<official-title display="yes">To discourage speculative oil and gas leasing and to promote enhanced multiple use management of public land and National Forest System land, and for other purposes.</official-title>

<section section-type="section-one" id="H4207C516CD3B42B2ADBCE566E70F6A93"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Speculative Oil and Gas Leasing Act of 2021</short-title></quote>.</text></section> <section id="HCB5581B22E2146FFB9E3EAC978BD93CB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
<paragraph id="H2488EA496AA64B21832A133F1A237865"><enum>(1)</enum><text>Federal land should be managed for multiple uses, resources, and values, including recreation use, grazing use, timber resources, mineral resources, watershed management, wildlife and fish habitat, and natural, scenic, scientific, and historic values;</text></paragraph> <paragraph id="H3EFE22B9195345A983AF682CC9D92427"><enum>(2)</enum><text>section 17(a) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(a)</external-xref>) authorizes the Secretary of the Interior to offer for lease only land that is <quote>known or believed to contain oil or gas deposits</quote>;</text></paragraph>
<paragraph id="H954BCE6126804FB6A8A565096D8237D1"><enum>(3)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="H22CFE26BF1334E0E9680D14AF5F126CF"><enum>(A)</enum><text>in determining whether a parcel of Federal land should be made available for oil and gas leasing and development, and in offering such a parcel for sale, the Secretary does not meaningfully take into consideration the oil and gas development potential of that parcel; and</text></subparagraph> <subparagraph id="H3264E6E963C44384BDDD6B5BD4CAB405" indent="up1"><enum>(B)</enum><text>as a result, the Secretary regularly offers and leases for oil and gas development Federal land that has no or low potential for the development of oil and gas resources (referred to in this section as <quote>no- or low-potential Federal land</quote>);</text></subparagraph></paragraph>
<paragraph id="HDD344E9889754EA3808408157C872475"><enum>(4)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="HA92DF94C83774151A051D6BCC1840634"><enum>(A)</enum><text>no- or low-potential Federal land is frequently leased for or near the minimum lease bid, or noncompetitively, and rarely produce oil or gas resources; and</text></subparagraph> <subparagraph id="HC64C235931A745EE9B752297CF822C98" indent="up1"><enum>(B)</enum><text>as a result, taxpayers in the United States receive minimal revenue from the leasing of no- or low-potential Federal land;</text></subparagraph></paragraph>
<paragraph id="HD4FB8DC1C6CA47F1B357406AD8553252"><enum>(5)</enum><text>making no- or low-potential Federal land available for oil and gas leasing can result in leases being obtained for speculative purposes;</text></paragraph> <paragraph id="HB0A6D9DD73A641CE9C8E513434A6A675"><enum>(6)</enum><text>the Secretary wastes taxpayer resources in issuing and managing leases on no- or low-potential Federal land;</text></paragraph>
<paragraph id="H65BBBFAA62134A8B89D548BCA7347BA9"><enum>(7)</enum><text>no- or low-potential Federal land frequently supports other economically important uses, resources, and values including the uses, resources, and values described in paragraph (1);</text></paragraph> <paragraph id="H16C2808806884E0286B785A63D40FA32"><enum>(8)</enum><text>the existence of leases on no- and low-potential Federal land can and does limit the ability of the Secretary to support and enhance the uses, resources, and values described in paragraph (1); and</text></paragraph>
<paragraph id="H11F93491D913420E9B0A68BDD66BB220"><enum>(9)</enum><text>meaningful public participation in leasing decisions is essential and can help to ensure that the decisions of the Secretary are well-informed and based on current and reliable information and data.</text></paragraph></section> <section id="H7B28285233EE4D55AA687B30B573DE30"><enum>3.</enum><header>Policy</header><text display-inline="no-display-inline">In accordance with Federal multiple use land management goals, it is the policy of the United States that—</text>
<paragraph id="HD886D9DE5DF24D1E8353A60B874AC1B2"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary—</text> <subparagraph commented="no" id="HC86022B6FB394DDD8CF04D891C1F0293"><enum>(A)</enum><text display-inline="yes-display-inline">shall not, absent exceptional circumstances, offer for lease any Federal land that has low or no potential for the development of oil and gas resources;</text></subparagraph>
<subparagraph id="H11C7D97AE96A479BAFA5210F43105B33"><enum>(B)</enum><text display-inline="yes-display-inline">shall discourage speculation in the Federal onshore oil and gas leasing program; and</text></subparagraph> <subparagraph id="H009AB586376047208CA8918C57A3D5E8"><enum>(C)</enum><text display-inline="yes-display-inline">by not offering for lease Federal land described in subparagraph (A), shall conserve limited Federal resources that can be better applied elsewhere; and</text></subparagraph></paragraph>
<paragraph id="HB20343B8D349482883F772A3F727D55B"><enum>(2)</enum><text display-inline="yes-display-inline">the policies described in paragraph (1) are in keeping with, and are not detrimental to, the energy security of the United States.</text></paragraph></section> <section id="H3D58C4BA6FBE4B8B8D5A16BECC3C00BE"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H35AC93B424FB42D69210DA8D45F566BE"><enum>(1)</enum><header>Drainage</header><text>The term <term>drainage</term> means the migration of hydrocarbons, inert gases (other than helium), or associated resources from a well caused by production from another well.</text></paragraph> <paragraph id="H90487DD0FFA44631A69F5C2DECF425D5"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means—</text>
<subparagraph id="HC0102ABB9C78451CA6729BEE6A4231A8"><enum>(A)</enum><text>public land; and</text></subparagraph> <subparagraph id="HA370D4BA2BD84A119E2F3DCEA73C669B"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph>
<paragraph id="H495187C031F242BE8955667CF1CAFE01"><enum>(3)</enum><header>Land use plan</header><text>The term <term>land use plan</term> means—</text> <subparagraph id="H08A6F88CEAE64C51A4C31B923FFE3705"><enum>(A)</enum><text>a land use plan required under sections 201 and 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1711">43 U.S.C. 1711</external-xref>, 1712), including any resource management plan (as defined in section 1601.0–5 of title 43, Code of Federal Regulations (or successor regulations)); and</text></subparagraph>
<subparagraph id="HA7DDC97D0DB04C1F9D98C4F5371BC030"><enum>(B)</enum><text>a land and resource management plan developed by the Secretary of Agriculture pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>).</text></subparagraph></paragraph> <paragraph id="H2E3B75249444433D9732657EF1C8FF27"><enum>(4)</enum><header>Public land</header><text>The term <term>public land</term> has the meaning given the term <term>public lands</term> in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph>
<paragraph id="H7E8AEFD92CE54443B71B508070901287"><enum>(5)</enum><header>Reasonably foreseeable development scenario</header><text>The term <term>reasonably foreseeable development scenario</term> has the meaning given the term in the handbook of the Bureau of Land Management entitled <quote>H—1624–1—Planning for Fluid Mineral Resources</quote> (as in effect on the date of enactment of this Act) and issued pursuant to the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701</external-xref> et seq.).</text></paragraph> <paragraph id="H49F15FDB490946E988B0EDEF0E6D98F2"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></paragraph></section>
<section id="HA5ADDF60B68A43158303168F60499239"><enum>5.</enum><header>Federal land covered by reasonably foreseeable development scenario issued before date of enactment</header>
<subsection id="H434A5F3F3FB64402977E622BA10AFB82"><enum>(a)</enum><header>In general</header><text>With respect to Federal land otherwise available for leasing of oil and gas resources pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.) that is covered by a reasonably foreseeable development scenario issued before the date of enactment of this Act, except as provided in subsection (b), the Secretary shall not offer the Federal land for lease unless the reasonably foreseeable development scenario for that land includes an assessment of the oil and gas development potential of that land that specifically identifies the potential for all acres subject to decisions on availability for leasing.</text></subsection> <subsection id="H7693E4FC695A4BB38ADCE3FF2E73130D"><enum>(b)</enum><header>Exception for drainage</header> <paragraph id="HA019AE5CB2F9452FAE982C67F77FB02F"><enum>(1)</enum><header>In general</header><text>The Secretary may offer for lease any Federal land described in subsection (a) without meeting the requirements of that subsection if—</text>
<subparagraph commented="no" id="H0481213B9EEB4642A784C7F8744BC8A8"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H0E34995525FD45B3BCFF368966D028C1"><enum>(i)</enum><text>the Federal land is adjacent to land currently producing oil or gas; and</text></clause> <clause commented="no" id="HCC26BCE9CAA54FF7BEEA73F5A488752D" indent="up1"><enum>(ii)</enum><text>the lease is issued for the purpose of preventing drainage from the adjacent land; or</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC74502210BDC42C680759E4F1F48D046"><enum>(B)</enum><text>the Federal land—</text> <clause commented="no" display-inline="no-display-inline" id="H3BBA03007DEC40FAB1C79A78B172619C"><enum>(i)</enum><text>does not exceed 640 acres; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H25BB58F20C47411D9509703B7CA3011D"><enum>(ii)</enum><text>is located within 1 mile of a well producing oil or gas in paying quantities on the date on which the Federal land is offered for leasing.</text></clause></subparagraph></paragraph> <paragraph id="H10265ECCD0A14250AAAAAB4277EECE93"><enum>(2)</enum><header>Requirement</header><text>A lease issued under paragraph (1) shall be consistent with the applicable land use plan and all other applicable law.</text></paragraph></subsection></section>
<section id="HFAF41EB6376841CAB2DB323303003696"><enum>6.</enum><header>Federal land not covered by current reasonably foreseeable development scenario</header>
<subsection id="H3C88F9A92A1649188FB1108C7D402D85"><enum>(a)</enum><header>In general</header>
<paragraph id="H3DF3EC51A9E8442CB178746E30EF09CE"><enum>(1)</enum><header>In general</header><text>Except as provided in subsection (c), if the Secretary determines that Federal land otherwise available for leasing of oil and gas resources pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.) is not covered by a reasonably foreseeable development scenario issued in accordance with this subsection or section 5(a), the Secretary, in cooperation with the Secretary of Agriculture with respect to National Forest System land, shall complete such a reasonably foreseeable development scenario.</text></paragraph> <paragraph id="H8F876C93130649E9B4C7FB7D63F8F579"><enum>(2)</enum><header>Requirements</header><text>Any reasonably foreseeable development scenario issued on or after the date of enactment of this Act shall, at a minimum—</text>
<subparagraph id="H215D5468B2AC46FB8AC58439E4B030CE"><enum>(A)</enum><text>assess and designate all Federal land covered by the reasonably foreseeable development scenario as having high, moderate, low, or no potential for development of oil and gas resources; and</text></subparagraph> <subparagraph id="H3D62DA6231A740318F4CAE7A826A0E55"><enum>(B)</enum><text>publish a map depicting the covered Federal land and the development potential for that Federal land designated under subparagraph (A).</text></subparagraph></paragraph>
<paragraph id="H9D5E4CBC2B2F4E958CD2A8FA286BBC9F"><enum>(3)</enum><header>Factors</header>
<subparagraph id="H34A96EC82B4B47E581A087E705A11ECF"><enum>(A)</enum><header>In general</header><text>In completing a reasonably foreseeable development scenario for Federal land, the Secretary shall take into consideration—</text> <clause id="HD7175D02CAE64F858B099F831948551C"><enum>(i)</enum><text>past and present exploration and development activity in the vicinity, including historic trends;</text></clause>
<clause id="H0C17082ADFF24CD6B756BA4E91019B3C"><enum>(ii)</enum><text>for each lease in the vicinity, the number, location, and types of wells drilled, the representative depth of wells drilled, the number and location of dry holes, the success ratio for wells drilled, and the location, production history, and life expectancy of producing fields;</text></clause> <clause id="H28FE2A0882374D94A53C1F482F572317"><enum>(iii)</enum><text>geological, geophysical, and geochemical information for the Federal land, including data and information from the United States Geological Survey, the Department of Energy, State agencies, industry, professional societies, academic sources, and the public;</text></clause>
<clause id="H1B6E7D88DDB041FEABE61C87C9A20ABC"><enum>(iv)</enum><text>structural and stratigraphic data and information relating to basins, fields, and plays on the Federal land; and</text></clause> <clause id="H531D08C639F94D8FB84BA4D3C004A976"><enum>(v)</enum><text>data and information on the likelihood that economically recoverable oil and gas resources are present in a given area, including information submitted by experts and the public.</text></clause></subparagraph>
<subparagraph id="H5CCACCB5D64C428F8629495401E21385"><enum>(B)</enum><header>Explanation of factors</header><text>The Secretary shall document how each factor described in subparagraph (A) and any other factors considered by the Secretary support the designation of the potential for development of oil and gas resources on the Federal land.</text></subparagraph></paragraph> <paragraph id="HC17F54D199C54C5E87A028EC6F3026F0"><enum>(4)</enum><header>Opportunity for public participation</header><text>In carrying out a reasonably foreseeable development scenario under this subsection, the Secretary shall—</text>
<subparagraph id="H7E58B3ED4EFA4E36981B60CCE6FCFD3A"><enum>(A)</enum><text>notify the public that the reasonably foreseeable development scenario is being initiated;</text></subparagraph> <subparagraph id="H5A38E71B1B8546A2AFEDAF5298D64CA0"><enum>(B)</enum><text>publish a request for information for the reasonably foreseeable development scenario;</text></subparagraph>
<subparagraph id="H2DD9E68BA26D4804998FC17F8E0A7BD3"><enum>(C)</enum><text>release a draft version of the reasonably foreseeable development scenario for a public review and comment for a period of not less than 60 days; and</text></subparagraph> <subparagraph id="HA520AAD3E15447658F90B4234C2A61CD"><enum>(D)</enum><text>consider and respond to public comments in the final version of the reasonably foreseeable development scenario.</text></subparagraph></paragraph></subsection>
<subsection id="H82B045357C1C48DDBA6EDB1FDF90E190"><enum>(b)</enum><header>Regular update</header>
<paragraph id="H27DCA7CAC7C74B2DB15BE1AF93E69B07"><enum>(1)</enum><header>In general</header><text>Not later than 15 years after the date of enactment of this Act, and not less frequently than every 15 years thereafter, the Secretary, consistent with subsection (a) and in cooperation with the Secretary of Agriculture with respect to National Forest System land, shall review and update all reasonably foreseeable development scenarios covering Federal land.</text></paragraph> <paragraph id="H5C17B94B96CE40EF98480713D407D570"><enum>(2)</enum><header>Prohibition</header><text>Except as provided in subsection (c), the Secretary shall not offer for lease any Federal land otherwise available for leasing of oil and gas resources pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.) unless the Secretary has updated the reasonably foreseeable development scenario covering that Federal land in accordance with paragraph (1).</text></paragraph></subsection>
<subsection id="H33B5AD051E8C44DA851F515C6A2044F0"><enum>(c)</enum><header>Exception for drainage</header>
<paragraph id="HFD6552C63EB24EB091C3A78E9086F7BB"><enum>(1)</enum><header>In general</header><text>The Secretary may offer for lease any Federal land otherwise available for leasing of oil and gas resources pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.) without completing or updating a reasonably foreseeable development scenario for that land under subsection (a) or (b), as applicable, if—</text> <subparagraph commented="no" id="H097B0EACBAB249D8A1E7E0E98F88CB5C"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="H5C2BF149ABD34720AEA0C9B369785DC2"><enum>(i)</enum><text>the Federal land is adjacent to land currently producing oil or gas; and</text></clause>
<clause commented="no" id="H63B073D387EE409B8DBE0584FB29A5C0" indent="up1"><enum>(ii)</enum><text>the lease is issued for the purpose of preventing drainage from the adjacent land; or</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H90F08665B40D4C5F8A67728E462D6C63"><enum>(B)</enum><text>the Federal land—</text>
<clause commented="no" display-inline="no-display-inline" id="H43F1CA666D4A44AE8AB45A42C5B1079D"><enum>(i)</enum><text>does not exceed 640 acres; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="HAD3BDF7DF06A45C0A4D480D0780132DC"><enum>(ii)</enum><text>is located within 1 mile of a well producing oil or gas in paying quantities on the date on which the Federal land is offered for leasing.</text></clause></subparagraph></paragraph>
<paragraph id="H8446E18EDC0949CDB81B1700EF5CB238"><enum>(2)</enum><header>Requirement</header><text>A lease issued under paragraph (1) shall be consistent with the applicable land use plan and all other applicable law.</text></paragraph></subsection></section> <section id="HD871A79779F945E4AA7E248FB055AC2C"><enum>7.</enum><header>Land having no or low development potential under a reasonably foreseeable development scenario</header> <subsection id="HEB645581757040DCB2FF539C315E9884"><enum>(a)</enum><header>In general</header><text>Except as provided in subsections (b) and (c), the Secretary shall not offer for lease any Federal land otherwise available for leasing of oil and gas resources pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.) if the Federal land is designated in the applicable reasonably foreseeable development scenario as having low or no potential for development of oil or gas resources.</text></subsection>
<subsection id="HA7185C561AAE407A890607166ABEE98F"><enum>(b)</enum><header>Exception for drainage</header>
<paragraph id="H02B20BF6BDB042F1887EE57B29C02D5B"><enum>(1)</enum><header>In general</header><text>The Secretary may offer for lease any Federal land described in subsection (a) if—</text> <subparagraph commented="no" id="H1C604017296A4104B28226BD287E23C9"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="HB5C8041A51674373B20B209892E4AED7"><enum>(i)</enum><text>the Federal land is adjacent to land currently producing oil or gas; and</text></clause>
<clause commented="no" id="H4DB2C35076A3457390B586BE64AA5FB0" indent="up1"><enum>(ii)</enum><text>the lease is issued for the purpose of preventing drainage from the adjacent land; or</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H9F56E22C9A784CC482414EF72B253E1A"><enum>(B)</enum><text>the Federal land—</text>
<clause commented="no" display-inline="no-display-inline" id="HBAA37A2DD33542088C64EAE99527F62C"><enum>(i)</enum><text>does not exceed 640 acres; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H139E19798253446F92AF5D3C634081E9"><enum>(ii)</enum><text>is located within 1 mile of a well producing oil or gas in paying quantities on the date on which the Federal land is offered for leasing.</text></clause></subparagraph></paragraph>
<paragraph id="HAD9E29D7B03344CB9FC2F8A4C99C3169"><enum>(2)</enum><header>Requirement</header><text>A lease issued under paragraph (1) shall be consistent with the applicable land use plan and all other applicable law.</text></paragraph></subsection> <subsection id="HB7B9B3ADD8924FA29EB26DED76850C39"><enum>(c)</enum><header>Variance process</header> <paragraph id="H1BD752DB4155403689BF0534FE6DEBED"><enum>(1)</enum><header>In general</header><text>An entity seeking to lease Federal land described in subsection (a) for purposes other than the purpose described in subsection (b)(1)(A)(ii) may submit to the Secretary an application for a variance under which the applicant shall bear the full burden of establishing and documenting that providing a variance for the Federal land would—</text>
<subparagraph id="H470D4AC54BDC4F329238136D70E0BD9A"><enum>(A)</enum><text>be consistent with decisions contained in the land use plan in effect for the Federal land;</text></subparagraph> <subparagraph id="H134A1A746A50461C94CCA22BA5A19A4C"><enum>(B)</enum><text>affect only areas—</text>
<clause id="HF0DCD85B4C68474DBA8F671CFDC236E8"><enum>(i)</enum><text>with low wildlife, recreation, livestock, and other multiple-use resource values; and</text></clause> <clause id="H410787CA86A7465E97BEE629FF045E45"><enum>(ii)</enum><text>where impacts to those values arising from the variance can be resolved;</text></clause></subparagraph>
<subparagraph id="HFF534CD84973433C9F11FB860A494F1B"><enum>(C)</enum><text>optimize the use of existing infrastructure and avoid duplication of infrastructure and disruption of public land;</text></subparagraph> <subparagraph id="H914DFD6D895347C0B416B1418F40884C"><enum>(D)</enum><text>minimize adverse impacts on fish and wildlife habitats and migration and movement corridors in nearby areas;</text></subparagraph>
<subparagraph id="H59710D7EAC684C869C8BA7AEC608A057"><enum>(E)</enum><text>cause no significant effects on species listed as endangered species or threatened species under the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531</external-xref> et seq.) or the habitats of those species;</text></subparagraph> <subparagraph id="H872F001B072441E59F9EE757E1CE972D"><enum>(F)</enum><text>cause no cumulative impacts on air or water resources of concern that cannot be avoided or minimized;</text></subparagraph>
<subparagraph id="HB7922E2F45AC40BBB6056990D9F5DAFA"><enum>(G)</enum><text>cause no adverse impacts on—</text> <clause id="H1B65014ED8324E0B9AA146D69F7DBD35"><enum>(i)</enum><text>units of the National Park System;</text></clause>
<clause id="H7DCBB3092E73441BB099C51A5B59BC7F"><enum>(ii)</enum><text>units of the National Wildlife Refuge System;</text></clause> <clause id="H7B150F9EFCEB45E090D74F21082C2435"><enum>(iii)</enum><text>areas of critical environmental concern;</text></clause>
<clause id="HD0FF197C64DD40DEA4B18830E33B8866"><enum>(iv)</enum><text>components of the National Wilderness Preservation System; or</text></clause> <clause id="H5DFE1E842F184DB19F76648CFB825351"><enum>(v)</enum><text>other special status areas, including State and local parks and wildlife and recreation areas; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H577D2E2F45E04E59B34CCF07ADF815D1"><enum>(H)</enum><text>allow the Federal land to be developed in the public interest.</text></subparagraph></paragraph> <paragraph id="H0CE15778BDB94185A8771C87C705CF5C"><enum>(2)</enum><header>Opportunity for public participation</header> <subparagraph id="H7A1D5CFC4EA24F32B2691727A2D7A089"><enum>(A)</enum><header>In general</header><text>On receipt of an application for a variance under paragraph (1), the Secretary shall—</text>
<clause id="HB63BD0F6686C45D49B96540FD81EF89F"><enum>(i)</enum><text>promptly notify the public that the application has been received; and</text></clause> <clause id="H54FBAC1299DD4AC8A66E45AF91CD0738"><enum>(ii)</enum><text>provide the public with an opportunity to review and comment on the application, including any supporting documents, for a period of not less than 60 days.</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H90B6B214351E403FB571E63AEF60D890"><enum>(B)</enum><header>Response</header><text>The Secretary shall consider and respond in writing to any public comments received under subparagraph (A)(ii) before making a determination under paragraph (3)(A).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE9925710F4394AF7ABCD860D8D7F6BB4"><enum>(3)</enum><header>Granting of variance</header><text>The Secretary may grant a variance for Federal land described in subsection (a) pursuant to an application submitted under paragraph (1), and offer that Federal land for lease, if—</text>
<subparagraph id="HD08C0E2C391549A493F7348589198D9B"><enum>(A)</enum><text>the Secretary publishes in the Federal Register a determination that—</text> <clause id="H21D21818B4B043DFAD0BF311A925D94D"><enum>(i)</enum><text>the applicant met the burden of establishing and documenting that the variance would meet the requirements described in paragraph (1);</text></clause>
<clause id="H62491847C15E48229DF26E36D09347A6"><enum>(ii)</enum><text>offering the Federal land for lease—</text> <subclause id="HA9C1AF4C338D4BB090579306F157DB5F"><enum>(I)</enum><text>would not preclude the use of the Federal land for other uses, including grazing, fish and wildlife, and recreation uses; and</text></subclause>
<subclause commented="no" id="H66CF5C426A414898BBD600FA7E11F32E"><enum>(II)</enum><text>would be managed in accordance with the principles of multiple use (as defined in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>)); and</text></subclause></clause> <clause id="H8691958F8607459598C6C77E136F4AF8"><enum>(iii)</enum><text>the variance is in the public interest; and</text></clause></subparagraph>
<subparagraph id="H5F7161FAA3854B289F7EE0F6BAA1BE07"><enum>(B)</enum><text>the Federal land—</text> <clause commented="no" id="HAAF854BFFD5146798F23537798980278"><enum>(i)</enum><text>is adjacent to land currently producing oil or gas in commercial quantities on the date on which the variance is granted; and</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H03A05FA8446C4DA6BD803ED3F85814A9"><enum>(ii)</enum><text>does not exceed 640 acres.</text></clause></subparagraph></paragraph> <paragraph id="H149CAB04DB9A42C0985D7B592C252D25"><enum>(4)</enum><header>Requirement</header><text>A lease issued under paragraph (3) shall be consistent with the applicable land use plan and all other applicable law.</text></paragraph>
<paragraph id="H838566C3B2A0411CBCF4294751088BEF"><enum>(5)</enum><header>Limitation</header><text>The Secretary shall not grant more than 1 variance under this subsection per 5-year period to an applicant or to an entity under common ownership or control with the applicant.</text></paragraph></subsection></section> <section id="HDFCF9318963347B2B92719DF711A3513"><enum>8.</enum><header>Effect</header> <subsection id="H7F774100423A48FFB50EABA09D1B6276"><enum>(a)</enum><header>Multiple use considerations</header><text>Nothing in this Act, including a determination under a reasonably foreseeable development scenario issued pursuant to this Act that Federal land has high or moderate potential for development of oil and gas resources, alters—</text>
<paragraph id="H22ADDFE590F04670B2B9D467303FAF44"><enum>(1)</enum><text>the requirements under section 202(c) of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712(c)</external-xref>) that prior to offering for lease any public land otherwise available for leasing of oil and gas resources pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.), the Secretary shall consider and weigh the multiple use and sustained yield values of the public land;</text></paragraph> <paragraph id="HD8731F4AFCDF45C78E1DD7E4E512CD79"><enum>(2)</enum><text>the requirements of subsections (b) and (e) of section 6 of the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>) that prior to offering for lease any National Forest System land otherwise available for leasing of oil and gas resources pursuant to the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181</external-xref> et seq.) or the Mineral Leasing Act for Acquired Lands (<external-xref legal-doc="usc" parsable-cite="usc/30/351">30 U.S.C. 351</external-xref> et seq.), the Secretary of Agriculture shall consider and weigh the multiple use and sustained yield values of the National Forest System land; or</text></paragraph>
<paragraph id="H12477D68AF094C108882193857CA0BCF"><enum>(3)</enum><text>any other applicable requirements of law.</text></paragraph></subsection> <subsection id="H77D7F4CB745C48E487C2093DDD3E0A6B"><enum>(b)</enum><header>NEPA</header><text>Nothing in this Act modifies, alters, or impacts the applicability of the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.) to the leasing of Federal land by the Secretary.</text></subsection></section>
