Maloney of New York</cosponsor>, <cosponsor name-id="T000193">Mr. Thompson of Mississippi</cosponsor>, <cosponsor name-id="S000510">Mr. Smith of Washington</cosponsor>, <cosponsor name-id="N000002">Mr. Nadler</cosponsor>, <cosponsor name-id="C001078">Mr. Connolly</cosponsor>, <cosponsor name-id="S001150">Mr. Schiff</cosponsor>, <cosponsor name-id="G000551">Mr. Grijalva</cosponsor>, and <cosponsor name-id="T000472">Mr. Takano</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to modify the provisions of that title relating to the Federal Vacancies Reform Act of 1998, and for other purposes.</official-title></form><legis-body id="H2FCC21840D1A443A9FFEDD7D018E3760" style="OLC"><section id="HF730B292D7994BB8B5FFB498EF53B4EE" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Accountability for Acting Officials Act</short-title></quote>.</text></section><section id="H9ADE9412779E4262BD86948173224F46"><enum>2.</enum><header>Clarification of Federal Vacancies Reform Act of 1998</header><subsection id="H994B890746AD42CE8F4D7C7E4689BE7D"><enum>(a)</enum><header>First assistant requirements</header><text display-inline="yes-display-inline">Section 3345 of title 5, United States Code, is amended as follows:</text><paragraph id="H1A302A1ADF544FEFBCCB30E9A111292D"><enum>(1)</enum><text>In subsection (a)—</text><subparagraph id="HE817F11B5A5A4F348DE7B3A17BB3C55A"><enum>(A)</enum><text>in paragraph (1), by adding at the end before the semi-colon the following: <quote>, but, and except as provided in subsection (e), only if the individual serving in the position of first assistant has occupied such position for a period of at least 30 days during the 365-day period preceding the date of the death, resignation, or beginning of inability to serve</quote>; and</text></subparagraph><subparagraph id="H9D60B1C297274BEB9B133B49020E0F3B"><enum>(B)</enum><text>by striking subparagraph (A) of paragraph (3) and inserting the following:</text><quoted-block style="USC" id="H08DD5C500E424944BE7C71D42122BD2C" display-inline="no-display-inline"><subparagraph id="H4A8F2C16AFFB434B84AEED961654EB7B"><enum>(A)</enum><text display-inline="yes-display-inline">the officer or employee served in a position in such agency for a period of at least 1 year preceding the date of death, resignation, or beginning of inability to serve of the applicable officer; and </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HE5B98128EE774471A21C2F465B5AE492"><enum>(2)</enum><text>By adding at the end the following:</text><quoted-block style="USC" id="H589D55F83B1047519E295EBF396B523B" display-inline="no-display-inline"><subsection id="H6C3F0605DD56419BA31C892876E14671" commented="no"><enum>(d)</enum><text display-inline="yes-display-inline">For purposes of this section, a position shall be considered to be the first assistant to the office with respect to which a vacancy occurs only if such position has been designated, at least 30 days before the date of the vacancy, by law, rule, or regulation as the first assistant position. The previous sentence shall begin to apply on the date that is 180 days after the date of enactment of the Accountability for Acting Officials Act. </text></subsection><subsection id="H3B09AC3CAE09438CB47EC8DCEF4250C7"><enum>(e)</enum><text display-inline="yes-display-inline">The 30-day service requirement in subsection (a)(1) shall not apply to any individual who is a first assistant if—</text><paragraph id="H61959D193444459A9FA74DE5A3F777B8"><enum>(1)</enum><text display-inline="yes-display-inline">the office of such first assistant is an office for which appointment is required to be made by the President, by and with the advice and consent of the Senate; and</text></paragraph><paragraph id="H4859578247384CE8A28B526CD6960816"><enum>(2)</enum><text display-inline="yes-display-inline">the Senate has approved the appointment of such individual to such office.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H18B194D934484F0F95FD05C0F48683CA"><enum>(b)</enum><header>Qualifications</header><text display-inline="yes-display-inline">Section 3345(b) of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H621341A482524ACF9BA7A0AFA715AD8B" display-inline="no-display-inline"><paragraph id="H0AABE38B93F7484EB526FF3AB2738286" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Any individual directed to perform the functions and duties of the vacant office temporarily in an acting capacity under subsection (a)(2) or (f) shall possess the qualifications (if any) set forth in law, rule, or regulation that are otherwise applicable to an individual appointed by the President, by and with the advice and consent of the Senate, to occupy such office.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8AE32D9332134DC9BD3437C772033CF2" commented="no"><enum>(c)</enum><header>Application to individuals removed from office</header><text>Paragraph (2) of section 3345(c) of title 5, United States Code, is amended by inserting after <quote>the expiration of a term of office</quote> the following: <quote>or removal (voluntarily or involuntarily) from office</quote>. </text></subsection><subsection id="HC3245724F6C2495E818DEBFEEC4ACE12"><enum>(d)</enum><header>Vacancy of Inspector General positions</header><paragraph id="H1C2ABA75F0574632818F6A8B93B5D04F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3345 of title 5, United States Code, as amended by subsection (a)(2), is further amended by adding at the end the following:</text><quoted-block style="USC" id="HFC146C884FF0430B8E58E305D19133E2" display-inline="no-display-inline"><subsection id="HABE698899FC44CBD926834DE451428CB"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HFC242EC20FED44959B987CF14DE65528"><enum>(1)</enum><text>Notwithstanding subsection (a), if an Inspector General position that requires appointment by the President by and with the advice and consent of the Senate to be filled is vacant, the first assistant of such position shall perform the functions and duties of the Inspector General temporarily in an acting capacity subject to the time limitations of section 3346.</text></paragraph><paragraph id="H24A271BC108B46A28715A8D7EF744F91" indent="up1"><enum>(2)</enum><text>Notwithstanding subsection (a), if for purposes of carrying out paragraph (1) of this subsection, by reason of absence, disability, or vacancy, the first assistant to the position of Inspector General is not available to perform the functions and duties of the Inspector General, an acting Inspector General shall be appointed by the President from among individuals serving in an office of any Inspector General, provided that—</text><subparagraph id="HD5895B8E972342EFB20ABD0B38851CC4"><enum>(A)</enum><text display-inline="yes-display-inline">during the 365-day period preceding the date of death, resignation, or beginning of inability to serve of the applicable Inspector General, the individual served in a position in an office of any Inspector General for not less than 90 days; and</text></subparagraph><subparagraph id="HD1434D5FF7FF4FE388D88A02B5FECC55"><enum>(B)</enum><text display-inline="yes-display-inline">the rate of pay for the position of such individual is equal to or greater than the minimum rate of pay payable for a position at GS–15 of the General Schedule.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H071FD598A204412DB68A791D69ADBDFF" commented="no"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall apply to any vacancy first occurring with respect to an Inspector General position on or after the date of enactment of this Act.</text></paragraph></subsection><subsection id="H14D2FFDEB0D041F0BD7055D6AC51CB31"><enum>(e)</enum><header>Testimony of acting officials before Congress</header><text>Section 3345 of title 5, United States Code, as amended by subsection (d)(1), is further amended by adding at the end the following:</text><quoted-block style="USC" id="H90825E3A83DC40008E1ECACBF312D01B" display-inline="no-display-inline"><subsection id="HDF035D2D6B19408A84C752D32996BC09" commented="no"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6ECDC2931D3D46659A6818C01FF4DFEA"><enum>(1)</enum><text display-inline="yes-display-inline">Any individual serving as an acting officer due to a vacancy to which this section applies, or any individual who has served in such capacity and continues to perform the same or similar duties beyond the time limits described in section 3346, shall appear, at least once during any 60-day period that the individual is so serving, before the appropriate committees of jurisdiction of the House of Representatives and the Senate.</text></paragraph><paragraph id="HA3D8F54D2593441898D1AA613BDED8C0" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Paragraph (1) may be waived upon mutual agreement of the chairs and ranking members of such committees.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1C485D14314E4826AD7071B053487431"><enum>(f)</enum><header>Time limitation for principal officers</header><text display-inline="yes-display-inline">Section 3346 of title 5, United States Code, is amended—</text><paragraph id="HA968205815B74C7392977131AEDE5944"><enum>(1)</enum><text>in subsection (a), by inserting <quote>or as provided in subsection (d)</quote> after <quote>sickness</quote>; and</text></paragraph><paragraph id="HE88F29CE296B48ADA7EEE3C6FA6EB615"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H7F0E277B031A40D9AC0B19B243688AB3" display-inline="no-display-inline"><subsection id="HF8FDAAEE1D1244039D56BA2D2A34302E" commented="no"><enum>(d)</enum><text display-inline="yes-display-inline"> With respect to the vacancy of the position of head of any agency listed in subsection (b) of section 901 of title 31, or any other position that is within the President's cabinet and to which this section applies, subsections (a) through (c) of this section and sections 3348(c), 3349(b), and 3349a(b) shall be applied by substituting <quote>120</quote> for <quote>210</quote> in each instance. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC46243442A074434B06802E76FF3597C"><enum>(g)</enum><header>Exclusivity</header><text>Section 3347 of title 5, United States Code, is amended—</text><paragraph id="HADE3CF77BE3A46CFA24DFEDB16FBCF35"><enum>(1)</enum><text>by redesignating subsection (b) as subsection (c); and</text></paragraph><paragraph id="HB37C8C42EC824E10A34D869605847325"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text><quoted-block style="USC" id="HF16E9C40CAE541C0AE50CF8E99B5DDD3" display-inline="no-display-inline"><subsection id="H94257AB8431B46448151A990D00A11DE"><enum>(b)</enum><text display-inline="yes-display-inline">Notwithstanding subsection (a), any statutory provision covered under paragraph (1) of such subsection that contains a non-discretionary order or directive to designate an officer or employee to perform the functions and duties of a specified office temporarily in an acting capacity shall be the exclusive means for temporarily authorizing an acting official to perform the functions and duties of such office.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3D8B04311B2D4106B1B74A37A617324C" commented="no"><enum>(h)</enum><header>Reporting of vacancies</header><paragraph id="H64D93DDA5F31454D8BFEBAA93B7D1962"><enum>(1)</enum><header>In general</header><text>Section 3349 of title 5, United States Code, is amended—</text><subparagraph id="H1648DF52E5164260AF2F8C5CC8A82416"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HB1D48F5C99174FFDA116A6933C60EACB"><enum>(i)</enum><text>by striking <quote>immediately upon</quote> in each instance and inserting <quote>not later than 7 days after</quote>; </text></clause><clause id="H5126D5289A0B4823841835EF55F30EC5"><enum>(ii)</enum><text>in paragraph (3), by striking <quote>and</quote> at the end;</text></clause><clause id="HCCCF4923A1F04F29A2FA2B16B4E54AC0"><enum>(iii)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="HE28C60858051477E98F18276F10CCEAA"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="H1A61B4FBD22E42D0871754671B93F4F9" display-inline="no-display-inline"><paragraph id="H4713C440906448D69802BD2801075761" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">notification of the end of the term of service of any person serving in an acting capacity and the name of any subsequent person serving in an acting capacity and the date the service of such subsequent person began not later than 7 days after such date.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HF77A62A7CAC54755AECF5EEB7992AD1C"><enum>(B)</enum><text>in subsection (b), by striking <quote>immediately</quote> and inserting <quote>not later than 14 days after the date of such determination</quote>.</text></subparagraph></paragraph><paragraph id="H1638CBB21D9346ADABCB8DDC50D210CF" commented="no"><enum>(2)</enum><header>Technical corrections</header><text>Paragraphs (1) and (2) of subsection (b) of such section 3349 are amended to read as follows:</text><quoted-block style="USC" id="HCB64A2B7E62D4BBFB6DDEF317E97EAFA" display-inline="no-display-inline"><paragraph id="HC05F1E1C6F2A48878741100BAE6139DA" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and Governmental Affairs of the Senate;</text></paragraph><paragraph id="H1B0B452DFE54487586266234B7135FF4" commented="no"><enum>(2)</enum><text>the Committee on Oversight and Reform of the House of Representatives; </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1B20C13B70E04720AAAD67C5E09FA54E"><enum>(i)</enum><header>Vacancies during presidential inaugural transitions</header><text display-inline="yes-display-inline">Subsection (b) of section 3349a of title 5, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="HC05EF1B2EAB84410BEEDFEA1772FEA4A" display-inline="no-display-inline"><subsection id="H7AA886BAAFDD4768896FD83B4BCDF8F1"><enum>(b)</enum><text display-inline="yes-display-inline">Notwithstanding section 3346 (except as provided in paragraph (2) of this subsection) or 3348(c), with respect to any vacancy that exists on a transitional inauguration day, or that arises during the 60-day period beginning on such day, the person serving as an acting officer as described under section 3345 may serve in the office—</text><paragraph id="H32D1EB6810C443B59439B86F131ED973"><enum>(1)</enum><text display-inline="yes-display-inline">for no longer than 300 days beginning on such day; or</text></paragraph><paragraph id="H746D99B89C9640458A03FFDC00FC7344"><enum>(2)</enum><text display-inline="yes-display-inline">subject to subsection 3346(b), once a first or second nomination for the office is submitted to the Senate, from the date of such nomination for the period that the nomination is pending in the Senate.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
