which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Omnibus Crime Control and Safe Streets Act of 1968 with respect to payments to certain public safety officers who have become permanently and totally disabled as a result of personal injuries sustained in the line of duty, and for other purposes.</official-title></form><legis-body id="H6DCDF25CDC46433BAF611756FCACC8C2" style="OLC"><section id="H0BF1083DAF7140BA8EA74908F68CB478" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting America’s First Responders Act of 2021</short-title></quote>.</text></section><section id="HBDA4675569304041B93053AD8C3C7EB7"><enum>2.</enum><header>Payment of death and disability benefits under Public Safety Officers’ Death Benefits Program</header><text display-inline="no-display-inline">Section 1201 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281</external-xref>) is amended—</text><paragraph id="HB066F8F76051487187A664FBF3D234F5"><enum>(1)</enum><text>in subsection (a), by striking <quote>the Bureau shall pay a benefit of $250,000, adjusted in accordance with subsection (h)</quote> and inserting <quote>a benefit of $250,000, adjusted in accordance with subsection (h), and calculated in accordance with subsection (i), shall be payable by the Bureau</quote>;</text></paragraph><paragraph id="HD80F9BC1775C4C7D94A1BA488AD745D3" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="HCABE8DFD982E493186E55FB176A38240"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>the Bureau shall pay the same benefit</quote> and inserting <quote>a benefit shall be payable</quote>;</text></subparagraph><subparagraph id="HAB15AD9B0FF6447EB9B175F7C112989E"><enum>(B)</enum><text>by striking <quote>that is payable under subsection (a) with respect to the date on which the catastrophic injury occurred,</quote> and inserting <quote>in the same amount that would be payable, as of the date such injury was sustained (including</quote>; </text></subparagraph><subparagraph id="H488A7AE99E9649F2B85453FB58ABC037"><enum>(C)</enum><text>by inserting <quote>, and calculated in accordance with subsection (i)), if such determination were a determination under subsection (a)</quote> before <quote>: <italic>Provided</italic>, That</quote>; and </text></subparagraph><subparagraph id="H4954F3BE7C3445F19B3509841494B490"><enum>(D)</enum><text>by striking <quote>necessary:</quote> and all that follows and inserting <quote>necessary.</quote>;</text></subparagraph></paragraph><paragraph id="H5C85EA7E645D4645B8B5CD6D7D862812" commented="no"><enum>(3)</enum><text>in subsection (c), by striking <quote>$3,000</quote> and inserting <quote>$6,000, adjusted in accordance with subsection (h),</quote>;</text></paragraph><paragraph id="HA19F5F3B81EC4090AA23E2A244092796"><enum>(4)</enum><text>in subsection (h), by striking <quote>subsection (a)</quote> and inserting <quote>subsections (a) and (b) and the level of the interim benefit payable immediately before such October 1 under subsection (c)</quote>;</text></paragraph><paragraph id="H5801E48D4AC44C12B5E985541222AB57"><enum>(5)</enum><text display-inline="yes-display-inline">by striking subsection (i) and inserting the following:</text><quoted-block style="OLC" id="HF46E3FA430144A07BE543C419CCF4D93" display-inline="no-display-inline"><subsection id="H69FEE165FE7E453897999F57B17F4F6D"><enum>(i)</enum><text display-inline="yes-display-inline">The amount payable under subsections (a) and (b), with respect to the death or permanent and total disability of a public safety officer, shall be the greater of—</text><paragraph id="HB548EF8520164640B2CAE39210F8BCBF"><enum>(1)</enum><text display-inline="yes-display-inline">the amount payable under the relevant subsection as of the date of death or the catastrophic injury of the public safety officer; or</text></paragraph><paragraph id="H0E79A0B5D24943DF9B4DACACA63EFDA5"><enum>(2)</enum><text display-inline="yes-display-inline">in any case in which the claim filed thereunder has been pending for more than 365 days at the time of final determination by the Bureau, the amount that would be payable under the relevant subsection if the death or the catastrophic injury of the public safety officer had occurred on the date on which the Bureau makes such final determination.</text></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H7FB94EB8F05C4185B7171DCE819C8CCF"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (m), by inserting <quote>, (b),</quote> after <quote>subsection (a)</quote>.</text></paragraph></section><section id="HF71A5DBA8A994D05BC6134827DF4382C"><enum>3.</enum><header>Definitions with respect to Public Safety Officers’ Death Benefits Program</header><text display-inline="no-display-inline">Section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10284">34 U.S.C. 10284</external-xref>) is amended—</text><paragraph id="H1A2F65655DC14E899114270577C95D30"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1), (2), (3), (4), (5), (6), (7), (8), and (9) as paragraphs (4), (5), (6), (7), (8), (9), (10), (13), and (14), respectively;</text></paragraph><paragraph id="H80D252C159CB4EABB346CA238E89DE9C"><enum>(2)</enum><text>by striking paragraph (4), as so redesignated, and inserting: </text><quoted-block style="OLC" id="H0E37C79C8A76485DBA922D28F87E9FB0" display-inline="no-display-inline"><paragraph id="H8EAF58F26BE44C278B73270CA0E180F4"><enum>(4)</enum><text display-inline="yes-display-inline">‘catastrophic injury’ means an injury, the direct and proximate result of which is to permanently render an individual functionally incapable (including through a directly and proximately resulting neurocognitive disorder), based on the state of medicine on the date on which the claim is determined by the Bureau, of performing work, including sedentary work: <italic>Provided</italic>, That, if it appears that a claimant may be functionally capable of performing work—</text><subparagraph id="H9F9512C78F8D4E24A203EA316E2B153E"><enum>(A)</enum><text display-inline="yes-display-inline">the Bureau shall disregard work where any compensation provided is de-minimis, nominal, honorary, or mere reimbursement of incidental expenses, such as—</text><clause id="H6DDC8FF421534200B5D688C141916D9E"><enum>(i)</enum><text display-inline="yes-display-inline">work that involves ordinary or simple tasks, that because of the claimed disability, the claimant cannot perform without significantly more supervision, accommodation, or assistance than is typically provided to an individual without the claimed disability doing similar work;</text></clause><clause id="HC84C1482BE6F4C1DB61CE5BE8049009B"><enum>(ii)</enum><text display-inline="yes-display-inline">work that involves minimal duties that make few or no demands on the claimant and are of little or no economic value to the employer; or</text></clause><clause id="HCE16BDC31FFE49E7880AB72E10169D66"><enum>(iii)</enum><text display-inline="yes-display-inline">work that is performed primarily for therapeutic purposes and aids the claimant in the physical or mental recovery from the claimed disability; and</text></clause></subparagraph><subparagraph id="H24770A4FF62446ABAD6C18634E876D7B"><enum>(B)</enum><text display-inline="yes-display-inline">the claimant shall be presumed, absent clear and convincing medical evidence to the contrary as determined by the Bureau, to be functionally incapable of performing such work if the direct and proximate result of the injury renders the claimant—</text><clause id="H39D042D0A57A4EEBBCCDEB3B532BA2FA"><enum>(i)</enum><text>blind;</text></clause><clause id="H897E59D606274A22A02D6099292B353A"><enum>(ii)</enum><text>parapalegic; or</text></clause><clause id="H8ABE3F29BA0546E192544CC40E11C560"><enum>(iii)</enum><text>quadriplegic;</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H8C5B785EA886445FAF4769AAE6268360"><enum>(3)</enum><text>in paragraph (6), as so redesignated, by striking <quote>as of the date of the public safety officer’s fatal or catastrophic injury</quote> and inserting <quote>at the time of the public safety officer’s death or fatal injury (in connection with any claim predicated upon such death or injury) or the date of the public safety officer’s catastrophic injury or of the final determination by the Bureau of any claim predicated upon such catastrophic injury</quote>;</text></paragraph><paragraph id="H4297DBE198184A0084387074E8F10DBF"><enum>(4)</enum><text>in paragraph (7), as so redesignated, by inserting <quote>, including an individual who, as such a member, engages in scene security or traffic management as the primary or only duty of the individual during emergency response</quote> before the semicolon; and</text></paragraph><paragraph id="H4D93687EB1FE45CFB5CFC70785BE3950"><enum>(5)</enum><text>in paragraph (9), as so redesignated by striking <quote>delinquency).,</quote> and inserting <quote>delinquency),</quote>;</text></paragraph><paragraph id="H8E5E6DDD999B4EB5995EC499E45D9929"><enum>(6)</enum><text>in paragraph (13), as so redesignated, by inserting <quote>, and includes (as may be prescribed by regulation hereunder) a legally organized volunteer fire department that is a nonprofit entity and provides services without regard to any particular relationship (such as a subscription) a member of the public may have with such a department</quote> before the semicolon;</text></paragraph><paragraph id="HFE8B0A17ACE84252B3AF41DDF61E74BA"><enum>(7)</enum><text>in paragraph (14), as so redesignated,—</text><subparagraph id="H8794D3FB15564C48AF4B2C5EC48B4A65"><enum>(A)</enum><text>by striking subparagraph (A) and inserting: </text><quoted-block style="OLC" id="H8A6A818FAF1A4B139BB3C76061AE76D3" display-inline="no-display-inline"><subparagraph id="HC6A368DEFBD64D4682BBC85930FE37B6"><enum>(A)</enum><text>an individual serving a public agency in an official capacity, with or without compensation, as a law enforcement officer, as a firefighter, or as a chaplain: <italic>Provided</italic>, That (notwithstanding section 1205(b)(2) or (3)) the Bureau shall, absent clear and convincing evidence to the contrary as determined by the Bureau, deem the actions outside of jurisdiction taken by any such law enforcement officer or firefighter, to have been taken while serving such public agency in such capacity, in any case in which the principal legal officer of such public agency, and the head of such agency, together, certify that such actions—</text><clause id="H1057D47107A04F64AADB93F020F5591B"><enum>(i)</enum><text display-inline="yes-display-inline">were not unreasonable;</text></clause><clause id="H0A00E24BEA6A4240B2BFB28B9089FA7B"><enum>(ii)</enum><text display-inline="yes-display-inline">would have been within the authority and line of duty of such law enforcement officer or such firefighter to take, had they been taken in a jurisdiction where such law enforcement officer or firefighter was authorized to act, in the ordinary course, in an official capacity; and</text></clause><clause id="HC034500B9C4B46ECA6B538CECB5FEAD0"><enum>(iii)</enum><text display-inline="yes-display-inline">would have resulted in the payment of full line-of-duty death or disability benefits (as applicable), if any such benefits typically were payable by (or with respect to or on behalf of) such public agency, as of the date the actions were taken;</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="HCB1CF9205F0B41F58C9D63F6F27D282C"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (B), (C), (D), and (E) as subparagraphs (C), (D), (E), and (F), respectively;</text></subparagraph><subparagraph id="HB73561E166E341F08ED43C915BED1CB2"><enum>(C)</enum><text>by inserting after subparagraph (A), the following new subparagraph:</text><quoted-block style="OLC" id="H4C210C48BE1C45BD83A8BB74D3C88D44" display-inline="no-display-inline"><subparagraph id="HB39588ADFDDB4EC687504B7B641AB06B"><enum>(B)</enum><text display-inline="yes-display-inline">a candidate officer who is engaging in an activity or exercise that itself is a formal or required part of the program in which the candidate officer is enrolled or admitted, as provided in this section;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H34485BDFC7884C3EB58ED8111A22C931"><enum>(D)</enum><text>by striking subparagraph (E), as so redesignated, and inserting the following:</text><quoted-block style="OLC" id="H41B68EA67E0A40F6970414F3EFC98083" display-inline="no-display-inline"><subparagraph id="H27DE2E0B0C0A4A4D9AA794BD1657EC79"><enum>(E)</enum><text>a member of a rescue squad or ambulance crew who, as authorized or licensed by law and by the applicable agency or entity, is engaging in rescue activity or in the provision of emergency medical services: <italic>Provided</italic>, That (notwithstanding section 1205(b)(2) or (3)) the Bureau shall, absent clear and convincing evidence to the contrary as determined by the Bureau, deem the actions outside of jurisdiction taken by any such member to have been thus authorized or licensed, in any case in which the principal legal officer of such agency or entity, and the head of such agency or entity together, certify that such actions—</text><clause id="HC78DAAB269884E23B3D1996A4B066976"><enum>(i)</enum><text display-inline="yes-display-inline">were not unreasonable;</text></clause><clause id="HCE125F65BC7E4390A22156FDC3784F19"><enum>(ii)</enum><text display-inline="yes-display-inline">would have been within the authority and line of duty of such member to take, had they been taken in a jurisdiction where such member was authorized or licensed by law and by a pertinent agency or entity to act, in the ordinary course; and</text></clause><clause id="HCD1990E1BDFC4874936DC6B7A4FD8B10"><enum>(iii)</enum><text display-inline="yes-display-inline"> would have resulted in the payment of full line-of-duty death or disability benefits (as applicable), if any such benefits typically were payable by (or with respect to or on behalf of) such applicable agency or entity, as of the date the action was taken; </text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H68639EC150324386842257CA9C67A52B"><enum>(8)</enum><text display-inline="yes-display-inline">by inserting before paragraph (4), as so redesignated, the following new paragraphs: </text><quoted-block style="OLC" id="H5E95B99765144D7EBB97201BC4363802" display-inline="no-display-inline"><paragraph id="HC1D3149FD4614E59B7D5A0BBFABE1356"><enum>(1)</enum><text display-inline="yes-display-inline">‘action outside of jurisdiction’ means an action, not in the course of any compensated employment involving either the performance of public safety activity or the provision of security services, by a law enforcement officer, firefighter, or member of a rescue squad or ambulance crew that—</text><subparagraph id="HE0E3CF8721E14E89BFE17BCC8A78518E"><enum>(A)</enum><text>was taken in a jurisdiction where—</text><clause id="H718DB019ADFC4ECBA41A417ED524CAE3"><enum>(i)</enum><text>the law enforcement officer or firefighter then was not authorized to act, in the ordinary course, in an official capacity; or</text></clause><clause id="H0D22D574E83C4F549972351CAF3A80AB"><enum>(ii)</enum><text>the member of a rescue squad or ambulance crew then was not authorized or licensed to act, in the ordinary course, by law or by the applicable agency or entity;</text></clause></subparagraph><subparagraph id="HBA2FBF033A2E4C0DA6A8BEF7E9F91E5D"><enum>(B)</enum><text>then would have been within the authority and line of duty of—</text><clause id="H2C01B9BD45834A92BCDA41E12F43D040"><enum>(i)</enum><text>a law enforcement officer or a firefighter to take, who was authorized to act, in the ordinary course, in an official capacity, in the jurisdiction where the action was taken; or</text></clause><clause id="H521DB85E8ABC420E9A79A57ACC345182"><enum>(ii)</enum><text>a member of a rescue squad or ambulance crew to take, who was authorized or licensed by law and by a pertinent agency or entity to act, in the ordinary course, in the jurisdiction where the action was taken; and</text></clause></subparagraph><subparagraph id="HE370B05E2B8D4D8E8FFDFC55A33CDBF4"><enum>(C)</enum><text>was, in an emergency situation that presented an imminent and significant danger or threat to human life or of serious bodily harm to any individual, taken—</text><clause id="H852241B2465F47719484EDBF8DAAAA2E"><enum>(i)</enum><text>by a law enforcement officer—</text><subclause id="H707F280BB3D84C20893174292E33F012"><enum>(I)</enum><text>to prevent, halt, or respond to the immediate consequences of a crime (including an incident of juvenile delinquency); or </text></subclause><subclause id="H39DF334AF7114DBE8AE0CB3E9F1491E7"><enum>(II)</enum><text>while engaging in a rescue activity or in the provision of emergency medical services; or</text></subclause></clause><clause id="H1713362B7DCE45299619D54354AB0BAA"><enum>(ii)</enum><text>by a firefighter—</text><subclause id="H32DC896B9D254288B30B5F5E0BA7EF9C"><enum>(I)</enum><text>while engaging in fire suppression; or</text></subclause><subclause id="H041CA83C642645F9B655A143464334EB"><enum>(II)</enum><text>while engaging in a rescue activity or in the provision of emergency medical services; or</text></subclause></clause><clause id="H98FB1EFB55E544F59FFEB621E56987B8"><enum>(iii)</enum><text>by a member of a rescue squad or ambulance crew, while engaging in a rescue activity or in the provision of emergency medical services; </text></clause></subparagraph></paragraph><paragraph id="H8756B62F92E7414BB588D90C3BBABB5A"><enum>(2)</enum><text display-inline="yes-display-inline">‘candidate officer’ means an individual who is enrolled or admitted, as a cadet or trainee, in a formal and officially established program of instruction or of training (such as a police or fire academy) that is specifically intended to result upon completion, in the—</text><subparagraph id="H8F7AD1B6ED3A481599134A41ACA2D188"><enum>(A)</enum><text>commissioning of such individual as a law enforcement officer;</text></subparagraph><subparagraph id="H0C3AC32357E34A0C93547C1987956437"><enum>(B)</enum><text>conferral upon such individual of official authority to engage in fire suppression (as an officer or employee of a public fire department or as an officially recognized or designated member of a legally organized volunteer fire department); or</text></subparagraph><subparagraph id="H5C8BF634FF4E43A8AAABE62C221014FD"><enum>(C)</enum><text>granting to such individual official authorization or license to engage in a rescue activity, or in the provision of emergency medical services, as a member of a rescue squad, or as a member of an ambulance crew that is (or is a part of) the agency or entity that is sponsoring the individual’s enrollment or admission;</text></subparagraph></paragraph><paragraph id="H7B5D8B63F8AF4C87AB153AE5703A081C"><enum>(3)</enum><text>‘blind’ means an individual who has central visual acuity of 20/200 or less in the better eye with the use of a correcting lens or whose eye is accompanied by a limitation in the fields of vision such that the widest diameter of the visual field subtends an angle no greater than 20 degrees;</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H2BC86A1387F64F78AB7A3877459B7AA9"><enum>(9)</enum><text>in the matter following paragraph (10), as so redesignated, by inserting the following new paragraphs:</text><quoted-block style="OLC" id="HC326048F52A84DEFA6BC9EC31D343A20" display-inline="no-display-inline"><paragraph id="H950CD8BF0B16456387E2B7B609C11ACE"><enum>(11)</enum><text display-inline="yes-display-inline">‘neurocognitive disorder’ means a disorder that is characterized by a clinically significant decline in cognitive functioning and may include symptoms and signs such as disturbances in memory, executive functioning (that is, higher-level cognitive processes, such as, regulating attention, planning, inhibiting responses, decision-making), visual-spatial functioning, language, speech, perception, insight, judgment, or an insensitivity to social standards; and </text></paragraph><paragraph id="HA0A26B250A5C49AF83823531645A0B99"><enum>(12)</enum><text display-inline="yes-display-inline">‘sedentary work’ means work that—</text><subparagraph id="HCC9693A7A34D4B4FBFB77469DC6FC385"><enum>(A)</enum><text>involves lifting articles weighing no more than 10 pounds at a time or occasionally lifting or carrying articles such as docket files, ledgers, or small tools; and</text></subparagraph><subparagraph id="H5C42316CDF8D4FA4954E7106EB61667B"><enum>(B)</enum><text>despite involving sitting on a regular basis, may require walking or standing on an occasional basis.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HEC24B693BD9C4DB38D4C8DDC82F857D5" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header>Due diligence in paying benefit claims under Public Safety Officers’ Death Benefits Program</header><text display-inline="no-display-inline">Section 1206(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10288">34 U.S.C. 10288(b)</external-xref>) is amended by striking “the Bureau may not” and all that follows and inserting the following: “the Bureau—</text><quoted-block style="OLC" id="H4EE6934D978641A6A7EC4FFF19DD9550" display-inline="no-display-inline"><paragraph id="HA83BB3FDD5254960AFA83CF910C33B55"><enum>(1)</enum><text display-inline="yes-display-inline">may use available investigative tools, including subpoenas, to—</text><subparagraph id="HF0744D7A95DC4B2AAB5146BFF9189784"><enum>(A)</enum><text display-inline="yes-display-inline">adjudicate or to expedite the processing of the benefit claim, if the Bureau deems such use to be necessary to adjudicate or conducive to expediting the adjudication of such claim; and</text></subparagraph><subparagraph id="H061E9C7798B148BFA3305D2A59859B53"><enum>(B)</enum><text display-inline="yes-display-inline">obtain information or documentation from third parties, including public agencies, if the Bureau deems such use to be necessary to adjudicate or conducive to expediting the adjudication of a claim; and</text></subparagraph></paragraph><paragraph id="H9A35E7EFC3744338A60B3A2189A108C8"><enum>(2)</enum><text display-inline="yes-display-inline">may not abandon the benefit claim unless the Bureau has used investigative tools, including subpoenas, to obtain the information or documentation deemed necessary to adjudicate such claim by the Bureau under subparagraph (1)(B).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H54A7E7BEB519470CBE916D2B04A65855"><enum>5.</enum><header>Educational assistance to dependents of certain public safety officers</header><text display-inline="no-display-inline">Section 1216(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10306">34 U.S.C. 10306(b)</external-xref>) is amended, in the first sentence, by striking <quote>may</quote> and inserting <quote>shall (unless prospective assistance has been provided)</quote>. </text></section><section id="H83FDC8FCB55E42B5B7DDACAA9D77F781" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Technical correction</header><text display-inline="no-display-inline"> Section 1205(e)(3)(B) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10285">34 U.S.C. 10285(e)(3)(B)</external-xref>) is amended by striking <quote>subparagraph (B)(ix)</quote> and inserting <quote>subparagraph (I)</quote>. </text></section><section id="HFFCCF7AEAA944DF79CFFC236EC000BA6"><enum>7.</enum><header>Subpoena power</header><text display-inline="no-display-inline">Section 806 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10225">34 U.S.C. 10225</external-xref>) is amended—</text><paragraph id="HF001AEB2F53C4F2EB82DBEF63E580EF0"><enum>(1)</enum><text>by inserting <quote>Attorney General, the</quote> before the <quote>Bureau of Justice Assistance</quote>;</text></paragraph><paragraph id="H18C4785BEA6B4274A6C293671B5B857D"><enum>(2)</enum><text>by striking <quote>may appoint</quote> and inserting <quote>may appoint (to be assigned or employed on an interim or as-needed basis) such hearing examiners (who shall, if so designated by the Attorney General, be understood to be comprised within the meaning of “special government employee” under section 202 of title 18, United States Code)</quote>;</text></paragraph><paragraph id="H25D465246F534937B194D4A9934EB93E"><enum>(3)</enum><text>by striking <quote>under this chapter. The</quote> and inserting <quote>or other law. The Attorney General, the</quote>; and </text></paragraph><paragraph id="H49E36CD408074C1B8639A7736D96B9F7"><enum>(4)</enum><text>by inserting <quote>conduct examinations</quote> after <quote>examine witnesses,</quote>.</text></paragraph></section><section id="H3BCE866A872C4013B8C14714514D88C1" section-type="subsequent-section" display-inline="no-display-inline"><enum>8.</enum><header>Effective date; applicability</header><subsection id="H0D5B119302184B65A8AF07CEDAAEA788"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, the amendments made by this Act shall take effect on the date of enactment of this Act.</text></subsection><subsection id="H8EF7F11C61264ABA855653808103D7E1"><enum>(b)</enum><header>Applicability</header><paragraph id="HF01228C5097B461491EFB08CDFF47371"><enum>(1)</enum><header>Certain injuries</header><text display-inline="yes-display-inline">The amendments made to paragraphs (2) and (7) of section 1204 of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10284">34 U.S.C. 10284</external-xref>) shall apply with respect to injuries occurring on or after January 1, 2008.</text></paragraph><paragraph id="H06553D612CC84E7396AB2219F47FF92E" commented="no"><enum>(2)</enum><header>Matters pending</header><text>Except as provided in paragraph (1), the amendments made by this Act shall apply to any matter pending, before the Bureau or otherwise, on the date of enactment of this Act, or filed (consistent with pre-existing effective dates) or accruing after that date.</text></paragraph></subsection><subsection id="HAC8F6905123442BAA205098BF2660C0F"><enum>(c)</enum><header>Effective date for WTC responders</header><paragraph id="H81F36F0556154B5AADBE7FD908CF6E71"><enum>(1)</enum><header>Certain new claims</header><text>Not later than two years after the effective date of this Act, a WTC responder may file a claim, under section 1201(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(b)</external-xref>), that is predicated on a personal injury sustained in the line of duty by such responder as a result of the September 11, 2001, attacks, where—</text><subparagraph id="HEA7460C04D3C4D7E9DE4B8FDF6C04B31"><enum>(A)</enum><text>no claim under such section 1201(b) so predicated has previously been filed; or</text></subparagraph><subparagraph id="HD3DE8442DBA74DF891432F08C6F53705"><enum>(B)</enum><text>a claim under such section 1201(b) so predicated had previously been denied, in a final agency determination, on the basis (in whole or in part) that the claimant was not totally disabled.</text></subparagraph></paragraph><paragraph id="HE459CFD2D74F4F0ABB7F3DC64CE4E22D"><enum>(2)</enum><header>Claims for a deceased WTC responder</header><text display-inline="yes-display-inline">Not later than two years after the effective date of this Act, a claim may be filed, constructively under section 1201(a) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(a)</external-xref>), where a WTC responder who otherwise could have filed a claim pursuant to paragraph (1) has died before such effective date (or dies not later than 365 days after such effective date), or where a WTC responder has filed such a claim but dies while it is pending before the Bureau: <italic>Provided</italic>, That—</text><subparagraph id="H1DBEE35CDA654965B782269B3C212AF7"><enum>(A)</enum><text>no claim under such section 1201(a) otherwise shall have been filed, or determined, in a final agency determination; and</text></subparagraph><subparagraph id="H638D1292FEF74495A9354C82FA4C55AB"><enum>(B)</enum><text>if it is determined, in a final agency determination, that a claim under such paragraph (1) would have been payable had the WTC responder not died, then the WTC responder shall irrebutably be presumed (solely for purposes of determining to whom benefits otherwise pursuant to such paragraph (1) may be payable under the claim filed constructively under such section 1201(a)) to have died as the direct and proximate result of the injury on which the claim under such paragraph (1) would have been predicated.</text></subparagraph></paragraph><paragraph id="HBFCCDE12AD554C27B36EE64D42544693"><enum>(3)</enum><header>Difference in benefit pay</header><text display-inline="yes-display-inline">In the event that a claim under section 1201(b) of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(b)</external-xref>) and predicated on an injury sustained in the line of duty by a WTC responder as a result of the September 11, 2001, attacks was approved, in a final agency determination, before the effective date of this Act, the Bureau shall, upon application filed (not later than three years after such effective date of this Act) by the payee (or payees) indicated in subparagraphs (A) or (B), pay a bonus in the amount of the difference (if any) between the amount that was paid pursuant to such determination and the amount that would have been payable had the amendments made by this Act, other than those indicated in subsection (b)(1), been in effect on the date of such determination—</text><subparagraph id="H7182CB7B6B2441C6B00A204ABF19E1EE"><enum>(A)</enum><text>to the WTC responder, if living on the date the application is determined, in a final agency determination; or</text></subparagraph><subparagraph id="HDCE19C0E70F448E88441EEEBBA3E8522" commented="no"><enum>(B)</enum><text>if the WTC responder is not living on the date indicated in subparagraph (A), to the individual (or individuals), if living on such date, to whom benefits would have been payable on such date under section 1201(a) of such title I (<external-xref legal-doc="usc" parsable-cite="usc/34/10281">34 U.S.C. 10281(a)</external-xref>) had the application been, instead, a claim under such section 1201(a).</text></subparagraph></paragraph><paragraph id="H8C2D1BB1710844E9A7E0375C00E9813F"><enum>(4)</enum><header>Special limited rule of construction</header><text display-inline="yes-display-inline">A claim filed pursuant to paragraph (1) or (2) shall be determined as though the date of catastrophic injury of the public safety officer were the date of enactment of this Act, for purposes of determining the amount that may be payable.</text></paragraph></subsection></section></legis-body></bill>
