committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for certain programs and developments in the Department of Energy concerning the cybersecurity and vulnerabilities of, and physical threats to, the electric grid, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="HCDBB0FC32CE6407C9D6E0BFD0312D044" style="OLC"><section id="H2F7B62A4E32E405BA71B789A33F2E09A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing Grid Security through Public-Private Partnerships Act</short-title></quote>.</text></section><section id="H09EB3575B9294AB3B0A30840EA4A10C1" section-type="subsequent-section"><enum>2.</enum><header>Program to promote and advance physical security and cybersecurity of electric utilities</header><subsection id="HBAF8CFD11E57485DA5EFBAD3F4D59F05"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Energy, in coordination with relevant Federal agencies and in consultation with State regulatory authorities, industry stakeholders, and the Electric Reliability Organization, as the Secretary determines appropriate, shall carry out a program to—</text><paragraph id="HCFF2D103446943599D3B98F10DB0296C"><enum>(1)</enum><text display-inline="yes-display-inline">develop, and provide for voluntary implementation of, maturity models, self-assessments, and auditing methods for assessing the physical security and cybersecurity of electric utilities;</text></paragraph><paragraph id="H0B87B649D4764E04833B0BDC6B7A4420"><enum>(2)</enum><text display-inline="yes-display-inline">provide training to electric utilities to address and mitigate cybersecurity supply chain management risks;</text></paragraph><paragraph id="HF44E6DB22C2F45DFAB9CA4AC8599F3B7"><enum>(3)</enum><text>increase opportunities for sharing best practices and data collection within the electric sector;</text></paragraph><paragraph id="H10DE1C682CEF41A384C532C439ED5F80"><enum>(4)</enum><text display-inline="yes-display-inline">assist with cybersecurity training for electric utilities;</text></paragraph><paragraph id="HFBA7DA65604C4FC08A7701C3DFDC6030"><enum>(5)</enum><text>advance the cybersecurity of third-party vendors that work in partnerships with electric utilities; and</text></paragraph><paragraph id="H9216559184234408A1029245E26D205D"><enum>(6)</enum><text display-inline="yes-display-inline">provide technical assistance for electric utilities subject to the program.</text></paragraph></subsection><subsection id="H63B65F63C28D462198F6692ADF0A1FF3"><enum>(b)</enum><header>Scope</header><text>In carrying out the program under subsection (a), the Secretary of Energy shall—</text><paragraph id="H8E85E555AA144330A5E732C133277BC5"><enum>(1)</enum><text>take into consideration different sizes of electric utilities and the regions that such electric utilities serve;</text></paragraph><paragraph id="H7B691B47691A4531A231D8907BEC3607"><enum>(2)</enum><text>prioritize electric utilities with fewer available resources due to size or region; and</text></paragraph><paragraph id="H3006F5BE9D574F41801E292496A0D202"><enum>(3)</enum><text>to the extent practicable, utilize and leverage existing Department of Energy programs.</text></paragraph></subsection><subsection id="HBA5236C984BB4076ABCCD5F04D132164"><enum>(c)</enum><header>Protection of information</header><text>Information provided to, or collected by, the Federal Government pursuant to this section—</text><paragraph id="H81ECE222F7E84C42A008F2DD3D193E0B"><enum>(1)</enum><text>shall be exempt from disclosure under section 552(b)(3) of title 5, United States Code; and</text></paragraph><paragraph id="HDEACB05B7D4541ADAFDE4C5600F9B48E"><enum>(2)</enum><text>shall not be made available by any Federal, State, political subdivision or tribal authority pursuant to any Federal, State, political subdivision, or tribal law requiring public disclosure of information or records.</text></paragraph></subsection></section><section commented="no" id="HC8321D85A8CF447F9EDF17A5015340C8"><enum>3.</enum><header>Report on cybersecurity and distribution systems</header><subsection id="H330A9C3B403C4A3C9BB5825076DD2226"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Energy, in coordination with relevant Federal agencies and in consultation with State regulatory authorities, industry stakeholders, and the Electric Reliability Organization, as the Secretary determines appropriate, shall submit to Congress a report that assesses—</text><paragraph commented="no" id="H5212B2AFC0CF461180F968628B1A711A"><enum>(1)</enum><text display-inline="yes-display-inline">priorities, policies, procedures, and actions for enhancing the physical security and cybersecurity of electricity distribution systems to address threats to, and vulnerabilities of, such electricity distribution systems; and</text></paragraph><paragraph id="H416A0F61ADE44B419CB109D17000E964"><enum>(2)</enum><text display-inline="yes-display-inline">implementation of such priorities, policies, procedures, and actions, including an estimate of potential costs and benefits of such implementation, including any public-private cost-sharing opportunities.</text></paragraph></subsection><subsection display-inline="no-display-inline" id="H243B9765586D49278372E3426E30C6F9"><enum>(b)</enum><header>Protection of information</header><text>Information provided to, or collected by, the Federal Government pursuant to this section—</text><paragraph id="HDF3DB0DE7CC54431ACC93479ACF8F79F"><enum>(1)</enum><text>shall be exempt from disclosure under section 552(b)(3) of title 5, United States Code; and</text></paragraph><paragraph id="HA26560A8986645AAB7505A77312687CB"><enum>(2)</enum><text>shall not be made available by any Federal, State, political subdivision or tribal authority pursuant to any Federal, State, political subdivision, or tribal law requiring public disclosure of information or records.</text></paragraph></subsection></section><section id="HE201714B480B4C348BB0EFC81DD72C4B"><enum>4.</enum><header>Electricity interruption information</header><subsection id="H06FA16560CB84B359D46A1F3084FE93C"><enum>(a)</enum><header>Interruption cost estimate calculator</header><text display-inline="yes-display-inline">The Secretary of Energy, in coordination with relevant Federal agencies and in consultation with State regulatory authorities, industry stakeholders, and the Electric Reliability Organization, as the Secretary determines appropriate, shall update the Interruption Cost Estimate Calculator, as often as appropriate and feasible, but not less than once every 2 years.</text></subsection><subsection id="HA45DB6B4DC2A47C5A3F1682EDAEBBB27"><enum>(b)</enum><header>Indices</header><text display-inline="yes-display-inline">The Secretary of Energy, in coordination with relevant Federal agencies and in consultation with State regulatory authorities, industry stakeholders, and the Electric Reliability Organization, as the Secretary determines appropriate, shall, as often as appropriate and feasible, update the following:</text><paragraph id="HB64E4987BBBD4B9B93A5D8D1BAE12971"><enum>(1)</enum><text>The System Average Interruption Duration Index.</text></paragraph><paragraph id="H8A3DB9409AE8438E976EEA768F981BEC"><enum>(2)</enum><text>The System Average Interruption Frequency Index.</text></paragraph><paragraph id="H2D24B4EC66D74D21A6D9B90252C55677"><enum>(3)</enum><text>The Customer Average Interruption Duration Index.</text></paragraph></subsection><subsection id="H352A701CAF3B44BE98CF484CCC40B5F9"><enum>(c)</enum><header>Survey</header><text>The Administrator of the Energy Information Administration shall collect information on electricity interruption costs, if available, from a representative sample of owners of electric grid assets through a biennial survey.</text></subsection></section><section id="H30EB3C19AFB44AFD86D43764DE4C3184"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In the Act, the following definitions apply:</text><paragraph id="HFED1B8A232F34B5BBCC2F73C161277BC"><enum>(1)</enum><header>Electric reliability organization</header><text>The term <term>Electric Reliability Organization</term> has the meaning given such term in section 215(a)(2) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)(2)</external-xref>).</text></paragraph><paragraph id="H3E40A9FCDCBA41EABE8E417156E8F39F"><enum>(2)</enum><header>Electric utility</header><text>The term <term>electric utility</term> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph id="HA4A14E21ED254813B937F85A864B4A54"><enum>(3)</enum><header>State regulatory authority</header><text>The term <term>State regulatory authority</term> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph></section></legis-body><endorsement display="yes"><action-date>July 20, 2021</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
