<section id="HED0311897F604A16A1A6C5E45D858D9E"><enum>2.</enum><header>Findings and sense of Congress</header>
<subsection id="HA7884A222360491CBC9AF2467C51DA76"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> <paragraph id="H128C90C9E0AE4606B795483EA38E0E71"><enum>(1)</enum><text>The use of technology in health care and coverage of telehealth services are rapidly evolving.</text></paragraph>
<paragraph id="HCEA385FB41EF4F85B5587860E6389D72"><enum>(2)</enum><text>Research has found that telehealth services can expand access to care, improve the quality of care, and reduce spending, and that patients receiving telehealth services are satisfied with their experiences.</text></paragraph> <paragraph id="H1331F4144E414E788854980003AC1F32"><enum>(3)</enum><text>Health care workforce shortages are a significant problem in many areas and for many types of health care clinicians.</text></paragraph>
<paragraph id="HA4653B712FE04C5C935B4453FCB5158C"><enum>(4)</enum><text>Telehealth increases access to care in areas with workforce shortages and for individuals who live far away from health care facilities, have limited mobility or transportation, or have other barriers to accessing care.</text></paragraph> <paragraph id="HD65ADE595E7A4B43AEA770379F411ACF"><enum>(5)</enum><text>The use of health technologies can strengthen the expertise of the health care workforce, including by connecting clinicians to specialty consultations.</text></paragraph>
<paragraph id="H453796BFFED24F108382AA257ED99F3F"><enum>(6)</enum><text>Prior to the COVID–19 pandemic, the utilization of telehealth services in the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) was low, with only 0.25 percent of Medicare fee-for-service beneficiaries utilizing telehealth services in 2016.</text></paragraph> <paragraph id="H613C2D956DD447AB8CEC3769EBA8CA9F"><enum>(7)</enum><text>The COVID–19 pandemic demonstrated additional benefits of telehealth, including reducing infection risk of patients and health care professionals and conserving space in health care facilities, and the Centers for Disease Control and Prevention recommended that telehealth services should be optimized, when available and appropriate, during the pandemic.</text></paragraph>
<paragraph id="HD3F065146DAA4459A5CDCEDFB752F5E4"><enum>(8)</enum><text>Long-term certainty about coverage of telehealth services under the Medicare program is necessary to fully realize the benefits of telehealth.</text></paragraph></subsection> <subsection id="HB14A29847C054FD28123DE6B2B2945C3"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text>
<paragraph id="H827D2EF2426A44ECB95B2CB76DC754A5"><enum>(1)</enum><text>health care providers can furnish safe, effective, and high-quality health care services through telehealth;</text></paragraph> <paragraph id="H3DADA98A64E3483DB98E144BAF71A16A"><enum>(2)</enum><text>the Secretary of Health and Human Services should promptly take all necessary measures to ensure that providers and beneficiaries can continue to furnish and utilize, respectively, telehealth services in the Medicare program during and after the conclusion of the COVID–19 pandemic, including modifying, as appropriate, the definition of <quote>interactive telecommunications system</quote> in regulations and program instruction under the Medicare program to ensure that providers can utilize all appropriate means and types of technology, including audio-visual, audio-only, and other types of technologies, to furnish telehealth services; and </text></paragraph>
<paragraph id="H0CF23D63DBA444179FB72A890B24595D"><enum>(3)</enum><text>barriers to the use of telehealth should be removed.</text></paragraph></subsection></section> <title id="H868BFAD690504F4DB16E8019740172ED" style="OLC"><enum>I</enum><header>Removing barriers to telehealth coverage</header> <section id="H67D5F2DF81AE4309A71E98D1158046CF"><enum>101.</enum><header>Expanding the use of telehealth through the waiver of requirements</header> <subsection id="HA6B902A0E983453CBDD878CE7CFC0305"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text>
<paragraph id="HA611DC730FFC4B94B8F53551BE4754EB"><enum>(1)</enum><text>in paragraph (4)(C)(i), by striking <quote>and (7)</quote> and inserting <quote>(7), and (9)</quote>; and</text></paragraph> <paragraph id="HD9BADA77161C45598BCEF5A8F4DD527F"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H5283EEF11B204A92BE433E406498A5AB">
<paragraph id="H327031E090D3425BA1B0266B6F08731D"><enum>(9)</enum><header>Authority to waive requirements and limitations</header>
<subparagraph id="H4308EF9D3E8C4ACFA463AE83EEA6788B"><enum>(A)</enum><header>In general</header><text>Notwithstanding the preceding provisions of this subsection, in the case of telehealth services furnished on or after January 1, 2022, the Secretary may waive any requirement described in subparagraph (B) that is applicable to payment for telehealth services under this subsection, but only if the Secretary determines that such waiver would not adversely impact quality of care.</text></subparagraph> <subparagraph id="HF50FEB5D69234349BC49979FE6E26326"><enum>(B)</enum><header>Requirements described</header><text>For purposes of this paragraph, requirements applicable to payment for telehealth services under this subsection are—</text>
<clause id="H5896BFA6C0AF4199B1C285D21D3C0B98"><enum>(i)</enum><text>requirements relating to qualifications for an originating site under paragraph (4)(C)(ii);</text></clause> <clause id="H962A839974AC45C98726BFCC741A8630"><enum>(ii)</enum><text>any geographic requirement under paragraph (4)(C)(i) (other than applicable State law requirements, including State licensure requirements);</text></clause>
<clause id="H1625C988944F4B9FAF9692C9C73992AA"><enum>(iii)</enum><text>any limitation on the type of technology used to furnish telehealth services;</text></clause> <clause id="H5A283C83E46A4943B7F567F408C9E312"><enum>(iv)</enum><text>any limitation on the types of practitioners who are eligible to furnish telehealth services (other than the requirement that the practitioner is enrolled under this title);</text></clause>
<clause id="H1170F49A970D420C9C2D31487FD1CD4B"><enum>(v)</enum><text>any limitation on specific services designated as telehealth services pursuant to this subsection (provided the Secretary determines that such services are clinically appropriate to furnish remotely); or</text></clause> <clause id="H8095202A58744F54814439CCFCC87BA6"><enum>(vi)</enum><text>any other limitation relating to the furnishing of telehealth services under this title identified by the Secretary.</text></clause></subparagraph>
<subparagraph id="H2F47C21F71514AFF813DD6CD58EB29F4"><enum>(C)</enum><header>Waiver implementation</header><text>In implementing a waiver under this paragraph, the Secretary may establish parameters, as appropriate, for telehealth services under such waiver, including with respect to payment of a facility fee for originating sites and beneficiary and program integrity protections. </text></subparagraph> <subparagraph id="HF700E0E1B8474564BE2B3137F4CBDB91"><enum>(D)</enum><header>Public comment</header><text>The Secretary shall establish a process by which stakeholders may (on at least an annual basis) provide public comment on waivers under this paragraph.</text></subparagraph>
<subparagraph id="HBABD9DC80BB94FAC8BE022A89843B6B3"><enum>(E)</enum><header>Periodic review of waivers</header><text>The Secretary shall periodically, but not more often than every 3 years, reassess each waiver under this paragraph to determine whether the waiver continues to meet the quality of care condition applicable under subparagraph (A). The Secretary shall terminate any waiver that does not continue to meet such condition.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HC971C2A2E2384A1A9C5572D02FE4D54C"><enum>(b)</enum><header>Posting of information</header><text>Not later than 2 years after the date on which a waiver under section 1834(m)(9) of the Social Security Act, as added by subsection (a), first becomes effective, and at least every 2 years thereafter, the Secretary of Health and Human Services shall post on the internet website of the Centers for Medicare &amp; Medicaid Services—</text>
<paragraph id="H5042B6CB2073485C9B6524DAE59B3AA7"><enum>(1)</enum><text>the number of Medicare beneficiaries receiving telehealth services by reason of each waiver under such section;</text></paragraph> <paragraph id="HE5AF35F8924E43D5BC6921552F66424B"><enum>(2)</enum><text>the impact of such waivers on expenditures and utilization under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.); and</text></paragraph>
<paragraph id="HBDD902DFDC3542E099FDDED3A636C6A2"><enum>(3)</enum><text>other outcomes, as determined appropriate by the Secretary.</text></paragraph></subsection></section> <section id="H511869A72774453D9112BC5EC7BABA9F"><enum>102.</enum><header>Removing geographic requirements for telehealth services</header><text display-inline="no-display-inline">Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>), as amended by section 101, is amended—</text>
<paragraph id="H1E74FAF6F4CA462F98C94CF76C34FDA9"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), in the matter preceding subclause (I), by inserting <quote>and clause (iii)</quote> after <quote>and (9)</quote>; and</text></paragraph> <paragraph id="H538637E4F2C0468DBF8D2BCC8E4B8161"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new clause:</text>

<clause id="HCC4B608B9CD3470AA0468D38252109CE"><enum>(iii)</enum><header>Removal of geographic requirements</header><text>The geographic requirements described in clause (i) shall not apply with respect to telehealth services furnished on or after the date of the enactment of this clause.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HC9458FCE51AC42AC87695DBEE9F3B943"><enum>103.</enum><header>Expanding originating sites</header> <subsection id="HB2A926AC629F46C0A49FC19095923EED"><enum>(a)</enum><header>Expanding the home as an originating site</header><text>Section 1834(m)(4)(C)(ii)(X) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(ii)(X)</external-xref>) is amended to read as follows:</text>

<subclause id="H2F89B2D00FCD4CAEBAF97CCE67EFE868"><enum>(X)</enum>
<item commented="no" display-inline="yes-display-inline" id="HFEFEB1D700FD499E8F80AB06B7FA97F4"><enum>(aa)</enum><text>Prior to the date of enactment of the <short-title>CONNECT for Health Act of 2021</short-title>, the home of an individual but only for purposes of section 1881(b)(3)(B) or telehealth services described in paragraph (7).</text></item> <item indent="up1" id="H28C83384FE3146E49DE3494C5B0BDF08"><enum>(bb)</enum><text>On or after such date of enactment, the home of an individual.</text></item></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HCAE2FEF41CAF48BF94A1A8F3BDB43EA3"><enum>(b)</enum><header>Allowing additional originating sites</header><text>Section 1834(m)(4)(C)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(ii)</external-xref>) is amended by adding at the end the following new subclause:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H9D60DCCA616E42CD9280CC0F66601233"> <subclause id="HEC006E48F8A0400E903F152499718936"><enum>(XII)</enum><text>Any other site determined appropriate by the Secretary at which an eligible telehealth individual is located at the time a telehealth service is furnished via a telecommunications system.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H6A167CD544B6408B884DD88CD89B3C27"><enum>(c)</enum><header>Parameters for new originating sites</header><text>Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>), as amended by section 102, is amended by adding at the end the following new clause:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HAD8CECF0354F477488B4AC4C32A375E3"> <clause id="H5E277678D3B448C48AA649E0DCB9E92B"><enum>(iv)</enum><header>Requirements for new sites</header> <subclause id="H22FFA4F75268481A8EC9ED84525F25CC"><enum>(I)</enum><header>In general</header><text>The Secretary may establish requirements for the furnishing of telehealth services at sites described in clause (ii)(XII) to provide for beneficiary and program integrity protections.</text></subclause>
<subclause id="H8FEE2DDEAC0F4B2E8368E18DC0BCF2ED"><enum>(II)</enum><header>Clarification</header><text>Nothing in this clause shall be construed to preclude the Secretary from establishing requirements for other originating sites described in clause (ii)</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HD602BDB745794D9586AFA2F0772B9BFF"><enum>(d)</enum><header>No originating site facility fee for new sites</header><text>Section 1834(m)(2)(B)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(2)(B)(ii)</external-xref>) is amended—</text>
<paragraph id="H89AB6C4CB78144A49205EFF2E917AF26"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text style="OLC" level="clause">if originating site is the home</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="clause">for certain sites</header-in-text></quote>; and</text></paragraph> <paragraph id="H06C64D55CCFE4E2BB492A7286A88F7FF"><enum>(2)</enum><text>by striking <quote>paragraph (4)(C)(ii)(X)</quote> and inserting <quote>subclause (X) or (XII) of paragraph (4)(C)</quote>.</text></paragraph></subsection></section>
<section id="H9394A7B9F113457F8BB4D64D1D01C30C" commented="no"><enum>104.</enum><header>Use of telehealth in emergency medical care</header>
<subsection id="H1BCE04C206DF44DCB1DBEF50E4B340A9" commented="no"><enum>(a)</enum><header>In general</header><text>Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>), as amended by sections 101 and 102, is amended—</text> <paragraph id="H538AF399E6744E1296726C316B5F5478"><enum>(1)</enum><text>in paragraph (4)(C)(i), by striking <quote>and (9)</quote> and inserting <quote>(9), and (10)</quote>; and</text></paragraph>
<paragraph id="HE7B37238050F45DDB470A8E214D0A96E"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE80FFF81C6A14FFF8678D24316982A71"> <paragraph id="HFFB821CE7957438BA63B74061DD1183E"><enum>(10)</enum><header>Treatment of emergency medical care furnished through telehealth</header><text>The geographic requirements described in paragraph (4)(C)(i) (other than applicable State law requirements, including State licensure requirements) shall not apply with respect to telehealth services that are services for emergency medical care (as determined by the Secretary) furnished on or after January 1, 2022, to an eligible telehealth individual.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HFD01DF2DD3884176B3B91FF807658531"><enum>(b)</enum><header>Additional services</header><text>As part of the implementation of the amendments made by this section, the Secretary of Health and Human Services shall consider whether additional services should be added to the services specified in paragraph (4)(F)(i) of section 1834(m) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m</external-xref>)) for authorized payment under paragraph (1) of such section.</text></subsection></section> <section id="HA3DB671C33B945F3A7F8370A8A6AFCE4"><enum>105.</enum><header>Improvements to the process for adding telehealth services</header> <subsection id="HAE57E9E4D43745DF938CACA06DB1C06C"><enum>(a)</enum><header>Review</header><text display-inline="yes-display-inline">The Secretary shall undertake a review of the process established pursuant to section 1834(m)(4)(F)(ii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)(ii)</external-xref>), and based on the results of such review—</text>
<paragraph id="HD2C431D7AD36463391CDDEC4DFFF827B"><enum>(1)</enum><text>implement revisions to the process so that the criteria to add services prioritizes, as appropriate, improved access to care through clinically appropriate telehealth services; and</text></paragraph> <paragraph id="HE797F2EE7A77411E8E62C0BABF9B74EA"><enum>(2)</enum><text>provide clarification on what requests to add telehealth services under such process should include.</text></paragraph></subsection>
<subsection id="HEF3DB3A160EC486EB197A42B0685D0B6"><enum>(b)</enum><header>Temporary coverage of certain telehealth services</header><text>Section 1834(m)(4)(F) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)</external-xref>) is amended by adding at the end the following new clause:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H3E5D066227B64EA293F0538A34A69573"> <clause id="H623729E0AA2D47CBA1EF55E842AF7B58"><enum>(iii)</enum><header>Temporary coverage of certain telehealth services</header><text>The Secretary may add services with a reasonable potential likelihood of clinical benefit and improved access to care when furnished via a telecommunications system (as determined by the Secretary) on a temporary basis to those specified in clause (i) for authorized payment under paragraph (1).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H8128D7D0E2ED4103BB11065942D834FF"><enum>106.</enum><header>Federally qualified health centers and rural health clinics</header><text display-inline="no-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>), as amended by sections 101, 102, and 104, is amended—</text> <paragraph id="H0A06F30F1DAF4CDA8C3255510341F7E6"><enum>(1)</enum><text>in paragraph (4)(C)(i), in the matter preceding subclause (I), by inserting <quote>, (8)</quote> after <quote>(7)</quote>; and</text></paragraph>
<paragraph id="H3BCA3BEC381A4186AB56D0A9ACC02AF7"><enum>(2)</enum><text>in paragraph (8)—</text> <subparagraph id="HE365DCC3E79644D2A4D31AA1E0842E44"><enum>(A)</enum><text>in the paragraph heading by inserting <quote><header-in-text level="paragraph" style="OLC">and after</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">during </header-in-text></quote>;</text></subparagraph>

<subparagraph id="HBA9E7B77D2954AD09FA76EC5AFEA197A"><enum>(C)</enum><text>by striking subparagraph (B) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HF9CE7156468048E28FEEDEBD686CAF0A"> <subparagraph id="H023E5D1BE93940FD918446BDFC95432E"><enum>(B)</enum><header>Payment</header> <clause id="H6C2A24BBFD9D48E792F3A9DCC86565EB"><enum>(i)</enum><header>In general</header><text>A telehealth service furnished by a Federally qualified health center or a rural health clinic to an individual pursuant to this paragraph on or after the date of the enactment of this subparagraph shall be deemed to be so furnished to such individual as an outpatient of such clinic or facility (as applicable) for purposes of paragraph (1) or (3), respectively, of section 1861(aa) and payable as a Federally qualified health center service or rural health clinic service (as applicable) under the prospective payment system established under section 1834(o) or under section 1833(a)(3), respectively.</text></clause>
<clause id="H76B17DE2212A4E1184AAC98C9BA7AC88"><enum>(ii)</enum><header>Treatment of costs for FQHC PPS calculations and RHC AIR calculations</header><text>Costs associated with the delivery of telehealth services by a Federally qualified health center or rural health clinic serving as a distant site pursuant to this paragraph shall be considered allowable costs for purposes of the prospective payment system established under section 1834(o) and any payment methodologies developed under section 1833(a)(3), as applicable.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> <section id="HFEBEB779FE1247689D6BA06055C1E0AB"><enum>107.</enum><header>Native American health facilities</header> <subsection id="H154E199BD0CB4FABB9F48900AAD19934"><enum>(a)</enum><header>In general</header><text>Section 1834(m)(4)(C) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)</external-xref>), as amended by sections 101, 102, and 103, is amended—</text>
<paragraph id="H2FD152F6DA7A4B99B3CC547FDA764587"><enum>(1)</enum><text>in clause (i), by striking <quote>clause (iii)</quote> and inserting <quote>clauses (iii) and (v)</quote>; and</text></paragraph> <paragraph id="H3838CBD5881F4A529D0E3B453DE84393"><enum>(2)</enum><text>by adding at the end the following new clause:</text>

<clause id="H3E23A60B62E6429E8676F6FD9AA56B95"><enum>(v)</enum><header>Native American health facilities</header><text>With respect to telehealth services furnished on or after January 1, 2022, the originating site requirements described in clauses (i) and (ii) shall not apply with respect to a facility of the Indian Health Service, whether operated by such Service, or by an Indian tribe (as that term is defined in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>)) or a tribal organization (as that term is defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)), or a facility of the Native Hawaiian health care systems authorized under the Native Hawaiian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11701">42 U.S.C. 11701</external-xref> et seq.).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HB7FDBE7917B54320957B526ADEAFD52D"><enum>(b)</enum><header>No originating site facility fee for Certain Native American facilities</header><text>Section 1834(m)(2)(B)(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(2)(B)(i)</external-xref>) is amended, in the matter preceding subclause (I), by inserting <quote>(other than an originating site that is only described in clause (v) of paragraph (4)(C), and does not meet the requirement for an originating site under clauses (i) and (ii) of such paragraph)</quote> after <quote>the originating site</quote>.</text></subsection></section>
<section id="H87B2F2AB8E764C2699451578E063783D"><enum>108.</enum><header>Waiver of telehealth requirements during public health emergencies</header><text display-inline="no-display-inline">Section 1135(g)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-5">42 U.S.C. 1320b–5(g)(1)</external-xref>) is amended—</text> <paragraph id="HC5E84EB45FD648299C329433BD04044B"><enum>(1)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraphs (B) and (C)</quote>; and</text></paragraph>
<paragraph id="HDFF915E0009046A78730993C07D9BE47"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H35EB3410F5624F0EA85AAB6B9118946E"> <subparagraph id="HB49BF1222C924509A1B4A2EA17E41E68"><enum>(C)</enum><header>Exception for waiver of telehealth requirements during public health emergencies</header><text>For purposes of subsection (b)(8), in addition to the emergency period described in subparagraph (B), an <quote>emergency area</quote> is a geographical area in which, and an <quote>emergency period</quote> is the period during which, there exists a public health emergency declared by the Secretary pursuant to section 319 of the Public Health Service Act.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H0E403CC3FFCD4EFBB58178E886237CCA"><enum>109.</enum><header>Use of telehealth in recertification for hospice care</header>
<subsection id="H8290DA704FB94703AB0171A110DDAB5B"><enum>(a)</enum><header>In general</header><text>Section 1814(a)(7)(D)(i)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(7)(D)(i)(II)</external-xref>) is amended by inserting <quote>and after such emergency period</quote> after <quote>1135(g)(1)(B)</quote>.</text></subsection> <subsection id="H0EA924145E984A8F93E412972CEF01B6"><enum>(b)</enum><header>GAO report</header><text>Not later than 3 years after the date of enactment of this Act, the Comptroller General of the United States shall submit a report to Congress evaluating the impact of the amendment made by subsection (a) on—</text>
<paragraph id="H7ADE800546CB42D499AE5F9FE853FFF3"><enum>(1)</enum><text>the number and percentage of beneficiaries recertified for the Medicare hospice benefit at 180 days and for subsequent benefit periods;</text></paragraph> <paragraph id="H5159EEFB4FEA44C98D036A26DE80927C"><enum>(2)</enum><text>the appropriateness for hospice care of the patients recertified through the use of telehealth; and</text></paragraph>
<paragraph id="H845EE7C11B5F47FBA269385BFFD6F8A9"><enum>(3)</enum><text>any other factors determined appropriate by the Comptroller General.</text></paragraph></subsection></section></title> <title id="H6241CC0B23F74D0594AD02A4DD51764B" style="OLC"><enum>II</enum><header>Program integrity</header> <section id="H0318475CE998471DBA73517B080D59BC"><enum>201.</enum><header>Clarification for fraud and abuse laws regarding technologies provided to beneficiaries</header><text display-inline="no-display-inline">Section 1128A(i)(6) of the Social Security Act (42 U.S.C. 1320a–7a(i)(6)) is amended—</text>
<paragraph id="H2CCB5442697041BDAFC857F3C13A038A"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph> <paragraph id="H8B7796164B3342EDB15EA965DC9D31F7"><enum>(2)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph>
<paragraph id="H3B51B7D47BF3439F8F92500B78252403"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB806DB05BE06496E8540475A5E01E35F"> <subparagraph id="H3590C738F65A44B48B3924DB4173C912"><enum>(K)</enum><text>the provision of technologies (as defined by the Secretary) on or after the date of the enactment of this subparagraph, by a provider of services or supplier (as such terms are defined for purposes of title XVIII) directly to an individual who is entitled to benefits under part A of title XVIII, enrolled under part B of such title, or both, for the purpose of furnishing telehealth services, remote patient monitoring services, or other services furnished through the use of technology (as defined by the Secretary), if—</text>
<clause id="HBAADB630A3964C03A820FCE33D22F7AA"><enum>(i)</enum><text>the technologies are not offered as part of any advertisement or solicitation; and</text></clause> <clause id="HA3C762174C3F4192A05196B741067502"><enum>(ii)</enum><text>the provision of the technologies meets any other requirements set forth in regulations promulgated by the Secretary.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HAF321B8380D849E18BDCD662BE0A8275"><enum>202.</enum><header>Additional resources for telehealth oversight</header><text display-inline="no-display-inline">In addition to amounts otherwise available, there are authorized to be appropriated to the Inspector General of the Department of Health and Human Services for each of fiscal years 2022 through 2026, out of any money in the Treasury not otherwise appropriated, $3,000,000, to remain available until expended, for purposes of conducting audits, investigations, and other oversight and enforcement activities with respect to telehealth services, remote patient monitoring services, or other services furnished through the use of technology (as defined by the Secretary).</text></section> <section id="H5B9C46B0B6B940469F437BC310C475AB"><enum>203.</enum><header>Provider and beneficiary education on telehealth</header> <subsection id="HC513AF293FDA49098BDD0B9FB61CB628"><enum>(a)</enum><header>Educational resources and training sessions</header> <paragraph id="H86FF9CC5B4B542E3A2361234DCD3083A"><enum>(1)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary of Health and Human Services shall develop and make available to beneficiaries and health care professionals educational resources and training sessions on requirements relating to the furnishing of telehealth services under section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) and topics including—</text>
<subparagraph id="HAEA9E9C1528F4B99BF11FCAD01DD6AC1"><enum>(A)</enum><text>requirements for payment for telehealth services;</text></subparagraph> <subparagraph id="H00087CE17580412D9272030EFA5E64DD"><enum>(B)</enum><text>telehealth-specific health care privacy and security training;</text></subparagraph>
<subparagraph id="H9E2B66451C124740B9B11F00BA041F5C"><enum>(C)</enum><text>utilizing telehealth services to engage and support underserved, high-risk, and vulnerable patient populations; and</text></subparagraph> <subparagraph id="HFBBE9617D6EF4B558A0E54940AE072E1"><enum>(D)</enum><text>other topics as determined appropriate by the Secretary.</text></subparagraph></paragraph>
<paragraph id="HB748F169F29A4AB3BEB62A8AD6078884"><enum>(2)</enum><header>Accounting for age and other differences</header><text>Such resources and training sessions must account for age and sociodemographic, geographic, cultural, cognitive, and linguistic differences in how individuals interact with technology.</text></paragraph></subsection> <subsection id="H373BDFA5AFB14944927E194D5793B468"><enum>(b)</enum><header>Quality improvement organizations</header><text>The Secretary shall consider including technical assistance, education, and training on telehealth services as a required activity of the quality improvement organizations described in section 1862(g) of the Social Security Act.</text></subsection>
<subsection id="H5DA82A5F0E25448CB7E9C68751FBC249"><enum>(c)</enum><header>Funding</header><text>There are authorized to be appropriated such sums as necessary to carry out the activities described in sections (a) and (b).</text></subsection></section></title> <title id="H7E9A00AD7D374A8182261B68B3B0E431" style="OLC"><enum>III</enum><header>Data and testing of models</header> <section id="H2D47474EDD464B75AEE5294A34C76523"><enum>301.</enum><header>Study on telehealth utilization during the COVID–19 pandemic</header> <subsection id="HBDB8C42BA6694E62BAC807ACEA596F09"><enum>(a)</enum><header>In general</header><text>The Secretary shall collect and analyze qualitative and quantitative data on the impact of telehealth services, virtual check-ins, remote patient monitoring services, and other services furnished through the use of technology permitted by the waiver or modification of certain requirements under title XVIII of the Social Security Act (42 <external-xref legal-doc="usc" parsable-cite="usc/15/1395">15 U.S.C. 1395</external-xref> et seq.) and, as feasible, under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.), and any regulations thereunder during the COVID–19 public health emergency, which may include the collection of data regarding—</text>
<paragraph id="H0CBE110393054B3981990AB5DF2928C6"><enum>(1)</enum><text>health care utilization rates under such title XVIII and, as feasible, under such title XIX, including utilization—</text> <subparagraph id="HB0CE17A0D3E84F60838237F404F3F148"><enum>(A)</enum><text>in different types of areas;</text></subparagraph>
<subparagraph id="H5A1D959BACC24898B55FF5B78123D64C"><enum>(B)</enum><text>by race, ethnicity, or income levels; and</text></subparagraph> <subparagraph id="HB7D062755E234006A09C6BC57F2C2BEC"><enum>(C)</enum><text>of telehealth services furnished by different types of health care professionals;</text></subparagraph></paragraph>
<paragraph id="H142E6BCE215742288E1B94FA40C64DDC"><enum>(2)</enum><text>health care quality, such as measured by hospital readmission rates, missed appointment rates, patient and provider satisfaction, or other appropriate measures;</text></paragraph> <paragraph id="H0D1A289EFE384957822C2FD309F74804"><enum>(3)</enum><text>health outcomes of individuals utilizing telehealth services;</text></paragraph>
<paragraph id="HDA6EFD87C1534CC0B58715952E3AAB1A"><enum>(4)</enum><text>audio-only telehealth utilization rates when video-based telehealth was not an option, including the types of services and the types of providers treating individuals using audio-only telehealth;</text></paragraph> <paragraph id="H5F39288B525B49609999E48F80E3ABF1"><enum>(5)</enum><text>waivers of State licensure requirements;</text></paragraph>
<paragraph id="H286AEB8B15564895A25A86D2D386D3BD"><enum>(6)</enum><text>the types of technologies utilized to deliver or receive telehealth care and utilization rates, disaggregated by type of technology (as applicable);</text></paragraph> <paragraph id="HB488D625139D40CBB2B0717B9AE518C9"><enum>(7)</enum><text>challenges for providers in furnishing telehealth services;</text></paragraph>
<paragraph id="HC926445FAC494DAEADB69C1F81204A51"><enum>(8)</enum><text>the investments necessary for providers to effectively provide telehealth services to their patients, including the costs of necessary technology and of training staff; and</text></paragraph> <paragraph id="HD2D7FFFCAE5E44DD9AFD675EAC5CDB33"><enum>(9)</enum><text>any additional information determined appropriate by the Secretary.</text></paragraph></subsection>
<subsection id="H9A71DAE13464475C88A3A492394D255A"><enum>(b)</enum><header>Interim report to Congress</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Finance and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Ways and Means and the Committee on Energy and Commerce of the House of Representatives an interim report on the impact of telehealth based on the data collected and analyzed under subsection (a). For the purposes of the interim report, the Secretary may determine which data collected and analyzed under such subsection is most appropriate to complete such report.</text></subsection> <subsection id="H79116E198D1646B792A9F77E4353AF19"><enum>(c)</enum><header>Final report to Congress</header><text>Not later than one year after the date of enactment of this Act, the Secretary shall submit to the Committee on Finance and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Ways and Means and the Committee on Energy and Commerce of the House of Representatives a final report on the impact of telehealth based on the data collected and analyzed under subsection (a) that includes—</text>
<paragraph id="H21F0FB3B2E9D49B5A15944F970451EC3"><enum>(1)</enum><text>conclusions regarding the impact of telehealth services on health care delivery during the COVID–19 public health emergency; and</text></paragraph> <paragraph id="HD4AE167F1C2D4F7BBFC668CEA84BB267"><enum>(2)</enum><text>an estimation of total spending on telehealth services under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395</external-xref> et seq.) and, as feasible, under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396</external-xref> et seq.).</text></paragraph></subsection>
<subsection id="H30D9A13C2EB5453287CF5C2DEA3A291C"><enum>(d)</enum><header>Stakeholder input</header><text>For purposes of subsections (a), (b), and (c), the Secretary shall seek input from the Medicare Payment Advisory Commission, the Medicaid and CHIP Payment and Access Commission, and nongovernmental stakeholders, including patient organizations, providers, and experts in telehealth.</text></subsection> <subsection id="H5FB453A92F5C40ACBDB9183C5AAB91FD"><enum>(e)</enum><header>Funding</header><text>There are authorized to be appropriated such sums as necessary to carry out this section.</text></subsection></section>
<section id="H25339DE98E754831A9B1DA235500FD94"><enum>302.</enum><header>Analysis of telehealth waivers in alternative payment models</header><text display-inline="no-display-inline">The second sentence of section 1115A(g) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a(g)</external-xref>) is amended by inserting <quote>an analysis of waivers (if applicable) under subsection (d)(1) related to telehealth and the impact on quality and spending under the applicable titles of such waivers,</quote> after <quote>subsection (c),</quote>.</text></section> <section id="HE35DB52B62BA41CFAF3AD72D5F52CFCC"><enum>303.</enum><header>Model to allow additional health professionals to furnish telehealth services</header><text display-inline="no-display-inline">Section 1115A(b)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a(b)(2)(B)</external-xref>) is amended by adding at the end the following new clause:</text>

<clause id="H0F5B0246B4864DAEAA844F996C5B696B"><enum>(xxviii)</enum><text>Allowing health professionals, such as those described in section 1819(b)(5)(G) or section 1861(ll)(4)(B), who are enrolled under section 1866(j) and not otherwise eligible under section 1834(m) to furnish telehealth services to furnish such services.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H6FB65202990048309C032961AA1EB0A8"><enum>304.</enum><header>Testing of models to examine the use of telehealth under the Medicare program</header><text display-inline="no-display-inline">Section 1115A(b)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315a">42 U.S.C. 1315a(b)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text>
