Reforms relating to recovery by Department of Veterans Affairs of amounts owed by individuals to the United States.</toc-entry></toc></subsection></section><section id="H2420CA4061DE4E23BB117B1F8BC7EFFC" changed="not-changed"><enum>2.</enum><header>Prohibition of debt arising from overpayment due to delay in processing by the Department of Veterans Affairs</header><subsection id="HDE357089C4684DBD8E9C122C41E7BF87" changed="not-changed"><enum>(a)</enum><header>Bar to recovery</header><paragraph id="H924BCDEC04DE42449C5DEB9CC5C9F6FF" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/53">Chapter 53</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/5302A">section 5302A</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H6A5BC9C9E286406DBA788006E18835A9" changed="not-changed"><section id="H328D8AB83CF144C6B0C6A6A8A6CF405B" changed="not-changed"><enum>5302B.</enum><header>Prohibition of debt arising from overpayment due to delay in processing</header><subsection id="H7E08FE9F94F34160A3A823C9CC566C14" changed="not-changed"><enum>(a)</enum><header>Limitation</header><paragraph commented="no" display-inline="yes-display-inline" id="H5C0FA64F37C94635AF52A58F7F8E6FE3" changed="not-changed"><enum>(1)</enum><text>Except as provided in paragraph (2), no individual may incur a debt to the United States that—</text><subparagraph id="HE06AED1797ED4F9FB3D1048C581537D4" changed="not-changed" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">arises from the participation of the individual in a program or benefit administered by the Under Secretary for Benefits; and</text></subparagraph><subparagraph id="H459DD811AB9442B888282A481CC85B42" changed="not-changed" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">is attributable to the failure of an employee or official of the Department to process information provided by or on behalf of that individual within applicable timeliness standards established by the Secretary.</text></subparagraph></paragraph><paragraph changed="not-changed" indent="up1" id="H11B7D25E737546259A1006498E6B3AE2"><enum>(2)</enum><text>Nothing in this section shall be construed to affect the penal and forfeiture provisions for fiduciaries set forth in chapter 61 of this title.</text></paragraph></subsection><subsection id="H33B174971DCB4BAAA219B15AD2843B92" changed="not-changed"><enum>(b)</enum><header>Notice</header><paragraph commented="no" display-inline="yes-display-inline" id="H7819681ECCB64B8E9041AC5AB982EF3D" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">If the Secretary determines that the Secretary has made an overpayment to an individual, the Secretary shall provide notice to the individual of the overpayment.</text></paragraph><paragraph id="H2E20CCF208BD4546A95ED0D378EE8BA6" indent="up1" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">Notice under paragraph (1) shall include a detailed explanation of the right of the individual—</text><subparagraph id="HF3D34861D8D64D9C929198B14672EE41" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">to dispute the overpayment, including a detailed explanation of the process by which to dispute the overpayment; or</text></subparagraph><subparagraph id="HD409A7E3F27E4C24ADBF62D767264DBD" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">to request a waiver of indebtedness.</text></subparagraph></paragraph></subsection><subsection id="HA26682AD5DB8496FB018BD828AA407EB"><enum>(c)</enum><header>Delay on collection</header><paragraph commented="no" display-inline="yes-display-inline" id="H1986211226DE43688A0F8BB0630CCA8C"><enum>(1)</enum><text>Subject to paragraph (2), the Secretary may not take any action under section 3711 of title 31 regarding an overpayment described in a notice under subsection (b) of this section until the date that is 90 days after the date the Secretary issues such notice.</text></paragraph><paragraph id="H7EAEA991DAD341C6A6B1A111A22D7A2E" indent="up1"><enum>(2)</enum><text>The Secretary may take action under section 3711 of title 31 regarding an overpayment described in a notice under subsection (b) of this section before the date that is 90 days after the date the Secretary issues such notice if the Secretary determines that delaying such action is—</text><subparagraph id="H1D432FAEC4F54E79ABAC922D079570AE"><enum>(A)</enum><text>likely to make repayment of such overpayment more difficult for an individual;</text></subparagraph><subparagraph id="H244A5E4459F148179D9F5EE4DA171383"><enum>(B)</enum><text>likely to cause an unpaid debt to be referred to the Treasury Offset Program; or</text></subparagraph><subparagraph id="H99EF6C25348647F0A77ACDFF7E8ABA07"><enum>(C)</enum><text>not in the best interest of the individual.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF05E5F2012404DF39364E917288881D1" changed="not-changed"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 5302A the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="H436DCFFAC6C4426D98DF1F7B9621FB33" changed="not-changed"><toc regeneration="no-regeneration" changed="not-changed"><toc-entry level="section" changed="not-changed">5302B. Prohibition of debt arising from overpayment due to delay in processing.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H057B4E2211784003A112662D69E5F32B" changed="not-changed"><enum>(3)</enum><header>Deadline</header><text>The Secretary of Veterans Affairs shall prescribe regulations to establish standards under section 5302B(a)(2) of such title, as added by subsection (a), not later than 180 days after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="HD3DD04F7B31540EF895FBF8ED2CE8799" changed="not-changed"><enum>(b)</enum><header>Plan for improved notification and communication of debts</header><paragraph id="H408D8E3FB2E147828FD68FFDC02A6005" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and one year thereafter, the Secretary of Veterans Affairs shall submit to Congress a report on the improvement of the notification of and communication with individuals who receive overpayments made by the Secretary.</text></paragraph><paragraph id="HE79F5C4F48C244DF88B5304A76F89824" changed="not-changed"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each report under paragraph (1) shall include each of the following:</text><subparagraph id="H2568E464A80648D4A62DB8A2D964E5CB" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">The plan of the Secretary to carry out each of the following:</text><clause id="H6AF99A20504B49EBA495A215B4458691" changed="not-changed"><enum>(i)</enum><text>The development and implementation of a mechanism by which individuals enrolled in the patient enrollment system under section 1705 of title 38, United States Code, may view their monthly patient medical statements electronically.</text></clause><clause id="H2C0B5433C32C468295526074909AA650" changed="not-changed"><enum>(ii)</enum><text>The development and implementation of a mechanism by which individuals eligible for benefits under the laws administered by the Secretary may receive electronic correspondence relating to debt and overpayment information.</text></clause><clause id="HCD2B33FEB7534DB8938B911241A45B45" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">The development and implementation, by not later than October 1, 2022, of a mechanism by which individuals eligible for benefits under the laws administered by the Secretary may access information related to Department of Veterans Affairs debt electronically.</text></clause><clause id="H6B4B9EE6750E48B9946EFF18D43E5A93" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">The improvement and clarification of Department communications relating to overpayments and debt collection, including letters and electronic correspondence and including information relating to the most common reasons individuals eligible for benefits under the laws administered by the Secretary incur debts to the United States and the process for requesting a waiver of such debt. The Secretary shall develop such improvements and clarifications in consultation with veterans service organizations, labor organizations that represent employees of the Department, and other relevant nongovernmental organizations.</text></clause></subparagraph><subparagraph id="HD2DAC55AEFEC411F8A5DAB3A5ECEA088" changed="not-changed"><enum>(B)</enum><text>A description of the current efforts and plans for improving the accuracy of payments to individuals entitled to benefits under the laws administered by the Secretary, including specific data matching agreements.</text></subparagraph><subparagraph id="H772A903E31824BB1B19E35598A50C275" changed="not-changed"><enum>(C)</enum><text>A description of steps to be taken to improve the identification of underpayments to such individuals and to improve Department procedures and policies to ensure that such individuals who are underpaid receive adequate compensation payments.</text></subparagraph><subparagraph id="H4D3CE7DC3CF542F5AB199BD44C1F534D" changed="not-changed"><enum>(D)</enum><text>A list of actions completed, implementation steps, and timetables for each requirement described in subparagraphs (A) through (C).</text></subparagraph><subparagraph id="H9D6AD175711648788F7445ED1F8D76FF" changed="not-changed"><enum>(E)</enum><text>A description of any new legislative authority required to complete any such requirement.</text></subparagraph></paragraph></subsection></section><section id="HEF7D8B61717C4E969A03876067323C7C" changed="not-changed"><enum>3.</enum><header>Prohibition on Department of Veterans Affairs interest and administrative cost charges for debts relating to certain benefits programs</header><subsection id="HF22D496E584B41E6A832100F13B6C045" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5315(a)(1) of title 38, United States Code, is amended—</text><paragraph id="HB643A4005021448C8E5D39C431D6B06F" changed="not-changed"><enum>(1)</enum><text>by striking <quote>other than a loan</quote> and all that follows through the semicolon and inserting <quote>other than—</quote>; and</text></paragraph><paragraph id="H5396A0425E984C42A2A8F2120614192A" changed="not-changed"><enum>(2)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="USC" display-inline="no-display-inline" id="H28A3526A66F2436A89C44F4BA4EB1AF9" changed="not-changed"><subparagraph id="HA345BE1BB9B1461B83473178D792F71F" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a loan, loan-guaranty, or loan-insurance program;</text></subparagraph><subparagraph id="H7635528E833B4E8B8C8DEBFAFB64C889" changed="not-changed"><enum>(B)</enum><text>a disability compensation program;</text></subparagraph><subparagraph id="H18BD5ED2D0AA4EE9BBD2D3709D724F47" changed="not-changed"><enum>(C)</enum><text>a pension program; or</text></subparagraph><subparagraph id="H32AAA33468424FADB654411F6C74ABAF" changed="not-changed"><enum>(D)</enum><text>an educational assistance program.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H077ED9141C8641248491E511EC70B67B" changed="not-changed"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply with respect to an indebtedness that occurs on or after the date of the enactment of this Act.</text></subsection></section><section id="H6F3B349126D34BD3BFD52E0E2A6263EC" changed="not-changed"><enum>4.</enum><header>Extension of window to request relief from recovery of debt arising under laws administered by the Secretary of Veterans Affairs</header><text display-inline="no-display-inline">Section 5302(a) of title 38, United States Code, is amended by striking <quote>180 days</quote> and inserting <quote>one year</quote>.</text></section><section id="H2EF41CF598AD4848AB6927C997644D1C" changed="not-changed"><enum>5.</enum><header>Reforms relating to recovery by Department of Veterans Affairs of amounts owed by individuals to the United States</header><subsection id="H5BD2150492F04E848DC35E06A8550E3C" changed="not-changed"><enum>(a)</enum><header>Limitation on indebtedness offsets</header><text>Subsection (a) of section 5314 of title 38, United States Code, is amended—</text><paragraph id="H917BFA5772594B78BD2F0A6D9B16CCD4" changed="not-changed"><enum>(1)</enum><text>by inserting <quote><header-in-text level="paragraph" style="USC"><enum-in-header>(1)</enum-in-header></header-in-text></quote> before <quote>Subject to</quote>; and</text></paragraph><paragraph id="H4EE15040B1D049A1B1ED48031AAA73C1" changed="not-changed"><enum>(2)</enum><text>by adding at the end the following new paragraph: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H89839BF7C92945BB9859A2F3E24DE6CB" changed="not-changed"><paragraph id="H223D3A4E3DBF45C69EA60CFAD9940379" indent="up1" changed="not-changed"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may not make a deduction under paragraph (1) while the existence or amount of such indebtedness is disputed under section 5314A of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA5D44B5822F140B58C2AA1DAFA442A36" changed="not-changed"><enum>(b)</enum><header>Administrative process for dispute of existence or amount of indebtedness</header><paragraph id="HFE084F16CDC843EEBD07D131EA47B9D0" changed="not-changed"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/53">Chapter 53</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/5314">section 5314</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="HF456717FAA414E3C8F74A4F03F88A04B" changed="not-changed"><section id="HF1C99903684146FFB84C0431EBBFA3FE" changed="not-changed"><enum>5314A.</enum><header>Dispute of indebtedness</header><subsection id="H464E04384E754C78ACFCB1B3816E0F78" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall prescribe regulations that establish an administrative process for the dispute of the existence or amount of an indebtedness described in section 5314(a)(1) of this title (without regard to whether the Secretary has made a deduction under such section regarding such indebtedness).</text></subsection><subsection id="H5EB6EE70B8C14C3C9546FA3D54F0D6AD" changed="not-changed" commented="no"><enum>(b)</enum><header>Standards</header><text>The process under subsection (a) shall be efficient, effective, and equitable.</text></subsection><subsection id="H4929A153752A4F769B3FCCCD5183791C" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Timeliness</header><text>The Secretary shall ensure that each dispute under subsection (a) proceeds in accordance with standards for timeliness prescribed by the Secretary under this section. </text></subsection><subsection id="H6DD905CC874F40E7A4A15B3440B85214"><enum>(d)</enum><header>Limitation</header><text>The Secretary may not submit to any debt collector (as defined in section 803 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a</external-xref>)) any dispute pending under this section.</text></subsection><subsection id="HD47775CBAC34403887A94AE5DDBA0926" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to modify the procedures for seeking review of a decision of the agency of original jurisdiction described in section 5104C(a)(1) of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H61B0312BD22D4B729E4AD56E67B6A8B7" changed="not-changed" commented="no"><enum>(2)</enum><header>Existing administrative process</header><text>The Secretary of Veterans Affairs shall carry out section 5314A of such title, as added by paragraph (1), by improving the administrative process of the Department of Veterans Affairs for the dispute of the existing or amount of an indebtedness that was in effect on the day before the date of the enactment of this Act.</text></paragraph><paragraph id="H98626EFA26BA4D98988DEC223056AEF5" changed="not-changed"><enum>(3)</enum><header>Improvements to Department website and notices</header><text>In carrying out paragraph (2), the Secretary shall—</text><subparagraph id="HB2153583AD71458EAB4F465D12C0EA58" changed="not-changed" commented="no"><enum>(A)</enum><text>improve the website of the Department; and</text></subparagraph><subparagraph id="H8127ACDA75F94FDD98D0CC96EF1D3BAA" changed="not-changed"><enum>(B)</enum><text>ensure that such website and written notices sent to a person about indebtedness described in section 5314(a) of title 38, United States Code, contain all information a person needs to dispute such an indebtedness, including a description of—</text><clause id="HC1933786162948959B868C41BA6755BF" changed="not-changed"><enum>(i)</enum><text>the specific actions the person will need to take in order to dispute the indebtedness;</text></clause><clause id="HB29E21FA7F724645B02FD5003A978FB3" changed="not-changed"><enum>(ii)</enum><text>the documentation that will be required for the dispute; and</text></clause><clause id="H12F5F7FCDC4B482E963DB359C5D5E7F0" changed="not-changed"><enum>(iii)</enum><text>how the documentation is to be submitted.</text></clause></subparagraph></paragraph><paragraph id="H95F06F5266284CB4A4EC78EB4CA713F9"><enum>(4)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 5314 the following new item:</text><quoted-block style="USC" id="H568C40B21A2F4781BCF953B64EE5E056" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">5314A. Dispute of indebtedness.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8B7D0B6D5DC64896883042DBEA2F093D"><enum>(c)</enum><header>Limitation on authority To recover debts</header><text>Section 5302(a) of title 38, United States Code, is amended—</text><paragraph id="HD8D75492ACA54A7AAA06A05B51E1B9E4"><enum>(1)</enum><text>by inserting <quote><header-in-text level="paragraph" style="USC"><enum-in-header>(1)</enum-in-header></header-in-text></quote> before <quote>There</quote>; and</text></paragraph><paragraph id="HA24B2A9F497F40ACB112106E1FD1A032"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HF7F96095DB5A4054B7F5AF7591331ECC" display-inline="no-display-inline"><paragraph id="HD4538644C00D4F9987E1EC8EA204B5A8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may not seek to recover an indebtedness described in paragraph (1) if the Secretary determines that the cost to the Department to recover such indebtedness, as determined when the debt is established, would exceed the amount of the indebtedness.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
