which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 46, United States Code, with respect to the projects eligible for certain port and intermodal improvement grants, and for other purposes.</official-title></form><legis-body id="HC10D437D44404D67BE71DC57BD058B17" style="OLC"><section id="HEF7DF5BCD7C44175AD9764445FE58400" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Resilient Ports Act</short-title></quote>.</text></section><section id="HA43CB30DA9FF4DC2A46352FF6E72CBC8" section-type="subsequent-section"><enum>2.</enum><header>Port development</header><text display-inline="no-display-inline">Section 50302 of title 46, United States Code, is amended—</text><paragraph id="H9117860A04A44A75A340230158A78D0D"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="H7A2199038369441597FFE251CAFABEBB"><enum>(A)</enum><text>in paragraph (3)(A)(ii)—</text><clause id="HEACC723BF4284E4F8A28C603DF642461"><enum>(i)</enum><text>in subclause (II) by striking <quote>; or</quote> and inserting a semicolon; and</text></clause><clause id="HFFCE264D844D487FAF3DE608B5FCF2BB"><enum>(ii)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="HB01D0FF6FA6C4DCE90199BFD88423628" display-inline="no-display-inline"><subclause id="H3C1E0ABDE1F44CC5ACC66C166A894A4E"><enum>(IV)</enum><text display-inline="yes-display-inline">emissions mitigation measures directly related to reducing the overall carbon footprint from port operations; or</text></subclause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA1814FA8C2914513A000606788090A37"><enum>(B)</enum><text>in paragraph (6)(B)—</text><clause id="HDE9E2AB04C2745DB9AA5CA38AD089A02"><enum>(i)</enum><text>in clause (i) by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="H8B9FAE6856F04AC79845A6FB704B59A3"><enum>(ii)</enum><text>in clause (ii) by striking the period and inserting <quote>; and</quote>; and</text></clause><clause id="H4844037B5EEC4EF4869EA606B4489772"><enum>(iii)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H972876668B044D9D82AA839615E7414E" display-inline="no-display-inline"><clause id="HB2E154BDCD0D435881D1BB9089F1FBC4"><enum>(iii)</enum><text display-inline="yes-display-inline">projects that increase the port’s resilience to sea-level rise, flooding, and extreme weather events, including such events related to climate change.</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HDE479A7B57584649AC1CF5D3A7F78E3A"><enum>(C)</enum><text>in paragraph (7)(B) by striking <quote>18 percent</quote> and inserting <quote>25 percent</quote>; and </text></subparagraph><subparagraph id="H9E792E1A2AC34CD49F21A83F78760E97"><enum>(D)</enum><text>in paragraph (12) by adding at the end the following:</text><quoted-block style="USC" id="HF669679A379B472589F41C060FBF1AF9" display-inline="no-display-inline"><subparagraph id="H05943596B38844B8B837FA69956C5A39"><enum>(D)</enum><header>Resilience</header><text display-inline="yes-display-inline">The term <quote>resilience</quote> means the ability to anticipate, prepare for, adapt to, withstand, respond to, and recover from operational disruptions and sustain critical operations at ports, including disruptions caused by natural or manmade hazards.</text></subparagraph><subparagraph id="HB96A1CE513364F56A51B549B31C6332A"><enum>(E)</enum><header>Carbon Footprint</header><text display-inline="yes-display-inline">The term <quote>carbon footprint</quote> means the total carbon-based pollutants, products, and any greenhouse gases that are emitted into the atmosphere resulting from the consumption of fossil fuels.</text></subparagraph><subparagraph id="H3CD71DE0738540D590D242C0CA7CFA09"><enum>(F)</enum><header>Climate change</header><text display-inline="yes-display-inline">The term <quote>climate change</quote> means detectable changes in 1 or more climate system components over multiple decades, including—</text><clause id="HBEA7F1F17950465E958D2A1A1A4EFAD4"><enum>(i)</enum><text>changes in the average temperature of the atmosphere or ocean;</text></clause><clause id="HE4608E2B42CE4529A881F5F92725D175"><enum>(ii)</enum><text>changes in regional precipitation, winds, and cloudiness; and </text></clause><clause id="HBE42AB34AB5748EA9EF94A6EF7ADC215"><enum>(iii)</enum><text>changes in the severity or duration of extreme weather, including droughts, floods, and storms.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H68DC2A2D2593498191D9833E246C5221"><enum>(2)</enum><text>in the heading for subsection (d) by striking <quote><header-in-text level="subsection" style="appropriations">Inland</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">Inland River</header-in-text></quote>. </text></paragraph></section></legis-body></bill>
