R. 3011</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210507">May 7, 2021</action-date><action-desc><sponsor name-id="B001299">Mr. Banks</sponsor> (for himself, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, and <cosponsor name-id="W000795">Mr. Wilson of South Carolina</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the definition of a communist Chinese military company for purposes of the imposition of certain sanctions, and for other purposes.</official-title></form><legis-body id="HF1735D21378B4783A7BC5BA00EA20363" style="OLC"><section id="HE60A4E79B7504CCE896EBF5D6B84BAEF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Holding Chinese Military Companies Accountable Act</short-title></quote>.</text></section><section id="H8126E7F717734E5193E5B2F98EDC2B42"><enum>2.</enum><header>Modifications to applications of IEEPA authorities to communist Chinese military companies</header><text display-inline="no-display-inline">Section 1237(b)(4)(B) of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text><paragraph id="HBA07912F0579451E96FB879CFBA92D30"><enum>(1)</enum><text display-inline="yes-display-inline">by striking clause (ii);</text></paragraph><paragraph id="H91C25EAFF31C4793A7F42CBC73B94ED7"><enum>(2)</enum><text>in the matter preceding clause (i), by striking <quote>that—</quote> and inserting <quote>that is engaged in providing commercial services, manufacturing, producing, or exporting and—</quote>;</text></paragraph><paragraph id="H8ED021E4059D4465B4D0E9A33927C227"><enum>(3)</enum><text>in clause (i), by striking <quote>; and</quote> and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HA2EFA02769614FB5AD1DDB21477FC783"><enum>(4)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" id="HE64A0138D75E4702BD2F3154DD234B06" display-inline="no-display-inline"><clause id="H326B7A4869A045EFBE22A971EAEF0F1F"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HABED0A93E5FF4248B8288C26EE4E5E97"><enum>(I)</enum><text>is owned or controlled by, or affiliated with, the Chinese Communist Party or any person who has ever been a delegate of a National People’s Congress of the Chinese Communist Party; and</text></subclause><subclause id="HB1EB0A44EBBF42CDA9316DEE1366D4B1" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">is engaged in significant investment in the sectors of fifth-generation wireless communications, artificial intelligence, advanced computing, <quote>big data</quote> analytics, autonomy, robotics, directed energy, hypersonics, or biotechnology.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HAEF1EEE0DD8A4C759875D5D022396479"><enum>3.</enum><header>Extension of authority</header><text display-inline="no-display-inline">Notwithstanding section 1061(i)(6) of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="usc" parsable-cite="usc/10/111">10 U.S.C. 111</external-xref> note), the submission required by subsection (b) of section 1237 of the Strom Thurmond National Defense Authorization Act for Fiscal Year 1999—</text><paragraph id="HEB9AD18CD3514A7D8232489805CBDF2A"><enum>(1)</enum><text>shall not terminate on December 31, 2021; and</text></paragraph><paragraph id="HA5ABBFF123784D01BC9980345EDA1CFA"><enum>(2)</enum><text>shall continue in effect until December 31, 2026.</text></paragraph></section></legis-body></bill>
