<section id="HF1B90B3E311E4C22BE6DC9B8BB2DF170" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Direct Creation, Advancement, and Retention of Employment Opportunity Act</short-title></quote> or the <quote><short-title>Direct CARE Opportunity Act</short-title></quote>.</text></section> <section id="HD7A77219518941288CB0EB6524A20150"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H418EC7ECABBF45A4A7781124551574FE"><enum>(1)</enum><text display-inline="yes-display-inline">Nearly 20,000,000 adults in the United States require assistance completing self-care and other daily tasks due to physical, cognitive, developmental, or behavioral conditions. This number includes about 17,000,000 individuals living in the community, 1,500,000 residing in nursing homes, and nearly 1,000,000 in residential care. The number of people needing this type of assistance is expected to rise as the percentage of the population that is over age 65 increases dramatically in the coming decades.</text></paragraph> <paragraph id="H10145AAF4E6E48AD94C65F2795A2CBDE"><enum>(2)</enum><text>The assistance of direct care workers allows older individuals and individuals with disabilities to live with dignity and safety, and to exercise their right to live independently in their own homes and communities, in keeping with what is most appropriate for their needs and preferences. Older individuals and individuals with disabilities may also participate in the direct care workforce, further supporting their ability to live independently.</text></paragraph>
<paragraph id="H2C66D673A8A94F439EC2822AEC283189"><enum>(3)</enum><text>According to PHI, direct care workers provide most of the paid, hands-on care for older individuals and individuals with disabilities.</text></paragraph> <paragraph id="HB8D12217BC29421FAC239B540904F31A"><enum>(4)</enum><text display-inline="yes-display-inline">From 2014 to 2024, home care occupations are projected to add more jobs than any other single occupation, with an additional 633,100 new jobs. Home care is also among the top 10 fastest-growing occupations, and with the projected growth in the population over age 65, this may underestimate the number of home care workers that will be needed to provide care for this growing population. </text></paragraph>
<paragraph id="HDD289AF4649745E7892AD080F1679F44"><enum>(5)</enum><text>Many direct care workers lack access to a career pathway or advanced training opportunities. This limits their ability to build competency and expertise in their field that, when gained, may lead to an increase in their earning capacity. According to PHI, more than half of home care workers have completed no formal education beyond high school, making high-quality, transferable training essential to success on the job.</text></paragraph> <paragraph id="HAD8CAA219BEB44A4830D5121D91B7EB3"><enum>(6)</enum><text display-inline="yes-display-inline">As of 2018, the median wage for direct care workers is $12.27 per hour and wages and earnings for home care workers are even lower in rural areas. Because of low wages, variable work hours, and the inability to access workplace-based benefits, 44 percent of such workers live in low-income households, and 15 percent of the workers from such households live below the poverty line. Nearly half of direct care workers rely on some form of public assistance to support themselves and their families.</text></paragraph>
<paragraph id="HD23B375F51764822A904C731A6B2DD89"><enum>(7)</enum><text display-inline="yes-display-inline">According to PHI, the direct care workforce is primarily comprised of low income women and people of color. Approximately 9 in 10 direct care workers are women, more than half are women of color, and one quarter of direct care workers are immigrants.</text></paragraph> <paragraph id="HB31BDC8FE93C40AE81485299AC98A2B8"><enum>(8)</enum><text>The direct care workforce is plagued with high turnover, low job satisfaction, and workforce shortages. These conditions can contribute to reduced quality of care and threaten the availability of supports for older individuals and individuals with disabilities.</text></paragraph>
<paragraph id="H31CAE4EA98B045258590328EABF203A6"><enum>(9)</enum><text>Because of the nature of the work, direct care workers suffer from disproportionately high rates of injury. In 2016, the injury rate for nursing assistants was 337 per 10,000 as compared to 100 per 10,000 for other occupations.</text></paragraph> <paragraph id="H900C7C351EBA4610AD54C42E3573CA84"><enum>(10)</enum><text>Training has been shown to reduce worker turnover, reduce rates of injury, and lead to increased job satisfaction.</text></paragraph>
<paragraph id="HDBE75F58E5E04D48BA28B225271FA79F"><enum>(11)</enum><text>The Institute of Medicine found that to ensure that the United States is prepared to meet the health care needs of older individuals during the 21st century, it is essential that the capacity of the direct care workforce be enhanced in both the number of workers available and their ability to meet their own health care and quality of life needs.</text></paragraph></section> <section id="H7900693C25CB4814A7E8B77C5F356F48"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H6EF2D6D2CBE94E88B41D89E0906B7A3A" commented="no"><enum>(1)</enum><header>Apprenticeship program</header><text display-inline="yes-display-inline">The term <term>apprenticeship program</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.), including any requirement, standard, or rule promulgated under such Act, as such requirement, standard, or rule was in effect on January 1, 2020. </text></paragraph> <paragraph id="H26706BB239D341B88732AD9299CD327C"><enum>(2)</enum><header>Direct care worker</header><text>The term <term>direct care worker</term> has the meaning given the term in section 799B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295p">42 U.S.C. 295p</external-xref>).</text></paragraph>
<paragraph id="HA49BA83F786F4E699C6B3EFD158DBAE9"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="HEBA59EACD7B346C9A6C4FB020C18BA49"><enum>(A)</enum><text>a State;</text></subparagraph>
<subparagraph id="H2F87F7542D9C4753AE4BDD7277199F9A"><enum>(B)</enum><text>a nonprofit organization, a labor organization, a joint labor-management organization, or an employer—</text> <clause id="HFE145AB235F346B2AE2FBC2BC4DBE571"><enum>(i)</enum><text>with an established record of recruiting or providing training to direct care workers; or</text></clause>
<clause id="HD32D14839ED746B98D87E9C32B5E0D4A"><enum>(ii)</enum><text>that establishes a training program in consultation with an organization with an established record of providing training to direct care workers;</text></clause></subparagraph> <subparagraph id="H587A15AF6F3240C0A0FA8E7DC95CA41A"><enum>(C)</enum><text>a local board;</text></subparagraph>
<subparagraph id="H682F795BB6B84C89951895FFD6C40F72"><enum>(D)</enum><text>an entity carrying out an apprenticeship program;</text></subparagraph> <subparagraph id="H5895C94EBBDD462BB7D9F3CD9BE87C17"><enum>(E)</enum><text>an Indian tribe or tribal organization; or</text></subparagraph>
<subparagraph id="H095979209D0443C0A65F2E833AB546AD"><enum>(F)</enum><text>a consortium of entities listed in subparagraph (A), (B), (C), (D), or (E) that may also include an institution of higher education.</text></subparagraph></paragraph> <paragraph id="H88B8C8CC1C7C4C8FBCACC23E4F2D8361"><enum>(4)</enum><header>Employ; employer</header><text>The terms <term>employ</term> and <term>employer</term> have the meanings given the terms in section 3 of the Fair Labor Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203</external-xref> et seq.).</text></paragraph>
<paragraph id="H5AF37320333D4ADF8C2C3D8ED345C5BB"><enum>(5)</enum><header>Indian tribe; tribal organization</header><text>The terms <term>Indian tribe</term> and <term>tribal organization</term> have the meanings given such terms in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph> <paragraph id="HA91A7886070F454CA49C1D623EF0319C"><enum>(6)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph>
<paragraph id="H38109A4F807942EC9493491293E97229" commented="no"><enum>(7)</enum><header>Project participant</header><text display-inline="yes-display-inline">The term <term>project participant</term> means an individual participating in a project assisted with a grant under this Act, including a direct care worker or an individual training to be such a worker.</text></paragraph> <paragraph id="HBB26AC7D74CA46D1892FB17D6D188459"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor, except as otherwise specified in this Act.</text></paragraph>
<paragraph id="H777F90E03C4041D6B92CF4F45D360ED1"><enum>(9)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph> <paragraph id="H0A82D2D8A0CE4BD4A79964EAD826BB66"><enum>(10)</enum><header>Supportive services</header><text>The term <term>supportive services</term> means services such as transportation, child care, dependent care, housing, and needs-related payments, that are necessary to enable an individual to participate in a project assisted with a grant under this Act.</text></paragraph>
<paragraph id="H1B2A90E393174F0186A9125AD24B3BAA"><enum>(11)</enum><header>Workforce Innovation and Opportunity Act terms</header><text>The terms <term>career pathway</term>, <term>career planning</term>, <term>in-demand industry sector or occupation</term>, <term>individual with a barrier to employment</term>, <term>individual with a disability</term>, <term>local board</term>, <term>older individual</term>, <term>one-stop center</term>, <term>on-the-job training</term>, <term>recognized postsecondary credential</term>, <term>region</term>, and <term>State board</term> have the meanings given such terms in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>). </text></paragraph> <paragraph id="HCB67E2A65EF846CCB42759F8F3C51802"><enum>(12)</enum><header>Work-based learning</header><text display-inline="yes-display-inline">The term <term>work-based learning</term> has the meaning given the term in section 3 of the Carl D. Perkins Career and Technical Education Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>).</text></paragraph></section>
<section id="H5966AEA797954EB1AC8F769D0CDDD629"><enum>4.</enum><header>Authority to award grants; duration</header>
<subsection id="H7D01BE20EB3E40E4A2C38706589E29C9"><enum>(a)</enum><header>Authority to award grants</header>
<paragraph id="H1162A46F5CCD45A2A1402822362E1C30"><enum>(1)</enum><header>In general</header><text>Not later than 12 months after the date of enactment of this Act, the Secretary, in consultation with the Secretary of Health and Human Services, shall award grants to eligible entities to develop and carry out projects for purposes of recruiting, retaining, or providing advancement opportunities to direct care workers.</text></paragraph> <paragraph id="H2C6736DF4D7740F88A44475FAEBE3CA3"><enum>(2)</enum><header>Projects for advancement opportunities</header><text display-inline="yes-display-inline">Not less than 30 percent of projects assisted with grants under this Act for a fiscal year shall be projects to provide advancement opportunities to direct care workers.</text></paragraph></subsection>
<subsection commented="no" id="HF06AE5D3BCAE4DF3B477617437C87212"><enum>(b)</enum><header>Treatment of continuation activities</header><text display-inline="yes-display-inline">An eligible entity that carries out activities for purposes of recruiting, retaining, or providing advancement opportunities to direct care workers prior to receipt of a grant under this Act may use such grant to continue carrying out such activities, and shall be treated as an eligible entity carrying out a project described in subsection (a)(1).</text></subsection> <subsection id="HCE9A880C200242CDA4208E885F60D624"><enum>(c)</enum><header>Duration</header><text display-inline="yes-display-inline">A grant under this Act shall be for not less than 5 years.</text></subsection></section>
<section id="H246660BFCE4349108E2CBBD35593F349"><enum>5.</enum><header>Project plans; consultation</header>
<subsection id="HE88BDC6D46524C9CA68BD8BC8E463F36"><enum>(a)</enum><header>Project plans</header>
<paragraph id="H922BFC076D444078AEF3DBF548EFF495"><enum>(1)</enum><header>In general</header><text>To receive a grant under this Act, an eligible entity shall submit to the Secretary a project plan for each project to be developed and carried out (or for activities to be continued) with the grant at such time and in such manner as the Secretary may determine, and which shall contain the information described in paragraph (2).</text></paragraph> <paragraph id="H2BC8A8091D094C7C9E30802ECC97BE14"><enum>(2)</enum><header>Contents</header><text>A project plan submitted by an eligible entity under paragraph (1) shall include a description of each of the following:</text>
<subparagraph id="H2DE21F8D7798493480C99E1007482773"><enum>(A)</enum><text display-inline="yes-display-inline">Demographic information regarding the population in the State or relevant geographic area, including a description of the populations likely to need long-term care services, such as people with significant disabilities and the aging population.</text></subparagraph> <subparagraph id="H8A04AF5EFB4345DBA4B66B70A88FCC56"><enum>(B)</enum><text display-inline="yes-display-inline">Projections of unmet need for direct care services based on enrollment waiting lists under home and community-based waivers under section 1115 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315</external-xref>) or section 1915(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>) and other relevant data to the extent practicable and feasible. </text></subparagraph>
<subparagraph id="H4E068800F4CF4D1891CECC31F6576C46"><enum>(C)</enum><text>Current or projected job openings for, or relevant labor market information related to, direct care workers in the State or region to be served by the project, and the geographic scope of the workforce to be served by the project.</text></subparagraph> <subparagraph id="H5437668FC602420B9229D0E9A53D937F"><enum>(D)</enum><text>Specific efforts and strategies that the project will undertake to reduce barriers to recruitment, retention, or advancement of direct care workers, including an assurance that such efforts and strategies will—</text>
<clause id="H9695756A6F3044AE9CFF067B9689ED7E"><enum>(i)</enum><text>be undertaken in consultation with the individuals served by the entities described in subsection (b); and</text></clause> <clause id="HC9987434FA054D778C8E1AF4383B6BCC"><enum>(ii)</enum><text>include—</text>
<subclause id="H68D7A17F411342BE96A37930EC59FF17"><enum>(I)</enum><text>an assessment of the wages or other compensation or benefits necessary to recruit and retain direct care workers; and</text></subclause> <subclause id="HE94596ACB2374D0D98ABAEFF668972AA" commented="no"><enum>(II)</enum><text>a description of the project’s projected wages and other compensation or benefits for direct care workers at the State or local level, including a comparison of such projected wages to regional and national wages.</text></subclause></clause></subparagraph>
<subparagraph id="H2284158635C24671B62CB1DE1CC9D90E"><enum>(E)</enum><text display-inline="yes-display-inline">In the case of a project offering an education and training program, a description of such program (including any curricula, models, and standards used under the program, and any associated recognized postsecondary credentials for which the program provides preparation, as applicable), which shall include an assurance that such program will provide to each project participant in such program—</text> <clause id="H93F137967B4C4846924A14561903217E"><enum>(i)</enum><text display-inline="yes-display-inline">relevant training regarding the rights of recipients of direct care services, including their rights to—</text>
<subclause id="H8F980668F92F4B569A9880F0AA15923C"><enum>(I)</enum><text display-inline="yes-display-inline">receive services in the most integrated setting;</text></subclause> <subclause id="HDE2068BE332249B5A8799E0AE2E897FB"><enum>(II)</enum><text>exercise self-determination; and</text></subclause>
<subclause id="H8F726EE5EBD74CCA8A7CC6CA68BE8085"><enum>(III)</enum><text>be free from physical, sexual, and financial abuse;</text></subclause></clause> <clause id="H594F0778CAF949AEA1682F81F9E0F053"><enum>(ii)</enum><text display-inline="yes-display-inline">relevant training regarding the provision of culturally competent services to recipients of direct care;</text></clause>
<clause id="HD2C5B4453A154E058B7FDE93FAAE4D25"><enum>(iii)</enum><text>an apprenticeship program, work-based learning, or on-the-job training opportunities;</text></clause> <clause id="H5342D98C99FA42BAB056BBC021B79526"><enum>(iv)</enum><text>supervision or mentoring; and</text></clause>
<clause commented="no" id="H065DA830A5754F53A884F0321F5EAE61"><enum>(v)</enum><text>for the on-the-job training portion of the program, a progressively increasing, clearly defined schedule of wages to be paid to each such participant that— </text> <subclause commented="no" id="HA664194829914C66B1CF9867F8154C26"><enum>(I)</enum><text>is consistent with skill gains or attainment of a recognized postsecondary credential received as a result of participation in or completion of such program; and</text></subclause>
<subclause commented="no" id="H7DD975FA899E4C7091964EB8F4B143E2"><enum>(II)</enum><text>ensures the entry wage is not less than the greater of—</text> <item commented="no" id="HF628A0D87C1048C7904E407E3847AA7C"><enum>(aa)</enum><text>the minimum wage required under section 6(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(a)</external-xref>); or</text></item>
<item commented="no" id="H915BDEED46A94FBD9A9265AEEF537A57"><enum>(bb)</enum><text>the applicable wage required by other applicable Federal or State law, or a collective bargaining agreement.</text></item></subclause></clause></subparagraph> <subparagraph id="H0B9045E5294D4ED38027FF84134862AF"><enum>(F)</enum><text display-inline="yes-display-inline">If applicable, any other innovative models or processes the eligible entity will implement to support the retention and career advancement of direct care workers.</text></subparagraph>
<subparagraph id="H7A1547C22CF04D88BEA3985BF84D56A5"><enum>(G)</enum><text>The supportive services and benefits to be provided to project participants to support the retention and career advancement of employment of direct care workers.</text></subparagraph> <subparagraph id="HE2D7AA14A306451A8F2C22D5768F9B21"><enum>(H)</enum><text>How the eligible entity will make use of career planning to support the identification of advancement opportunities and career pathways for direct care workers in the State or region to be served by the project.</text></subparagraph>
<subparagraph id="HC043EC1704FD4954B1F61231E3519CAD"><enum>(I)</enum><text>How the eligible entity will collect and submit to the Secretary workforce data and outcomes of the project.</text></subparagraph> <subparagraph id="HA8C6E27DA62442F49F5CE43F29905669" commented="no"><enum>(J)</enum><text display-inline="yes-display-inline">How the project will provide adequate and safe equipment, and facilities for training and supervision, which—</text>
<clause id="HA8CE59C3DD41419A827DECC5BFE2A589" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">may include the provision of personal protective equipment and other necessary equipment to prevent the spread of infectious disease among workers and recipients of services; and</text></clause> <clause id="HFAFBAA8FD333454497343DE7B5B43801" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">will include—</text>
<subclause id="HC59A2A484D884CA4A3FBF3973F031D22" commented="no"><enum>(I)</enum><text>a safe work environment free from discrimination; and</text></subclause> <subclause id="H91D3417E8A78428E8579467E68EB6FEE" commented="no"><enum>(II)</enum><text>adequate training for mentors and qualified instructors to ensure compliance with this subparagraph, including any equipment that may be provided under clause (i).</text></subclause></clause></subparagraph>
<subparagraph id="HE5451BBF4CB34409929B40BC8127527D" commented="no"><enum>(K)</enum><text>How the eligible entity will consult on the implementation of the project, or coordinate the project with, the entities described in subsection (b). </text></subparagraph> <subparagraph id="H7CF901C517FA4CDC8E611B785E9CA0C8"><enum>(L)</enum><text display-inline="yes-display-inline">An assurance that the eligible entity will take such steps necessary to reduce or eliminate costs to project participants for any benefit or service provided under the project.</text></subparagraph>
<subparagraph id="H1B8D5265E0CF4EC985399DCD175B7AA1"><enum>(M)</enum><text>How the eligible entity will consult with individuals employed as direct care workers, representatives of such workers, individuals assisted by such workers, and the families of such individuals throughout the project.</text></subparagraph> <subparagraph id="H839D5D6B7B35407D923F853073098FF5"><enum>(N)</enum><text>Outreach efforts to individuals for participation in such project, including targeted outreach efforts to—</text>
<clause id="H9A945100ACC84BF5A4D4074E98504809"><enum>(i)</enum><text>individuals who are recipients of assistance under a State program funded under part A of title IV of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/601">42 U.S.C. 601</external-xref> et seq.) or individuals who are eligible for such assistance; and</text></clause> <clause id="HF236447111924EAB8BA2B0CACB44AA87"><enum>(ii)</enum><text>individuals with barriers to employment.</text></clause></subparagraph></paragraph>
<paragraph id="HBE56BB1F405941A890B8832499362969"><enum>(3)</enum><header>Considerations</header><text>In selecting eligible entities to receive a grant under this Act, the Secretary shall—</text> <subparagraph id="HC5AE8531715A425F93EF4AFC975E05D8"><enum>(A)</enum><text>ensure—</text>
<clause id="H773832F2EA8941D3B67F0502F08C0089"><enum>(i)</enum><text>equitable geographic and demographic diversity, including among rural and urban areas; and</text></clause> <clause id="H20E96BE750854E6AB8FE1A3B54ADBD5A"><enum>(ii)</enum><text>that selected eligible entities will serve areas where direct care, or a related occupation, is an in-demand industry sector or occupation; and</text></clause></subparagraph>
<subparagraph commented="no" id="HF92F6F32B37F42F186207E8CA8FD1AD6"><enum>(B)</enum><text display-inline="yes-display-inline">give priority to eligible entities proposing to predominantly serve the individuals described in clauses (i) and (ii) of paragraph (2)(N).</text></subparagraph></paragraph></subsection> <subsection id="H16BB310677144145930F9C45D2306B8B"><enum>(b)</enum><header>Consultation</header><text display-inline="yes-display-inline">Each eligible entity receiving a grant under this Act shall consult on the implementation of each project assisted with such grant, or coordinate the project with—</text>
<paragraph id="H88698F5CB3684B03950FB679B8BA4AB0"><enum>(1)</enum><text display-inline="yes-display-inline">each applicable State board or local board; and</text></paragraph> <paragraph id="H97C754CA90674222BFBCCB15E4793864"><enum>(2)</enum><text>to the extent practicable—</text>
<subparagraph id="H5209C2EE03244509AF11F3CFB69A2B01"><enum>(A)</enum><text display-inline="yes-display-inline">institutions of higher education in the State or local areas to be served by the project;</text></subparagraph> <subparagraph id="HB0CC903867CC461E870A64D7BEB76242"><enum>(B)</enum><text display-inline="yes-display-inline">the State Apprenticeship Agency recognized under the Act of August 16, 1937 (commonly known as the “National Apprenticeship Act”; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50</external-xref> et seq.), for the State or region to be served by the eligible entity or, if no such agency has been recognized in the State or region, the Office of Apprenticeship of the Department of Labor;</text></subparagraph>
<subparagraph id="HD06FE7FE66EB4338ACDD6EC0F602F5CE"><enum>(C)</enum><text display-inline="yes-display-inline">one-stop centers in the State or local areas to be served by the project;</text></subparagraph> <subparagraph id="HB6ED4EF8105E4E73B76B89584480CFBF"><enum>(D)</enum><text display-inline="yes-display-inline">the State agency responsible for administering the State plan under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.) (or waiver of the plan), or the State agency with primary responsibility for providing services and supports for individuals with intellectual disabilities and individuals with developmental disabilities;</text></subparagraph>
<subparagraph id="HD472E8281D9B4B5494DD702FC1B49847"><enum>(E)</enum><text display-inline="yes-display-inline">in the case of a project that carries out an education and training program, a nonprofit organization with demonstrated experience in the development or delivery of curricula or coursework;</text></subparagraph> <subparagraph id="H9A5F75BFC6DC4498933B1CD9E2A54A14"><enum>(F)</enum><text display-inline="yes-display-inline">an organization that fosters the professional development and collective engagement of direct care workers, including labor organizations or joint labor-management organizations;</text></subparagraph>
<subparagraph id="H6C01327ADDBF4E6C9C32346F63B1284D"><enum>(G)</enum><text display-inline="yes-display-inline">a nonprofit organization with expertise in identifying and addressing the care needs of older individuals and individuals with disabilities and their caregivers (including area agencies on aging, as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>), and centers for independent living, as described in part C of title VII of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/796f">29 U.S.C. 796f</external-xref> et seq.));</text></subparagraph> <subparagraph id="HF89F815A4DA64C86AB7716AE2D11C43A"><enum>(H)</enum><text display-inline="yes-display-inline">the State Developmental Disability Council (as such term is used in subtitle B of title I of the Developmental Disabilities Assistance and Bill of Rights Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15021">42 U.S.C. 15021</external-xref> et seq.);</text></subparagraph>
<subparagraph id="H722A6637B457458196906F22C46F8F6B"><enum>(I)</enum><text display-inline="yes-display-inline">Aging and Disability Resource Centers (as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>));</text></subparagraph> <subparagraph id="HF0BF9D2ADA804CB9B5B5DD9C87FE5507"><enum>(J)</enum><text display-inline="yes-display-inline">a nonprofit State provider association that represents providers who employ direct care workers, where such associations exist; and</text></subparagraph>
<subparagraph id="H79876C06256548A4A2BCB6AB13B70120"><enum>(K)</enum><text display-inline="yes-display-inline">an entity that employs direct care workers.</text></subparagraph></paragraph></subsection></section> <section id="H7958007AB5574BB9AF98C1414241E51E"><enum>6.</enum><header>Uses of funds; supplement, not supplant</header> <subsection id="HC269AE947E314768AA5A9AEB22FBF880"><enum>(a)</enum><header>Uses of funds</header> <paragraph id="HD5F48C41988C45C99F2E8C1D3698F515"><enum>(1)</enum><header>In general</header><text>Each eligible entity receiving a grant under this Act shall use such funds to carry out at least 1 project or to continue activities commenced prior to receipt of such grant that—</text>
<subparagraph id="H0234C6B92D3445B2940E74AEF8221D88"><enum>(A)</enum><text>develop and implement a strategy for the recruitment, retention, or advancement of direct care workers, which includes the activities described in section 5(a)(2); and</text></subparagraph> <subparagraph id="H114A3662871F44E7AF283257C2CA0C72"><enum>(B)</enum><text>provide compensation to each project participant for any training received under the project or activities.</text></subparagraph></paragraph>
<paragraph id="HF95F5D3A053D4FBFA3A20C41BC96C9F4"><enum>(2)</enum><header>Administrative costs</header><text>Each eligible entity receiving a grant under this Act shall not use more than 5 percent of the funds of such grant for costs associated with the administration of activities under this Act.</text></paragraph> <paragraph id="H4229F0881ACA4BDC9464ED8E2FAFDDD6"><enum>(3)</enum><header>Direct support</header><text>Each eligible entity receiving a grant under this Act shall use not less than 5 percent of the funds of such grant to provide direct financial assistance, such as supportive services, to project participants to support the financial needs of such individuals to enter, remain enrolled in, and complete the project (or activities) assisted with such grant.</text></paragraph></subsection>
<subsection id="H7DFBC7DCD2BC49EDB005EA01D7B20472"><enum>(b)</enum><header>Supplement, not supplant</header><text>An eligible entity receiving a grant under this Act shall use such grant only to supplement, and not supplant, the amount of funds that, in the absence of such grant, would be available to address the recruitment, retention, or advancement of direct care workers in the State or region served by the eligible entity.</text></subsection></section> <section id="H6F05D1E2C3C54D8A9AAC871556C38897"><enum>7.</enum><header>Evaluations and reports</header> <subsection id="H1601975336FD414EADF9F10B9FCDD0C9"><enum>(a)</enum><header>Reports</header> <paragraph id="HB25ACEA07C2D4C749AF2315530E0D938"><enum>(1)</enum><header>Eligible entities</header> <subparagraph id="HB261190AEF15418FBF24D6E7A94EC171"><enum>(A)</enum><header>In general</header><text>Each eligible entity receiving a grant under this Act shall submit to the Secretary and the Secretary of Health and Human Services, with respect to each project assisted with such grant—</text>
<clause id="HA08CB07D164D4F25AC6E7E0800C67A1C"><enum>(i)</enum><text display-inline="yes-display-inline">for each year of the grant period, an annual report on the progress and outcomes of the project; and</text></clause> <clause id="HD70C138E85B14DFEA12099C3E1FFE26E"><enum>(ii)</enum><text>not later 6 months after the completion of such project, a final report on the progress and outcomes of the project.</text></clause></subparagraph>
<subparagraph id="HA49DEB611AA543798B2673A41A3A7B12"><enum>(B)</enum><header>Disaggregation</header><text>Each report submitted under paragraph (A) shall—</text> <clause id="HD831C8B26A6145CBAFF1F3CED6CB37AE"><enum>(i)</enum><text>include the information described in subparagraph (C); and</text></clause>
<clause id="H7C5A262DF523464C8583B28701795547"><enum>(ii)</enum><text>disaggregate such information in the manner described in subparagraph (D).</text></clause></subparagraph> <subparagraph id="HDF67B1A88D584435A240921A91B54D5A"><enum>(C)</enum><header>Contents</header><text>Each report submitted under subparagraph (A) shall include each of the following:</text>
<clause id="H36685555977B45BABED1D3BE293A90CF"><enum>(i)</enum><text>The number of project participants, including—</text> <subclause id="H96CCDFE2CF6843A3A2B9C47A9021D69F"><enum>(I)</enum><text display-inline="yes-display-inline">the number of such participants who completed an education and training program offered by such project, disaggregated by the type of education and training completed (including work-based learning, on-the-job training, an apprenticeship program, and a professional development or mentoring program); and</text></subclause>
<subclause id="H1B42CB9A7A7E4EDF89A4AD026FA1F1A2"><enum>(II)</enum><text display-inline="yes-display-inline">the number of such participants who—</text> <item id="H591958D7738F4AD5A597DE00715DE7CD"><enum>(aa)</enum><text>completed an education and training program offered by such project; and</text></item>
<item id="HD2743518A67B474490917CBFB704D93B"><enum>(bb)</enum><text display-inline="yes-display-inline">attained employment as a direct care worker after participating in such project.</text></item></subclause></clause> <clause id="H8F7DE43674AA40039A5040C4BB2E40F2"><enum>(ii)</enum><text>The number of individuals or families assisted by project participants.</text></clause>
<clause id="HEFE9920C942D4A8A881416767FCB4ECD"><enum>(iii)</enum><text>Other services, benefits, or supports (other than the services, benefits, or supports described in clause (i)) provided to assist in the recruitment, retention, or advancement of direct care workers, the number of individuals who accessed such services, benefits, or supports, and the impact of such services, benefits, or supports.</text></clause> <clause id="HF96D4FA5F8144534B33F989C4C3B8A59"><enum>(iv)</enum><text>How the project assessed satisfaction with respect to—</text>
<subclause id="H3A844C56D1AC4BDD9495962852D92421"><enum>(I)</enum><text display-inline="yes-display-inline">project participants assisted by the project;</text></subclause> <subclause id="H712E6054C0B642438E9C20F56B95E691"><enum>(II)</enum><text display-inline="yes-display-inline">individuals receiving services delivered by project participants, including—</text>
<item id="H02AE0FD2AEF44FCB920BF99E584C643E"><enum>(aa)</enum><text>any impact on the health or health outcomes of such individuals; and</text></item> <item id="HD672736689B64F94B00BB81448A6DB7C"><enum>(bb)</enum><text display-inline="yes-display-inline">any impact on the ability of individuals to transition to or remain in the community in an environment that meets the criteria established in the section 441.301(c)(4) of title 42, Code of Federal Regulations (or successor regulations); and</text></item></subclause>
<subclause id="H93AF5F058E1F477F952CAD20C0C1F564"><enum>(III)</enum><text>employers of such project participants, as determined in accordance with section 116(b)(2)(A)(i)(VI) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(2)(A)(i)(VI)</external-xref>).</text></subclause></clause> <clause commented="no" id="HB98A9EF1758D44EABB4EE86998A972C5"><enum>(v)</enum><text display-inline="yes-display-inline">The performance of the eligible entity with respect to the indicators of performance on unsubsidized employment, median earnings, credential attainment, measurable skill gains, and employer satisfaction, as described under section 116(b)(2)(A)(i) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(2)(A)(i)</external-xref>).</text></clause>
<clause id="HF4A8400C5A7F4711A23E91EABB129C1D"><enum>(vi)</enum><text display-inline="yes-display-inline">Any other information with respect to outcomes of the project, including outcomes related to cost savings achieved by the project based on increased access to an environment described in clause (v)(II)(bb) and cost savings related to reduced emergency care or hospitalizations. </text></clause></subparagraph> <subparagraph id="HA65FE97071AF4CF8A15508015A513142"><enum>(D)</enum><header>Disaggregation</header><text display-inline="yes-display-inline">The information described under subparagraph (C) shall be disaggregated by race, ethnicity, sex, and age in accordance with section 116(d)(2)(B) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(d)(2)</external-xref>), by each population listed in section 3(24) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102(24)</external-xref>), and by the individuals described in clauses (i) and (ii) of section 5(a)(2)(N).</text></subparagraph></paragraph>
<paragraph id="HA3CFC74837064BEBBF90EDFFB630CD64"><enum>(2)</enum><header>Review and reports</header>
<subparagraph id="H9545494CE4A2434AA8CE050ECB8E29E8"><enum>(A)</enum><header>Annual performance review</header><text display-inline="yes-display-inline">The Secretary shall annually conduct a performance review of each project carried out by an eligible entity receiving a grant under this Act, including—</text> <clause id="HFACADEF53C9F42F3BFBF8FAB34BFAC71"><enum>(i)</enum><text>the performance of the project with respect to the indicators of performance described in paragraph (1)(C)(vi), and disaggregated in the manner described in paragraph (1)(D); and</text></clause>
<clause display-inline="no-display-inline" id="H374FEA1295EA474EB2F1C0D46F213D9C"><enum>(ii)</enum><text>the efficacy of the project plan submitted under section 5(a)—</text> <subclause id="HC5525953214E424C84BA42B4D3F5F03C"><enum>(I)</enum><text>for recruiting, retaining, or providing advancement opportunities for direct care workers; and</text></subclause>
<subclause id="H7BFDE855EB894885A70CF78274FCBF6D"><enum>(II)</enum><text>on the methods used to recruit, retain, or provide advancement opportunities to direct care workers.</text></subclause></clause></subparagraph> <subparagraph id="H6F744F66040A437C9EE5D26D5AB287B4"><enum>(B)</enum><header>Report to Congress</header><text>Not later than 1 year after the completion of each project assisted with a grant under this Act, the Secretary shall prepare and submit to Congress, and make publicly available, a report containing—</text>
<clause id="H48A496F4792D420CB912AA3E4B4ACB7B"><enum>(i)</enum><text>the progress and outcomes of the project as identified in the final report submitted by the eligible entity under paragraph (1)(A)(ii);</text></clause> <clause id="H141CD251B2D54E2294D5AD07EAF65823"><enum>(ii)</enum><text>an analysis of the workforce supply, current and projected shortages, and distribution of direct care workers at the national, regional, and State levels; and</text></clause>
<clause id="H2875490C6A4D4FF382D8DCF55B567651"><enum>(iii)</enum><text>recommendations for such legislative or administrative action, as the Secretary determines appropriate.</text></clause></subparagraph></paragraph> <paragraph id="HE17CEF6E9AD3421A8DCBAD22C9739223"><enum>(3)</enum><header>GAO report</header><text>Not later than 1 year after the completion of each project assisted with a grant under this Act, the Comptroller General of the United States shall conduct a study and submit to Congress a report including—</text>
<subparagraph id="HE64031F24367401C9E0B1A5256805FBC"><enum>(A)</enum><text>an assessment of how the project assisted in the recruitment, retention, or advancement of direct care workers; and</text></subparagraph> <subparagraph id="HD84EB985205B4FE0AE58733E2923B949"><enum>(B)</enum><text>recommendations for such legislative or administrative actions, as the Comptroller General determines appropriate.</text></subparagraph></paragraph></subsection>
<subsection id="H6B5BE292E9634892B30EAA58B9DEA44C"><enum>(b)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">Not later than 5 months after the date of enactment of this Act, the Secretary shall provide technical assistance to eligible entities receiving a grant under this Act, for purposes of compliance with subsection (a)(1) of this section, on—</text> <paragraph id="H7AAE3E3A63B24D86B2BE5B21796DC39F"><enum>(1)</enum><text>the disaggregation requirements of section 116(d)(2)(B) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(d)(2)</external-xref>); and</text></paragraph>
<paragraph id="H4988CEAF44C740C59C674B0099ACD4CD"><enum>(2)</enum><text>the data collection requirements of section 116(b)(2)(A)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141(b)(2)(A)(i)</external-xref>).</text></paragraph></subsection></section> <section id="H55C86C7B3EDA49A9B133A401CF90BF1D"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated $300,000,000 to carry out this Act for each of fiscal years 2022 through 2027.</text></section>
