><subparagraph id="HFABA9A7FE33447719E7B9465D7776C9C"><enum>(C)</enum><text display-inline="yes-display-inline">the applicant’s work to foster, through rail transportation systems, economic development, particularly in rural communities and for disadvantaged populations;</text></subparagraph><subparagraph id="H1EB9FBAB9D0C4368892AA2BD97C86DEE"><enum>(D)</enum><text display-inline="yes-display-inline">the applicant’s efforts to provide guidance to local communities on public and private resources relate to community concerns, such as congestion, rail and grade crossing safety, trespasser prevention, quiet zones, idling, and rail line relocations;</text></subparagraph><subparagraph id="HC23849D961AE4684AFBC7DAEDA66FD42"><enum>(E)</enum><text display-inline="yes-display-inline">whether the applicant seeks to restore service over routes formerly operated by Amtrak, including routes described in section 11304(a) of the Passenger Rail Reform and Investment Act of 2015 (title XI of division A of <external-xref legal-doc="public-law" parsable-cite="pl/114/94">Public Law 114–94</external-xref>);</text></subparagraph><subparagraph id="H9D6E958CA6A54DC99415D0C9C1395C3B"><enum>(F)</enum><text display-inline="yes-display-inline">the applicant’s dedication to providing intercity passenger rail service to regions and communities that are underserved or not served by other intercity public transportation;</text></subparagraph><subparagraph id="HE5AE28AB3F94475B9930ED865DEEA191"><enum>(G)</enum><text display-inline="yes-display-inline">whether the applicant is enhancing connectivity and geographic coverage of the existing national network of intercity rail passenger service;</text></subparagraph><subparagraph id="H1A470D39A0D24F0094DAA5C6212D5BD3"><enum>(H)</enum><text display-inline="yes-display-inline">the applicant’s efforts to engage with entities to deploy railroad safety technology or programs, including trespassing prevention, rail integrity inspection systems, or grade crossing safety;</text></subparagraph><subparagraph id="HDAFA888636C84B739DD2389BB30216C3"><enum>(I)</enum><text display-inline="yes-display-inline">whether the applicant prepares regional rail and corridor service development plans and corresponding environmental analysis;</text></subparagraph><subparagraph id="HE0C71E8D04484692AF7CCD984B1FAF44"><enum>(J)</enum><text display-inline="yes-display-inline">whether the applicant would maximize the net benefits of the funds authorized for use under this section, considering the cost-benefit analysis of the proposed project, including anticipated private and public benefits relative to the costs of the proposed project; and</text></subparagraph><subparagraph id="H142620DF61EB48988C306F4BF2220725"><enum>(K)</enum><text display-inline="yes-display-inline">whether the applicant has engaged with the Federal, local, or State government and transportation planning agencies to identify projects necessary to enhance multimodal connections or facilitate service integration between rail service and other modes, including between intercity rail passenger transportation and intercity bus service, commercial air service, or commuter rail service.</text></subparagraph></paragraph><paragraph id="HF10BB28D44C54A49B7D2C3FF84C59272"><enum>(2)</enum><header>Preference</header><text>In selecting grant recipients, the Secretary shall give preference to applicants that are initiating, restoring, or enhancing intercity rail passenger transportation.</text></paragraph></subsection><subsection id="HF00C2A08256E45948203A50ECBADFF4C"><enum>(c)</enum><header>Application process</header><text>The Secretary shall prescribe the form and manner of filing applications under this section.</text></subsection><subsection id="H6705C008C91E42E98E243E008F653059"><enum>(d)</enum><header>Performance measures</header><paragraph id="H7568E4E6B2B34A618947F6E1A5D176BC"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish performance measures for each grant recipient to assess progress in achieving strategic goals and objectives.</text></paragraph><paragraph id="HDC66AC8B56264B35BD3372C64D2AECA6"><enum>(2)</enum><header>Annual report</header><text> The Secretary shall require grant recipients to submit an annual report of the activities of such recipient and information related to applicable performance measures, which may include—</text><subparagraph id="H06D226AFC9394765BAB9AD904C86C9AD"><enum>(A)</enum><text display-inline="yes-display-inline">a demonstration of progress to achieve or advance the relevant criteria described in subsection (c); and</text></subparagraph><subparagraph id="H2AFF968763DA4835BB39F2314D71781D"><enum>(B)</enum><text display-inline="yes-display-inline">receipt of non-Federal matching funds from each member State at least once during each fiscal year.</text></subparagraph></paragraph></subsection><subsection id="HD8D33C59D1EF4F139FBCF875E4128A4A"><enum>(e)</enum><header>Federal share of total project cost</header><text display-inline="yes-display-inline">The Secretary shall require each recipient of a grant under this subsection to provide a non-Federal match of not less than 50 percent of the administrative costs of the interstate rail compact.</text></subsection><subsection id="H7ADED2AE86294D93A97A3886135E4DDF" commented="no"><enum>(f)</enum><header>Applicable requirements</header><text display-inline="yes-display-inline">The use of any amounts appropriated for grants under this section shall be subject to the applicable requirements under this chapter.</text></subsection><subsection id="HB33EB666D12C41CA87BA79B4BAF9BBA6"><enum>(g)</enum><header>Applicability</header><text>Amounts appropriated to carry out this section shall remain available until expended.</text></subsection><subsection id="HA41570F0C54F4738BA7810EB4919E2AC"><enum>(h)</enum><header>Limitations</header><paragraph id="HB778496746D543EDBB9E0F4CE0AE0055" commented="no"><enum>(1)</enum><header>Maximum funding per applicant</header><text display-inline="yes-display-inline">The Secretary may not award a grant under this section in an amount exceeding $500,000 for each applicant in any fiscal year.</text></paragraph><paragraph id="HF2F71CF339404561982D973FAF909547"><enum>(2)</enum><header>Numeric limitation</header><text>The Secretary may not provide grants under this section to more than 10 interstate rail compacts in any fiscal year.</text></paragraph></subsection><subsection id="H23771BB97BAA4BDCA8AEBC714567E9FD"><enum>(i)</enum><header>Use of Interstate Rail Compact Grants and Other Federal Funding</header><text display-inline="yes-display-inline">A recipient of an interstate rail compact grant under this section may use such grant in combination with other Federal grants awarded that would benefit the applicable use.</text></subsection><subsection id="H85FE0CD805D04D46BC2C433E4D0FA3D4"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5A4F5C97762B4004B1226B5C171D1B11"><enum>(1)</enum><header>Applicant</header><text display-inline="yes-display-inline">The term <quote>applicant</quote> means an interstate rail compact or an interstate commission composed of 2 or more States that has been established to promote, develop, or operate intercity passenger rail transportation systems.</text></paragraph><paragraph id="HA664F49FDBE34903B5856030ACB50028"><enum>(2)</enum><header>Intercity passenger rail service</header><text display-inline="yes-display-inline">The term <quote>intercity passenger rail service</quote> has the meaning given the term <quote>intercity rail passenger transportation</quote> in section 24102.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H54B0A9B54EB04AED8882DBAF85BA6B81"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/229">chapter 229</external-xref> of title 49, United States code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H508F075DA2C94CC68ADE91EF910D892F"><toc regeneration="no-regeneration"><toc-entry level="section">22909. Interstate rail compacts support program. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0A60FF0F74604337863F79461E22C148"><enum>(d)</enum><header>Authorization of appropriations</header><text>Section 20117(a)(4) of title 49, United States Code, is amended to read as follows: </text><quoted-block style="USC" display-inline="no-display-inline" id="HAA9653CEA64647CDB2045BA4BAC3736B"><paragraph id="HBCD58D0045924B14AEC5B85462126623"><enum>(4)</enum><header>Regional planning guidance</header><text display-inline="yes-display-inline">The Secretary may withhold up to $20,000,000 annually of the amount made available for each fiscal year under paragraph (1) to facilitate and provide guidance for regional planning processes, including not more than $2,000,000 to provide funding for interstate rail compacts and commissions.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
