R. 2906</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210430">April 30, 2021</action-date><action-desc><sponsor name-id="L000589">Mrs. Lesko</sponsor> (for herself and <cosponsor name-id="B001270">Ms. Bass</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 9 of the United States Code to prohibit the enforcement of predispute arbitration agreements with respect to sexual assault claims.</official-title></form><legis-body id="H57B77BAE569E4417BEED621C751F334D" style="OLC"><section id="H482BFD1812E5443A9BCB6A9014884120" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Carrie’s Law</short-title></quote>.</text></section><section id="H7973B4B12ED349499D18DD661145B3F5"><enum>2.</enum><header>Arbitration of sexual assault claims</header><subsection id="HBE5CD570ABA24EE698FC442EA2AC7917"><enum>(a)</enum><header>In general</header><text>Title 9 of the United States Code is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H88372BEF17BF41B8B92BC4375A7367AC" style="USC"><chapter id="HC655ACA5518E44639F01AEAD9423B63F"><enum>4</enum><header>Arbitration of sexual assault claims</header><toc><toc-entry level="section">Sec. </toc-entry><toc-entry level="section" idref="H8C0A24941D314D539FAD8E7AB9B721A5">401. Definitions. </toc-entry><toc-entry level="section" idref="H8DD2652649B44BDCABBBF02155DCB6E3">402. Limit on validity and enforceability. </toc-entry></toc><section id="H8C0A24941D314D539FAD8E7AB9B721A5"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text><paragraph id="HE5059C868F2547DDB9AF6BE663F9097F"><enum>(1)</enum><text>the term <term>predispute arbitration agreement</term> means any agreement to arbitrate a claim that had not yet arisen at the time of the making of the agreement; and</text></paragraph><paragraph id="HD55D16A43722467EBFAEB88DBF3A826B"><enum>(2)</enum><text>the term <term>sexual assault</term> means a nonconsensual sexual act or sexual contact, as those terms are defined in section 2246 of title 18, or similar applicable State or Tribal law, including when the victim lacks capacity to consent. </text></paragraph></section><section id="H8DD2652649B44BDCABBBF02155DCB6E3"><enum>402.</enum><header>Limit on validity and enforceability</header><subsection id="H767BDDDB097042AC96C807A5550546C6"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of this title, a predispute arbitration agreement shall have no force or effect with respect to a sexual assault claim. </text></subsection><subsection id="H0D653DD1093045C199E98C2B83D9B385"><enum>(b)</enum><header>Related claims</header><paragraph id="HDA382A7DD0324F229EE9BEC95A6EC9FA"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), and notwithstanding any other provision of this title, a predispute arbitration agreement shall have no force or effect with respect to a claim asserted by a sexual assault victim that is based upon that sexual assault.</text></paragraph><paragraph id="HC8F3B311EC194DCA9BBBD69A3EF30AD4"><enum>(2)</enum><header>Sexual assault claim dismissed</header><subparagraph id="H0819186575934D80BC6E6C3B657C1CD7"><enum>(A)</enum><header>In general</header><text>If a court dismisses with prejudice a sexual assault claim that, but for subsection (a), would have been subject to a predispute arbitration agreement— </text><clause id="H0F06B5C425DF4C80A464894F86648D7B"><enum>(i)</enum><text>the court shall dismiss any other claim that, but for paragraph (1) of this subsection, would have been subject to a predispute arbitration agreement; and</text></clause><clause id="H315468CD85C0436B927B963ECDCE8625"><enum>(ii)</enum><text>the relevant predispute arbitration agreement shall apply with respect to any claim dismissed under clause (i).</text></clause></subparagraph><subparagraph id="HAFC17B458C62430D9673FE458400AAD3"><enum>(B)</enum><header>Tolling</header><text>Any time period under a predispute arbitration agreement that is applicable to a claim dismissed under subparagraph (A)(i) shall be tolled during the period during which the claim was pending before a Federal court. </text></subparagraph></paragraph></subsection><subsection id="H3DEA5780D97A45ECB134FBD4B4B58EB4"><enum>(c)</enum><header>Applicability</header><text>An issue as to whether this chapter applies to an arbitration agreement or a claim shall be determined under Federal law. The applicability of this chapter to an agreement to arbitrate or a claim and the force or effect of an agreement to which this chapter applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9B6423433B3145E1965B1204D4B4DB87"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H3F7F335D1B4144738AB90D539A442260"><enum>(1)</enum><header>In general</header><text>Title 9 of the United States Code is amended—</text><subparagraph id="H758A41F229AB449482C6136FFB6F4BBA"><enum>(A)</enum><text>in section 2, by inserting <quote>or as otherwise provided in chapter 4</quote> before the period at the end;</text></subparagraph><subparagraph id="H856FE10F4F184456A30C0903765B8431"><enum>(B)</enum><text>in section 208—</text><clause id="HB99F9AC00C7947EB9F93E491F65CAE07"><enum>(i)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Application</header-in-text></quote>; and</text></clause><clause id="HC2E75FBC7618486BA72C844B23EC6AE6"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>; and</text></clause></subparagraph><subparagraph id="H504234AD63CA46738750C67B8BD6B620"><enum>(C)</enum><text>in section 307—</text><clause id="H4F8F7837E3DE4BE4AC6DFBBE8F0EE248"><enum>(i)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Application</header-in-text></quote>; and</text></clause><clause id="H22A5A17322264B31A5C8D7973E932B2F"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>.</text></clause></subparagraph></paragraph><paragraph id="HF95F4DDCE2F3446D8B53C739C63B2A2F"><enum>(2)</enum><header>Table of sections</header><subparagraph id="H4FBE95E49AAF4B37A6C1758F0159B5A7"><enum>(A)</enum><header>Chapter 2</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/2">chapter 2</external-xref> of title 9, United States Code, is amended by striking the item relating to section 208 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H4B43EEE8DA444D5882898E44D7A785B9" style="OLC"><toc><toc-entry bold="off" level="section">208. Application.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="HBAC3A1779E944866ABF3D0591238C969"><enum>(B)</enum><header>Chapter 3</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/9/3">chapter 3</external-xref> of title 9, United States Code, is amended by striking the item relating to section 307 and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H637DAC038A914AB895DF10FB0A203A0D" style="OLC"><toc><toc-entry bold="off" level="section">307. Application.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD7CD48F37B06493EA871427CCB69F379"><enum>(3)</enum><header>Table of chapters</header><text>The table of chapters for title 9, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H7B4DA3589BEA41B484A426926DFE1840" style="OLC"><toc><multi-column-toc-entry bold="on" level="chapter"><toc-enum>4.</toc-enum><level-header level="chapter">Arbitration of sexual assault claims</level-header><target>401</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H0C73C7836F324585B3EC96DF82FC0B4C"><enum>3.</enum><header>Prospective effect</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall take effect on the date of enactment of this Act and shall apply with respect to any claim that arises on or after such date.</text></section></legis-body></bill>
