R. 3052</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210507">May 7, 2021</action-date><action-desc><sponsor name-id="L000585">Mr. LaHood</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the bases for ineligibility for countries to benefit from the Generalized System of Preferences, and for other purposes.</official-title></form><legis-body id="HBA2B18A605AC4E3D9C664FD85B9DED24" style="OLC"><section id="HA016EC1926E94AB38E9A7FEAFD30ACB2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Digital Trade for Development Act</short-title></quote>.</text></section><section id="HCF3E7E050C6D4125A955D59310CA8CC6"><enum>2.</enum><header>Modifications to authority to designate countries</header><text display-inline="no-display-inline">Section 502 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2462">19 U.S.C. 2462</external-xref>) is amended—</text><paragraph id="H0C928504B6884E8886230012B267B670"><enum>(1)</enum><text>in subsection (b)(2)—</text><subparagraph id="H278FBD83257C4EACAFE53DF1D394514F"><enum>(A)</enum><text>by redesignating subparagraphs (D) through (H) as subparagraphs (E) through (I), respectively;</text></subparagraph><subparagraph id="H9E204B09005E4435802AFBC1830CE293"><enum>(B)</enum><text>in the matter following subparagraph (H), by striking <quote>(D), (E), (F), (G), and (H) (to the extent described in section 507(6)(D))</quote> and inserting <quote>(D), (E), (F), (G), (H), and (I) (to the extent described in section 507(6)(D))</quote>; and</text></subparagraph><subparagraph id="H5FFF4B02B2ED443FAC3BD1444A07800B"><enum>(C)</enum><text>by inserting after subparagraph (C) the following new subparagraph:</text><quoted-block style="OLC" id="H6E06C10CACA345B08300B7F5D15B9EFE" display-inline="no-display-inline"><subparagraph id="H844DCDEE81174E8995C49F2A1B5977AC"><enum>(D)</enum><text display-inline="yes-display-inline">The President, acting through the United States Trade Representative, determines that such country restricts digital trade to the detriment of United States development goals, strategic interests, or competitiveness.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H35E00B3D78264747809BA7742FAC8E68"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text><subparagraph id="H8915A5B99BC7400A9EE57492D0AACB4D"><enum>(A)</enum><text>in paragraph (6)(B), by striking <quote>; and</quote> and the end and inserting a semicolon;</text></subparagraph><subparagraph id="H0ED6984E9D704EEE81EEB23C0A112687"><enum>(B)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H6B4EDF627C39455C8A8B53FE9D2D6E9B"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H5419594AB3E541119898AF6CDC2E3BF9" display-inline="no-display-inline"><paragraph id="HECB11AAE9F734CC7B397B3C31B4C2B7E"><enum>(8)</enum><text display-inline="yes-display-inline">the extent to which, in the determination of the President acting through the United States Trade Representative, such country—</text><subparagraph id="HC85421CCF112494283F6A1DB27B3D6B2"><enum>(A)</enum><text display-inline="yes-display-inline">has refrained from imposing, or has eliminated, digital trade barriers, including unnecessary data transfer restrictions and data localization mandates; and</text></subparagraph><subparagraph id="H8F5C1C9D79374D41912EADA41E7ACA5F"><enum>(B)</enum><text display-inline="yes-display-inline">has taken steps to support consumer protections and the privacy of personal information online and to extend the benefits of digital trade to all.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
