<official-title display="yes">To amend the Internal Revenue Code of 1986 to temporarily increase the educator expense deduction to facilitate the purchase of personal protective equipment and cleaning supplies during the COVID–19 pandemic, and for other purposes.</official-title>

<section id="HAF0D4DB02C474FBF88CC7EBDFD7B0737" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Teachers Assistance and Return To School Act of 2021</short-title></quote> or the <quote><short-title>STARTS Act of 2021</short-title></quote>. </text></section> <section id="H24F9E92819E346F7B82AD207A1DED22F"><enum>2.</enum><header>Deduction increases for certain expenses of elementary and secondary school teachers</header> <subsection id="H04BE41445EF24AF78A5AE9280F722BBD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/62">Section 62(a)(2)(D)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows: </text>

<subparagraph id="H69C58E6024174AD28F2A42A4F9BFA98F"><enum>(D)</enum><header>Certain expenses of elementary and secondary school teachers</header>
<clause id="H60E721D382C74B73872742FE24C16961"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The deductions allowed by section 162 which consist of expenses, not in excess of—</text> <subclause id="HE728F1651E354A86B6D21BF66127F99A"><enum>(I)</enum><text>$250, paid or incurred by an eligible educator—</text>
<item id="H21066D78D4B5456785BDB45A269EAA6D"><enum>(aa)</enum><text display-inline="yes-display-inline">by reason of the participation of the educator in professional development courses related to the curriculum in which the educator provides instruction or to the students for which the educator provides instruction, and</text></item> <item id="H5434993F86784EF9B37531B6AC0D43F9"><enum>(bb)</enum><text display-inline="yes-display-inline">in connection with books, supplies (other than nonathletic supplies for courses of instruction in health or physical education), computer equipment (including related software and services) and other equipment, and supplementary materials used by the eligible educator in the classroom.</text></item></subclause></clause>
<clause id="H608F788423074303B31D03A413CBDC9B"><enum>(ii)</enum><header>Temporary increase in deduction to support purchases of personal protective equipment and cleaning supplies due to the COVID–19 national emergency</header>
<subclause id="H4FB9A5128ADA4B8FA190B06425E652EE"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">For the purpose of facilitating the purchase of personal protective equipment necessitated by the COVID–19 national emergency, in the case of an expense described in clause (i) and paid or incurred in taxable years 2020 or 2021—</text> <item id="H200A349048B74DC59D26FC03A6A6A6DD"><enum>(aa)</enum><text>such clause shall be applied by substituting <quote>$1,000</quote> for <quote>$250</quote>, and</text></item>
<item id="HF4B34847BFD0493690F20B2EACF154DA"><enum>(bb)</enum><text>$750 of such $1,000 may only be used for the purpose of purchasing personal protective equipment or cleaning supplies to combat the spread of COVID–19. </text></item></subclause> <subclause id="H8B9A4EA4D2124D2CAB5E2374D8899FA5"><enum>(II)</enum><header>Unused deduction in taxable year 2020 may be carried to taxable year 2021</header><text display-inline="yes-display-inline">Any unused deduction or portion of such deduction remaining after application of subclause (I) with respect to taxable year 2020 shall be treated as a deduction allowable with respect to taxable year 2021. </text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HD296EB5CB70C40C9A4543E3301AEA14A"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply with respect to taxable years beginning after December 31, 2019.</text></subsection></section> </legis-body> </bill>
