<official-title display="yes">To amend title 18, United States Code, to require an alien lawfully admitted to the United States under a nonimmigrant visa to obtain the approval of the Attorney General before receiving a firearm, and for other purposes.</official-title>

<section id="H46C8F507BF2E48D1A57BECE913642E26" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign National Firearms Background Check Enhancement Act</short-title></quote>.</text></section> <section id="HF1D6682365A742E081EE9564DDDDD5FA"><enum>2.</enum><header>Requirement that alien lawfully admitted to the United States under a nonimmigrant visa obtain the approval of the Attorney General before receiving a firearm</header> <subsection id="H13FB9BFCDE6049128DF03A0059214389"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922(y) of title 18, United States Code, is amended—</text>
<paragraph id="HE510236AC0834043A996BDA61C13897A"><enum>(1)</enum><text>in paragraph (2)—</text> <subparagraph id="HC26C54A7EB044DBFAA73048ACB6BA99C"><enum>(A)</enum><text>by striking all that precedes subparagraph (B) and inserting the following:</text>
<quoted-block style="OLC" id="HBD177F65750B45C1B573D0EBCD46A655" display-inline="no-display-inline">
<paragraph id="HC86365A90D63452984F63D314D9F7342"><enum>(2)</enum><header>Exceptions</header><text display-inline="yes-display-inline">Subsections (d)(5)(B) and (g)(5)(B) do not apply to the transfer or other disposition of a firearm to, or the possession or receipt of a firearm by, an alien who has been lawfully admitted to the United States under a nonimmigrant visa, if—</text> <subparagraph id="H020EC0E4246B407AA4F4C83569F00145"><enum>(A)</enum> <clause commented="no" display-inline="yes-display-inline" id="HD350D421EC6D43A49C5C3D84D7BB19DC"><enum>(i)</enum><text>the alien has obtained a valid waiver issued by the Attorney General under paragraph (3), and, in the case of a transfer or other disposition, the transferor has received a copy of the waiver and verified the validity of the waiver with the Attorney General; and</text></clause>
<clause id="H065615C0BCD742C8A774100C5A47C6ED" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the alien—</text> <subclause id="H9B277AFD23C34F90B54ABB1D3864A00A" display-inline="no-display-inline"><enum>(I)</enum><text>is admitted to the United States for lawful hunting or sporting purposes or is in possession of a hunting license or permit lawfully issued in the United States; or</text></subclause>
<subclause id="H09DCC06CBD6042759B0D07B94D463CD2"><enum>(II)</enum><text>has resided in the United States for a continuous period of not less than 180 days before the date on which the petition is submitted under this paragraph;</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph> <subparagraph id="HE4636535E59E4CE1B190E06EF8B87ADC"><enum>(B)</enum><text>in each of subparagraphs (B) and (C), by inserting <quote>the alien is</quote> before <quote>an official</quote>; and</text></subparagraph>
<subparagraph id="HB02F06375AB847BAAAAF3A2E0E311AD3"><enum>(C)</enum><text>in subparagraph (D), by inserting <quote>the alien is</quote> before <quote>a foreign</quote>; and</text></subparagraph></paragraph> <paragraph id="HDC1D310FB595474CB3E442644960C87B"><enum>(2)</enum><text>in paragraph (3)—</text>
<subparagraph id="H95DBBD0239974816883A10DC22103DEB"><enum>(A)</enum><text>in subparagraph (A)—</text> <clause id="H381F1014C28A4B4994CD2F958B089702"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>subsection</quote> and inserting <quote>subsections (d)(5) and</quote>; and</text></clause>
<clause id="H7C834386F70E47FE927A6AABCD18ADB7"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>(C)</quote> and inserting <quote>(B)</quote>;</text></clause></subparagraph> <subparagraph id="H78E052C1D20A4EBDBE98C91054051F68"><enum>(B)</enum><text>in subparagraph (B)—</text>
<clause id="HA220631EF85D4AB9BED7B72CB25B773B"><enum>(i)</enum><text>by striking <quote>under subparagraph (B) shall—</quote> and all that follows through <quote>(ii)</quote> and inserting <quote>shall</quote>;</text></clause> <clause id="H3471EA30C5724B968754402F01BC4923"><enum>(ii)</enum><text>by striking <quote>, absent the application of subsection (g)(5)(B),</quote>; and</text></clause>
<clause id="H25686E2CD7FB4607BD5C835F9D2C4CC7"><enum>(iii)</enum><text>by inserting <quote>(d) or</quote> before <quote>(g)</quote>;</text></clause></subparagraph> <subparagraph id="H55790DF0E6E94052803028BE33E0DCEF"><enum>(C)</enum><text>in subparagraph (C), by striking <quote>subsection</quote> and inserting <quote>subsections (d)(5)(B) and</quote>; and</text></subparagraph>
<subparagraph id="H2B0437B4AD354282836AA783A105942E"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HE4C4611C160143A4BD7148A135912C2E" display-inline="no-display-inline"> <subparagraph id="HC096C36EB5FB476890A3BB185F6B8D46"><enum>(D)</enum><header>Validity of waiver</header><text display-inline="yes-display-inline">A waiver issued under this paragraph shall be valid for a term set by the Attorney General, which shall be not longer than 1 year from the date the petition for the waiver is approved.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="H8758030CE26E40D1AB8A268C8426C569"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect 180 days after the date of the enactment of this Act.</text></subsection></section> </legis-body> </bill>
