R. 295</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210113">January 13, 2021</action-date><action-desc><sponsor name-id="B001305">Mr. Budd</sponsor> (for himself, <cosponsor name-id="R000614">Mr. Roy</cosponsor>, <cosponsor name-id="T000479">Mr. Taylor</cosponsor>, <cosponsor name-id="P000599">Mr. Posey</cosponsor>, <cosponsor name-id="V000133">Mr. Van Drew</cosponsor>, <cosponsor name-id="G000578">Mr. Gaetz</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="C001118">Mr. Cline</cosponsor>, <cosponsor name-id="B001311">Mr. Bishop of North Carolina</cosponsor>, <cosponsor name-id="K000395">Mr. Keller</cosponsor>, <cosponsor name-id="C001114">Mr. Curtis</cosponsor>, <cosponsor name-id="S001192">Mr. Stewart</cosponsor>, <cosponsor name-id="W000816">Mr. Williams of Texas</cosponsor>, <cosponsor name-id="M001195">Mr. Mooney</cosponsor>, <cosponsor name-id="H001052">Mr. Harris</cosponsor>, <cosponsor name-id="C001053">Mr. Cole</cosponsor>, <cosponsor name-id="G000589">Mr. Gooden of Texas</cosponsor>, <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>, and <cosponsor name-id="B001291">Mr. Babin</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To waive high deductible health plan requirements for health savings accounts.</official-title></form><legis-body id="HE547E0D3CB944E048A1383E49AB7A6FE" style="OLC"><section id="H1CBCB7FDCCEC43C78C567C871199ED49" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pandemic Healthcare Access Act</short-title></quote>.</text></section><section id="H99FF873E67094F6481A6C12F2AE4E706"><enum>2.</enum><header>Access to health savings accounts</header><subsection id="H101C333151364207958E1CDDF31FC9B5"><enum>(a)</enum><header>In general</header><text>For purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/223">section 223</external-xref> of the Internal Revenue Code of 1986, notwithstanding subsection (c)(1) thereof, during the coronavirus emergency period, any individual who is covered by any health plan, including a health plan which is not a high deductible health plan, shall be treated as an eligible individual. </text></subsection><subsection id="HF1C25A404BFB4B78AD2FD3EF981A35D0"><enum>(b)</enum><header>Contribution deadline</header><text>An individual who is treated as an eligible individual for purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/223">section 223</external-xref> of the Internal Revenue Code of 1986 solely by reason of subsection (a) may make contributions to the health savings account (as defined in section 223(d) of such Code) of such individual up to the due date for the return of Federal income tax for the taxable year which includes the last day of the coronavirus emergency period.</text></subsection><subsection id="HBAD983B8D2AD4E79842E6B24B253F32B"><enum>(c)</enum><header>Coronavirus emergency period</header><text>For purposes of this section, the coronavirus emergency period is the period beginning on March 13, 2020, and ending on the later of—</text><paragraph id="H8878B0975A2C4C879BAA9F4B1E9953C3"><enum>(1)</enum><text>the last day on which the declaration of emergency involving Federal primary responsibility determined to exist by the President under section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191(b)</external-xref>) with respect to the Coronavirus Disease 2019 (COVID–19) is in effect; or</text></paragraph><paragraph id="H92D924742486407C8A1640EB9AA73F71"><enum>(2)</enum><text>the last day on which the declaration of national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.) with respect to the Coronavirus Disease 2019 (COVID–19) is in effect.</text></paragraph></subsection></section></legis-body></bill>
