which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for liability protection for health care providers for damages with respect to any harm caused by any act or omission of such health care professional or related health care entity in the course of arranging for or providing health care services during the COVID–19 public health emergency period, and for other purposes.</official-title></form><legis-body id="H4869E287D71E48838229409E3839C57B" style="OLC"><section id="H1552DCE3AD8045CD892E8318E59A30B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coronavirus Provider Protection Act</short-title></quote>.</text></section><section id="HED31D12E49734A348F8F1F77D33629C2" section-type="subsequent-section"><enum>2.</enum><header>Limitation on liability for health care professionals and related health care entities related to COVID–19 emergency response</header><subsection id="HA5A6CC54DD034219B1DDDE58DA164CE7"><enum>(a)</enum><header>Limitation on liability</header><text display-inline="yes-display-inline">Except as provided in subsection (b), a covered health care provider shall not be liable for damages under any law of the United States or of any State (or political subdivision thereof) for any harm caused by any act or omission of such covered health care provider in the course of arranging for or providing health care services if such health care services were provided in good faith or were withheld for reasons related to the COVID–19 pandemic and the act or omission—</text><paragraph id="HB5C2621C34A74A059776166BA9A2D288"><enum>(1)</enum><text>occurs—</text><subparagraph id="H4E7ABA1972EE4984BB382B825FB477E1"><enum>(A)</enum><text>during the emergency period or during the 60-day period following the termination of such emergency period; and</text></subparagraph><subparagraph id="H556920A206074131A295233006C5A14B"><enum>(B)</enum><text display-inline="yes-display-inline">in the course of providing health care services that, with respect to a health care professional—</text><clause id="H4BEEF6B6BA394E5C90974394DC85FE79"><enum>(i)</enum><text>are within the scope of the license, registration, or certification of the health care professional, as defined by the State of licensure, registration, or certification;</text></clause><clause id="HA71382FE8F534F3CABB460558CAC0FC0"><enum>(ii)</enum><text>do not exceed the scope of license, registration, or certification of a substantially similar health care professional in the State in which such act or omission occurs; and</text></clause><clause id="H94976C96492A439B9A86D281D5EB9B39"><enum>(iii)</enum><text>may be outside the health care professional’s normal area of practice; or</text></clause></subparagraph><subparagraph id="HC4A63828BE8241249C269546F123DCFE"><enum>(C)</enum><text display-inline="yes-display-inline">in the course of providing health care services that, with respect to a related health care entity, are within the licensure and accreditation of the related health care entity; and</text></subparagraph></paragraph><paragraph id="H12E71669081144359D91C0A7F63D2DF1"><enum>(2)</enum><text>is committed (or not undertaken)—</text><subparagraph id="HB0077CA7FF7F4105A2C5141FB3D2978E"><enum>(A)</enum><text>based upon any direction, guidance, recommendation, or other statement made by a Federal, State, or local official to address or in response to the COVID–19 pandemic;</text></subparagraph><subparagraph id="HB6F57623954046DEB3C7B30039EAD0BA"><enum>(B)</enum><text>based upon any guidance published by any Federal, State or local department or any division or agency of such department in response to the COVID–19 pandemic; or</text></subparagraph><subparagraph id="H7341B8E70C0D4A0787BFD1AA6F99BF3F"><enum>(C)</enum><text>due to a lack of resources, including manpower, attributable to the COVID–19 pandemic. </text></subparagraph></paragraph></subsection><subsection id="H1AE7B4FCC02042D6BCBC58158B3EF18B"><enum>(b)</enum><header>Exceptions</header><text>Subsection (a) does not apply with respect to harm caused by an act or omission of a covered health care provider, as described in such subsection, if—</text><paragraph id="H630763D123934738BF2FD697F0593AEC"><enum>(1)</enum><text>the act or omission constitutes willful or criminal misconduct, gross negligence, reckless misconduct, or a conscious flagrant indifference to the rights or safety of the individual harmed by the covered health care provider; or</text></paragraph><paragraph id="H7DC4F836E1754BE883938CE14E77E97D"><enum>(2)</enum><text>the health care provider provided the health care services under the influence (as determined pursuant to applicable State law) of alcohol or an intoxicating drug (other than a prescription drug taken under the orders of a physician).</text></paragraph></subsection><subsection id="H491EDDE4E19647C7A0FBAEBCD670E991"><enum>(c)</enum><header>Preemption</header><paragraph id="H6172702F429942158BAA5091DE171D7A"><enum>(1)</enum><header>In general</header><text>This section preempts the laws of a State or any political subdivision of a State to the extent that such laws are inconsistent with this section, unless such laws provide greater protection from liability.</text></paragraph><paragraph id="HAE8D0B347C504AFE86F09BBC7670A5EC"><enum>(2)</enum><header>Volunteer Protection Act</header><text>Protections afforded by this section are in addition to those provided by the Volunteer Protection Act of 1997 (<external-xref legal-doc="public-law" parsable-cite="pl/105/19">Public Law 105–19</external-xref>).</text></paragraph></subsection><subsection id="HBE31D3FE919841B8905E7C11B82CCFA2"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H26CEBC743F42496796194DCF96586AB3"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>covered health care provider</quote> means—</text><subparagraph id="HCC05F16D20C340E19C93F269589E56C3"><enum>(A)</enum><text display-inline="yes-display-inline">a health care professional; or</text></subparagraph><subparagraph id="HD65862D55CEC49B8964E317C922CC93A"><enum>(B)</enum><text>a related health care entity. </text></subparagraph></paragraph><paragraph id="H77F1633AB2214327AE54A82549FB257D"><enum>(2)</enum><text>The term <quote>emergency period</quote> has the meaning given such term in section 1135(g)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)(B)</external-xref>).</text></paragraph><paragraph id="H3EE3A585C8FA41D7A17E8F8EB4734A4C"><enum>(3)</enum><text>The term <quote>harm</quote> includes physical, nonphysical, economic, and noneconomic injury or losses.</text></paragraph><paragraph id="H69E4D87544174C8088CD6D5C6304315F"><enum>(4)</enum><text>The term <quote>health care professional</quote> means an individual who is licensed, registered, or certified under Federal or State law to provide health care services.</text></paragraph><paragraph id="H634058C789C14EC38B34C74EBC660B9C"><enum>(5)</enum><text>The term <quote>related health care entity</quote> means an entity with which a health care professional has a professional affiliation under which the health care professional performs health care services, including a skilled nursing facility, hospital, academic medical center, ambulatory surgical center, group medical practice, or medical clinic.</text></paragraph><paragraph id="H4194C4EB3AFF4A6DB190C3E28522122A"><enum>(6)</enum><text>The term <quote>professional affiliation</quote> includes staff privileges, medical staff membership, employment or contractual relationship, partnership or ownership interest, academic appointment, or other affiliation under which a health care professional provides health care services on behalf of, or in association with, the related health care entity.</text></paragraph><paragraph id="H4E9FE2D55C4348B592AB4B2A8E0C56BD"><enum>(7)</enum><text>The term <quote>health care services</quote> means any services rendered or items provided by a health care professional or related health care entity, or by any individual working under the supervision of a health care professional, that relate to—</text><subparagraph id="H008CB18353D84494AE5CE7C4E01228F9"><enum>(A)</enum><text>the treatment, diagnosis, prevention, or mitigation of COVID–19;</text></subparagraph><subparagraph id="H0E9D9A8202544CDD8C363671AA6A67AF"><enum>(B)</enum><text>the treatment, diagnosis, or care with respect to an individual with a confirmed or suspected case of COVID–19; or</text></subparagraph><subparagraph id="H606741638ECB4FD8BAC4B74D7A357301"><enum>(C)</enum><text>the treatment, diagnosis, or care with respect to an individual who presents to a health care professional or related health care entity during the emergency period.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
