which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to award grants to States that have enacted and are enforcing certain laws with respect to stretch limousines, and for other purposes.</official-title></form><legis-body id="H6B33BA4EAE7E4AE991675BAD2321CD16" style="OLC"><section id="H0C96EE3CE8A3472786B3115FB69AB1C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Take Unsafe Limos Off the Road Act</short-title></quote>.</text></section><section id="HBCB8E105CF4B4916AEF750F91A411436" section-type="subsequent-section"><enum>2.</enum><header>Grant program for safety of stretch limousines</header><subsection id="H2EF3859AE7B94B088157214C0583C483"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/311">Chapter 311</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H2EDE1E9729724E4CB88761FD4EFCFDA7" display-inline="no-display-inline"><section id="H1DA301EB5F3F419F969E2BAE3B382953"><enum>31162.</enum><header>Grant program for safety of stretch limousines</header><subsection id="H47135072044B40A3B19E8702F59AA790"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Transportation shall make a grant, in accordance with this section, to any State that has enacted and is enforcing a law that requires the impoundment or immobilization of a stretch limousine if such limousine is found to have an eligible defect upon inspection.</text></subsection><subsection id="H002F1A8892FD466185AC69C48FBA8D5F"><enum>(b)</enum><header>Eligibility</header><text>A State is eligible for a grant under this section for a fiscal year if such State has enacted and is enforcing a law described in subsection (a) on October 1 of such fiscal year.</text></subsection><subsection id="HAB9A475D7E8246C69CE334931DBB1E27"><enum>(c)</enum><header>Grants</header><paragraph id="H47CD49BA1AC744C3A5B460DFC07178CE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on October 1 of the first fiscal year beginning after the date of enactment of this section, the Secretary shall apportion funds appropriated to carry out this section to each State that has enacted and is enforcing a law described in subsection (a) in an amount determined by—</text><subparagraph id="HCC38F76EA4644979B2989B7A06E67BCA"><enum>(A)</enum><text>subtracting all amounts provided to States pursuant to paragraph (2) from $5,000,000; and</text></subparagraph><subparagraph id="H93F50D74D3BC4E73903DFD29C669FB0D"><enum>(B)</enum><text>dividing the amount described in subparagraph (A) by the number of States eligible for a grant for such fiscal year.</text></subparagraph></paragraph><paragraph id="H139053CAA0E5408D95265FA3FBC65BC0"><enum>(2)</enum><header>Increase of amounts</header><text display-inline="yes-display-inline">Beginning on October 1 of the first fiscal year beginning after the date of enactment of this section, a State is eligible for an additional $50,000 if the State has enacted and is enforcing a law or regulation that requires—</text><subparagraph id="HBB5F9D1B706B48FC85D820D846357A71"><enum>(A)</enum><text>any safety inspection of a stretch limousine to be conducted at a designated site controlled by the State; and</text></subparagraph><subparagraph id="H985C9861209448B4833FA6D3EF048E04"><enum>(B)</enum><text display-inline="yes-display-inline">the inspection described in subparagraph (A) to be conducted by employees trained in the inspection of stretch limousines. </text></subparagraph></paragraph></subsection><subsection id="HB340AED0BC7246908717674D6F8BF8CD"><enum>(d)</enum><header>Uses of funds</header><text>A State receiving a grant under this section may use such funds—</text><paragraph id="HC285DC0561E54C1092850B46AA1C40FB"><enum>(1)</enum><text display-inline="yes-display-inline">for the impoundment or immobilization of a stretch limousine;</text></paragraph><paragraph id="H2F0D9C06F7F64343B1EFBCA5998C0D84"><enum>(2)</enum><text display-inline="yes-display-inline">for the establishment and operating expenses of designated stretch limousine safety inspection sites; or</text></paragraph><paragraph id="H278BE433ED544117B2C9650D9CE7BC94"><enum>(3)</enum><text>to train employees in the inspection of stretch limousines. </text></paragraph></subsection><subsection id="H0A8EE95B0FCB464F8CADB2FE29851703"><enum>(e)</enum><header>Definitions</header><text>As used in this section:</text><paragraph id="HE1E1FD5493924FFB9EEA2F24ADD049A7"><enum>(1)</enum><header>Eligible defect</header><text>The term <quote>eligible defect</quote> means any defect that would cause a motor vehicle to fail a commercial motor vehicle safety inspection.</text></paragraph><paragraph id="H14F6BF4AED9C4505BEC48FB944B51FB3"><enum>(2)</enum><header>Passenger motor vehicle</header><text>The term <quote>passenger motor vehicle</quote> has the meaning given the term in section 32101 of title 49, United States Code. </text></paragraph><paragraph id="HF3F210C630A84C27AEFCD895B5B277F7"><enum>(3)</enum><header>Stretch limousine</header><text>The term <quote>stretch limousine</quote> means a new or used passenger motor vehicle that has been modified, altered, or extended in a manner that increases the overall wheelbase of the vehicle, exceeding the original equipment manufacturer’s wheelbase dimension for the base model and year of the vehicle, in any amount sufficient to accommodate additional passengers with a seating capacity of not fewer than 9 passengers including the driver.</text></paragraph></subsection><subsection id="H2FC6C8DF22ED4831BC99874CA7A2A273"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2022 through 2025.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3074E07F47464F33AABA5A7A24BDA340"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/311">chapter 311</external-xref> of title 49 is amended by adding at the end the following:</text><quoted-block style="USC" id="H13BD224853094FE7AA853EF34464F571" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">31162.
