<section section-type="section-one" id="H2E662DCF2BA742BB94E829B296192948"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeland Procurement Reform Act</short-title></quote> or the <quote><short-title>HOPR Act</short-title></quote>.</text></section> <section id="H02B35674E2AF4B3ABC33AEC6CB65F93F"><enum>2.</enum><header>Requirements to buy certain items related to national security interests according to certain criteria</header> <subsection id="H7BCFDE59CAB247E4B226E284490BE4E5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HFDFF74508D6A455BBA0DCB3ABEBF5052"><enum>836.</enum><header>Requirements to buy certain items related to national security interests</header>
<subsection id="H11CB588582084634A4D955975CF8967D"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H014E03F6EF654AA7B7811AFC4130A7CA"><enum>(1)</enum><header>Covered item</header><text>The term <term>covered item</term> means any of the following: </text>
<subparagraph id="HBD80F9C091FB4D7E8AD2FADEE2079C38"><enum>(A)</enum><text display-inline="yes-display-inline">Footwear provided as part of a uniform.</text></subparagraph> <subparagraph id="HC76AFF0CE49144F48FC66ED4EE7DBFB1"><enum>(B)</enum><text>Uniforms.</text></subparagraph>
<subparagraph id="H4FA9DD2B6AFE49BC8005041FDBD3AD8B"><enum>(C)</enum><text>Holsters and tactical pouches.</text></subparagraph> <subparagraph id="H10036A9EBBE34B6AB9904EEF12252412"><enum>(D)</enum><text>Patches, insignia, and embellishments.</text></subparagraph>
<subparagraph id="H969D1155A1A7481AAA8432350E76D809"><enum>(E)</enum><text>Chemical, biological, radiological, and nuclear protective gear.</text></subparagraph> <subparagraph id="H4751F9DD7EF9483985F283B95D5132A8"><enum>(F)</enum><text display-inline="yes-display-inline">Body armor components intended to provide ballistic protection for an individual, consisting of 1 or more of the following:</text>
<clause id="H229C2213D5F54E4DB9F5C62CA8011368"><enum>(i)</enum><text>Soft ballistic panels.</text></clause> <clause id="HD32594A8B2094FC9ACAB426C2A139938"><enum>(ii)</enum><text>Hard ballistic plates.</text></clause>
<clause id="HA19319A19B6C4874B5CA224DA37660B0"><enum>(iii)</enum><text>Concealed armor carriers worn under a uniform.</text></clause> <clause id="HF15A450083A74EA384C3966904256F08"><enum>(iv)</enum><text>External armor carriers worn over a uniform.</text></clause></subparagraph>
<subparagraph id="H5303497A75B043D3ABB158663591659A"><enum>(G)</enum><text display-inline="yes-display-inline">Any other item of clothing or protective equipment as determined appropriate by the Secretary. </text></subparagraph></paragraph> <paragraph id="H8678AC5E0A6A4758A5E006A692A5955E"><enum>(2)</enum><header>Frontline operational component</header><text> The term <term>frontline operational component</term> means any of the following organizations of the Department:</text>
<subparagraph id="H6E21145F516F4275A10493AED7831682"><enum>(A)</enum><text>U.S. Customs and Border Protection.</text></subparagraph> <subparagraph id="H561B264D4B924D018BA1A2396B5FDECC"><enum>(B)</enum><text>U.S. Immigration and Customs Enforcement.</text></subparagraph>
<subparagraph commented="no" id="H2DC4B438668D45C2996B74F4FF3BD6CD"><enum>(C)</enum><text>The United States Secret Service.</text></subparagraph> <subparagraph id="H70B125B7588644E783E6A8AD41A80510"><enum>(D)</enum><text>The Transportation Security Administration.</text></subparagraph>
<subparagraph id="H9307150A17184910A9A50C1C072C03C0"><enum>(E)</enum><text>The Coast Guard. </text></subparagraph> <subparagraph id="H3F87B7CDECB54CA2A8534F7FB4B936E2"><enum>(F)</enum><text display-inline="yes-display-inline">The Federal Protective Service.</text></subparagraph>
<subparagraph id="H6CC0FB7C97014366B3CE9EE36CE385A7"><enum>(G)</enum><text display-inline="yes-display-inline">The Federal Emergency Management Agency.</text></subparagraph> <subparagraph id="H0E6143EFEE94472095745B50BDA029EA"><enum>(H)</enum><text display-inline="yes-display-inline">The Federal Law Enforcement Training Centers.</text></subparagraph>
<subparagraph id="H309F6A4E96104AD8BB2DE5F3FCBB8F96"><enum>(I)</enum><text>The Cybersecurity and Infrastructure Security Agency. </text></subparagraph></paragraph></subsection> <subsection id="H2F85AD1B9F6948238D8B906A8CF94181"><enum>(b)</enum><header>Requirements</header> <paragraph id="HF24AAC7015794A29A7A388D4512A011E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall ensure that any procurement of a covered item for a frontline operational component meets the following criteria:</text>
<subparagraph id="H935D9F7B05C343F9BE49B9646D48310E"><enum>(A)</enum><text display-inline="yes-display-inline">To the maximum extent possible, not less than one-third of funds obligated in a specific fiscal year for the procurement of such covered items shall be covered items that are manufactured or supplied in the United States by entities that qualify as small business concerns, as such term is described under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></subparagraph> <subparagraph id="H2480AB105448431791E5A23E796BD51C"><enum>(B)</enum><text>Each contractor with respect to the procurement of such a covered item, including the end-item manufacturer of such a covered item—</text>
<clause id="H79E17C075D064B22B5B3F8F1B7E0BE65"><enum>(i)</enum><text>is an entity registered with the System for Award Management (or successor system) administered by the General Services Administration; and</text></clause> <clause id="H60E722CE887E434C86F11BDC8CE9E4D6"><enum>(ii)</enum><text>is in compliance with ISO 9001:2015 of the International Organization for Standardization (or successor standard) or a standard determined appropriate by the Secretary to ensure the quality of products and adherence to applicable statutory and regulatory requirements. </text></clause></subparagraph>
<subparagraph id="HE27A3435B5F94C569772259DBA2BA7FA"><enum>(C)</enum><text>Each supplier of such a covered item with an insignia (such as any patch, badge, or emblem) and each supplier of such an insignia, if such covered item with such insignia or such insignia, as the case may be, is not produced, applied, or assembled in the United States, shall—</text> <clause id="HCA8061D69D4F42889DB4D05B02D83DC6"><enum>(i)</enum><text>store such covered item with such insignia or such insignia in a locked area;</text></clause>
<clause id="H0516110725984AD99334A3CAA487B69B"><enum>(ii)</enum><text>report any pilferage or theft of such covered item with such insignia or such insignia occurring at any stage before delivery of such covered item with such insignia or such insignia; and</text></clause> <clause id="HEE9D9BBFF1C4482AA5BD82DCDB77CCE2"><enum>(iii)</enum><text>destroy any such defective or unusable covered item with insignia or insignia in a manner established by the Secretary, and maintain records, for three years after the creation of such records, of such destruction that include the date of such destruction, a description of the covered item with insignia or insignia destroyed, the quantity of the covered item with insignia or insignia destroyed, and the method of destruction. </text></clause></subparagraph></paragraph>
<paragraph id="HF7C62A8C1E064372B7ECC8DE4C45789D"><enum>(2)</enum><header>Waiver</header>
<subparagraph id="HCD209771076B4CDB8D26951FE29930D5"><enum>(A)</enum><header>In general</header><text>In the case of a national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>) or a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), the Secretary may waive a requirement in subparagraph (A), (B) or (C) of paragraph (1) if the Secretary determines there is an insufficient supply of a covered item that meets the requirement.</text></subparagraph> <subparagraph id="H41C8BD81402C47CB83FFAD68052094CC"><enum>(B)</enum><header>Notice</header><text>Not later than 60 days after the date on which the Secretary determines a waiver under subparagraph (A) is necessary, the Secretary shall provide to the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate and the Committee on Homeland Security, the Committee on Oversight and Reform, and the Committee on Appropriations of the House of Representatives notice of such determination, which shall include—</text>
<clause id="H2BB18ECF72D54FE08BAC6417F573E3DF"><enum>(i)</enum><text display-inline="yes-display-inline">identification of the national emergency or major disaster declared by the President;</text></clause> <clause id="HFFD15972EAEA423885B294A33D270955"><enum>(ii)</enum><text>identification of the covered item for which the Secretary intends to issue the waiver; and</text></clause>
<clause id="H8C0F50201D4D4E79881BD7B8CE5FD978"><enum>(iii)</enum><text>a description of the demand for the covered item and corresponding lack of supply from contractors able to meet the criteria described in subparagraph (B) or (C) of paragraph (1). </text></clause></subparagraph></paragraph></subsection> <subsection commented="no" id="HF32D6299AA824EB0906BE1B5366468C8"><enum>(c)</enum><header>Pricing</header><text display-inline="yes-display-inline">The Secretary shall ensure that covered items are purchased at a fair and reasonable price, consistent with the procedures and guidelines specified in the Federal Acquisition Regulation.</text></subsection>
<subsection id="H581B55B9EDB94AD5ABE6017C23B68117"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this section and annually thereafter, the Secretary shall provide to the Committee on Homeland Security, the Committee on Oversight and Reform, and the Committee on Appropriations of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate a briefing on instances in which vendors have failed to meet deadlines for delivery of covered items and corrective actions taken by the Department in response to such instances. </text></subsection> <subsection id="H441D2335465E445F9AF2AD945D758452"><enum>(e)</enum><header>Effective date</header><text>This section applies with respect to a contract entered into by the Department or any frontline operational component on or after the date that is 180 days after the date of enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HA1D1A197DB6A4553A5CD2CC8FA463093"><enum>(b)</enum><header>Study</header>
<paragraph id="HAC0B605DDBB442B2967F6724B8EB2011"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Secretary of Homeland Security shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives a study of the adequacy of uniform allowances provided to employees of frontline operational components (as defined in section 836 of the Homeland Security Act of 2002, as added by subsection (a)).</text></paragraph> <paragraph id="HBB54567F20984ABDAED694D775C57E15"><enum>(2)</enum><header>Requirements</header><text>The study conducted under paragraph (1) shall—</text>
<subparagraph id="H4EEA163B12404698BD49C996D7C7CB57"><enum>(A)</enum><text display-inline="yes-display-inline">be informed by a Department-wide survey of employees from across the Department of Homeland Security who receive uniform allowances that seeks to ascertain what, if any, improvements could be made to the current uniform allowances and what, if any, impacts current allowances have had on employee morale and retention;</text></subparagraph> <subparagraph id="H275677E166884712A7C8BA597B6D3E5A"><enum>(B)</enum><text>assess the adequacy of the most recent increase made to the uniform allowance for first year employees; and</text></subparagraph>
<subparagraph id="H9E45358B87E24F289839637F47DAA3E5"><enum>(C)</enum><text>consider increasing by 50 percent, at minimum, the annual allowance for all other employees.</text></subparagraph></paragraph></subsection> <subsection id="HF5CAA7CE890B44B28FCCC487CB529EFB"><enum>(c)</enum><header>Additional report</header> <paragraph id="H93D707D4294B456598AB2A3BAC2798A4"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary of Homeland Security shall provide a report with recommendations on how the Department of Homeland Security could procure additional items from domestic sources and bolster the domestic supply chain for items related to national security to—</text>
<subparagraph id="H12CCA18F94424B379EE5AFDEBECC1843"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate; and</text></subparagraph> <subparagraph id="H6EF1E291F8964A35A38E6DD62873C6E9"><enum>(B)</enum><text>the Committee on Homeland Security, the Committee on Oversight and Reform, and the Committee on Appropriations of the House of Representatives.</text></subparagraph></paragraph>
<paragraph id="H0594E3A427ED44A494061ACC2F77BD76"><enum>(2)</enum><header>Contents</header><text>The report required under paragraph (1) shall include the following:</text> <subparagraph id="H3E0EF75A3DEC4FF69CB4ED0F1935989A"><enum>(A)</enum><text>A review of the compliance of the Department of Homeland Security with the requirements under section 604 of title VI of division A of the American Recovery and Reinvestment Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/6/453b">6 U.S.C. 453b</external-xref>) to buy certain items related to national security interests from sources in the United States.</text></subparagraph>
<subparagraph id="HFEBF726CA5E448F6A7719A24467DAC32"><enum>(B)</enum><text>An assessment of the capacity of the Department of Homeland Security to procure the following items from domestic sources:</text> <clause id="H7F130FC7405248B88324DA4D532F17CF"><enum>(i)</enum><text>Personal protective equipment and other items necessary to respond to a pandemic such as that caused by COVID–19.</text></clause>
<clause id="H58CD2379738B4D43A0C1D9B9F287A7A3"><enum>(ii)</enum><text>Helmets that provide ballistic protection and other head protection and components.</text></clause> <clause id="H57AAA857303D46D19876B09343189338"><enum>(iii)</enum><text>Rain gear, cold weather gear, and other environmental and flame resistant clothing. </text></clause></subparagraph></paragraph></subsection>
<subsection id="H6D8D2BD524E943B6AC0946FB12784234"><enum>(d)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; 116 Stat. 2135) is amended by inserting after the item relating to section 835 the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HDC694DEFFC5D4162962D655EE2C05B95"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 836.
