<section id="H9F3C535115F04287AE71B41E214C287B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Regulation Through Litigation Act of 2021</short-title></quote>.</text></section> <section id="H2A055B8CBFD642E0A48D47ACD5618AFB"><enum>2.</enum><header>Settlement agreements and consent decrees</header> <subsection id="H4F069325FC58402BA124A7C8429019E4"><enum>(a)</enum><header>Limitation on consent decrees</header><text>The head of a Federal agency may not enter into a consent decree that exceeds the authority of the court that enters the order related to such decree.</text></subsection>
<subsection id="H3192C2700A7E4F23AED2E4EFF0F005F7"><enum>(b)</enum><header>Limitation on attorneys’ fees and litigation costs</header><text display-inline="yes-display-inline">A settlement agreement or consent decree resulting in a regulation or guidance document with respect to which a Federal agency is a party may not include the payment of attorneys’ fees or litigation costs.</text></subsection> <subsection id="HC57EDAD0F2164BB28886D36E6E3A6A6E"><enum>(c)</enum><header>Definitions</header><text>In this Act:</text>
<paragraph id="HF2CD08EBF19B467A839BE299ED23149B"><enum>(1)</enum><header>Guidance document</header><text>The term <quote>guidance document</quote>—</text> <subparagraph id="H5EFBCAA199AC46D3BD687EABBA2A21B0"><enum>(A)</enum><text>means an agency statement of general applicability (other than a regulation that has the force and effect of law promulgated in accordance with the notice and public procedure under section 553 of title 5, United States Code) that—</text>
<clause id="H70FB35A0EF334EAA97EFAD9B18FB5A76"><enum>(i)</enum><text>does not have the force and effect of law; and</text></clause> <clause id="H3983FD48884647969955ADF0DB2A4BF2"><enum>(ii)</enum><text>sets forth—</text>
<subclause id="H049299ED6B664804875A6F786CA436E4"><enum>(I)</enum><text>an agency decision or a policy on a statutory, regulatory, or technical issue; or</text></subclause> <subclause id="HB0329FFE352541F68F294449BED0F143"><enum>(II)</enum><text>an interpretation of a statutory or regulatory issue; and</text></subclause></clause></subparagraph>
<subparagraph id="H6A61218DF9A641B6B5BE9E6C236CEFC9"><enum>(B)</enum><text>may include—</text> <clause id="HFFF5A8724DB349C384CF08DB5486B414"><enum>(i)</enum><text>a memorandum;</text></clause>
<clause id="HF78E46616A76411A8D6AD76CCD177FA2"><enum>(ii)</enum><text>a notice;</text></clause> <clause id="H7C3A989AABD34160973F1707F02E6C15"><enum>(iii)</enum><text>a bulletin; </text></clause>
<clause id="H7F9C2CB3705F4731A5A07439BF174EFD"><enum>(iv)</enum><text>a directive; </text></clause> <clause id="HB3CE2286EF4047298ADBF3E866716118"><enum>(v)</enum><text>a news release;</text></clause>
<clause id="H15866F56ED2D4383933F41A6A424C111"><enum>(vi)</enum><text>a letter;</text></clause> <clause id="H39E39D9ED2CA4941B2C500195E97B3D1"><enum>(vii)</enum><text>a blog post; </text></clause>
<clause id="HEA6895BAB00047569B35E774D4774ED9"><enum>(viii)</enum><text>a no-action letter; </text></clause> <clause id="H0A505488E4F7442E9C900A4151E98BBE"><enum>(ix)</enum><text>a speech by an agency official; </text></clause>
<clause id="H50F82D08FAE44D25AA5CAD225327771D"><enum>(x)</enum><text>an advisory; </text></clause> <clause id="H296D964A4D524ECF915A580E19624804"><enum>(xi)</enum><text>a manual; </text></clause>
<clause id="HCE568F2CF0B64FD5B39E92321A0C36C1"><enum>(xii)</enum><text>a circular; or </text></clause> <clause id="H247FCA8E4EFA41BA917020300773EBDD"><enum>(xiii)</enum><text>any combination of the items described in clauses (i) through (xii).</text></clause></subparagraph></paragraph>
<paragraph id="HB8E545F3A59245E79EB3D4AFCDA5E824"><enum>(2)</enum><header>Regulation</header><text>The term <quote>regulation</quote>—</text> <subparagraph id="H323B38AC63B54C8D986DD928E59C5F2F"><enum>(A)</enum><text>means an agency statement of general applicability and future effect, which the agency intends to have the force and effect of law, that is designed to implement, interpret, or prescribe law or policy or to describe the procedure or practice requirements of an agency;</text></subparagraph>
<subparagraph id="HCE68002A94C549CAAC18F4FA6A3026E5"><enum>(B)</enum><text>includes regulations issued pursuant to—</text> <clause id="H013F961E461742BFB06F11CC512DD533"><enum>(i)</enum><text>an informal rulemaking under section 553 of title 5, United States Code;</text></clause>
<clause id="HCCD37F5923BC45E2A1CB985FB9CD0D86"><enum>(ii)</enum><text>a formal rulemaking under sections 556 and 557 of title 5, United States Code; and</text></clause> <clause id="H5AA13E4C56334AAFAFA58400222465A3"><enum>(iii)</enum><text>any combination of the informal rulemaking described in clause (i) and the formal rulemaking described in clause (ii); and</text></clause></subparagraph>
<subparagraph id="H53C4D11CBD7049768FB4D839C1FAEF5F"><enum>(C)</enum><text>does not include—</text> <clause id="HB5FA08D3ACDD4F5CA7B5FDE483703E2C"><enum>(i)</enum><text>regulations that pertain to a military or foreign affairs function of the United States, other than procurement regulations and regulations involving the import or export of non-defense articles and services;</text></clause>
<clause id="HC5874C34C7E44EA587702BB5F24EA189"><enum>(ii)</enum><text>regulations or regulations that are limited to agency organization, management, or personnel matters; or</text></clause> <clause id="HC9AEAF72DFDE48A0BE040462C640CEDC"><enum>(iii)</enum><text>any other category of regulations exempted by the Administrator of Office of Information and Regulatory Affairs.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H3E80F8A5514F44BEBD7C8589E1CF99B2"><enum>(d)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this Act or the application of any provision of this Act to any person or circumstance, is held invalid, the application of such provision to other persons or circumstances, and the remainder of this Act, shall not be affected thereby.</text></subsection></section> </legis-body> </bill>
